  • America is in the choosing sides phase of the coming civil war. To use a college recruiting phrase, it is accurate to state that the letters of intent to join one side or another have mostly been signed and the commitments offered. However, there is one big uncommitted piece, but very soon the sides will be drawn.
  • The Chess Pieces of Civil War What is going on today in America all about choosing sides. There are clear lines being formed in the United States. The recruiting pool consists of the Department of Homeland Security, the American military, local law enforcement, the Russian troops pouring into the United States, the trickle of Chinese troops coming into the country through Hawaii and, of course, the poor, the middle class and elite. This is the recruiting pool which will form the chess pieces of the coming American Civil War. Even if all parties in this country wanted the country to continue, even in its present mortally wounded state, it would be foolish to believe that it could continue for much longer.
  • Barring a false flag event, US martial law will have a trigger event, which will lead to martial law, that will be financial and it will naturally occur as we are already on a collision course with destiny.

  • The net result of these staggering numbers can only end one way, and that is with a financial collapse, followed by a bank holiday, rioting in the streets and the full roll out of martial law. These financial numbers guarantee that the party cannot continue much longer. Since America, in her present form, cannot continue much longer without experiencing a cataclysmic shift, we would be wise to realize what resources are going to be the impetus for civil war. When you play the board game, Monopoly, the properties on Boardwalk are among the most coveted. It is no different in real life. The biggest prize of the coming conflict is real estate. Homes, office buildings and shopping malls are the most coveted prize. The MERS mortgage fraud continues unabated as millions of homes have been confiscated through mortgage fraud. When the dollar is worthless and is awaiting its replacement (e.g. the Amero or the Worldo), real estate will be more valuable than gold.
  • Other big game that is being hunted by both sides in the coming civil war will be bank accounts, which must be looted before the dormant computer digits we call money can be converted into hard assets. That is why my advice is, and has been, convert your cash into tangible assets which can enhance your survivability in the upcoming crash.
  • Also, your pensions, your 401K’s and your various entitlement programs are also at risk as evidenced by Secretary of Treasury Jack Lew’s “borrowing” from various Federal retirement accounts in order to increase the debt ceiling fight that will resurface in Congress, again, early next year.

This unconstitutional legislation makes it illegal to criticize the President and the government, as a whole, in the presence of Federal officials.
  • The second provision which will allow this country to quickly transition to martial law is Executive Order (EO) 13603 which allows the President to take control over any resource, property and even human labor within the United States. This EO gives the President unlimited authority including the ability to initiate a civilian draft as well as a military draft.

    While I'd be the first to agree that the degree of fiscal mismanagement of this nation's economy is beyond insane and have to admit that I see very little to admire in Barack Obama's presidency, the meme about Executive Order 13603 authorizing confiscation of any property and enslavement of the American public needs to be put to rest. See http://www.archives.gov/federal-register/executive-orders/2012.html#13603 E.O. 13603 is not much more than an updating of similar executive orders issued by prior presidents beginning with Dwight Eisenhower. In fact, in skimming it a few minutes ago, I didn't see anything drastically different from some of the prior related orders. E.g., it reflects that a bunch of agencies that were formerly either independent or under other departments are now under the newish Department of Homeland Security, whose Secretary now gets the authority formerly delegated to other department and agency heads. If blame must be cast, it belongs on the Congress that enacted the Defense Production Act of 1950, 50 U.S.C. 2061, et seq. The executive order does no more than obey that Act's instructions. For example there is a section authorizing pre-emption of manufacturing capacity of critical industries over any existing civilian contracts in the event of a national emergency, but that language is in the statute as well. But that power hasn't had much traction since Harry Truman tried to nationalize the steel industry to break a nationwide strike. The Supreme Court swatted down that effort as an abuse of a power that would be lawful in a true emergency, like another major. But even that semi-radical "survival" power is ameliorated by other provisions of the statute and the order that authorize loan guarantees for companies' construction and maintenance of critical productive capacity. Much of that has been implemented over the years as outright grants. So for example, many chemical manufacturing plants were built with Defense Production Act funds, with

In a September 2009 article, James Simpson wrote an article entitled "Barack Obama and the Strategy of Manufactured Crisis". Part of a series, it connected then presidential candidate Barack Obama to individuals and organizations practicing a malevolent strategy for destroying our economy and our system of government.   The basis of this strategy is a plan called Cloward-Piven.

