Lack of Due Diligence: The NSA's "the Analyst Didn't Give a Fuck" Violation | emptywheel - 0 views

  • The NSA claims there have been no willful violations the law relating to the NSA databases. For example, NSA’s Director of Compliance John DeLong just said ”NSA has a zero tolerance policy for willful misconduct. None of the incidents were willful.” House Intelligence Chair Mike Rogers just said the documents show “no intentional or willful violations.” Which is why I want to look more closely at the user error categories included in the May 3, 2012 audit. The report doesn’t actually break down the root cause of errors across all violations. But it does for 3 different types of overlapping incident types (the 195 FISA authority incidents, the 115 database query ones, and the 772 S2 Directorate violations).
  • What I’m interested in are the three main types of operator error: human error, resources, and lack of due diligence.
  • But then there’s a third category: lack of due diligence. The report defines lack of due diligence as “a failure to follow standard operating procedures.” But some failure to follow standard operating procedure is accounted for in other categories, like training, the misapplied query techniques, and the apparent inadequate research violations. This category appears to be something different than the “honest mistake” errors categorized under human error. In fact, by the very exclusion of these violations from the “human error” category, NSA seems to be admitting these violations aren’t errors. These violations of standard operating procedures, it seems, are intentional. Not errors. Willful violations. At the very least, this category seems to count the violations on behalf of analysts who just don’t give a fuck what he rules are, they’re going to ignore the rules. This category, what consider the “Analyst didn’t give a fuck” category, accounts for 9% to 20% of all the violations broken out by root cause.

  • In aggregate, these violations may not amount to all that many given the thousands of queries run every year — they make up just 68 of the violations in S2, for example. Those 68 due diligence violations make up almost 8% of the violations in the quarter, not counting due diligence violations that may have happened in other Directorates. John DeLong, who is in charge of compliance at NSA, says the Agency has zero tolerance for willful misconduct. But the NSA appears to have a good deal more tolerance for a lack of due diligence.

    Marcy at EmptyWheel digs into the leaked NSA audit reports and exposes what appears to be another Obama Administration lie: that none of the violations of surveillance law by NSA staff were willful. NSA appears to be hiding the willful violations under the misleadingly titled "lack of due diligence" category. Who says numbers can't lie, if they're miscategorized?

But an earlier report shows that this claim may well be wrong and that the U.S. pushes Turkey to release such propaganda. Reuters (Mon Oct 5, 2015 7:54am BST): Turkey says Russian warplane violated its airspace A Russian warplane violated Turkish airspace near the Syrian border on Saturday, prompting the Air Force to scramble two F-16 jets to intercept it, the Foreign Ministry said on Monday. The Foreign Ministry summoned Moscow's ambassador to protest the violation, according to an e-mailed statement. Turkey urged Russia to avoid repeating such a violation, or it would be held "responsible for any undesired incident that may occur."   • Here now what McClatchy reported on these air space violations in a longer piece several hours before Reuters and AFP reported the Turkish claim: ISTANBUL - A Russian warplane on a bombing run in Syria flew within five miles of the Turkish border and may have crossed into Turkey’s air space, Turkish and U.S. officials said Sunday. ... A Turkish security official said Turkish radar locked onto the Russian aircraft as it was bombing early Friday in al Yamdiyyah, a Syrian village directly on the Turkish border. He said Turkish fighter jets would have attacked had it crossed into Turkish airspace. But a U.S. military official suggested the incident had come close to sparking an armed confrontation. Reading from a report, he said the Russian aircraft had violated Turkish air space by five miles and that Turkish jets had scrambled, but that the Russian aircraft had returned to Syrian airspace before they could respond. The Turkish security official said he could not confirm that account.
  • So it is the U.S., not Turkey, which was first pushing the claims of air space violation and of scrambling fighters. The Turkish source would not confirm that. But how could it be a real air space violation when Russian planes "flew within five miles of the Turkish border and may have crossed into Turkey’s air space". The Russian planes were flying in Syrian airspace. They "may have crossed" is like saying that the earth "may be flat". Well maybe it is, right? Fact is the Russians fly ery near to the border and bomb position of some anti-Syrian fighters Turkey supports. They have good reasons to do so: The town, in a mountainous region of northern Latakia province, has been a prime route for smuggling people and goods between Turkey and Syria and reportedly has functioned as a key entry for weapons shipped to Syrian rebels by the U.S.-led Friends of Syria group of Western and Middle Eastern countries.

