You Won't BELIEVE What's Going On with Government Spying on Americans - BlackListedNews.com - 1 views

  •
"New Revelations Are Breaking Every Day" This web page is very well sourced and filled with links where you will get lost for hours. Excellent reference document ............................ Revelations about the breathtaking scope of government spying are coming so fast that it's time for an updated roundup: - Just weeks after NSA boss Alexander said that a review of NSA spying found not even one violation, the Washington Post published an internal NSA audit showing that the agency has broken its own rules thousands of times each year - 2 Senators on the intelligence committee said the violations revealed in the Post article were just the "tip of the iceberg" - Glenn Greenwald notes:  "One key to the WashPost story: the reports are internal, NSA audits, which means high likelihood of both under-counting & white-washing".(Even so, the White House tried to do damage control by retroactively changing on-the-record quotes) - The government is spying on essentially everything we do. It is not just "metadata" … although that is enough to destroy your privacy - The government has adopted a secret interpretation of the Patriot Act which allows it to pretend that "everything" is relevant … so it spies on everyone - NSA whistleblowers say that the NSA collects all of our conversations word-for-word - It's not just the NSA … Many other agencies, like the FBI and IRS - concerned only with domesticissues - spy on Americans as well - The information gained through spying is shared with federal, state and local agencies, and they are using that information to prosecute petty crimes such as drugs and taxes.  The agencies are instructed to intentionally "launder" the information gained through spying, i.e. to pretend that they got the information in a more legitimate way … and to hide that from defense attorneys and judges - Top counter-terror experts say that the government's mass spying doesn't keep us

In Keeping Grip on Data Pipeline, Obama Does Little to Reassure Industry - NYTimes.com - 0 views

  • Google, which briefly considered moving all of its computer servers out of the United States last year after learning how they had been penetrated by the National Security Agency, was looking for a public assurance from President Obama that the government would no longer secretly suck data from the company’s corner of the Internet cloud.Microsoft was listening to see if Mr. Obama would adopt a recommendation from his advisers that the government stop routinely stockpiling flaws in its Windows operating system, then using them to penetrate some foreign computer systems and, in rare cases, launch cyberattacks.
  • Intel and computer security companies were eager to hear Mr. Obama embrace a commitment that the United States would never knowingly move to weaken encryption systems. They got none of that.
  • Perhaps the most striking element of Mr. Obama’s speech on Friday was what it omitted: While he bolstered some protections for citizens who fear the N.S.A. is downloading their every dial, tweet and text message, he did nothing, at least yet, to loosen the agency’s grip on the world’s digital pipelines. White House officials said that Mr. Obama was committed to studying the complaints by American industry that the revelations were costing them billions of dollars in business overseas, by giving everyone from the Germans to the Brazilians to the Chinese an excuse to avoid American hardware and cloud services. “The most interesting part of this speech was not how the president weighed individual privacy against the N.S.A.,” said Fred H. Cate, the director of the Center of Applied Cybersecurity Research at Indiana University, “but that he said little about what to do about the agency’s practice of vacuuming up everything it can get its hands on.”
  • ...4 more annotations...
  • In fact, behind the speech lies a struggle Mr. Obama nodded at but never addressed head on. It pits corporations that view themselves as the core of America’s soft power around the world — the country’s economic driver and the guardians of its innovative edge — against an intelligence community 100,000 strong that regards its ability to peer into any corner of the digital world, and manipulate it if necessary, as crucial to the country’s security. In public, the coalition was polite if unenthusiastic about the president’s speech. His proposals, the companies said in a statement, “represent positive progress on key issues,” even while “crucial details remain to be addressed on these issues, and additional steps are needed on other important issues.” But in the online chat rooms that users and employees of those services inhabit each day, the president’s words were mocked. “If they really cared about the security of US infrastructure, they’d divulge the vulnerabilities they found or bought from the black market that exploit the security of these systems, so those systems can be fixed, and no one else can exploit them with these exploits,” wrote a user called “higherpurpose” on Hacker News.
  • In an interview, a senior administration official acknowledged that the administration had weighed what the president could say in public about the delicate problems of encryption, or the N.S.A.’s use of “zero day” flaws in software, the name for security holes that have never been seen before. It is a subject the intelligence agencies have refused to discuss in public, and Mr. Obama determined that it was both too secret, and too fluid, to discuss in the speech, officials said.In response to questions, the White House said the president had asked his special assistant for cybersecurity, Michael Daniel, and the president’s office of science and technology policy to study a recent advisory panel’s recommendation that the government get out of the business of corrupting the encryption systems created by American companies.
  • It will not be an easy task. One of the recent disclosures, first reported by Reuters, indicated that the N.S.A. paid millions of dollars to RSA, a major encryption firm, to incorporate a deliberately weakened algorithm into some of its products, giving the government a “back door” to read whatever it wanted. But when the advisory panel concluded that the United States should not “in any way subvert, weaken or make vulnerable generally available commercial software,” the intelligence agencies protested.“Some in the intelligence community saw that as a call for the N.S.A. to get out of cryptography, which is the reason they were created,” the senior official said. He added: “We’ve said that we are very much supportive of U.S. industry and making sure that U.S. industry remains competitive, and able to produce really good products. And N.S.A. has been out there saying they have no interest in breaking encryption that guards global commerce.”
  • But as Mr. Obama himself acknowledged, the United States has a credibility problem that will take years to address. The discovery that it had monitored the cellphone of Chancellor Angela Merkel of Germany, or that it has now found a way to tap into computers around the world that are completely disconnected from the Internet — using covert radio waves — only fuels the argument that American products cannot be trusted. That argument, heard these days from Berlin to Mexico City, may only be an excuse for protectionism. But it is an excuse that often works.

Maybe Obama's Sanctions on Venezuela are Not Really About His "Deep Concern" Over Suppression of Political Rights - The Intercept - 0 views

  • The White House on Monday announced the imposition of new sanctions on various Venezuelan officials, pronouncing itself “deeply concerned by the Venezuelan government’s efforts to escalate intimidation of its political opponents”: deeply concerned. President Obama also, reportedly with a straight face, officially declared that Venezuela poses “an extraordinary threat to the national security” of the U.S. — a declaration necessary to legally justify the sanctions. Today, one of the Obama administration’s closest allies on the planet, Saudi Arabia, sentenced one of that country’s few independent human rights activists, Mohammed al-Bajad, to 10 years in prison on “terrorism” charges. That is completely consistent with that regime’s systematic and extreme repression, which includes gruesome state beheadings at a record-setting rate, floggings and long prison terms for anti-regime bloggers, executions of those with minority religious views, and exploitation of terror laws to imprison even the mildest regime critics. Absolutely nobody expects the “deeply concerned” President Obama to impose sanctions on the Saudis — nor on any of the other loyal U.S. allies from Egypt to the UAE whose repression is far worse than Venezuela’s. Perhaps those who actually believe U.S. proclamations about imposing sanctions on Venezuela in objection to suppression of political opposition might spend some time thinking about what accounts for that disparity.
  • That nothing is more insincere than purported U.S. concerns over political repression is too self-evident to debate. Supporting the most repressive regimes on the planet in order to suppress and control their populations is and long has been a staple of U.S. (and British) foreign policy. “Human rights” is the weapon invoked by the U.S. Government and its loyal media to cynically demonize regimes that refuse to follow U.S. dictates, while far worse tyranny is steadfastly overlooked, or expressly cheered, when undertaken by compliant regimes, such as those in Riyadh and Cairo (see this USA Today article, one of many, recently hailing the Saudis as one of the “moderate” countries in the region). This is exactly the tactic that leads neocons to feign concern for Afghan women or the plight of Iranian gays when doing so helps to gin up war-rage against those regimes, while they snuggle up to far worse but far more compliant regimes. Any rational person who watched the entire top echelon of the U.S. government drop what they were doing to make a pilgrimage to Riyadh to pay homage to the Saudi monarchs (Obama cut short a state visit to India to do so), or who watches the mountain of arms and money flow to the regime in Cairo, would do nothing other than cackle when hearing U.S. officials announce that they are imposing sanctions to punish repression of political opposition. And indeed, that’s what most of the world outside of the U.S. and Europe do when they hear such claims. But from the perspective of U.S. officials, that’s fine, because such pretenses to noble intentions are primarily intended for domestic consumption.
  • As for Obama’s decree that Venezuela now poses an “extraordinary threat to the national security” of the United States, is there anyone, anywhere, that wants to defend the reasonability of that claim? Think about what it says about our discourse that Obama officials know they can issue such insultingly false tripe with no consequences. But what’s not too obvious to point out is what the U.S is actually doing in Venezuela. It’s truly remarkable how the very same people who demand U.S. actions against the democratically elected government in Caracas are the ones who most aggressively mock Venezuelan leaders when they point out that the U.S. is working to undermine their government. The worst media offender in this regard is The New York Times, which explicitly celebrated the 2002 U.S.-supported coup of Hugo Chavez as a victory for democracy, but which now regularly derides the notion that the U.S. would ever do something as untoward as undermine the Venezuelan government. Watch this short video from Monday where the always-excellent Matt Lee of Associated Press questions a State Department spokesperson this week after she said it was “ludicrous” to think that the U.S. would ever do such a thing:
  • ...2 more annotations...
  • The real question is this: if concern over suppression of political rights is not the real reason the U.S. is imposing new sanctions on Venezuela (perish the thought!), what is? Among the most insightful commentators on U.S. policy in Latin America is Mark Weisbrot of Just Foreign Policy. Read his excellent article for Al Jazeera on the recent Obama decree on Venezuela. In essence, Venezuela is one of the very few countries with significant oil reserves which does not submit to U.S. dictates, and this simply cannot be permitted (such countries are always at the top of the U.S. government and media list of Countries To Be Demonized). Beyond that, the popularity of Chavez and the relative improvement of Venezuela’s poor under his redistributionist policies petrifies neoliberal institutions for its ability to serve as an example; just as the Cuban economy was choked by decades of U.S. sanctions and then held up by the U.S. as a failure of Communism, subverting the Venezuelan economy is crucial to destroying this success. As Weisbrot notes, every country in the hemisphere except for the U.S. and Canada have united to oppose U.S. sanctions on Venezuela. The Community of Latin American and Caribbean States (CELAC) issued a statement in February in response to the prior round of U.S. sanctions on Venezuela that “reiterates its strong repudiation of the application of unilateral coercive measures that are contrary to international law.” This week, the chief of the Union of South American Nations (UNASUR) issued a statement announcing that “UNASUR rejects any external or internal attempt at interference that seeks to disrupt the democratic process in Venezuela.” Weisbrot compares Obama’s decree this week on Venezuela to President Reagan’s quite similar 1985 decree that Nicaragua was a national security threat to the U.S., and notes: “The Obama administration is more isolated today in Latin America than even George W. Bush’s administration was.”
  • If Obama and supporters want the government of Venezuela to be punished and/or toppled because they refuse to comply with U.S. dictates, they should at least be honest about their beliefs so that their true character can be seen. Pretending that any of this has to do with the U.S. Government’s anger over suppression of political opponents — when their closest allies are the world champions at that — should be too insulting of everyone’s intelligence to even be an option.

