Why Today's Landmark Court Victory Against Mass Surveillance Matters | American Civil L... - 0 views

  • In a landmark victory for privacy, a federal appeals court ruled unanimously today that the mass phone-records program exposed two years ago by NSA whistleblower Edward Snowden is illegal because it goes far beyond what Congress ever intended to permit when it passed Section 215 of the Patriot Act. The ruling in ACLU v. Clapper is enormously significant, and not only because the program in question — the first to be revealed by Edward Snowden — is at the heart of a legislative reform effort playing out right now, or because it sparked the most significant debate about government surveillance in decades. The decision could also affect many other laws the government has stretched to the breaking point in order to justify dragnet collection of Americans’ sensitive information. Under the program, revealed in the Guardian on June 5, 2013, telecommunications companies hand over to the NSA, on a daily basis, records relating to the calls of all of their customers. Those records include information about who called whom, when, and for how long. The ACLU sued the NSA over the program just days after it was revealed, and we took the case to the Second Circuit Court of Appeals after it was dismissed by a district court.
  • A few points on what makes the decision so important. 1. It recognizes that Section 215 of the Patriot Act does not authorize the government to collect information on such a massive scale.
  • 2. The decision’s significance extends far beyond the phone records program alone. It implicates other mass spying programs that we have learned about in the past two years and — almost certainly ­— others that the government continues to conceal from the public. For example, we know that the Drug Enforcement Administration, for decades, employed a similar definition of “relevance” to amass logs of every call made from the United States to as many as 116 different countries. The same theory was also used to justify the collection of email metadata. Both those programs have been discontinued, but the legal reasoning hasn’t, and it could very well be the basis for programs the government has never acknowledged to the public, including the CIA’s bulk collection of Americans’ financial records.

  • 4. The importance of adversarial review. The court recognized that public, adversarial litigation concerning the lawfulness of this spying program was vitally important to its decision — and it drew a direct contrast to the secret, one-sided proceedings that occur in the Foreign Intelligence Surveillance Court.
  • 3. Metadata is incredibly sensitive and revealing. The government has long argued that the phone records program doesn’t reveal the contents of calls, and as such, it is not an invasion of privacy. But metadata, especially in aggregate, can be just as revealing as content, painting a detailed picture of a person’s life. 
  • 5. The congressional reforms under consideration just don’t cut it. Ahead of Section 215’s sunset on June 1, Sen. Majority Leader Mitch McConnell (R-Ky.) is trying to push through a straight reauthorization of the provision, extending its life by another five years. After today’s decision came down, he took to the floor to defend the program — a position altogether at odds with the appeals court decision, with the conclusions of multiple executive-branch review groups who found the program hasn’t been effective in stopping terrorism, and with the clear consensus that supports far-reaching surveillance reform. Another bill in play (which the ACLU neither supports nor opposes), the USA Freedom Act of 2015, doesn’t go nearly far enough, most notably in ensuring that the government cannot engage in broad collection of innocent Americans’ private information.

Senate Intelligence Committee Passes Bill That Codifies, Expands NSA Powers - 0 views

  • Just days after expressing outrage over reports of widespread surveillance of foreign leaders by the National Security Agency, Sen. Dianne Feinstein (D-Calif.) pushed through the Senate Intelligence Committee on an 11-4 vote a bill that enshrines the bulk collection of Americans' phone call records into law, and expands the agency's authority to track foreign nationals who enter the United States. The bill, passed on Thursday, is meant to respond to the revelations of leaker Edward Snowden. But critics immediately charged that it does little more than offer a fig leaf for the NSA's controversial surveillance operations.
  • In his statement, Udall disagreed. "The NSA's ongoing, invasive surveillance of Americans' private information does not respect our constitutional values and needs fundamental reform -- not incidental changes," Udall said. "Unfortunately, the bill passed by the Senate Intelligence Committee does not go far enough to address the NSA's overreaching domestic surveillance programs." Udall is a co-sponsor of a bill introduced earlier this week by Rep. James Sensenbrenner (R-Wisc.) and Sen. Patrick Leahy (D-Vt.) that would end the NSA's bulk collection of phone call records. The passage of Feinstein's bill sets up a confrontation with Leahy's Judiciary Committee over what version of NSA reform Congress will produce. "The Feinstein bill is terrible and would make things worse. I think the Leahy-Sensenbrenner bill begins to address some of the problems" with the NSA, said Jennifer Granick, director of civil liberties at the Stanford Center for Internet and Society. Neither bill, Granick said, addresses the NSA's infiltration of Yahoo and Google data centers worldwide, which could provide the agency a pathway to collecting Americans' communications.