  • One Russian plane may even indeed have slightly crossed the border while maneuvering. But the real reason why the U.S. military official and Turkey claim the above "violations" is because Turkey unilaterally "moved" the Turkish-Syrian border five miles south: Turkey has maintained a buffer zone five miles inside Syria since June 2012, when a Syrian air defense missile shot down a Turkish fighter plane that had strayed into Syrian airspace. Under revised rules of engagement put in effect then, the Turkish air force would evaluate any target coming within five miles of the Turkish border as an enemy and act accordingly. If Syrian rules of engagement would "move" its northern border up to the Black Sea would any plane in eastern Turkey be in violation of Syrian air space? No one would accept such nonsense and that is why no one should accept the U.S.-Turkish bullshit here. Russian planes should not respect the "new" Turkish defined border but only the legitimate one.
  • It would also be no good reason to start a NATO-Russia war just because such a plane might at times slightly intrude on the Turkish side due to an emergency or other accidental circumstances. Do we have to mention that the U.S., France, Britain and Jordan regularly violate Syrian airspace for their pretended ISIS bombing? That Turkey is bombing the PKK in north Iraq without the permission of the Iraqi government? What about Israels regular air space violations over Lebanon? But what is this all really about? Germany, the Netherlands and the U.S. stationed some Patriot air defense systems in Turkey to defend Turkey and its Islamist storm troops in north-Syria. These systems were announced to leave or have already left. Are these claims about air-space violation now an attempt to get these systems back into Turkey? For what real purpose?

    "James Robart, the U.S. district judge in Washington State, offered little explanation for his decision to stop President Trump's executive order temporarily suspending non-American entry from seven terror-plagued countries. Robart simply declared his belief that Washington State, which in its lawsuit against Trump argued that the order is both illegal and unconstitutional, would likely win the case when it is tried. Now the government has answered Robart, and unlike the judge, Justice Department lawyers have produced a point-by-point demolition of Washington State's claims. Indeed, for all except the most partisan, it is likely impossible to read the Washington State lawsuit, plus Robart's brief comments and writing on the matter, plus the Justice Department's response, and not come away with the conclusion that the Trump order is on sound legal and constitutional ground. Beginning with the big picture, the Justice Department argued that Robart's restraining order violates the separation of powers, encroaches on the president's constitutional and legal authority in the areas of foreign affairs, national security, and immigration, and "second-guesses the president's national security judgment" about risks faced by the United States. Indeed, in court last week, Robart suggested that he, Robart, knows as much, or perhaps more, than the president about the current state of the terrorist threat in Yemen, Somalia, Libya, and other violence-plagued countries. In an exchange with Justice Department lawyer Michelle Bennett, Robart asked, "How many arrests have there been of foreign nationals for those seven countries since 9/11?" "Your Honor, I don't have that information," said Bennett. "Let me tell you," said Robart. "The answer to that is none, as best I can tell. So, I mean, you're here arguing on behalf of someone [President Trump] that says: We have to protect the United States from these individuals coming from these countries, and there's no support for that."

Rep. Mike Rogers Angrily Defends Bathroom Spycam | Popehat - 0 views

  • Representative Mike Rogers (R-Michigan) was defiant today in the face of accusations that he had installed a small digital camera in the women's bathroom in his office at the Capitol. "This is just politics," said the ten-term Congressman. "I would argue the fact that we haven't had any women come forward with any specificity arguing that their privacy has been violated, clearly indicates, in ten years, clearly indicates that something must be doing right. Somebody must be doing something exactly right." When reporters asked how women would know to complain — the spycam, funded by the government, was expertly hidden — Rogers asserted that was the point. "You can't have your privacy violated if you don't know your privacy is violated," said Rogers.
  • Rogers went on to explain that the nation's Capitol — which has housed figures like former Congressman Bob Filner and former Senator Bob Packwood — presents known dangers to women, and that the spycam is calculated to make certain they are protected from those dangers. “If the women knew exactly what that spycam was about, they would be applauding and popping champagne corks. It’s a good thing. it keeps the women safe. It keeps the Capitol safe," Rogers asserted. Rogers then abruptly concluded the interview, threatening to sue reporters if they wrote about it.