  • Fasten your seatbelts; 2015 will be a whirlwind pitting China, Russia and Iran against what I have described as the Empire of Chaos.
  • Considering that this swift move was conceived as a checkmate, Moscow’s defensive strategy was not that bad. On the key energy front, the problem remains the West’s – not Russia’s. If the EU does not buy what Gazprom has to offer, it will collapse. Moscow’s key mistake was to allow Russia's domestic industry to be financed by external, dollar-denominated debt. Talk about a monster debt trap  which can be easily manipulated by the West. The first step for Moscow should be to closely supervise its banks. Russian companies should borrow domestically and move to sell their assets abroad. Moscow should also consider implementing a system of currency controls so the basic interest rate can be brought down quickly. And don’t forget that Russia can always deploy a moratorium on debt and interest, affecting over $600 billion. That would shake the entire world's banking system to the core. Talk about an undisguised “message” forcing the US/EU economic warfare to dissolve.
  • Global oil prices are bound to remain low. All bets are off on whether a nuclear deal will be reached by this summer between Iran and the P5+1. If sanctions (actually economic war) against Iran remain and continue to seriously hurt its economy, Tehran’s reaction will be firm, and will include even more integration with Asia, not the West.

  • Now let’s take a look at Russian fundamentals. Russia’s government debt totals only 13.4% of its GDP. Its budget deficit in relation to GDP is only 0.5%.  If we assume a US GDP of $16.8 trillion (the figure for 2013), the US budget deficit totals 4% of GDP, versus 0.5% for Russia. The Fed is essentially a private corporation owned by regional US private banks, although it passes itself off as a state institution. US publicly held debt is equal to a whopping 74% of GDP in fiscal year 2014. Russia’s is only 13.4%. The declaration of economic war by the US and EU on Russia – via the run on the ruble and the oil derivative attack – was essentially a derivatives racket. Derivatives – in theory – may be multiplied to infinity. Derivative operators attacked both the ruble and oil prices in order to destroy the Russian economy. The problem is, the Russian economy is more soundly financed than America's.
  • So yes – it will be all about further moves towards the integration of Eurasia as the US is progressively squeezed out of Eurasia. We will see a complex geostrategic interplay progressively undermining the hegemony of the US dollar as a reserve currency and, most of all, the petrodollar. For all the immense challenges the Chinese face, all over Beijing it's easy to detect unmistakable signs of a self-assured, self-confident, fully emerged commercial superpower. President Xi Jinping and the current leadership will keep investing heavily in the urbanization drive and the fight against corruption, including at the highest levels of the Chinese Communist Party (CCP). Internationally, the Chinese will accelerate their overwhelming push for new 'Silk Roads' – both overland and maritime – which will underpin the long-term Chinese master strategy of unifying Eurasia with trade and commerce.
  • Russia does not need to import any raw materials. Russia can easily reverse-engineer virtually any imported technology if it needs to. Most of all, Russia can generate — from the sale of raw materials – enough credit in US dollars or euros. Russia's sale of its energy wealth — or sophisticated military gear — may decline. However, they will bring in the same amount of rubles — as the ruble has also declined.  Replacing imports with domestic Russian manufacturing makes total sense. There will be an inevitable “adjustment” phase – but that won’t take long. German car manufacturers, for instance, can no longer sell their cars in Russia due to the ruble's decline. This means they will have to relocate their factories to Russia. If they don’t, Asia – from South Korea to China — will blow them out of the market.
  • The EU's declaration of economic war against Russia makes no sense whatsoever. Russia controls, directly or indirectly, most of the oil and natural gas between Russia and China: roughly 25% of the world's supply. The Middle East is bound to remain a mess. Africa is unstable. The EU is doing everything it can to cut itself off from its most stable supply of hydrocarbons, prompting Moscow to redirect energy to China and the rest of Asia. What a gift for Beijing – as it minimizes the alarm about the US Navy playing with "containment" across the high seas.  Still, an unspoken axiom in Beijing is that the Chinese remain extremely worried about an Empire of Chaos losing more and more control, and dictating the stormy terms of the relationship between the EU and Russia. The bottom line is that Beijing would never allow itself to be in a position where the US could interfere with China's energy imports – as was the case with Japan in July 1941 when the US declared war by imposing an oil embargo, cutting off 92% of Japanese oil imports. Everyone knows a key plank of China’s spectacular surge in industrial power was the requirement for manufacturers to produce in China. If Russia did the same, its economy would be growing at a rate of over 5% per year in no time. It could grow even more if bank credit was tied only to productive investment.
  • Now imagine Russia and China jointly investing in a new gold, oil and natural resource-backed monetary union as a crucial alternative to the failed debt "democracy" model pushed by the Masters of the Universe on Wall Street, the Western central bank cartel, and neoliberal politicians. They would be showing the Global South that financing prosperity and improved standards of living by saddling future generations with debt was never meant to work in the first place. Until then, a storm will be threatening our very lives – today and tomorrow. The Masters of the Universe/Washington combo won’t give up their strategy to make Russia a pariah state cut off from trade, the transfer of funds, banking and Western credit markets and thus prone to regime change. Further on down the road, if all goes according to plan, their target will be (who else) China. And Beijing knows it. Meanwhile, expect a few bombshells to shake the EU to its foundations. Time may be running out – but for the EU, not Russia. Still, the overall trend won’t be altered; the Empire of Chaos is slowly but surely being squeezed out of Eurasia.