USA Freedom Act Passes House, Codifying Bulk Collection For First Time, Critics Say - T... - 0 views

  • After only one hour of floor debate, and no allowed amendments, the House of Representatives today passed legislation that opponents believe may give brand new authorization to the U.S. government to conduct domestic dragnets. The USA Freedom Act was approved in a 338-88 vote, with approximately equal numbers of Democrats and Republicans voting against. The bill’s supporters say it will disallow bulk collection of domestic telephone metadata, in which the Foreign Intelligence Surveillance Court has regularly ordered phone companies to turn over such data. The Obama administration claims such collection is authorized by Section 215 of the USA Patriot Act, which is set to expire June 1. However, the U.S. Court of Appeals for the Second Circuit recently held that Section 215 does not provide such authorization. Today’s legislation would prevent the government from issuing such orders for bulk collection and instead rely on telephone companies to store all their metadata — some of which the government could then demand using a “specific selection term” related to foreign terrorism. Bill supporters maintain this would prevent indiscriminate collection.
  • However, the legislation may not end bulk surveillance and in fact could codify the ability of the government to conduct dragnet data collection. “We’re taking something that was not permitted under regular section 215 … and now we’re creating a whole apparatus to provide for it,” Rep. Justin Amash, R-Mich., said on Tuesday night during a House Rules Committee proceeding. “The language does limit the amount of bulk collection, it doesn’t end bulk collection,” Rep. Amash said, arguing that the problematic “specific selection term” allows for “very large data collection, potentially in the hundreds of thousands of people, maybe even millions.” In a statement posted to Facebook ahead of the vote, Rep. Amash said the legislation “falls woefully short of reining in the mass collection of Americans’ data, and it takes us a step in the wrong direction by specifically authorizing such collection in violation of the Fourth Amendment to the Constitution.”

  • Not addressed in the bill, however, are a slew of other spying authorities in use by the NSA that either directly or inadvertently target the communications of American citizens. Lawmakers offered several amendments in the days leading up to the vote that would have tackled surveillance activities laid out in Section 702 of the Foreign Intelligence Surveillance Act and Executive Order 12333 — two authorities intended for foreign surveillance that have been used to collect Americans’ internet data, including online address books and buddy lists. The House Rules Committee, however, prohibited consideration of any amendment to the USA Freedom Act, claiming that any changes to the legislation would have weakened its chances of passage.
  • The measure now goes to the Senate where its future is uncertain. Majority Leader Mitch McConnell has declined to schedule the bill for consideration, and is instead pushing for a clean reauthorization of expiring Patriot Act provisions that includes no surveillance reforms.   • The NSA agency is not preoccupied solely with national security, but also spies on foreign industrial entities in US business interests, former American intelligence contractor, Edward Snowden, has revealed in an interview to German TV. Edward Snowden chose the German ARD broadcaster to make his first TV interview ever since he became a whistleblower. The interview was made in strict secrecy in an unspecified location in Russia, where Snowden is currently living under temporary asylum. “There is no question that the US is engaged in economic spying,” said Snowden. If an industrial giant like Siemens has something that the NSA believes “would be beneficial to the national interests, not the national security, of the United States, they will go after that information and they'll take it,” the whistleblower said, giving an example.

Former NSA contractor, Edward Snowden, remains in Russia, where his temporary political asylum status could be extended every year. He has no plans for returning to the US where he would face trial for alleged treason.