    Ken White of Popehat gives a great satirical take on the statement by Rep. Mike Rogers's statement that this week during a hearing on the NSA scandal that: "You can't have your privacy violated if you don't know your privacy is violated." (Put that one in your memorable quotes file, quick.) Worse, Rogers seemed to be sincere. And even worse yet, he is the chairman of the House Intelligence Committee. Chairman Rogers apparently has a double standard on what constitutes "privacy" that distinguishes between victims of NSA snooping and victims of an insecure Affordable Care Act web site: "Continuing with the issue of privacy, Rep. Mike Rogers, R-Mich., ridiculed the program as unsafe for private information, stating that functionality concerns are indicative of a lack of privacy. "If it's not functioning, you know it's not secure," said Rogers. Things Barack Obama Doesn't Consider "Abuse" | emptywheel - 0 views

  • President Obama will shortly give a speech in which he’ll make cosmetic changes to the NSA dragnet, but will continue, in many ways, the accessing of personal data from Americans with no probable cause. As part of his cosmetic effort, he will also say there has been no evidence of abuse in these programs. That means he does not consider any of the following abuse: The NSA spied on the porn and phone sex habits of ideological opponents, including those with no significant ties to extremists, and including a US person.
  • According to the NSA in 2009, it had a program similar to Project Minaret — the tracking of anti-war opponents in the 1970s — in which it spied on people in the US in the guise of counterterrorism without approval. We still don’t have details of this abuse. When the NSA got FISC approval for the Internet (2004) and phone (2006) dragnets, NSA did not turn off features of Bush’s illegal program that did not comply with the FISC authorization. These abuses continued until 2009 (one of them, the collection of Internet metadata that qualified as content, continued even after 2004 identification of those abuses). Even after the FISC spent 9 months reining in some of this abuse, the NSA continued to ignore limits on disseminating US person data. Similarly, the NSA and FBI never complied with PATRIOT Act requirements to develop minimization procedures for the Section 215 program (in part, probably, because NSA’s role in the phone dragnet would violate any compliant minimization procedures).
  • The NSA has twice — in 2009 and 2011 — admitted to collecting US person content in the United States in bulk after having done so for years. It tried to claim (and still claims publicly in spite of legal rulings to the contrary) this US person content did not count as intentionally-collected US person content (FISC disagreed both times), and has succeeded in continuing some of it by refusing to count it, so it can claim it doesn’t know it is happening. As recently as spring 2012, 9% of the NSA’s violations involved analysts breaking standard operating procedures they know. NSA doesn’t report these as willful violations, however, because they’ve deemed any rule-breaking in pursuit of “the mission” not to be willful violations. In 2008, Congress passed a law allowing bulk collection of foreign-targeted content in the US, Section 702, to end the NSA’s practice of stealing Internet company data from telecom cables. Yet in spite of having a legal way to acquire such data, the NSA (through GCHQ) continues to steal data from some of the same companies, this time overseas, from their own cables. Arguably this is a violation of Section 702 of FISA.

  • NSA may intentionally collect US person content (including Internet metadata that legally qualifies as content) overseas (it won’t count this data, so we don’t know how systematic it is). If it does, it may be a violation of Section 703 of FISA. Rather than discussing any of these violations, the NSA has waved around a few cases of LOVEINT (most, if not all, of which have not been prosecuted) as part of a successful ploy to distract from much more systemic abuses of its authority, affecting far more Americans. But there has been abuse, even beyond practices (like back door searches) that gut the Fourth Amendment or (like NSA’s approach to encryption) that hurt Americans’ security. President Obama will spend a lot of time saying there have been no abuses. He’s wrong.

  • A House Democrat said information revealed about the National Security Agency's secret surveillance programs are "the tip of the iceberg," Daniel Strauss of The Hill reports. "I think it's just broader than most people even realize, and I think that's, in one way, what astounded most of us, too," Rep. Loretta Sanchez (D-Calif.) told C-SPAN's "Washington Journal" after a classified briefing with national security officials. Rep. Joe Barton (R-Texas), who also attended the meeting, said that the NSA "violated the spirit of the law when it started collecting data from everyone in the country just because technology now makes that possible.” Barton added that "in America ... You don’t target everyone and violate their 4th Amendment rights just because of a handful of threats. But that is exactly what is happening at the NSA ... it is wrong and it needs to stop now.” More from Sanchez: "I don't know if there are other leaks, if there's more information somewhere, if somebody else is going to step up, but I will tell you that I believe it's the tip of the iceberg."