Israel Spied on Iran Nuclear Talks With U.S. - WSJ - 0 views

  • Soon after the U.S. and other major powers entered negotiations last year to curtail Iran’s nuclear program, senior White House officials learned Israel was spying on the closed-door talks. The spying operation was part of a broader campaign by Israeli Prime Minister Benjamin Netanyahu’s government to penetrate the negotiations and then help build a case against the emerging terms of the deal, current and former U.S. officials said. In addition to eavesdropping, Israel acquired information from confidential U.S. briefings, informants and diplomatic contacts in Europe, the officials said.
  • The espionage didn’t upset the White House as much as Israel’s sharing of inside information with U.S. lawmakers and others to drain support from a high-stakes deal intended to limit Iran’s nuclear program, current and former officials said. “It is one thing for the U.S. and Israel to spy on each other. It is another thing for Israel to steal U.S. secrets and play them back to U.S. legislators to undermine U.S. diplomacy,” said a senior U.S. official briefed on the matter.
  • The U.S. and Israel, longtime allies who routinely swap information on security threats, sometimes operate behind the scenes like spy-versus-spy rivals. The White House has largely tolerated Israeli snooping on U.S. policy makers—a posture Israel takes when the tables are turned. The White House discovered the operation, in fact, when U.S. intelligence agencies spying on Israel intercepted communications among Israeli officials that carried details the U.S. believed could have come only from access to the confidential talks, officials briefed on the matter said. Israeli officials denied spying directly on U.S. negotiators and said they received their information through other means, including close surveillance of Iranian leaders receiving the latest U.S. and European offers. European officials, particularly the French, also have been more transparent with Israel about the closed-door discussions than the Americans, Israeli and U.S. officials said.

  • Mr. Netanyahu and Israeli Ambassador Ron Dermer early this year saw a rapidly closing window to increase pressure on Mr. Obama before a key deadline at the end of March, Israeli officials said. Using levers of political influence unique to Israel, Messrs. Netanyahu and Dermer calculated that a lobbying campaign in Congress before an announcement was made would improve the chances of killing or reshaping any deal. They knew the intervention would damage relations with the White House, Israeli officials said, but decided that was an acceptable cost. The campaign may not have worked as well as hoped, Israeli officials now say, because it ended up alienating many congressional Democrats whose support Israel was counting on to block a deal. Obama administration officials, departing from their usual description of the unbreakable bond between the U.S. and Israel, have voiced sharp criticism of Messrs. Netanyahu and Dermer to describe how the relationship has changed.
  • “People feel personally sold out,” a senior administration official said. “That’s where the Israelis really better be careful because a lot of these people will not only be around for this administration but possibly the next one as well.” This account of the Israeli campaign is based on interviews with more than a dozen current and former U.S. and Israeli diplomats, intelligence officials, policy makers and lawmakers. Weakened ties Distrust between Mr. Netanyahu and Mr. Obama had been growing for years but worsened when Mr. Obama launched secret talks with Iran in 2012. The president didn’t tell Mr. Netanyahu because of concerns about leaks, helping set the stage for the current standoff, according to current and former U.S. and Israeli officials. U.S. officials said Israel has long topped the list of countries that aggressively spy on the U.S., along with China, Russia and France. The U.S. expends more counterintelligence resources fending off Israeli spy operations than any other close ally, U.S. officials said.
  • A senior official in the prime minister’s office said Monday: “These allegations are utterly false. The state of Israel does not conduct espionage against the United States or Israel’s other allies. The false allegations are clearly intended to undermine the strong ties between the United States and Israel and the security and intelligence relationship we share.” Current and former Israeli officials said their intelligence agencies scaled back their targeting of U.S. officials after the jailing nearly 30 years ago of American Jonathan Pollard for passing secrets to Israel. While U.S. officials may not be direct targets, current and former officials said, Israeli intelligence agencies sweep up communications between U.S. officials and parties targeted by the Israelis, including Iran. Americans shouldn’t be surprised, said a person familiar with the Israeli practice, since U.S. intelligence agencies helped the Israelis build a system to listen in on high-level Iranian communications.
  • As secret talks with Iran progressed into 2013, U.S. intelligence agencies monitored Israel’s communications to see if the country knew of the negotiations. Mr. Obama didn’t tell Mr. Netanyahu until September 2013. Israeli officials, who said they had already learned about the talks through their own channels, told their U.S. counterparts they were upset about being excluded. “ ‘Did the administration really believe we wouldn’t find out?’ ” Israeli officials said, according to a former U.S. official.
  • The episode cemented Mr. Netanyahu’s concern that Mr. Obama was bent on clinching a deal with Iran whether or not it served Israel’s best interests, Israeli officials said. Obama administration officials said the president was committed to preventing Iran from developing nuclear weapons. Mr. Dermer started lobbying U.S. lawmakers just before the U.S. and other powers signed an interim agreement with Iran in November 2013. Mr. Netanyahu and Mr. Dermer went to Congress after seeing they had little influence on the White House. Before the interim deal was made public, Mr. Dermer gave lawmakers Israel’s analysis: The U.S. offer would dramatically undermine economic sanctions on Iran, according to congressional officials who took part. After learning about the briefings, the White House dispatched senior officials to counter Mr. Dermer. The officials told lawmakers that Israel’s analysis exaggerated the sanctions relief by as much as 10 times, meeting participants said.
  • When the next round of negotiations with Iran started in Switzerland last year, U.S. counterintelligence agents told members of the U.S. negotiating team that Israel would likely try to penetrate their communications, a senior Obama administration official said. The U.S. routinely shares information with its European counterparts and others to coordinate negotiating positions. While U.S. intelligence officials believe secured U.S. communications are relatively safe from the Israelis, they say European communications are vulnerable. Mr. Netanyahu and his top advisers received confidential updates on the Geneva talks from Undersecretary of State for Political Affairs Wendy Sherman and other U.S. officials, who knew at the time that Israeli intelligence was working to fill in any gaps. The White House eventually curtailed the briefings, U.S. officials said, withholding sensitive information for fear of leaks. Current and former Israeli officials said their intelligence agencies can get much of the information they seek by targeting Iranians and others in the region who are communicating with countries in the talks. In November, the Israelis learned the contents of a proposed deal offered by the U.S. but ultimately rejected by Iran, U.S. and Israeli officials said. Israeli officials told their U.S. counterparts the terms offered insufficient protections.
  • U.S. officials urged the Israelis to give the negotiations a chance. But Mr. Netanyahu’s top advisers concluded the emerging deal was unacceptable. The White House was making too many concessions, Israeli officials said, while the Iranians were holding firm. Obama administration officials reject that view, saying Israel was making impossible demands that Iran would never accept. “The president has made clear time and again that no deal is better than a bad deal,” a senior administration official said. In January, Mr. Netanyahu told the White House his government intended to oppose the Iran deal but didn’t explain how, U.S. and Israeli officials said. On Jan. 21, House Speaker John Boehner (R., Ohio) announced Mr. Netanyahu would address a joint meeting of Congress. That same day, Mr. Dermer and other Israeli officials visited Capitol Hill to brief lawmakers and aides, seeking a bipartisan coalition large enough to block or amend any deal. Most Republicans were already prepared to challenge the White House on the negotiations, so Mr. Dermer focused on Democrats. “This deal is bad,” he said in one briefing, according to participants.
  • A spokesman for the Israeli embassy in Washington, Aaron Sagui, said Mr. Dermer didn’t launch a special campaign on Jan 21. Mr. Dermer, the spokesperson said, has “consistently briefed both Republican and Democrats, senators and congressmen, on Israel’s concerns regarding the Iran negotiations for over a year.” Mr. Dermer and other Israeli officials over the following weeks gave lawmakers and their aides information the White House was trying to keep secret, including how the emerging deal could allow Iran to operate around 6,500 centrifuges, devices used to process nuclear material, said congressional officials who attended the briefings. The Israeli officials told lawmakers that Iran would also be permitted to deploy advanced IR-4 centrifuges that could process fuel on a larger scale, meeting participants and administration officials said. Israeli officials said such fuel, which under the emerging deal would be intended for energy plants, could be used to one day build nuclear bombs. The information in the briefings, Israeli officials said, was widely known among the countries participating in the negotiations. When asked in February during one briefing where Israel got its inside information, the Israeli officials said their sources included the French and British governments, as well as their own intelligence, according to people there.
  • “Ambassador Dermer never shared confidential intelligence information with members of Congress,” Mr. Sagui said. “His briefings did not include specific details from the negotiations, including the length of the agreement or the number of centrifuges Iran would be able to keep.” Current and former U.S. officials confirmed that the number and type of centrifuges cited in the briefings were part of the discussions. But they said the briefings were misleading because Israeli officials didn’t disclose concessions asked of Iran. Those included giving up stockpiles of nuclear material, as well as modifying the advanced centrifuges to slow output, these officials said. The administration didn’t brief lawmakers on the centrifuge numbers and other details at the time because the information was classified and the details were still in flux, current and former U.S. officials said. Unexpected reaction The congressional briefings and Mr. Netanyahu’s decision to address a joint meeting of Congress on the emerging deal sparked a backlash among many Democratic lawmakers, congressional aides said.
  • On Feb. 3, Mr. Dermer huddled with Sen. Joe Manchin, a West Virginia Democrat, who said he told Mr. Dermer it was a breach of protocol for Mr. Netanyahu to accept an invitation from Mr. Boehner without going through the White House. Mr. Manchin said he told Mr. Dermer he would attend the prime minister’s speech to Congress, but he was noncommittal about supporting any move by Congress to block a deal. Mr. Dermer spent the following day doing damage control with Sen. Kirsten Gillibrand, a New York Democrat, congressional aides said. Two days later, Mr. Dermer met with Sen. Dianne Feinstein of California, the top Democrat on the SenateIntelligence Committee, at her Washington, D.C., home. He pressed for her support because he knew that she, too, was angry about Mr. Netanyahu’s planned appearance. Ms. Feinstein said afterward she would oppose legislation allowing Congress to vote down an agreement.
  • Congressional aides and Israeli officials now say Israel’s coalition in Congress is short the votes needed to pass legislation that could overcome a presidential veto, although that could change. In response, Israeli officials said, Mr. Netanyahu was pursuing other ways to pressure the White House. This week, Mr. Netanyahu sent a delegation to France, which has been more closely aligned with Israel on the nuclear talks and which could throw obstacles in Mr. Obama’s way before a deal is signed. The Obama administration, meanwhile, is stepping up its outreach to Paris to blunt the Israeli push. “If you’re wondering whether something serious has shifted here, the answer is yes,” a senior U.S. official said. “These things leave scars.”