  • US Central Command, or CENTCOM, reported yesterday that it killed Abu Malik, an Islamic State "chemical weapons engineer," in an airstrike near Mosul, Iraq. Abu Malik was associated with al Qaeda in Iraq and then the Islamic State for a decade before he was killed. "Malik was an ISIL (Islamic State) chemical weapons engineer who worked at Saddam Hussein's Muthana chemical weapon production facility before affiliating with al Qaeda in Iraq in 2005," according to the CENTCOM press release. "He later joined ISIL and his past training and experience provided the terrorist group with expertise to pursue a chemical weapons capability." "His death is expected to temporarily degrade and disrupt the terrorist network and diminish ISIL's ability to potentially produce and use chemical weapons against innocent people," CENTCOM concluded. It is unclear if Abu Malik was associated with the al Qaeda in Iraq cell that the Iraqi Ministry of Defense broke up in 2013 (al Qaeda in Iraq was eventually rebranded as the Islamic State). That cell was seeking to manufacture chemical weapons, including sarin nerve gas, and plotting to conduct attacks within Iraq, Europe, and North America, according to the Iraqi government.

  • The FBI and major media outlets yesterday trumpeted the agency’s latest counterterrorism triumph: the arrest of three Brooklyn men, ages 19 to 30, on charges of conspiring to travel to Syria to fight for ISIS (photo of joint FBI/NYPD press conference, above). As my colleague Murtaza Hussain ably documents, “it appears that none of the three men was in any condition to travel or support the Islamic State, without help from the FBI informant.” One of the frightening terrorist villains told the FBI informant that, beyond having no money, he had encountered a significant problem in following through on the FBI’s plot: his mom had taken away his passport. Noting the bizarre and unhinged ranting of one of the suspects, Hussain noted on Twitter that this case “sounds like another victory for the FBI over the mentally ill.” In this regard, this latest arrest appears to be quite similar to the overwhelming majority of terrorism arrests the FBI has proudly touted over the last decade. As my colleague Andrew Fishman and I wrote last month — after the FBI manipulated a 20-year-old loner who lived with his parents into allegedly agreeing to join an FBI-created plot to attack the Capitol — these cases follow a very clear pattern
  • Once again, we should all pause for a moment to thank the brave men and women of the FBI for saving us from their own terror plots.
  • We’re constantly bombarded with dire warnings about the grave threat of home-grown terrorists, “lone wolf” extremists and ISIS. So intensified are these official warnings that The New York Times earlier this month cited anonymous U.S. intelligence officials to warn of the growing ISIS threat and announce “the prospect of a new global war on terror.” But how serious of a threat can all of this be, at least domestically, if the FBI continually has to resort to manufacturing its own plots by trolling the Internet in search of young drifters and/or the mentally ill whom they target, recruit and then manipulate into joining? Does that not, by itself, demonstrate how over-hyped and insubstantial this “threat” actually is? Shouldn’t there be actual plots, ones that are created and fueled without the help of the FBI, that the agency should devote its massive resources to stopping? This FBI tactic would be akin to having the Drug Enforcement Agency (DEA) constantly warn of the severe threat posed by drug addiction while it simultaneously uses pushers on its payroll to deliberately get people hooked on drugs so that they can arrest the addicts they’ve created and thus justify their own warnings and budgets (and that kind of threat-creation, just by the way, is not all that far off from what the other federal law enforcement agencies, like the FBI, are actually doing). As we noted the last time we wrote about this, the Justice Department is aggressively pressuring U.S. allies to employ these same entrapment tactics in order to create their own terrorists, who can then be paraded around as proof of the grave threat.