  • Glenn Greenwald of the Guardian, who has served as a conduit for Snowden's leaks, recently said that there will me many more "significant revelations that have not yet been heard." Greenwald told The New York Times that he received “thousands” of classified documents — “dozens” of which are newsworthy — from the the 29-year-old ex-Booz Allen employee who was contracted by the NSA. Sanchez said that what lawmakers learned "is significantly more than what is out in the media today," which is interesting when considering previous reports by journalists and whistleblowers.

  • Here's a rundown of the reports and the allegations: In 2006 NSA insiders told Leslie Cauley of USA Today that the NSA has been collecting almost all U.S. phone records since shortly after 9/11. In 2010 Dana Priest and William Arkin of The Washington Post reported that "collection systems at the [NSA] intercept and store 1.7 billion emails, phone calls, and other types of communications" every day. According to a 2007 lawsuit, Verizon built a fiber optic cable to give the "access to all communications flowing through the carrier’s operations center." In April 2012 Wired's James Bamford reported how the U.S. government hired two secretive Israeli companies to wiretap AT&T. AT&T engineer Mark Klein discovered the "secret room" at AT&T central office in San Francisco, through which the NSA actively "vacuumed up Internet and phone-call data from ordinary Americans with the cooperation of AT&T" through the wiretapping rooms, emphasizing that "much of the data sent through AT&T to the NSA was purely domestic." Former NSA executive and whistleblower Thomas Drake testified that the NSA is using Israeli-made hardware to "seize and save all personal electronic communications."
  • A classified program called Prism, leaked by Snowden, appears to acquire information from the servers of nine of the biggest internet companies. The Washington Post reported that the government's orders "serve as one-time blanket approvals for data acquisition and surveillance on selected foreign targets for periods of as long as a year." NSA Whistleblower William Binney that the NSA began using the program he built (i.e. ThinThread) to use communications data for creating, in real time, profiles of nearly all Americans so that the government is "able to monitor what people are doing" and who they are doing it with. In July the Foreign Intelligence Surveillance Court (FISC), established to "hear applications for and grant orders approving electronic surveillance," found that the NSA violated the Fourth Amendment's restriction against unreasonable searches and seizures "on at least one occasion." BONUS: In March CIA Chief Technology Officer Ira "Gus" Hunt said: "It is really very nearly within our grasp to be able to compute on all human generated information." If there is "significantly more" to the NSA's domestic snooping, then we're all ears and eyes.

  • Amidst another week of deadly Israeli-Palestinian violence, fifteen faith leaders representing U.S. churches and faith organizations have called on Congress to condition U.S. military aid to Israel upon Israel’s “compliance with applicable U.S. laws and policies.” These leaders--representing Baptist, Lutheran, Catholic, Presbyterian, Methodist, Orthodox, Quaker and other major Christian groups--agree that unconditional U.S. military assistance to Israel has contributed to “sustaining the conflict and undermining the long-term security interests of both Israelis and Palestinians.”  [SEE LETTER BELOW]   As a Quaker peace lobby that has advocated for Israeli-Palestinian peace for decades in Washington, the Friends Committee on National Legislation (FCNL) is proud to be a partner in this effort.   These organizations draw upon their decades of experience in the region, during which they have collectively witnessed the horror of suicide bombing, rocket attacks, shootings of civilians, home demolitions, forced displacement, and other widespread human rights violations. These faith groups “recognize that each party — Israeli and Palestinian — bears responsibilities for its actions and we therefore continue to stand against all violence regardless of its source.”      Unconditional U.S. military aid has become one of those sources fueling violence and further entrenchment of Israel’s military occupation of the Palestinian territories. This statement highlights the United States’ responsibility to hold Israel accountable for “a troubling and consistent pattern of disregard by the government of Israel for U.S. policies that support a just and lasting peace.”