Obama is moving preemptively to blunt Israel's influence in Congress on the Iran negotiation.

Welcome to Post-Constitution America - Peter Van Buren - 0 views

  • On July 30, 1778, the Continental Congress created the first whistleblower protection law, stating “that it is the duty of all persons in the service of the United States to give the earliest information to Congress or other proper authority of any misconduct, frauds, or misdemeanors committed by any officers or persons in the service of these states.”
  • Two hundred thirty-five years later, on July 30, 2013, Bradley Manning was found guilty on 20 of the 22 charges for which he was prosecuted, specifically for “espionage” and for videos of war atrocities he released, but not for “aiding the enemy.”
  • Days after the verdict, with sentencing hearings in which Manning could receive 136 years of prison time ongoing, the pundits have had their say. The problem is that they missed the most chilling aspect of the Manning case: the way it ushered us, almost unnoticed, into post-Constitutional America.
  • ...22 more annotations...
  • As at Guantanamo, rules of evidence reaching back to early
  • During the months of the trial, the U.S. military refused to release official transcripts of the proceedings. Even a private courtroom sketch artist was barred from the room. Independent journalist and activist Alexa O’Brien then took it upon herself to attend the trial daily, defy the Army, and make an unofficial record of the proceedings by hand. Later in the trial, armed military police were stationed behind reporters listening to testimony. Above all, the feeling that Manning’s fate was predetermined could hardly be avoided. After all, President Obama, the former Constitutional law professor, essentially proclaimed him guilty back in 2011 and the Department of Defense didn’t hesitate to state more generally that “leaking is tantamount to aiding the enemies of the United States.”
  • And so to Bradley Manning. As the weaponry and technology of war came home, so did a new, increasingly Guantanamo-ized definition of justice. This is one thing the Manning case has made clear. As a start, Manning was treated no differently than America’s war-on-terror prisoners at Guantanamo and the black sites that the Bush administration set up around the world. Picked up on the “battlefield,” Manning was first kept incommunicado in a cage in Kuwait for two months with no access to a lawyer. Then, despite being an active duty member of the Army, he was handed over to the Marines, who also guard Guantanamo, to be held in a military prison in Quantico, Virginia. What followed were three years of cruel detainment, where, as might well have happened at Gitmo, Manning, kept in isolation, was deprived of clothing, communications, legal advice, and sleep. The sleep deprivation regime imposed on him certainly met any standard, other than Washington’s and possibly Pyongyang’s, for torture. In return for such abuse, even after a judge had formally ruled that he was subjected to excessively harsh treatment, Manning will only get a 112-day reduction in his eventual sentence. Eventually the Obama administration decided Manning was to be tried as a soldier before a military court. In the courtroom, itself inside a military facility that also houses NSA headquarters, there was a strikingly gulag-like atmosphere.  His trial was built around secret witnesses and secret evidence; severe restrictions were put on the press -- the Army denied press passes to 270 of the 350 media organizations that applied; and there was a clear appearance of injustice. Among other things, the judge ruled against nearly every defense motion.
  • “What constitutes due process in this case is a due process in war.”
  • Given all this, it is small comfort to know that Manning, nailed on the Espionage Act after multiple failures in other cases by the Obama administration, was not convicted of the extreme charge of “aiding the enemy.”
  • Obama administration lawyers went on to claim the legal right to execute U.S. citizens without trial or due process and have admitted to killing four Americans. Attorney General Eric Holder declared that “United States citizenship alone does not make such individuals immune from being targeted.”
  • As if competing for an Orwellian prize, an unnamed Obama administration official told the Washington Post,
  • English common law were turned upside down. In Manning’s case, he was convicted of espionage, even though the prosecution did not have to prove either his intent to help another government or that harm was caused; a civilian court had already paved the way for such a ruling in another whistleblower case. In addition, the government was allowed to label Manning a “traitor” and an “anarchist” in open court, though he was on trial for neither treason nor anarchy.
  • Similarly, full-spectrum spying is not considered to violate the Fourth Amendment and does not even require probable cause.
  • Justice can be twisted and tangled into an almost unrecognizable form and then used to send a young man to prison for decades.
  • Government officials concerned over possible wrongdoing in their departments or agencies who “go through proper channels” are fired or prosecuted.
  • Government whistleblowers are commanded to return to face justice, while law-breakers in the service of the government are allowed to flee justice. CIA officers who destroy evidence of torture go free, while a CIA agent who blew the whistle on torture is locked up.
  • Thanks to the PATRIOT Act, citizens, even librarians, can be served by the FBI with a National Security Letter (not requiring a court order) demanding records and other information, and gagging them from revealing to anyone that such information has been demanded or such a letter delivered.
  • Citizens may be held without trial, and denied their Constitutional rights as soon as they are designated “terrorists.” Lawyers and habeas corpus are available only when the government allows.
  • The war on whistleblowers is metastasizing into a war on the First Amendment.
  • People may now be convicted based on secret testimony by unnamed persons.
  • Military courts and jails can replace civilian ones.
  • An Obama administration Insider Threat Program requires federal employees (including the Peace Corps) to report on the suspicious behavior of coworkers.
  • Claiming its actions lawful while shielding the “legal” opinions cited, often even from Congress, the government can send its drones to assassinate its own citizens.
  • One by one, the tools and attitudes of the war on terror, of a world in which the “gloves” are eternally off, have come home.
  • The comic strip character Pogo’s classic warning -- “We have met the enemy and he is us” -- seems ever less like a metaphor.
  • According to the government, increasingly we are now indeed their enemy.