  • In a step to follow the world’s political  evolution, Egypt is working on changing its foreign policy to accommodate the “multipolarity” system, former Minister of Foreign Affairs Mohamed Kamel Amr said in a conference held by the Egyptian Council for Foreign Affairs (ECFA), Tuesday. The two-day international conference dubbed “Egypt and the World… a New Era” was held in order to “correct misconceptions” of Egypt’s political development after the ouster of President Mohamed Morsi. The members of ECFA, which was formed 15 years ago, are predominantly former diplomats. “To say that Egypt is turning its back to a certain power is emotional for it is rebalancing its relations,” Amr said at the “Egypt and the World’s Major Powers” session of the conference. The U.S. delivered 10 Apache Helicopters to Egypt in November, but other than that, strategic cooperation has pretty much stopped in the past two years, said Mostafa Elwi, a Cairo University professor of political science. China and Russia supported the change after June 30, 2013, when millions marched to topple Morsi, and exchanged visits between Egyptian officials and their counterparts from these two countries have been “very fruitful,” unlike U.S. Secretary of State John Kerry’s visits to Egypt, Elwi added. Amr explained that Egypt’s foreign policy has been successful in moving forward in coalitions, rather than its own, in the face of major powers, such as the Non-Aligned Movement, the Arab League and as part of coordination with regional forces.
  • “Ridding Egypt of the U.S. dominancy is not an easy task because it is the only country in the world that has the four factors of being a dominant power: military, economy, culture and science,” Elwy said. However, he added that as bilateral relations with China and Russia have very wide and open horizons, renewed strategic relations with them should not stop at purchasing arms, but should expand to cooperation in manufacturing weapons in Egypt.
  • For his part, Councilor of the Chinese People’s Institute of Foreign Affairs Wu Sike emphasized that China respects the Egyptian people’s will, and that foreign interference in Egypt’s internal affairs is “unacceptable.” Economically, Elwy and Sike underlined that their countries realize the potential of their anticipate cooperation, especially in the New Suez Canal Project and the proposed project of the New Silk Road, planned to pass through Egypt and expected to change the course of world trade. “After the revolution of June 30, relations with Egypt, including strategic relations, will deepen. Our government encourages Chinese companies to invest in Egypt’s Suez Canal and the route of the Silk Road in its territory,” said Sike, who was also a former Egyptian Ambassador, calling on Egypt to focus on development efforts to “compensate for the time it lost.”

    One I had missed in December, 2014. China is bankrolling an upgrade of the Suez Canal and Egypt has rejected U.S. hegemony. Egypt will buy Russian and Chinese weapons but wants to expand to collaborative manufacture of weapons in Egypt.  The U.S. is paying the price of having initiated a failed "color revolution" in Egypt that gave temporary control of Egyptian government to the non-secular Muslim Brotherhood, subsquently overthrown by the Egyptian military with enormous public support.