In a historic speech delivered at the prestigious Herzliya National Security Conference in Israel in early 2010, Mr. Barak warned of Israel’s future in the absence of a political settlement, saying in stark terms:   “The reality is cruel but simple. Between the Jordan River...and the Mediterranean, 12 million people live, 7.5 million Israelis and 4.5 million Palestinians. And the simple truth is that as long as in this territory to the West of the Jordan River, there is one political entity which is called Israel[...]and if this bloc of Palestinians would not be able to vote, it’s going to be an apartheid state.”     Israeli, Palestinian, and U.S. interests require urgent efforts to avoid the nightmare that Israeli leader Ehud Barak has described as an apartheid state. A just and peaceful future for Israelis and Palestinians requires that all parties to a conflict are held accountable and that a comprehensive, inclusive diplomatic settlement be secured. An essential step for Congress to support Israeli-Palestinian peace efforts is to heed these warnings, and hold Israel accountable for how it uses U.S. military aid.   • Congress must investigate possible violations of U.S. law The latest State Department human rights report on Israel and the Occupied Territories provides a devastating account of Israel’s human rights violations against civilians, many of which involve the misuse of U.S.-supplied weapons. This diverse religious coalition has called for “an immediate investigation into possible violations by Israel of the U.S. Foreign Assistance Act and the U.S. Arms Export Control Act,” and urges Congress to “ensure that our aid is not supporting actions by the government of Israel that undermine prospects for peace”.     The signers affirm that these are laws that “should be enforced in all instances regardless of location,” but that it is especially critical for Israel to comply with laws that regulate the use of U.S. supplied weapons, since Israel is the single largest recipient of U.S. foreign aid since World War II. Notably, the United States has initiated investigations of violations of these laws by other countries, and on four different occasions between 1978 and 1982, the Secretary of State notified Congress that Israel “may” have violated the provisions of the Arms Export Control Act.   The coalition has called for renewed investigations into human rights violations documented by the State Department’s report, including Israel’s escalation of home demolitions, forced displacement, suppression of dissent, and its use of prohibited weapons in densely populated areas during Israel’s military Operation Cast Lead in the Gaza Strip.  
  • Unfortunately, unconditional U.S. military assistance to Israel has contributed to this deterioration, sustaining the conflict and undermining the long-term security interests of both Israelis and Palestinians. This is made clear in the most recent 2011 State Department Country Report on Human Rights Practices covering Israel and the Occupied Territories (1), which details widespread Israeli human rights violations committed against Palestinian civilians, many of which involve the misuse of U.S.-supplied weapons. Accordingly, we urge an immediate investigation into possible violations by Israel of the U.S. Foreign Assistance Act and the U.S. Arms Export Control Act which respectively prohibit assistance to any country which engages in a consistent pattern of human rights violations and limit the use of U.S. weapons (2) to “internal security” or “legitimate self-defense.” (3) More broadly, we urge Congress to undertake careful scrutiny to ensure that our aid is not supporting actions by the government of Israel that undermine prospects for peace. We urge Congress to hold hearings to examine Israel’s compliance, and we request regular reporting on compliance and the withholding of military aid for non-compliance.

DOJ's Motion to Dismiss in Smith v. Obama, the case challenging the legality of the war... - 0 views

  • As I noted in an earlier post, Nathan Smith, a U.S. Army captain deployed to Kuwait as part of the campaign against ISIL, Operation Inherent Resolve, has sued the President, seeking a declaration that Congress has not authorized the hostilities in Iraq and Syria and that therefore the War Powers Resolution requires the President to remove U.S. forces from hostilities in those nations. On Tuesday, the Department of Justice filed a motion to dismiss the case. Its brief in support of the motion includes one argument that I think is correct (albeit not for all the reasons the government offers) — namely, that Smith lacks standing to sue. That ought to be sufficient to have the case dismissed. The brief also includes an argument on the merits (albeit not designated as such) that is very interesting and potentially important — an account of how Congress has allegedly authorized Inherent Resolve in three ways: (i) in the 2001 AUMF; (ii) in the 2002 AUMF; and (iii) in current appropriations statutes. The heart of the brief, however, is devoted to a third argument — that Judge Koller-Kotelly must dismiss the case on the basis of the political question doctrine — that is not only wrong, but that simply ignores the Supreme Court’s recent (and repeated) repudiation of that very argument.
  • On page 39 of its 45-page brief, the government finally gets around to the reason why the court should dismiss the complaint: Smith lacks standing. Importantly, Smith’s theory of standing is not that he — an Army captain deployed to perform intelligence services in Kuwait — is more likely to be injured or killed by virtue of the President’s decision to deploy troops into hostilities in Iraq and Syria. It is, instead, that the President’s alleged failure to comply with the War Powers Act results in Captain Smith’s own violation of his officer’s oath to “support and defend” the Constitution “against all enemies, foreign and domestic,” and to “bear true faith and allegiance” to the Constitution.
  • The government’s standing argument begins (p. 35) by suggesting that “[p]laintiff’s claim that he is being forced to betray his oath is insufficient to establish standing because the violation of an oath, by itself, is not an injury in fact.” The cases the government cites for that proposition, however, do not say that a forced oath violation would not be an injury in fact — and that’s not a question the judge needs to resolve. What the cases establish, instead, is the point the government finally argues at page 39 — namely, that a government officer does not violate his oath by complying with superiors’ orders, even if it turns out that the law prohibits the military operation in which those orders are issued. Indeed, Smith would not violate his oath of office even if his superiors’ orders themselves were unauthorized, or if the intelligence activities he is ordered to performed were unauthorized. But he does not allege even those things (as I discuss below, he does not, for instance, alleged that he is being ordered to do anything unlawful). Instead, he merely argues that because President Obama should have withdrawn troops from Syria and Iraq 60 days after their deployment, Smith himself is violating his oath to “bear true faith and allegiance to the Constitution.” This is a non sequitur: Even if Smith is right that the continuation of Operation Inherent Resolve is unlawful, that would not mean that he is acting in violation of his oath. (Much more on this in my earlier post.) And that simple fact is reason enough for Judge Koller-Kotelly to dismiss the case.