Karl Rove: The President Is No B+ - WSJ.com - 0 views

Once again Karl Rove lays the lumber to the liar Obama.  Rove provides a trove of stats and facts exposing Obama as a shameless liar and phony.  And then Rove points out that the American people are not fooled.  Polls show an increasing number of Americans are angry and aware that they have been had.  Obama is not who he claimed to be. excerpt:Barack Obama has won a place in history with the worst ratings of any president at the end of his first year: 49% approve and 46% disapprove of his job performance in the latest USA Today/Gallup Poll. There are many factors that explain it, including weakness abroad, an unprecedented spending binge at home, and making a perfectly awful health-care plan his signature domestic initiative. But something else is happening. Mr. Obama has not governed as the centrist, deficit-fighting, bipartisan consensus builder he promised to be. And his promise to embody a new kind of politics-free of finger-pointing, pettiness and spin-was a mirage. He has cheapened his office with needless attacks on his predecessor.

Fast And Furious: 22 Shocking Facts About The Scandal That Could Bring Down The Obama Administration - 0 views

Good summary of the facts involving the horrific guns for drugs program launched by Obama in his continuing efforts to discredit and compromise the 2nd Amendment.  Over 2,500 assault weapons intentionally sold to illegal Mexican drug gangs, using over $10 Million of Obama "Stimulous Funds".  No wonder there are no shovel ready projects.  Good stuff coming out of CBS too!  From Sharyl Attkisson... excerpt: With the full knowledge of the Department of Justice, ATF agents facilitated the sale of thousands of guns to Mexican drug cartels and dropped all surveillance of those weapons once they crossed the border.  Weapons sold during Operation Fast and Furious have been used to shoot U.S. border control agents.  Weapons sold during Operation Fast and Furious have been found at dozens of crime scenes in Mexico.  Nobody has been held accountable for this scandal yet.  U.S. Attorney General Eric Holder has been stonewalling all efforts by members of Congress to look into Fast and Furious.  A CBS reporter that has been aggressively investigating this story was recently screamed at and cussed at by a high ranking official that works in the White House.  It has become abundantly clear that the Obama administration desperately wants to hide what went on during Operation Fast and Furious.  So will they succeed or will we eventually find out the truth? What you are about to read should shock the living daylights out of you.  The U.S. government purposely armed Mexican drug cartels with thousands of guns and then ordered agents not to follow the weapons across the border. This should be a story that the mainstream media is pounding on every single day. But they aren't. In fact, they are mostly ignoring it.

Quitting Over Syria | The American Conservative - 0 views

  • The release of the White House “Government Assessment” on August 30, providing the purported evidence to support a bombing attack on Syria, defused a conflict with the intelligence community that had threatened to become public through the mass resignation of a significant number of analysts. The intelligence community’s consensus view on the status of the Syrian chemical-weapons program was derived from a National Intelligence Estimate (NIE) completed late last year and hurriedly updated this past summer to reflect the suspected use of chemical weapons against rebels and civilians. The report maintained that there were some indications that the regime was using chemicals, while conceding that there was no conclusive proof. There was considerable dissent from even that equivocation, including by many analysts who felt that the evidence for a Syrian government role was subject to interpretation and possibly even fabricated. Some believed the complete absence of U.S. satellite intelligence on the extensive preparations that the government would have needed to make in order to mix its binary chemical system and deliver it on target was particularly disturbing. These concerns were reinforced by subsequent UN reports suggesting that the rebels might have access to their own chemical weapons. The White House, meanwhile, considered the somewhat ambiguous conclusion of the NIE to be unsatisfactory, resulting in considerable pushback against the senior analysts who had authored the report.
  • In a scenario unfortunately reminiscent of the lead up to Iraq, the National Security Council tasked the various intelligence agencies to beat the bushes and come up with more corroborative information. Israel obligingly provided what was reported to be interceptions of telephone conversations implicating the Syrian army in the attack, but it was widely believed that the information might have been fabricated by Tel Aviv, meaning that bad intelligence was being used to confirm other suspect information, a phenomenon known to analysts as “circular reporting.” Other intelligence cited in passing by the White House on the trajectories and telemetry of rockets that may have been used in the attack was also somewhat conjectural and involved weapons that were not, in fact, in the Syrian arsenal, suggesting that they were actually fired by the rebels. Also, traces of Sarin were not found in most of the areas being investigated, nor on one of the two rockets identified. Whether the victims of the attack suffered symptoms of Sarin was also disputed, and no autopsies were performed to confirm the presence of the chemical.
  • With all evidence considered, the intelligence community found itself with numerous skeptics in the ranks, leading to sharp exchanges with the Director of Central Intelligence John Brennan and Director of National Intelligence James Clapper. A number of analysts threatened to resign as a group if their strong dissent was not noted in any report released to the public, forcing both Brennan and Clapper to back down. This led to the White House issuing its own assessment, completely divorcing the process from any direct connection to the intelligence community. The spectacle of CIA Director George Tenet sitting behind Secretary of State Colin Powell in the United Nations, providing him with credibility as Powell told a series of half-truths, would not be repeated. Philip Giraldi, a former CIA officer, is executive director of the Council for the National Interest.
  •
More detail about backing up previous reports that the information supplied in the White House "Government Assessment of the Syrian Government's Use of Chemical Weapons on August 21, 2013" cooking of intelligence to justify missile strikes on Syria. Note that the same day the Assessment was published by the White House Offiice of the Press Secretary, active duty intelligence officials passed a message to Obama through veteran intelligence officers that the intelligence in the report was unreliable and that there was strong evidence that it was the "rebels" rather than Syrian government that had used sarin gas. http://www.globalresearch.ca/u-s-military-and-intelligence-officials-to-obama-assad-not-responsible-for-chemical-attack/5348576 Next came a report three days later citing and quoting an anonymous former intelligence official who said the format used and its publication by the White House rather than by the Chief of Intelligence were both strong indications that the document was not the product of the intelligence community. http://www.ipsnews.net/2013/09/obamas-case-for-syria-didnt-reflect-intel-consensus/ Now we learn the reason the White House had to cook its own "public summary of intelligence,"  because many top intelligence threatened to resign if the cherry-picked version of events without reservations explaining the likelihood that it was the rebels who did it. So the Obama Administration, like the Bush II Administration, deliberately lied to the public in an attempt to stampede the nation into another foreign war in the Mideast. The only relevant difference is that Obama didn't get away with launching his own "shock and awe" campaign. Impeachable offense? Yes. Likely to happen? No. Too many hawks in Congress who want war against both Syria and Iran.