Obama's Lies, NSA Spies, and the Sons of Liberty: Will You Choose Dangerous Freedom or ... - 0 views

  • After such a 1984-esque send-up, it doesn’t even really matter what else Obama had to say in his speech about NSA reforms and the like. Rest assured, it was largely a pack of lies. Mind you, Obama said it eloquently enough and interspersed it with all the appropriately glib patriotic remarks about individual freedom and the need to defend the Constitution and securing the life of our nation while preserving our liberties. After all, Obama has proven to be very good at saying one thing and doing another, whether it’s insisting that “you can keep your health care plan,” that he’ll close Guantanamo, or that his administration’s controversial drone strikes only target terrorists and not civilians. When it comes to the NSA, Obama has been lying to the American people for quite some time now. There was the time he claimed the secret FISA court is “transparent.” Then he insisted that “we don’t have a domestic spying program.” And then, to top it all off, he actually insisted there was no evidence the NSA was “actually abusing” its power. As David Sirota writes for Salon: “it has now become almost silly to insinuate or assume that the president hasn’t also been lying. Why? Because if that’s true — if indeed he hasn’t been deliberately lying — then it means he has been dangerously, irresponsibly and negligently ignorant of not only the government he runs, but also of the news breaking around him.”
  • So in terms of Obama’s latest speech on the NSA, if you read between the lines—or just ignore the president’s words and pay attention to his actions—it’s clear that nothing is going to change. The NSA will continue to abuse its power by spying on Americans’ phone calls and emails. They will continue to collect metadata on our various communications and activities. And they will continue to carry out their surveillance in secret, with no attempts at transparency or accountability. The NSA will do so, no matter what Obama claims to the contrary, because this black ops-funded agency whose very existence is abhorrent to the Constitution has become a power unto itself. They no longer work for us or for the president, for that matter. He works for them. Remember, Obama is the chief executive of a super secretive surveillance state whose overarching purpose is to remain in power by any means available. As such, he and his surveillance state cohorts have far more in common with King George and the British government of his day than with the American colonists who worked hard to foment a rebellion and overthrow a despotic regime.
  • Indeed, Obama and his speechwriters would do well to brush up on their history. In doing so, they will find that the Sons of Liberty, the “small, secret surveillance committee” they conveniently liken to the NSA, was in fact an underground, revolutionary movement that fought the established government of its day, whose members were considered agitators, traitors and terrorists not unlike Edward Snowden.

Ah, yes, the T-word. We must keep killing civilians in foreign lands so we can have more terrorists to catch, therefore we need to do more intensive spying on Americans in case they reach the American shores.  It all makes perfect nonsense to me. I have not yet found a suitable adjective to describe such people, but when I do it won't be nice.

  • A Senate bill promoted as a surveillance reform would codify the ability of the National Security Agency to search its troves of foreign phone and email communications for Americans’ information, and permit law enforcement agencies to search the vast databases as well. The Fisa Improvements Act, promoted by Dianne Feinstein, the California Democrat who chairs the Senate intelligence committee, would both make permanent a loophole permitting the NSA to search for Americans’ identifying information without a warrant – and, civil libertarians fear, contains an ambiguity that might allow the FBI, the DEA and other law enforcement agencies to do the same thing. “For the first time, the statute would explicitly allow the government to proactively search through the NSA data troves of information without a warrant,” said Michelle Richardson, the surveillance lobbyist for the ACLU.
  • “It may also expand current practices by allowing law enforcement to directly access US person information that was nominally collected for foreign intelligence purposes. This fourth amendment back door needs to be closed, not written into stone.” Feinstein’s bill passed the committee on an 11 to 4 vote on 31 October. An expanded report on its provisions released by the committee this week added details about the ability of both intelligence and law enforcement to sift through foreign communications databases that it accumulates under section 702 of the Fisa Amendments Act of 2008. Section 6 of Feinstein’s bill blesses what her committee colleague Ron Wyden, the Oregon Democrat and civil libertarian, has called the “backdoor search provision,” which the Guardian revealed thanks to a leak by Edward Snowden.  The section permits intelligence agencies to search “the contents of communications” collected primarily overseas for identifying information on US citizens, resident aliens and people inside the US, provided that the “purpose of the query is to obtain foreign intelligence information or information necessary to understand foreign intelligence information or to assess its importance.”
  • Section 6 bills itself as a “restriction,” but it would not stop the NSA from performing the warrantless search, merely requiring intelligence agencies to log their queries and make them “available for review” to Congress, the Fisa court, the Justice Department and inspectors general inside the executive branch. A declassified Fisa court document from 2011 refers to “FBI minimization procedures,” but it is unclear what those procedures are. A copy of the FBI minimization procedures from 2009, acquired by the ACLU under the Freedom of Information Act is almost completely redacted. So is the section in the government’s most recent report on its Section 702 collection dealing with the FBI’s role, though it contains references to how the FBI “receive[s] … unminimized Section 70 acquired communications” from the NSA.