  • One of Smith’s counsel, Professor Bruce Ackerman, argues that this reason for rejecting the oath-based theory of standing ignores the Supreme Court’s 1804 decision in Little v. Barreme. Little, however, is not on point. In that case, Navy Captain Little was sued by the owners of a Danish ship for damages caused when Little seized that neutral ship. The Court held that Little could be liable, notwithstanding the fact that he was following orders, because the capture violated a implicit statutory prohibition on the military’s seizure of ships sailing from France to the United States. In this case, however, Captain Smith has not argued — nor could he — that he has been ordered to do anything unlawful (in violation of a statute), let alone that he has been ordered to do something that would subject him to possible liability for damages. He is, instead, arguing that President Obama violated a statute. That is not enough to establish Smith’s standing to sue.

As some of us predicted, the government relies on three arguable authorizations, any one of which would be sufficient to defeat Smith’s WPR claim if the courts were to reach the merits. In this post I’m not going to assess the merits of the three arguments. For now, my purpose is only to describe them, and to raise one issue with respect to the third. i. First, the government argues that the 2001 AUMF authorizes the operation against ISIL.
  • Second, the government argues that the 2002 AUMF also authorizes Operation Inherent Resolve, just as it authorized operations in Iraq against AQI (which became ISIL) from 2003 to 2011, after the Hussain regime fell.
  • Finally, and most interestingly (in part because the government has not previously made this argument), DOJ argues that a recent “unbroken stream” of appropriations statutes not only confirm the authorities allegedly conferred by the 2001 and 2002 AUMFs, but also offer their own, independent congressional authorization.
  • Two things are fairly clear from this: The members of Congress approve of Operation Inherent Resolve — indeed, there’s virtually no opposition. And Congress has (most likely) appropriated funds to pay for it. The operative question, however, is whether Congress’s appropriations also serve as an authorization that would supersede the requirement of WPR section 5(b). The government brief alludes to one important argument that the plaintiff will undoubtedly raise: Section 8(a)(1) of the WPR provides that, for purposes of tolling the 60-day clock of section 5(b), “[a]uthority to introduce United States Armed Forces into hostilities or into situations wherein involvement in hostilities is clearly indicated by the circumstances shall not be inferred (1) from any provision of law . . . including any provision contained in any appropriations Act, unless such provision specifically authorizes the introduction of United States Armed Forces into hostilities or into such situations and states that it is intended to constitute specific statutory authorization within the meaning of this chapter.” Obviously, the 2016 Act does not satisfy that requirement. Is that fatal to the appropriations-as-authorization argument?
  • As the Office of Legal Counsel 50 U.S.C. 1542 and 1543). These provisions might be read simply to convey that the executive must continue to comply with the consultation and reporting requirements of WPR sections 3 and 4, even after the 2016 Act authorizes the introduction of troops into hostilities in Iraq and Syria. Or they might alternatively be construed to also specify that the Act is not providing the authority that section 5(b) of the WPR calls for.
  • Not surprisingly, DOJ argues for the former view (pp. 27-28 of the brief): “[I]n the few provisions in which Congress did reference the War Powers Resolution, to clarify that no funds made available for Operation Inherent Resolve are to be used ‘in contravention’ of the Resolution, Congress signaled its agreement that the President’s counter-ISIL military actions were authorized by simultaneously funding Operation Inherent Resolve. If Congress believed that the United States had been conducting airstrikes and other counter-ISIL military activities ‘in contravention of the War Powers Resolution,’ it would have made no sense for Congress to use the ‘in contravention’ proviso in the same laws that make funds available for the express purpose of continuing those military activities.” That’s not a bad argument, at least at first glance; but it’s not a slam-dunk, either, in part because appropriations provisions do not necessarily establish authorizations. It’ll be interesting to see how Captain Smith’s lawyers respond to this particular aspect of the merits argument. I doubt Judge Koller-Kotelly will reach it, however, because she is likely to dismiss the case for want of standing.