  • The latest report from the International Atomic Energy Agency on Iran’s nuclear program contains much that is worth emphasizing. Iran is continuing to account for all its declared nuclear material (and the agency appears to have no reason to suspect the existence of undeclared nuclear material). Iran is also continuing to comply fully with the commitments it made to the United States and others on November 24, 2013 and which it has renewed since. Much of the commentary on the report on Iran will inevitably highlight Iran’s continuing failure to resolve two concerns the IAEA raised in May 2014. I, however, am surprised, that the IAEA director general omits all mention of two Iranian attempts, since the last IAEA report in mid-November, to address those and some other allegations that the IAEA is investigating. On December 2, Reuters reported that in a statement to the IAEA Iran had rejected accusations that it was stonewalling IAEA investigations. Instead, Iran had affirmed that it had given the IAEA “pieces of evidence” indicating that documents adduced by the IAEA as reasons for concern were “full of mistakes and contain fake names with specific pronunciations which only point towards a certain IAEA member as their forger.” (The member Iran probably had in mind was Israel). Yet there is no mention whatsoever of this Iranian rebuttal in the latest report, still less any detailed IAEA rebuttal of the rebuttal. Instead, the director general resorts to an exceptionally bland (and in the circumstances misleading) phrase: “Iran has not provided any explanations that enable the Agency to clarify the two outstanding practical measures [concerns].”
  • In effect Iran is being asked to prove its innocence. But when it tries to do so, the evidence it submits is rejected out of hand because it calls into question the evidence that is being used to justify the suspicion of guilt. Is that consistent with due process? Also surprising is the omission of any mention of Iran’s offer of access to a suspected nuclear site at Marivan, reported by Reuters on December 11. A controversial annex to the IAEA’s November 2011 report referred to one member state having informed the agency that major high-explosives tests were conducted at Marivan in the first part of the last decade. Since the IAEA has not taken Iran up on the offer, it presumably believes that a visit to Marivan would serve no useful purpose. If that is the case, do they not owe it to Iran to withdraw the November 2011 charge relating to Marivan? This access has enabled the IAEA to conclude that centrifuge rotor manufacturing and assembly are consistent with Iran’s replacement program for failed centrifuges. In other words, Iran is not manufacturing and diverting rotors to some clandestine enrichment facility. This is highly significant. Amid the endless furor over the number of centrifuges that Iran should retain under a comprehensive agreement, the public could be forgiven for failing to appreciate that, theoretically, Iran is far more likely to “sneak out”—using a clandestine enrichment facility—than to “break out” under the eyes of IAEA inspectors, using the centrifuges it wants to retain. I inserted “theoretically” to emphasize that at this point there is no evidence that Iran intends either to break out or to sneak out. And as long as the IAEA retains access to Iran’s rotor manufacturing, assembly, and storage facilities—which it will lose if the opponents of a deal have their way—we can all feel confident of a continuing absence of intention. In essence, the latest IAEA report contains nothing that would justify the United States and its allies declining to close a deal with Iran in the course of the coming four weeks.   • Less than a week after the attacks in Paris — while the public and policymakers were still reeling, and the investigation had barely gotten off the ground — Cy Vance, Manhattan’s District Attorney, released a policy paper calling for legislation requiring companies to provide the government with backdoor access to their smartphones and other mobile devices. This is the first concrete proposal of this type since September 2014, when FBI Director James Comey reignited the “Crypto Wars” in response to Apple’s and Google’s decisions to use default encryption on their smartphones. Though Comey seized on Apple’s and Google’s decisions to encrypt their devices by default, his concerns are primarily related to end-to-end encryption, which protects communications that are in transit. Vance’s proposal, on the other hand, is only concerned with device encryption, which protects data stored on phones. It is still unclear whether encryption played any role in the Paris attacks, though we do know that the attackers were using unencrypted SMS text messages on the night of the attack, and that some of them were even known to intelligence agencies and had previously been under surveillance. But regardless of whether encryption was used at some point during the planning of the attacks, as I lay out below, prohibiting companies from selling encrypted devices would not prevent criminals or terrorists from being able to access unbreakable encryption. Vance’s primary complaint is that Apple’s and Google’s decisions to provide their customers with more secure devices through encryption interferes with criminal investigations. He claims encryption prevents law enforcement from accessing stored data like iMessages, photos and videos, Internet search histories, and third party app data. He makes several arguments to justify his proposal to build backdoors into encrypted smartphones, but none of them hold water.
  • Before addressing the major privacy, security, and implementation concerns that his proposal raises, it is worth noting that while an increase in use of fully encrypted devices could interfere with some law enforcement investigations, it will help prevent far more crimes — especially smartphone theft, and the consequent potential for identity theft. According to Consumer Reports, in 2014 there were more than two million victims of smartphone theft, and nearly two-thirds of all smartphone users either took no steps to secure their phones or their data or failed to implement passcode access for their phones. Default encryption could reduce instances of theft because perpetrators would no longer be able to break into the phone to steal the data.
  • Vance argues that creating a weakness in encryption to allow law enforcement to access data stored on devices does not raise serious concerns for security and privacy, since in order to exploit the vulnerability one would need access to the actual device. He considers this an acceptable risk, claiming it would not be the same as creating a widespread vulnerability in encryption protecting communications in transit (like emails), and that it would be cheap and easy for companies to implement. But Vance seems to be underestimating the risks involved with his plan. It is increasingly important that smartphones and other devices are protected by the strongest encryption possible. Our devices and the apps on them contain astonishing amounts of personal information, so much that an unprecedented level of harm could be caused if a smartphone or device with an exploitable vulnerability is stolen, not least in the forms of identity fraud and credit card theft. We bank on our phones, and have access to credit card payments with services like Apple Pay. Our contact lists are stored on our phones, including phone numbers, emails, social media accounts, and addresses. Passwords are often stored on people’s phones. And phones and apps are often full of personal details about their lives, from food diaries to logs of favorite places to personal photographs. Symantec conducted a study, where the company spread 50 “lost” phones in public to see what people who picked up the phones would do with them. The company found that 95 percent of those people tried to access the phone, and while nearly 90 percent tried to access private information stored on the phone or in other private accounts such as banking services and email, only 50 percent attempted contacting the owner.