In his speech, the President ensured that National Security Letters would not come with perpetual gag orders, brought new levels of transparency and fairness to the FISA court, and ended bulk collection of telephone records by the NSA. However, there is still much more to be done. We’ve put together a scorecard showing how Obama’s announcements stack up against 12 common sense fixes that should be a minimum for reforming NSA surveillance. Each necessary reform was worth 1 point, and we were willing to award partial credit for steps in the right direction. On that scale, President Obama racked up 3.5 points out of a possible 12.

President Barack Obama plans new limits on National Security Agency surveillance - POLI... - 0 views

  • President Barack Obama said Thursday that he'll be reining in some of the snooping conducted by the National Security Agency, but he did not detail what new limits he plans to impose on the embattled spy organization. "I'll be proposing some self-restraint on the NSA. And...to initiate some reforms that can give people more confidence, " Obama told Chris Matthews in an interview recorded for MSNBC's "Hardball." The president insisted that the NSA's work shows respect for the rights of Americans, but he conceded that its activities are often more intrusive when it comes to foreigners communicating overseas. "The N.S.A. actually does a very good job about not engaging in domestic surveillance, not reading people's emails, not listening to the contents of their phone calls. Outside of our borders, the NSA's more aggressive. It's not constrained by laws," Obama said.
  • The White House has already acknowledged imposing some limits on overseas surveillance, publicly promising not to intercept phone calls of German Chancellor Angela Merkel and indicating that surveillance on leaders of other allies has also been curtailed.

  • However, Obama also cited the terrorist threat the NSA is trying to combat. And, in with some at the NSA feeling hung out to dry by the president, he went out of his way to praise the agency's personnel for their discretion.

  • One should not expect any change to come from the U.S. government itself (which includes Congress), whose strategy in such cases is to enact the pretext of “reform” so as to placate public anger, protect the system from any serious weakening, and allow President Obama to go before the country and the world and give a pretty speech about how the U.S. heard their anger and re-calibrated the balance between privacy and security. Any new law that comes from the radically corrupted political class in DC will either be largely empty, or worse. The purpose will be to shield the NSA from real reform. There are, though, numerous other avenues with the real potential to engender serious limits on the NSA’s surveillance powers, including the self-interested though genuine panic of the U.S. tech industry over how surveillance will impede their future business prospects, the efforts of other countries to undermine U.S. hegemony over the internet, the newfound emphasis on privacy protections from internet companies worldwide, and, most of all, the increasing use of encryption technology by users around the world that poses genuine obstacles to state surveillance. Those are all far, far more promising avenues than any bill Barack Obama, Dianne Feinstein and Saxby Chambliss will let Congress cough up.
  • That national security state officials routinely mislead and deceive the public should never have even been in serious doubt in the first place – certainly not for journalists, and especially now after the experience of the Iraq War. That fact — that official pronouncements merit great skepticism rather than reverence — should be (but plainly is not) fundamental to how journalists view the world. More evidence for that is provided by a Washington Post column today by one of the national security state’s favorite outlets, David Ignatius. Ignatius interviewed the chronic deceiver, Director of National Intelligence James Clapper, who now “says it appears the impact [of Snowden's leaking] may be less than once feared because ‘it doesn’t look like he [Snowden] took as much’ as first thought.” Clapper specifically casts serious doubt on the U.S. government’s prior claim that Snowden ”had compromised the communications networks that make up the military’s command and control system”; instead, “officials now think that dire forecast may have been too extreme.” Ignatius — citing an anonymous “senior intelligence official” (who may or may not be Clapper) — also announces that the government has yet again revised its rank speculation about how many documents Snowden took: “This batch of probably downloaded material is about 1.5 million documents, the senior official said. That’s below an earlier estimate of 1.77 million documents.”
  • Most notable is Ignatius’ summary of the government’s attempt to claim Snowden seriously compromised the security of the U.S.: Pressed to explain what damage Snowden’s revelations had done, the official was guarded, saying that there was “damage in foreign relations” and that the leaks had “poisoned [NSA’s] relations with commercial providers.” He also said that terrorist groups had carefully studied the disclosures, turning more to anonymizers, encryption and use of couriers to shield communications. The senior official wouldn’t respond to repeated questions about whether the intelligence community has noted any changes in behavior by either the Russian or Chinese governments, in possible response to information they may have gleaned from Snowden’s revelations. In other words, the only specific damage they can point to is from the anger that other people around the world have about what the U.S. government has done and the fact that people will not want to buy U.S. tech products if they fear (for good reason) that those companies collaborate with the NSA. But, as usual, there is zero evidence provided (as opposed to bald, self-serving assertions) of any harm to genuine national security concerns (i.e., the ability to monitor anyone planning actual violent attacks).