    I've read the brief. I don't think the implied partial repeal of the War Powers Resolution argument should fly. The relevant provision establishes a rule of interpretation of later statutes and the appropriations bills neither reject the rule of interpretation nor specifically provide authorization for use of military force. They just authorize funding. On the standing issue, I think the DoJ position is correct; the oath of office applies only to senior officers who make the decision to initiate a war. But DoJ may have opened the door to a more compelling standing argument by arguing that the war does not constitute a war crime, a crime against peace, or a crime against humanity under international law. DoJ did not need to make that argument because Smith had not alleged in his complaint that he was being ordered to commit such crimes, but by doing so DoJ waives any argument that such issues are beyond the scope of Smith's standing and the evidence that the Iraq and Syrian wars are illegal under international law is, to say the least, strong.

    The article is dated April 12, 2004, before Allen West was defeated in his bid for re-election to the House. West is far from a reliable source of information, which shows in the 100 purported reasons for impeachment, which reads like a military-industrial complex wish list. For example, with "allies" like Israel, who needs enemies? West has repeatedly made serious charges that, when pressed by the media for proof, he offered neither evidence nor withdrawal of his charges. West is also a confessed war criminal who admittedly used torture in Iraq to obtain erroneous information from an innocent detainee. Because of the incident, he was removed from his command, charged, and scheduled for court martial under articles 128 and 134 of the Uniform Code of Military Justice. A trial was held but he was rescued from that situation before the decision was rendered by a letter signed by 95 members of Congress. As a result, the felony counts were dropped and he was recharged under Article 15 (minor infractions), fined $5,000, and allowed to resign his commission. Notwithstanding his shameful dereliction of duty, West ran for the House in 2010 as a Tea Party Republican and won, with a campaign that painted himself as a war hero. That is not to say that all of the reasons given for impeachment are invalid. I agree with some of them. I would support Obama's impeachment were there enough votes in the Senate to convict. But even in the House, all of the wind fell out of the impeachment drive's sails when Obama was re-elected.

But another issue is nearly as important and has gotten far less attention: our crumbling commitment to the rule of law. The notion that we are governed by rules that are transparent and enacted through the legislative process-not by the whims of our leaders-is at the heart of that commitment. If legislators exceed their authority under the Constitution, or if otherwise legitimate laws are misused, courts must step in to prevent or remedy the potential harm. During the 2008 financial crisis, the government repeatedly violated these principles. When regulators bailed out Bear Stearns by engineering its sale to J.P. Morgan Chase, they flagrantly disregarded basic corporate law by "locking up" the transaction so that no other bidder could intervene. When the government bailed out AIG six months later, the Federal Reserve funded the bailout by invoking extraordinary loan powers for what was clearly an acquisition rather than a loan. (The government acquired nearly 80% of AIG's stock.) Two months later, the Treasury Department used money from the $700-billion Troubled Asset Relief Program fund to bail out the car companies. This was dubious. Under the statute, the funds were to be used for financial institutions. But the real violation came a few months later, when the government used a sham bankruptcy sale to transfer Chrysler to Fiat while almost certainly stiffing Chrysler's senior creditors. After all, if the government knows that you call the Unitarian Church or Calguns or People for the American Way or Students for Sensible Drug Policy regularly, it has a very good indication that you are a member and it certainly knows that you associate regularly. The law has long recognized that government access to associations can create a chilling effect—people are less likely to associate with organizations when they know the government is watching and when the government can track their associations.