Nate Jackson: Does Seeking to Jail Political Opponents Count as a 'Smidgen of Corruption'? - The Patriot Post - 0 views

  • And they wonder why people don’t trust the NSA’s mass metadata collection. The conversations that began at least in 2010 continued for three years. In fact, two days before Lerner “apologized” and outed the whole conspiracy, she wrote an email to the acting IRS commissioner’s chief of staff detailing ongoing discussions with DOJ officials. “These new documents show that the Obama IRS scandal is also an Obama DOJ and FBI scandal,” said Judicial Watch President Tom Fitton. “The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his reelection. And this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information. How can the Justice Department and FBI investigate the very scandal in which they are implicated?”
  • The answer to that last, albeit rhetorical, question is that they can’t and they aren’t. Any “investigation” by the DOJ or FBI will no doubt exonerate anyone of importance in the Obama administration. If any guilt is unavoidable, it will be hung around the necks of those rascals in Cincinnati or some other unfortunate scapegoat. All while Lerner continues to enjoy her comfortable retirement, and Obama himself remains untouched. On top of the serious breach of law and abuse of power in targeting Obama’s political opponents, the agencies' carefully crafted stonewall blocked the timely release of information. As with Hillary Clinton’s emails and the Benghazi cover-up, the slow bleed of information leaves the public tired of hearing “old news” and makes it all the more certain the perpetrators won’t face real accountability, much less justice.
  • Finally, we’re reminded of a commencement speech Obama delivered in 2009 at Arizona State University, after university officials declined to give Obama an honorary doctorate. Obama “joked” that “[university president Michael] Crowe and the Board of Regents will soon learn all about being audited by the IRS.” Clearly, that wasn’t much of a joke.
  •
"There was "not even a smidgen of corruption" at the IRS, Barack Obama told us in February 2014, though he conceded "there were some bone-headed decisions." That was a bald-faced lie at the time, and new information only reinforces that conclusion. While the mainstream media turns a blind eye and deaf ear, Judicial Watch has continued digging for information regarding IRS targeting of Tea Party and Patriot groups leading up to (and almost surely aiding in) Obama's re-election in 2012. And they discovered some serious collusion that sounds more like something out of Soviet Russia or Red China than here in the U.S. "Judicial Watch … released new Department of Justice (DOJ) and Internal Revenue Service (IRS) documents that include an official 'DOJ Recap' report detailing an October 2010 meeting between Lois Lerner, DOJ officials and the FBI to plan for the possible criminal prosecution of targeted nonprofit organizations for alleged illegal political activity." In other words, imprisoning political opponents. Remember when the IRS initially blamed the whole fiasco on a couple of low-level employees in Cincinnati? Good times. The documents reveal numerous conversations between the three agencies, including Lois Lerner, about creative ways to charge and jail conservatives for the "crime" of political activity opposing Obama. To do so, the DOJ and FBI needed to illegally obtain taxpayer information from the IRS. So the IRS sent the FBI more than one million pages of taxpayer information on 113,000 non-profit groups."

Judicial Watch: Benghazi Documents Point to White House on Misleading Talking Points - Judicial Watch - 0 views

  • Judicial Watch announced today that on April 18, 2014, it obtained 41 new Benghazi-related State Department documents. They include a newly declassified email showing then-White House Deputy Strategic Communications Adviser Ben Rhodes and other Obama administration public relations officials attempting to orchestrate a campaign to “reinforce” President Obama and to portray the Benghazi consulate terrorist attack as being “rooted in an Internet video, and not a failure of policy.”  Other documents show that State Department officials initially described the incident as an “attack” and a possible kidnap attempt. The documents were released Friday as result of a June 21, 2013, Freedom of Information Act (FOIA) lawsuit filed against the Department of State (Judicial Watch v. U.S. Department of State (No. 1:13-cv-00951)) to gain access to documents about the controversial talking points used by then-UN Ambassador Susan Rice for a series of appearances on television Sunday news programs on September 16, 2012.  Judicial Watch had been seeking these documents since October 18, 2012. The Rhodes email was sent on sent on Friday, September 14, 2012, at 8:09 p.m. with the subject line:  “RE: PREP CALL with Susan, Saturday at 4:00 pm ET.”  The documents show that the “prep” was for Amb. Rice’s Sunday news show appearances to discuss the Benghazi attack.
  • The document lists as a “Goal”: “To underscore that these protests are rooted in and Internet video, and not a broader failure or policy.” Rhodes returns to the “Internet video” scenario later in the email, the first point in a section labeled “Top-lines”: [W]e’ve made our views on this video crystal clear. The United States government had nothing to do with it. We reject its message and its contents. We find it disgusting and reprehensible. But there is absolutely no justification at all for responding to this movie with violence. And we are working to make sure that people around the globe hear that message. Among the top administration PR personnel who received the Rhodes memo were White House Press Secretary Jay Carney, Deputy Press Secretary Joshua Earnest, then-White House Communications Director Dan Pfeiffer, then-White House Deputy Communications Director Jennifer Palmieri, then-National Security Council Director of Communications Erin Pelton, Special Assistant to the Press Secretary Howli Ledbetter, and then-White House Senior Advisor and political strategist David Plouffe. The Rhodes communications strategy email also instructs recipients to portray Obama as “steady and statesmanlike” throughout the crisis. Another of the “Goals” of the PR offensive, Rhodes says, is “[T]o reinforce the President and Administration’s strength and steadiness in dealing with difficult challenges.” He later includes as a PR “Top-line” talking point: I think that people have come to trust that President Obama provides leadership that is steady and statesmanlike. There are always going to be challenges that emerge around the world, and time and again, he has shown that we can meet them.
  • The documents Judicial Watch obtained also include a September 12, 2012, email from former Deputy Spokesman at U.S. Mission to the United Nations Payton Knopf to Susan Rice, noting that at a press briefing earlier that day, State Department spokesperson Victoria Nuland explicitly stated that the attack on the consulate had been well planned.  The email sent by Knopf to Rice at 5:42 pm said: Responding to a question about whether it was an organized terror attack, Toria said that she couldn’t speak to the identity of the perpetrators but that it was clearly a complex attack. In the days following the Knopf email, Rice appeared on ABC, CBS, NBC, Fox News and CNN still claiming the assaults occurred “spontaneously” in response to the “hateful video.” On Sunday, September 16 Rice told CBS’s “Face the Nation:” But based on the best information we have to date, what our assessment is as of the present is in fact what began spontaneously in Benghazi as a reaction to what had transpired some hours earlier in Cairo where, of course, as you know, there was a violent protest outside of our embassy–sparked by this hateful video. The Judicial Watch documents confirm that CIA talking points, that were prepared for Congress and may have been used by Rice on “Face the Nation” and four additional Sunday talk shows on September 16, had been heavily edited by then-CIA deputy director Mike Morell. According to one email: The first draft apparently seemed unsuitable….because they seemed to encourage the reader to infer incorrectly that the CIA had warned about a specific attack on our embassy.  On the SVTS, Morell noted that these points were not good and he had taken a heavy hand to editing them. He noted that he would be happy to work with [then deputy chief of staff to Hillary Clinton]] Jake Sullivan and Rhodes to develop appropriate talking points.

  • The documents obtained by Judicial Watch also contain numerous emails sent during the assault on the Benghazi diplomatic facility.  The contemporaneous and dramatic emails describe the assault as an “attack”:
  • “Now we know the Obama White House’s chief concern about the Benghazi attack was making sure that President Obama looked good,” said Judicial Watch President Tom Fitton. “And these documents undermine the Obama administration’s narrative that it thought the Benghazi attack had something to do with protests or an Internet video.  Given the explosive material in these documents, it is no surprise that we had to go to federal court to pry them loose from the Obama State Department.”

Has there ever been a White House caught in so many lies as the Obama Administration? Maybe, in Nixon's Watergate years. But IMHO it would take a detailed study to determine the winner. It's close.

Clinton Body Count - 0 views

  •
The infamous list of Clinton associates mysteriously found dead.  The dead bodies associated with the Clintons is well worth reviewing on this the eve of congressional testimony from the many Benghazi Whistleblowers.   Just speculation, but i'm in the camp of those who believe that the Benghazi Massacre was an arranged kidnapping gone bad.  The idea was to kidnap Libyan Ambassador Christopher Stevens, and trade him for the blind Sheikh, Oamr Abdel-Rahman - the man behind the 1993 World Trade Center bombing.   Ever since the Muslim Brotherhood took over Egypt, and did so with the assistance of Obama, President Morsi has been lobbying Obama to release and return the blind Sheikh.  In fact, Morsi's first statement as President of Egypt was to promise the Muslim Brotherhood that he would secure the release of the blind Sheikh.  For sure not something Obama could do without some sort of compelling pretext.  Hence the kidnapping plot. Hard to figure out what went wrong with the grand plan. There was never an embassy or consulate in Benghazi. The facilities in Benghazi served as a logistics center for arms and weapons transfers from Libya ultimately destined for the anti-Assad - Muslim Brotherhood terrorists in Syria. It was used by the "State Department's CIA," which is quite different than the actual CIA, to collect and store all the weapons Obama had supplied the Libyan rebels with in their efforts to overthrow Ghadaffi.  And then there's the 20,000 (400 tons worth) heat seeking surface-to-air (SA-7's) missles that Ghaddafi had amassed. Just prior to his kidnapping, Ambassador Stevens was meeting with the Turkish Consul General Ali Sait Akin to arrange another shipment of the captured arms.   The al-Qaeda linked Lybian Islamiuc Fighting Group, headed by Abdelhakim Belhadj, also coveted those weapons.  But this group was supposedly disbanded when Ghadaffi was killed!    It was Belhadj's guys that killed Ambassador Stevens, even though Belhadj him