What was supposed to be a single agency with a dual mission -- protecting the security of U.S. communications and eavesdropping on the communications of our enemies -- has become unbalanced in the post-Cold War, all-terrorism-all-the-time era. Putting the U.S. Cyber Command, the military's cyberwar wing, in the same location and under the same commander, expanded the NSA's power. The result is an agency that prioritizes intelligence gathering over security, and that's increasingly putting us all at risk. It's time we thought about breaking up the National Security Agency. Broadly speaking, three types of NSA surveillance programs were exposed by the documents released by Edward Snowden. And while the media tends to lump them together, understanding their differences is critical to understanding how to divide up the NSA's missions.

Missouri house bans cellphone tracking without a warrant, 134-13 | Tenth Amendment Cent... - 0 views

  • Yesterday, the Missouri house overwhelmingly approved a bill to ban the obtaining of cellphone location tracking information without a warrant. House Bill 1388 (HB1388) prohibits use of such information in civil or criminal proceedings, and even bans its use as “an affidavit of probable cause in an effort to obtain a search warrant.” Introduced by Rep. Robert Cornejo, the measure passed by a vote of 134-13. HB1388 will not only add a key protection to bolster the privacy rights of Missourians from potential local abuse, it will also end some practical effects of unconstitutional data gathering by the federal government. NSA collects, stores, and analyzes data on countless millions of people without a warrant, and without even the mere suspicion of criminal activity. The NSA tracks the physical location of people through their cellphones. In late 2013, the Washington Post reported that NSA is “gathering nearly 5 billion records a day on the whereabouts of cellphones around the world.” This includes location data on “tens of millions” of Americans each year – without a warrant. Through fusion centers, state and local law enforcement act as “information recipients” to various federal departments under Information Sharing Environment (ISE). ISE partners include the Office of Director of National Intelligence, which is an umbrella covering 17 federal agencies and organizations, including the NSA.
  • The NSA expressly shares warrantless data with state and local law enforcement through a super-secret DEA unit known as the Special Operations Division (SOD). That information is being used for criminal prosecutions. Reuters reported that most of this shared data has absolutely nothing to do with national security issues. Most of it involves routine criminal investigations. In short – banning state government entities in Missouri from obtaining phone location tracking information without a warrant will block them from receiving that kind of information from federal agencies who routinely collect it without warrant. HB1388 is part of a package of bills designed to thwart the surveillance state being considered in the Missouri legislature this year.  SB819 would deny compliance and material support from the state to the NSA as long as they continue their unconstitutional spying programs. SJR27 would amend the Missouri State Constitution to protect residents’ electronic data from warrantless searches. HB1388 now moves to the State Senate where it will first be assigned to a committee for approval before the full senate has an opportunity to send it to Gov. Nixon’s desk for a signature.