NSA is the bulk telephone records collection program that was confirmed by the publication of an order from the Foreign Intelligence Surveillance Court (FISC) in June of 2013. The Director of National Intelligence (DNI) further confirmed that this formerly secret document was authentic, and part of a broader program to collect all major telecommunications customers’ call history. The order demands wholesale collection of every call made, the location of the phone, the time of the call, the duration of the call, and other “identifying information” for every phone and call for all customers of Verizon for a period of three months. Government officials further confirmed that this was just one of series of orders issued on a rolling basis since at least 2006. First Unitarian v. NSA argues that this spying violates the First Amendment, which protects the freedom to associate and express political views as a group.
  • The First Amendment right of association is a well established doctrine that prevents the government “interfering with the right to peaceably assemble or prohibit the petition for a governmental redress of grievances.” The most famous case embracing it is a 1958 Supreme Court Case from the Civil Rights era called  NAACP v. Alabama. In that case the Supreme Court held that it would violate the First Amendment for the NAACP to have to turn over its membership lists in litigation. The right stems from the simple fact that the First Amendment protects the freedom to associate and express political views as a group. This constitutional protection is critical because, as the court noted “[e]ffective advocacy of both public and private points of view, particularly controversial ones, is undeniably enhanced by group association[.]” NAACP v. Alabama, 357 U.S. at 460. As another court noted: the Constitution protects freedom of association to encourage the “advancing ideas and airing grievances” Bates v. City of Little Rock, 361 U.S. 516, 522-23 (1960).
  • The collection and analysis of telephone records give the government a broad window into our associations. The First Amendment protects against this because, as the Supreme Court has recognized, “it may induce members to withdraw from the association and dissuade others from joining it because of fear of exposure of their beliefs shown through their associations and of the consequences of their exposure.” NAACP v. Alabama, 357 U.S. at 462-63. See also Bates, 361 U.S. at 523; Gibson v. Florida Legislative Investigation Comm., 372 U.S. 539 (1963).  Privacy in one’s associational ties is also closely linked to freedom of association: “Inviolability of privacy in group association may in many circumstances be indispensable to preservation of freedom of association, particularly where a group espouses dissident beliefs.” NAACP v. Alabama, 357 U.S. at 462. 
  • The Supreme Court has made clear that infringements on freedom of association may survive constitutional scrutiny only when they “serve compelling state interests, unrelated to the suppression of ideas, that cannot be achieved through means significantly less restrictive of associational freedoms.” Roberts v. United States Jaycees, 468 U.S. 609, 623 (1984); see also NAACP v. Button, 371 U.S. at 341; Knox v. SEIU, Local 1000, 132 S. Ct. 2277, 2291 (2012)  Here, the wholesale collection of telephone records of millions of innocent Americans’ communications records, and thereby collection of their associations, is massively overbroad, regardless of the government’s interest. Thus, the NSA spying program fails under the basic First Amendment tests that have been in place for over fifty years.

NSA and has been assigned to Judge Whyte, the same judge who ruled earlier in Jewel that the State Secrets Privilege does not apply to NSA's call metadata "haystack." The plaintiffs are 22 different groups who would make strange bedfellows indeed, except in opposition to government surveillance and repression.

That is the question that many Americans should be asking themselves following the news conference where Obama unveiled his plan for destroying the Bill of Rights to the U.S. Constitution. At first glance it appeared to be a case of Obama shamelessly using the deaths of innocents, and some live children as a backdrop, to push for the passage of radical gun control measures by Congress. Most of these have no chance of passing, yet, Obama's signing of Executive orders initiating 23 so called Executive actions on gun control seemed like an afterthought. Unfortunately, that is the real story, but it is generally being overlooked. The fact is that with a few strokes of his pen Obama set up the mechanisms he will personally use to not only destroy the Second Amendment to the Constitution, but also the First, Fourth, and Fifth Amendments. It will not matter what Congress does, Obama can and will act on his own, using these Executive actions, and will be violating both the Constitution and his oath of office when he does it. Here are the sections of the Executive Order that he will use: "1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background-check system." What exactly is relevant data? Does it include our medical records obtained through Obamacare, our tax returns, our political affiliations, our military background, and our credit history? I suggest that all of the above, even if it violates our fourth Amendment right to privacy will now be relevant data for determining if we are allowed to purchase a firearm. "2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background-check system." Because many on our side seem to believe that John Roberts did us a favor in his decision upholding the Affordable Healthcare Act, or as it is known colloquially, Obamacare. The argument in conservative circles for a silver lining to this dark cloud of human bodily excretions is that this ends the debate over the right to use the Commerce Clause to justify any action of Congress and that it hangs this around Osama's neck, a huge tax increase, for the November elections. While a little soothing may be in order we are making a terrible mistake here, because, A.) an eggplant could see this is unconstitutional and, B.) it simply kicks the can down the road, forcing us to fight yet another unnecessary battle. We should have declared victory here. First, this is not a mere political move on Roberts part.