Obama grants waiver for military support of foreign fighters in Syria - White House - 0 views

  • President Barack Obama has ordered a waiver of restrictions on military aid for foreign forces and others in Syria, deeming it “essential to the national security interests” of the US to allow exceptions from provisions in the four-decades-old Arms Export Control Act.
  • A White House press release Thursday announced that foreign fighters in Syria supporting US special operations “to combat terrorism in Syria” would be excused from restrictions on military assistance. “I hereby determine that the transaction, encompassing the provision of defense articles and services to foreign forces, irregular forces, groups, or individuals engaged in supporting or facilitating ongoing U.S. military operations to counter terrorism in Syria, is essential to the national security interests of the United States,” President Obama affirmed in the presidential determination and waiver. The order delegates responsibility to the US secretary of state to work with and report to Congress on weapons export proposals, requiring 15 days of notice before they are authorized. Obama announced a similar waiver of the Arms Export Control Act in September 2013, following the Ghouta chemical attack in August of that year. That order facilitated the transfer of US military weaponry to "select vetted members" of opposition forces battling Syrian President Bashar al-Assad, while Thursday's order appears less narrow in scope. Last year, Obama signed the National Defense Authorization Act (NDAA) of 2016, which allocated nearly $500 million to arm and train "moderate rebels" in Syria, despite a failed Pentagon program abandoned earlier in 2015. The challenge of differentiating between terrorist forces, such as Al-Nusra, and more moderate forces in Syria has been acknowledged by press secretaries in recent State Department briefings
  • The “counterterrorism” pretext is just a “convenient misappropriation of language,” aimed at arming various militants to battle the Syrian Army and its allies, believes geopolitical analyst Patrick Henningsen. “Putting this under the banner of fighting terrorism … follows on [from] a sort of fantasy concept that’s been pushed out as a talking point for the last year and a half, that if we train and equip the ‘moderate opposition’ they will fight [Islamic State (IS, formerly ISIS/ISIL)],” Henningsen told RT. “They want to open the floodgates basically for trafficking weapons to religious extremists and militants and terrorist groups, internationally recognized terrorist groups … it’s all being done still under this kind of false pretense of the fight against ISIS, that somehow ‘moderate’ rebels, if they even exist, will turn their weapons and fight against ISIS. And we know from the facts on the ground, from the beginning, that [this] simply has not been the case. This is to arm the opposition to fight the Syrian government and to fight Russian forces. This is a desperate move on the part of the lame duck president.” President Obama’s decision could lead to an almost immediate escalation of the conflict and basically put the US in a situation of “waging a proxy war against the Russians and Syrians,” a former Pentagon official, Michael Maloof, told RT. “The rebels, whom we cannot identify, are going to be getting some very sophisticated weapons. Potentially, I should say, man-portable air defense systems, which can knock down Russian and Syrian aircraft,” Maloof said. “And the fact too, that we have stocks already in Europe, that can easily be transferred with this waiver. Under the waiver, it’s supposed to be a 15-day notification to Congress, but Congress, as of tonight, Washington time, is going to be out of session until January. So these arms can go within hours.”

Obama Visits Jamaica as U.S. Helps Caribbean Quit Venezuelan Oil - Bloomberg Business - 0 views

  • Obama arrives ahead of a trip to Panama on April 9-11 for the Summit of the Americas

Starting today, Obama will be catching a lot of flack from Latin-American and Caribbean heads of state for classifying Venezuela as a threat to U.S. National Security and imposing sancitons on that basis. Obama undoubtedly hopes that the blows will be softened by his "i didn't really mean it" line delivered two days ago by a deputy national security advisor. . Not withstanding the soothing words, Obama has not withdrawn his finding or the sanctions he imposed on Venezuela. But those nations' leaders are even more upset by the fact that the U.S., working with Israel, Germany, and the UK, made its second coup attempt in Venezuela earlier this year. The arrest of the conspirators was Obama's excuse for declaring Venezuela a threat to U.S. national security. The U.S. has a sordid history of engineering coups in Latin America and the Caribbean, violating the human right of self-determination of a nation's form of government and other international law prohibiting interference in the internal affairs of other nations.

Bang!  Right between the eyes... excerpt:  Memo to the ruling class media: We are not ignorant or stupid. We've not forgotten Jeremiah Wright. It's not that we don't "know" what faith Obama subscribes to -- it's more that we don't believe him. Or you. Sorry. Not buying. Besides, sometimes we just like to tweak you with our poll answers -- and use any poll as an excuse to "vote against Obama" in any way, shape, or form. *** Frankly, it has been equal parts comedy and insult to watch the ruling-class media haplessly wrestle with the reality that millions of Americans believe Obama to be a Muslim. They are so clueless. As if we needed any more proof -- this is simply another positive dose that the ruling-class media and the country are divided by a huge gulf of philosophy, reality, and experiences. And they are just beside themselves that a country that was concerned that Obama's (Christian?) pastor is a crazy nut in the spring and summer of 2008 can totally forget about all that in the summer of 2010 and call Obama a Muslim. They so miss the point. We have forgotten none of that. If fact, apparently, now more Americans are deciding to look into all of this and process it in light of Obama's actions.

Comment:  While researching the September 2008 financial collapse, a freind introduced me to Porter Stansberry (thanks Marux!).  I've been following Porter through the Daily Crux Report ever since, and, as extreme as his opinions appear, time and again he has proven to be drop dead right.  This latest presentation summarizes Porter's thinking and is buttressed with facts and quotes.  The first part of the presentation is a fictional press conference dated December 2012.  This about 15 minutes.  Porter then follows that with near 45 minutes of facts and quotes woven into a comprehensive summary of how we got into this mess and what the possible outcomes going forward.   The basics are simple enough: the combination of Government borrowing, spending, printing and regulating is killing the dollar.  Our currency is very special in that it's the world's reserve currency; a good fortune that has unfortunately resulted in our spending and borrowing way more than we produce.  On top of this dilemma, the financial crisis of 2008 resulted in the world's Banksters offloading their $Trillions of debt and losses onto the US Treasury; the taxpayers.  So now we have the taxpayers holding the debt of an out of control socialist government spending, borrowing, and regulating us into the dirt regulating.  And, these same taxpayers picking up all the losses of the World's most greedy and evil criminals - the Banksters.  At the center of it all is the Federal Reserve, a world Bankster cartel in control of our currency, and printing it out like there's no tomorrow.  Porter talks about that tomorrow, and what it might look like if we the people do not take back our government and our currency.   excerpt: THE FOLLOWING IS A FICTIONAL DRAMATIZATION OF A PRESS CONFERENCE BY PRESIDENT BARACK OBAMA, ADDRESSING THE AMERICAN PEOPLE, FROM THE EAST ROOM OF THE WHITE HOUSE Set in December 2012, this speech details what we believe The President might say on the day America's fore

Court Rebukes White House Over "Secret Law" - Secrecy News - 1 views

  • DC District Judge Ellen Segal Huvelle yesterday ordered the Obama Administration to release a copy of an unclassified presidential directive, and she said the attempt to withhold it represented an improper exercise of “secret law.” The Obama White House has a “limitless” view of its authority to withhold presidential communications from the public, she wrote, but that view is wrong. “The government appears to adopt the cavalier attitude that the President should be permitted to convey orders throughout the Executive Branch without public oversight– to engage in what is in effect governance by ‘secret law’,” Judge Huvelle wrote in her December 17 opinion. “The Court finds equally troubling the government’s complementary suggestion that ‘effective’ governance requires that a President’s substantive and non-classified directives to Executive Branch agencies remain concealed from public scrutiny,” she wrote.
  • The directive in question, Presidential Policy Directive (PPD) 6, “is a widely-publicized, non-classified Presidential Policy Directive on issues of foreign aid and development that has been distributed broadly within the Executive Branch and used by recipient agencies to guide decision-making,” the Judge noted. “Even though issued as a directive, the PPD-6 carries the force of law as policy guidance to be implemented by recipient agencies, and it is the functional equivalent of an Executive Order.” “Never before has a court had to consider whether the [presidential communications] privilege protects from disclosure under FOIA a final, non-classified, presidential directive.”
  • Several significant points emerge from this episode. First, President Obama’s declared commitment to “creating an unprecedented level of openness in Government” has not been internalized even by the President’s own staff. This latest case of “unbounded” secrecy cannot be blamed on the CIA or an overzealous Justice Department attorney. It is entirely an Obama White House production, based on a White House policy choice. Second, and relatedly, it has proved to be an error to expect the executive branch to unilaterally impose transparency on itself. To do so is to ignore, or to wish away, the Administration’s own conflicting interests in secrecy and disclosure.  Instead, it is the role of the other branches of government to check the executive and to compel appropriate disclosure.
  • ...3 more annotations...
  • Significantly, Judge Huvelle insisted on examining the document herself in camera instead of simply relying on the Administration’s characterization of the document.  Having done so, she found that it “is not ‘revelatory of the President’s deliberations’ such that its public disclosure would undermine future decision-making.” She criticized the government for “the unbounded nature” of its claim. “In the government’s view, it can shield from disclosure under FOIA any presidential communication, even those — like the PPD-6 — that carry the force of law, simply because the communication originated with the President…. The Court rejects the government’s limitless approach….”
  • An official Fact Sheet on PPD-6 (which has not yet been released) is available here. The Electronic Privacy Information Center is currently pursuing release of another presidential directive, the Bush Administration’s NSPD-54 on cyber security. In October, Judge Beryl Howell unexpectedly ruled that that directive was exempt from disclosure because, she said, it was not an “agency record” that would be subject to the FOIA.  Her opinion came as a surprise and was not persuasive to everyone. In a footnote in yesterday’s ruling, Judge Huvelle said that the arguments over the two directives were sufficiently distinguishable that “this Court need not decide if it will follow Judge Howell’s rationale”– suggesting that if pressed, she might not have done so.  Yesterday, EPIC filed a notice of its intent to appeal the decision.