  • Today, the US House of Representatives passed an amendment to the Defense Appropriations bill designed to cut funding for NSA backdoors. The amendment passed overwhelmingly with strong bipartisan support: 293 ayes, 123 nays, and 1 present. Currently, the NSA collects emails, browsing and chat history under Section 702 of the FISA Amendments Act, and searches this information without a warrant for the communications of Americans—a practice known as "backdoor searches." The amendment would block the NSA from using any of its funding from this Defense Appropriations Bill to conduct such warrantless searches. In addition, the amendment would prohibit the NSA from using its budget to mandate or request that private companies and organizations add backdoors to the encryption standards that are meant to keep you safe on the web.   • A federal judge in Idaho has upheld the constitutionality of the National Security Agency's program that gathers massive quanities of data on the telephone calls of Americans. The ruling Tuesday from U.S. District Court Judge B. Lynn Winmill leaves the federal government with two wins in lawsuits decided since the program was revealed about a year ago by ex-NSA contractor Edward Snowden. In addition, one judge handling a criminal case ruled that the surveillance did not violate the Constitution. Opponents of the program have only one win: U.S. District Court Judge Richard Leon's ruling in December that the program likely violates the Fourth Amendment. In the new decision, Winmill said binding precedent in the Ninth Circuit holds that call and email metadata are not protected by the Constitution and no warrant is needed to obtain it.
  • "The weight of the authority favors the NSA," wrote Winmill, an appointee of President Bill Clinton. Winmill took note of Leon's contrary decision and called it eloquent, but concluded it departs from current Supreme Court precedent — though perhaps not for long. "Judge Leon’s decision should serve as a template for a Supreme Court opinion. And it might yet," Winmill wrote as he threw out the lawsuit brought by an Idaho registered nurse who objected to the gathering of data on her phone calls. USA Freedom Act Passes: What We Celebrate, What We Mourn, and Where We Go From Here | E... - 0 views

  • The Senate passed the USA Freedom Act today by 67-32, marking the first time in over thirty years that both houses of Congress have approved a bill placing real restrictions and oversight on the National Security Agency’s surveillance powers. The weakening amendments to the legislation proposed by NSA defender Senate Majority Mitch McConnell were defeated, and we have every reason to believe that President Obama will sign USA Freedom into law. Technology users everywhere should celebrate, knowing that the NSA will be a little more hampered in its surveillance overreach, and both the NSA and the FISA court will be more transparent and accountable than it was before the USA Freedom Act. It’s no secret that we wanted more. In the wake of the damning evidence of surveillance abuses disclosed by Edward Snowden, Congress had an opportunity to champion comprehensive surveillance reform and undertake a thorough investigation, like it did with the Church Committee. Congress could have tried to completely end mass surveillance and taken numerous other steps to rein in the NSA and FBI. This bill was the result of compromise and strong leadership by Sens. Patrick Leahy and Mike Lee and Reps. Robert Goodlatte, Jim Sensenbrenner, and John Conyers. It’s not the bill EFF would have written, and in light of the Second Circuit's thoughtful opinion, we withdrew our support from the bill in an effort to spur Congress to strengthen some of its privacy protections and out of concern about language added to the bill at the behest of the intelligence community. Even so, we’re celebrating. We’re celebrating because, however small, this bill marks a day that some said could never happen—a day when the NSA saw its surveillance power reduced by Congress. And we’re hoping that this could be a turning point in the fight to rein in the NSA.