Outrageous. I read the court's opinion. This happened only because: [i] federal judges are reluctant to impose sanctions on government attorneys; and [ii] government attorneys know that. In all my years of legal practice, I read only one court opinion where an assistant U.S. attorney was sanctioned and instead of the normal sanction of paying the other side's attorney fees and expenses of litigation, the judge just awarded a $500 sanction. That is also why litigating against the Feds is such a chore; you spend half your time shooting down blatantly implausible arguments. That's far less of a problem when facing attorneys who are in private practice. But so much for Obama's "transparency" platform; this was the result of the Obama Administration itself asserting a preposterous privilege claim supported only by ridiculous arguments, no more than a delaying action.

JW: Obama Admin Knew About Benghazi Before It Happened - 0 views

  • The State Department has yet to turn over any documents from the secret email accounts of Hillary Clinton and other top State Department officials. “These documents are jaw-dropping. No wonder we had to file more FOIA lawsuits and wait over two years for them.  If the American people had known the truth – that Barack Obama, Hillary Clinton and other top administration officials knew that the Benghazi attack was an al-Qaeda terrorist attack from the get-go – and yet lied and covered this fact up – Mitt Romney might very well be president. And why would the Obama administration continue to support the Muslim Brotherhood even after it knew it was tied to the Benghazi terrorist attack and to al Qaeda? These documents also point to connection between the collapse in Libya and the ISIS war – and confirm that the U.S. knew remarkable details about the transfer of arms from Benghazi to Syrian jihadists,” stated Tom Fitton, Judicial Watch president.  “These documents show that the Benghazi cover-up has continued for years and is only unraveling through our independent lawsuits. The Benghazi scandal just got a whole lot worse for Barack Obama and Hillary Clinton.”
  • The DOD documents also contain the first official documentation that the Obama administration knew that weapons were being shipped from the Port of Benghazi to rebel troops in Syria. An October 2012 report confirms: Weapons from the former Libya military stockpiles were shipped from the port of Benghazi, Libya to the Port of Banias and the Port of Borj Islam, Syria. The weapons shipped during late-August 2012 were Sniper rifles, RPG’s, and 125 mm and 155mm howitzers missiles. During the immediate aftermath of, and following the uncertainty caused by, the downfall of the ((Qaddafi)) regime in October 2011 and up until early September of 2012, weapons from the former Libya military stockpiles located in Benghazi, Libya were shipped from the port of Benghazi, Libya to the ports of Banias and the Port of Borj Islam, Syria. The Syrian ports were chosen due to the small amount of cargo traffic transiting these two ports. The ships used to transport the weapons were medium-sized and able to hold 10 or less shipping containers of cargo. The DIA document further details: The weapons shipped from Syria during late-August 2012 were Sniper rifles, RPG’s and 125mm and 155mm howitzers missiles.  The numbers for each weapon were estimated to be: 500 Sniper rifles, 100 RPG launchers with 300 total rounds, and approximately 400 howitzers missiles [200 ea – 125mm and 200ea – 155 mm.] The heavily redacted document does not disclose who was shipping the weapons.
  • Another DIA report, written in August 2012 (the same time period the U.S. was monitoring weapons flows from Libya to Syria), said that the opposition in Syria was driven by al Qaeda and other extremist Muslim groups: “the Salafist, the Muslim Brotherhood, and AQI are the major forces driving the insurgency in Syria.” The growing sectarian direction of the war was predicted to have dire consequences for Iraq, which included the “grave danger” of the rise of ISIS: The deterioration of the situation has dire consequences on the Iraqi situation and are as follows: This creates the ideal atmosphere for AQI [al Qaeda Iraq] to return to its old pockets in Mosul and Ramadi, and will provide a renewed momentum under the presumption of unifying the jihad among Sunni Iraq and Syria, and the rest of the Sunnis in the Arab world against what it considers one enemy, the dissenters. ISI could also declare an Islamic state through its union with other terrorist organizations in Iraq and Syria, which will create grave danger in regards to unifying Iraq and the protection of its territory. Some of the “dire consequences” are blacked out but the DIA presciently warned one such consequence would be the “renewing facilitation of terrorist elements from all over the Arab world entering into Iraqi Arena.”

  • From a separate lawsuit, the State Department produced a document created the morning after the Benghazi attack by Hillary Clinton’s offices, and the Operations Center in the Office of the Executive Secretariat that was sent widely through the agency, including to Joseph McManus (then-Hillary Clinton’s executive assistant).  At 6:00 am, a few hours after the attack, the top office of the State Department sent a “spot report” on the “Attack on U.S. Diplomatic Mission in Benghazi” that makes no mention of videos or demonstrations: Four COM personnel were killed and three were wounded in an attack by dozens of fighters on the U.S. Diplomatic Mission in Benghazi beginning approximately 1550 Eastern Time….

"Administration knew three months before the November 2012 presidential election of ISIS plans to establish a caliphate in Iraq  Administration knew of arms being shipped from Benghazi to Syria (Washington, DC) - Judicial Watch announced today that it obtained more than 100 pages of previously classified "Secret" documents from the Department of Defense (DOD)and the Department of State revealing that DOD almost immediately reported that the attack on the U.S. Consulate in Benghazi was committed by the al Qaeda and Muslim Brotherhood-linked "Brigades of the Captive Omar Abdul Rahman" (BCOAR), and had been planned at least 10 days in advance. Rahman is known as the Blind Sheikh, and is serving life in prison for his involvement in the 1993 World Trade Center bombing and other terrorist acts.  The new documents also provide the first official confirmation that shows the U.S. government was aware of arms shipments from Benghazi to Syria.  The documents also include an August 2012 analysis warning of the rise of ISIS and the predicted failure of the Obama policy of regime change in Syria. The documents were released in response to a court order in accordance with a May 15, 2014, Freedom of Information Act (FOIA) lawsuit filed against both the DOD and State Department seeking communications between the two agencies and congressional leaders "on matters related to the activities of any agency or department of the U.S. government at the Special Mission Compound and/or classified annex in Benghazi." Spelling and punctuation is duplicated in this release without corrections. A Defense Department document from the Defense Intelligence Agency (DIA), dated September 12, 2012, the day after the Benghazi attack, details that the attack on the compound had been carefully planned by the BOCAR terrorist group "to kill as many Americans as possible."  The document was sent to then-Secretary of State Hillary Clinton, then-Defense Secretary Leon P

Obama's "Catastrophic Defeat" in Ukraine » CounterPunch: Tells the Facts, Names the Names - 0 views

The Ukrainian regular army and the punitive battalions are suffering a catastrophic defeat to the south of Donetsk…..It still is not quite clear how the Junta intends to avoid a complete defeat here…. Now he wants to blame Russia for the damage he’s done. It’s absurd. Moscow is in no way responsible for Ukraine’s descent into anarchy. • Ukraine’s troubles began when the US State Department toppled the elected president in February and replaced him with a compliant stooge who agreed to follow Washington’s directives. The new “junta” government quickly launched a full-blown war against Russian-speaking Ukrainians in the east which split the civilian population and drove the country to ruin. The plan “pacify” the East was concocted in Washington, not Kiev and certainly not Moscow.