UN Report Finds Mass Surveillance Violates International Treaties and Privacy Rights - ... - 0 views

  • The United Nations’ top official for counter-terrorism and human rights (known as the “Special Rapporteur”) issued a formal report to the U.N. General Assembly today that condemns mass electronic surveillance as a clear violation of core privacy rights guaranteed by multiple treaties and conventions. “The hard truth is that the use of mass surveillance technology effectively does away with the right to privacy of communications on the Internet altogether,” the report concluded. Central to the Rapporteur’s findings is the distinction between “targeted surveillance” — which “depend[s] upon the existence of prior suspicion of the targeted individual or organization” — and “mass surveillance,” whereby “states with high levels of Internet penetration can [] gain access to the telephone and e-mail content of an effectively unlimited number of users and maintain an overview of Internet activity associated with particular websites.” In a system of “mass surveillance,” the report explained, “all of this is possible without any prior suspicion related to a specific individual or organization. The communications of literally every Internet user are potentially open for inspection by intelligence and law enforcement agencies in the States concerned.”
  • Mass surveillance thus “amounts to a systematic interference with the right to respect for the privacy of communications,” it declared. As a result, “it is incompatible with existing concepts of privacy for States to collect all communications or metadata all the time indiscriminately.” In concluding that mass surveillance impinges core privacy rights, the report was primarily focused on the International Covenant on Civil and Political Rights, a treaty enacted by the General Assembly in 1966, to which all of the members of the “Five Eyes” alliance are signatories. The U.S. ratified the treaty in 1992, albeit with various reservations that allowed for the continuation of the death penalty and which rendered its domestic law supreme. With the exception of the U.S.’s Persian Gulf allies (Saudi Arabia, UAE and Qatar), virtually every major country has signed the treaty. Article 17 of the Covenant guarantees the right of privacy, the defining protection of which, the report explained, is “that individuals have the right to share information and ideas with one another without interference by the State, secure in the knowledge that their communication will reach and be read by the intended recipients alone.”
  • The report’s key conclusion is that this core right is impinged by mass surveillance programs: “Bulk access technology is indiscriminately corrosive of online privacy and impinges on the very essence of the right guaranteed by article 17. In the absence of a formal derogation from States’ obligations under the Covenant, these programs pose a direct and ongoing challenge to an established norm of international law.” The report recognized that protecting citizens from terrorism attacks is a vital duty of every state, and that the right of privacy is not absolute, as it can be compromised when doing so is “necessary” to serve “compelling” purposes. It noted: “There may be a compelling counter-terrorism justification for the radical re-evaluation of Internet privacy rights that these practices necessitate. ” But the report was adamant that no such justifications have ever been demonstrated by any member state using mass surveillance: “The States engaging in mass surveillance have so far failed to provide a detailed and evidence-based public justification for its necessity, and almost no States have enacted explicit domestic legislation to authorize its use.”