  • Donetsk and Lugansk have formed militias and taken the war to the enemy. They’ve engaged Obama’s proxy-army on the battlefield and pounded it into mincemeat. That’s why Obama deployed his propagandists to lie about the fictitious “Russian invasion”. The administration needs a diversion because the Novorussia forces (aka-the “pro Russia separatists”) are kicking the holy crap out of Obama’s legions. That’s why Washington and Kiev are in full panic-mode, because none of this was supposed to happen. Obama figured the army would put down the insurrection, crush the resistance, and move him one step closer to his goal of establishing NATO bases and missile defense systems on Russia’s western flank. Well, guess what? It’s not playing out that way and it probably never will. The Novorussia fighters are too tough, too smart and too motivated to be one-upped by Obama’s feckless troopers. (Check out this short video and you’ll see why the rebels are winning: Vineyard of the Saker)
  • Putin hasn’t sent tanks and artillery into Ukraine. He doesn’t need to. The militias are loaded with battle-hardened veterans who know how to fight and who are quite good at it. Just ask Poroshenko whose army has been taking it in the shorts for the last couple of weeks. Check out this blurb in Thursday’s Itar Tass: “Over the week of August 16-23, the self-defense fighters of the Donetsk and Luhansk People’s Republics seized 14 T-64 tanks, 25 infantry fighting vehicles, 18 armored personnel carriers, one armored reconnaissance and patrol vehicle, one Uragan multiple launch rocket system, two Gvozdika self-propelled artillery guns, four D-30 howitzers, four mortars, one ZU-23-2 air defense system and 33 vehicles.” (East Ukraine militias seize large amount of Ukrainian armor, Itar Tass) Get the picture? The Ukrainian army is getting beaten to a pulp, which means that Obama’s glorious “pivot strategy” just slammed into a brick wall.
  • Bottom line: Russia has not invaded Ukraine. The propagandists in the media are just trying to hide the fact that the Novorussia Army Forces (NAF; aka-the pro Russia separatists) are kicking ass and taking names. That’s what’s really going on. That’s why Obama and his gaggle of miscreant neocons are in a furor. It’s because they don’t know what to do next, so they’ve returned to their default position on every issue; lie like hell until they settle on a plan.
  • So, who do you believe; Kerry or the facts? And who are you going to believe this time; “Aluminum tubes” Gordie or Organization for Security and Co-operation in Europe (OSCE) monitor Andrey Kelin who said yesterday: “We have said that no Russian involvement has been spotted, there are no soldiers or equipment present.” “Accusations relating to convoys of armored personnel carriers have been heard during the past week and the week before that. All of them were proven false back then, and are being proven false again now.” (RT) Repeat: “No Russian involvement”. All the accusations “were proven false.” “False” as in fake, phony, propaganda, bunkum, lies which, by the way, appears to be Gordon’s area of expertise.

Don't miss the video at http://vineyardsaker.blogspot.com/2014/08/watershed-press-conference-by-top.html It's a press conference by Alexander V. Zakharchenko, Chairman of The Council of Ministers of The Donetsk National Republic, describing the rout of coup government forces and the reconstitution of the Novorussia militias into a national army. Russian with English subtitle translation.  According to him the DNR army has killed thousands of Ukrainian soldiers, but the coup government is notifying family members that they are "missing in action," even when the DNR transfers the bodies to Ukraine. He also describes encountering coup government soldiers wearing the insignia of the Galacia SS Division, a Ukraine collaborators' division of the Nazi World War II Waffen SS. (The coup government includes in its leadership neo-Nazis, and neo-Nazi militias are fighting on the side of the coup government.)

To Defend Iran Deal, Obama Boasts That He's Bombed Seven Countries - 0 views

  • Obama also accurately described himself and his own record of militarism. To defend against charges that he Loves the Terrorists, he boasted: As commander-in-chief, I have not shied away from using force when necessary. I have ordered tens of thousands of young Americans into combat. … I’ve ordered military action in seven countries. By “ordered military actions in seven countries,” what he means is that he has ordered bombs dropped, and he has extinguished the lives of thousands of innocent people, in seven different countries, all of which just so happen to be predominantly Muslim. The list includes one country where he twice escalated a war that was being waged when he was inaugurated (Afghanistan), another where he withdrew troops to great fanfare only to then order a new bombing campaign (Iraq), two countries where he converted very rare bombings into a constant stream of American violence featuring cluster bombs and “signature strikes” (Pakistan and Yemen), one country where he continued the policy of bombing at will (Somalia), and one country where he started a brand new war even in the face of Congressional rejection of his authorization to do so, leaving it in tragic shambles (Libya). That doesn’t count the aggression by allies that he sanctioned and supported (in Gaza), nor the proxy wars he enabled (the current Saudi devastation of Yemen), nor the whole new front of cyberattacks he has launched, nor the multiple despots he has propped up, nor the clandestine bombings that he still has not confirmed (Philippines).
  • [As the military historian and former U.S. Army Col. Andrew Bacevich noted in the Washington Post after Obama began bombing Syria, “Syria has become at least the 14th country in the Islamic world that U.S. forces have invaded or occupied or bombed, and in which American soldiers have killed or been killed. And that’s just since 1980.” That is the fact that, by itself, renders tribalistic Westerners who obsessively harp on the violence of Muslims such obvious self-deluded jokes.]

Hacked Emails Reveal NATO General Plotting Against Obama on Russia Policy - 0 views

  • Retired U.S. Air Force Gen. Philip Breedlove, until recently the supreme commander of NATO forces in Europe, plotted in private to overcome President Barack Obama’s reluctance to escalate military tensions with Russia over the war in Ukraine in 2014, according to apparently hacked emails from Breedlove’s Gmail account that were posted on a new website called DC Leaks. Obama defied political pressure from hawks in Congress and the military to provide lethal assistance to the Ukrainian government, fearing that doing so would increase the bloodshed and provide Russian President Vladimir Putin with the justification for deeper incursions into the country. Breedlove, during briefings to Congress, notably contradicted the Obama administration regarding the situation in Ukraine, leading to news stories about conflict between the general and Obama. But the leaked emails provide an even more dramatic picture of the intense back-channel lobbying for the Obama administration to begin a proxy war with Russia in Ukraine. In a series of messages in 2014, Breedlove sought meetings with former Secretary of State Colin Powell, asking for advice on how to pressure the Obama administration to take a more aggressive posture toward Russia.
  • Breedlove attempted to influence the administration through several channels, emailing academics and retired military officials, including former NATO supreme commander Wesley Clark, for assistance in building his case for supplying military assistance to Ukrainian forces battling Russian-backed separatists.
  • Breedlove did not respond to a request for comment. He stepped down from his NATO leadership position in May and retired from service on Friday, July 1. Breedlove was a four-star Air Force general and served as the 17th Supreme Allied Commander of NATO forces in Europe starting on May 10, 2013. Phillip Karber, an academic who corresponded regularly with Breedlove — providing him with advice and intelligence on the Ukrainian crisis —  verified the authenticity of several of the emails in the leaked cache. He also told The Intercept that Breedlove confirmed to him that the general’s Gmail account was hacked and that the incident had been reported to the government.

  • Der Spiegel reported that Breedlove “stunned” German leaders with a surprise announcement in 2015 claiming that pro-Russian separatists had “upped the ante” in eastern Ukraine with “well over a thousand combat vehicles, Russian combat forces, some of the most sophisticated air defense, battalions of artillery” sent to Donbass, a center of the conflict. Breedlove’s numbers were “significantly higher” than the figures known to NATO intelligence agencies and seemed exaggerated to German officials. The announcement appeared to be a provocation designed to disrupt mediation efforts led by Chancellor Angela Merkel. In previous instances, German officials believed Breedlove overestimated Russian forces along the border with Ukraine by as many as 20,000 troops and found that the general had falsely claimed that several Russian military assets near the Ukrainian border were part of a special build-up in preparation for a large-scale invasion of the country. In fact, much of the Russian military equipment identified by Breedlove, the Germans said, had been stored there well before the revolution in Ukraine.
  • The emails, however, depict a desperate search by Breedlove to build his case for escalating the conflict, contacting colleagues and friends for intelligence to illustrate the Russian threat. Karber, who visited Ukrainian politicians and officials in Kiev on several occasions, sent frequent messages to Breedlove — “per your request,” he noted — regarding information he had received about separatist military forces and Russian troop movements. In several updates, Breedlove received military data sourced from Twitter and social media. Karber, the president of the Potomac Foundation, became the center of a related scandal last year when it was discovered that he had facilitated a meeting during which images of purported Russian forces in Ukraine were distributed to the office of Sen. James Inhofe, R-Okla., and were published by a neoconservative blog. The pictures turned out to be a deception; one supposed picture of Russian tanks in Ukraine was, in fact, an old photograph of Russian tanks in Ossetia during the war with Georgia.
  • The emails were released by D.C. Leaks, a database run by self-described “hacktivists” who are collecting the communications of elite stakeholders such as political parties, major politicians, political campaigns, and the military. The website currently has documents revealing some internal communications of the Hillary Clinton presidential campaign and George Soros’s Open Society Foundation, among others.