  • Instead, explained the Rapporteur, states have relied on vague claims whose validity cannot be assessed because of the secrecy behind which these programs are hidden: “The arguments in favor of a complete abrogation of the right to privacy on the Internet have not been made publicly by the States concerned or subjected to informed scrutiny and debate.” About the ongoing secrecy surrounding the programs, the report explained that “states deploying this technology retain a monopoly of information about its impact,” which is “a form of conceptual censorship … that precludes informed debate.” A June report from the High Commissioner for Human Rights similarly noted “the disturbing lack of governmental transparency associated with surveillance policies, laws and practices, which hinders any effort to assess their coherence with international human rights law and to ensure accountability.” The rejection of the “terrorism” justification for mass surveillance as devoid of evidence echoes virtually every other formal investigation into these programs. A federal judge last December found that the U.S. Government was unable to “cite a single case in which analysis of the NSA’s bulk metadata collection actually stopped an imminent terrorist attack.” Later that month, President Obama’s own Review Group on Intelligence and Communications Technologies concluded that mass surveillance “was not essential to preventing attacks” and information used to detect plots “could readily have been obtained in a timely manner using conventional [court] orders.”
  • Three Democratic Senators on the Senate Intelligence Committee wrote in The New York Times that “the usefulness of the bulk collection program has been greatly exaggerated” and “we have yet to see any proof that it provides real, unique value in protecting national security.” A study by the centrist New America Foundation found that mass metadata collection “has had no discernible impact on preventing acts of terrorism” and, where plots were disrupted, “traditional law enforcement and investigative methods provided the tip or evidence to initiate the case.” It labeled the NSA’s claims to the contrary as “overblown and even misleading.” While worthless in counter-terrorism policies, the UN report warned that allowing mass surveillance to persist with no transparency creates “an ever present danger of ‘purpose creep,’ by which measures justified on counter-terrorism grounds are made available for use by public authorities for much less weighty public interest purposes.” Citing the UK as one example, the report warned that, already, “a wide range of public bodies have access to communications data, for a wide variety of purposes, often without judicial authorization or meaningful independent oversight.”
  • The report was most scathing in its rejection of a key argument often made by American defenders of the NSA: that mass surveillance is justified because Americans are given special protections (the requirement of a FISA court order for targeted surveillance) which non-Americans (95% of the world) do not enjoy. Not only does this scheme fail to render mass surveillance legal, but it itself constitutes a separate violation of international treaties (emphasis added): The Special Rapporteur concurs with the High Commissioner for Human Rights that where States penetrate infrastructure located outside their territorial jurisdiction, they remain bound by their obligations under the Covenant. Moreover, article 26 of the Covenant prohibits discrimination on grounds of, inter alia, nationality and citizenship. The Special Rapporteur thus considers that States are legally obliged to afford the same privacy protection for nationals and non-nationals and for those within and outside their jurisdiction. Asymmetrical privacy protection regimes are a clear violation of the requirements of the Covenant.
  • That principle — that the right of internet privacy belongs to all individuals, not just Americans — was invoked by NSA whistleblower Edward Snowden when he explained in a June, 2013 interview at The Guardian why he disclosed documents showing global surveillance rather than just the surveillance of Americans: “More fundamentally, the ‘US Persons’ protection in general is a distraction from the power and danger of this system. Suspicionless surveillance does not become okay simply because it’s only victimizing 95% of the world instead of 100%.” The U.N. Rapporteur was clear that these systematic privacy violations are the result of a union between governments and tech corporations: “States increasingly rely on the private sector to facilitate digital surveillance. This is not confined to the enactment of mandatory data retention legislation. Corporates [sic] have also been directly complicit in operationalizing bulk access technology through the design of communications infrastructure that facilitates mass surveillance. ”
  • The latest finding adds to the growing number of international formal rulings that the mass surveillance programs of the U.S. and its partners are illegal. In January, the European parliament’s civil liberties committee condemned such programs in “the strongest possible terms.” In April, the European Court of Justice ruled that European legislation on data retention contravened EU privacy rights. A top secret memo from the GCHQ, published last year by The Guardian, explicitly stated that one key reason for concealing these programs was fear of a “damaging public debate” and specifically “legal challenges against the current regime.” The report ended with a call for far greater transparency along with new protections for privacy in the digital age. Continuation of the status quo, it warned, imposes “a risk that systematic interference with the security of digital communications will continue to proliferate without any serious consideration being given to the implications of the wholesale abandonment of the right to online privacy.” The urgency of these reforms is underscored, explained the Rapporteur, by a conclusion of the United States Privacy and Civil Liberties Oversight Board that “permitting the government to routinely collect the calling records of the entire nation fundamentally shifts the balance of power between the state and its citizens.”

"Upon learning of this matter, the White House immediately requested that the director of national intelligence undertake an assessment of intelligence community policies, training standards or directives that promote diversity and tolerance, and as necessary, make any recommendations changes or additional reforms," Hayden said.It is at least the second time the White House has ordered a review of agency training materials said to include offensive language.

But it is reminiscent of an earlier incident in which the White House ordered the government's vast counter-terrorism apparatus to find and purge inflammatory training material, particularly that which singled out Muslims for particular scrutiny. In 2011, this reporter published FBI training material instructing newer counter-terrorism agents that Islam itself was a threat to US national security and compared the prophet Muhammad to a cult leader. That instruction came six years after the "Mohammed Raghead" material and stretched far beyond the FBI. Anti-Islam training material, including some urging "Hiroshima" tactics against Islamic nations, was found and removed from professional education courses for US military officers, at the behest of Army General Martin Dempsey, the chairman of the joint chiefs of staff.