  • In addition to his weak reasoning for why it would be feasible to create backdoors to encrypted devices without creating undue security risks or harming privacy, Vance makes several flawed policy-based arguments in favor of his proposal. He argues that criminals benefit from devices that are protected by strong encryption. That may be true, but strong encryption is also a critical tool used by billions of average people around the world every day to protect their transactions, communications, and private information. Lawyers, doctors, and journalists rely on encryption to protect their clients, patients, and sources. Government officials, from the President to the directors of the NSA and FBI, and members of Congress, depend on strong encryption for cybersecurity and data security. There are far more innocent Americans who benefit from strong encryption than there are criminals who exploit it. Encryption is also essential to our economy. Device manufacturers could suffer major economic losses if they are prohibited from competing with foreign manufacturers who offer more secure devices. Encryption also protects major companies from corporate and nation-state espionage. As more daily business activities are done on smartphones and other devices, they may now hold highly proprietary or sensitive information. Those devices could be targeted even more than they are now if all that has to be done to access that information is to steal an employee’s smartphone and exploit a vulnerability the manufacturer was required to create.
  • Privacy is another concern that Vance dismisses too easily. Despite Vance’s arguments otherwise, building backdoors into device encryption undermines privacy. Our government does not impose a similar requirement in any other context. Police can enter homes with warrants, but there is no requirement that people record their conversations and interactions just in case they someday become useful in an investigation. The conversations that we once had through disposable letters and in-person conversations now happen over the Internet and on phones. Just because the medium has changed does not mean our right to privacy has.
  • Vance attempts to downplay this serious risk by asserting that anyone can use the “Find My Phone” or Android Device Manager services that allow owners to delete the data on their phones if stolen. However, this does not stand up to scrutiny. These services are effective only when an owner realizes their phone is missing and can take swift action on another computer or device. This delay ensures some period of vulnerability. Encryption, on the other hand, protects everyone immediately and always. Additionally, Vance argues that it is safer to build backdoors into encrypted devices than it is to do so for encrypted communications in transit. It is true that there is a difference in the threats posed by the two types of encryption backdoors that are being debated. However, some manner of widespread vulnerability will inevitably result from a backdoor to encrypted devices. Indeed, the NSA and GCHQ reportedly hacked into a database to obtain cell phone SIM card encryption keys in order defeat the security protecting users’ communications and activities and to conduct surveillance. Clearly, the reality is that the threat of such a breach, whether from a hacker or a nation state actor, is very real. Even if companies go the extra mile and create a different means of access for every phone, such as a separate access key for each phone, significant vulnerabilities will be created. It would still be possible for a malicious actor to gain access to the database containing those keys, which would enable them to defeat the encryption on any smartphone they took possession of. Additionally, the cost of implementation and maintenance of such a complex system could be high.
  • Vance also suggests that the US would be justified in creating such a requirement since other Western nations are contemplating requiring encryption backdoors as well. Regardless of whether other countries are debating similar proposals, we cannot afford a race to the bottom on cybersecurity. Heads of the intelligence community regularly warn that cybersecurity is the top threat to our national security. Strong encryption is our best defense against cyber threats, and following in the footsteps of other countries by weakening that critical tool would do incalculable harm. Furthermore, even if the US or other countries did implement such a proposal, criminals could gain access to devices with strong encryption through the black market. Thus, only innocent people would be negatively affected, and some of those innocent people might even become criminals simply by trying to protect their privacy by securing their data and devices. Finally, Vance argues that David Kaye, UN Special Rapporteur for Freedom of Expression and Opinion, supported the idea that court-ordered decryption doesn’t violate human rights, provided certain criteria are met, in his report on the topic. However, in the context of Vance’s proposal, this seems to conflate the concepts of court-ordered decryption and of government-mandated encryption backdoors. The Kaye report was unequivocal about the importance of encryption for free speech and human rights. The report concluded that:
  • States should promote strong encryption and anonymity. National laws should recognize that individuals are free to protect the privacy of their digital communications by using encryption technology and tools that allow anonymity online. … States should not restrict encryption and anonymity, which facilitate and often enable the rights to freedom of opinion and expression. Blanket prohibitions fail to be necessary and proportionate. States should avoid all measures that weaken the security that individuals may enjoy online, such as backdoors, weak encryption standards and key escrows. Additionally, the group of intelligence experts that was hand-picked by the President to issue a report and recommendations on surveillance and technology, concluded that: [R]egarding encryption, the U.S. Government should: (1) fully support and not undermine efforts to create encryption standards; (2) not in any way subvert, undermine, weaken, or make vulnerable generally available commercial software; and (3) increase the use of encryption and urge US companies to do so, in order to better protect data in transit, at rest, in the cloud, and in other storage.
  • The clear consensus among human rights experts and several high-ranking intelligence experts, including the former directors of the NSA, Office of the Director of National Intelligence, and DHS, is that mandating encryption backdoors is dangerous. Unaddressed Concerns: Preventing Encrypted Devices from Entering the US and the Slippery Slope In addition to the significant faults in Vance’s arguments in favor of his proposal, he fails to address the question of how such a restriction would be effectively implemented. There is no effective mechanism for preventing code from becoming available for download online, even if it is illegal. One critical issue the Vance proposal fails to address is how the government would prevent, or even identify, encrypted smartphones when individuals bring them into the United States. DHS would have to train customs agents to search the contents of every person’s phone in order to identify whether it is encrypted, and then confiscate the phones that are. Legal and policy considerations aside, this kind of policy is, at the very least, impractical. Preventing strong encryption from entering the US is not like preventing guns or drugs from entering the country — encrypted phones aren’t immediately obvious as is contraband. Millions of people use encrypted devices, and tens of millions more devices are shipped to and sold in the US each year.
  • Finally, there is a real concern that if Vance’s proposal were accepted, it would be the first step down a slippery slope. Right now, his proposal only calls for access to smartphones and devices running mobile operating systems. While this policy in and of itself would cover a number of commonplace devices, it may eventually be expanded to cover laptop and desktop computers, as well as communications in transit. The expansion of this kind of policy is even more worrisome when taking into account the speed at which technology evolves and becomes widely adopted. Ten years ago, the iPhone did not even exist. Who is to say what technology will be commonplace in 10 or 20 years that is not even around today. There is a very real question about how far law enforcement will go to gain access to information. Things that once seemed like merely science fiction, such as wearable technology and artificial intelligence that could be implanted in and work with the human nervous system, are now available. If and when there comes a time when our “smart phone” is not really a device at all, but is rather an implant, surely we would not grant law enforcement access to our minds.

Undermining encryption, regardless of whether it is protecting data in transit or at rest, would take us down a dangerous and harmful path. Instead, law enforcement and the intelligence community should be working to alter their skills and tactics in a fast-evolving technological world so that they are not so dependent on information that will increasingly be protected by encryption.

    Tea party groups' allegations that the IRS has long been targeting them for their political beliefs were recently confirmed by an apology from the IRS. The scandal gained traction as congressional leaders began efforts to hold the IRS accountable and understand the depths of the federal government's politically-motivated abuses of power. True the Vote, a Houston-based nonprofit which focuses on election integrity issues, was formed by Catherine Engelbrecht and her King Street Patriots Tea Party group. True the Vote applied to the IRS for their 501(c3) non-profit status in July 2010, and almost immediately their problems began.  Within two years, multiple federal agencies, along with an EPA-affiliated Texas state agency, began auditing True the Vote and its founders, visiting their group, their businesses, and asking questions of people who knew them. The IRS was not the only governmental agency involved.  "Engelbrecht's application with the IRS for non-profit status allegedly triggered aggressive audits of one of her family's personal businesses as well. The FBI (Federal Bureau of Investigation) began a series of inquiries about her and her group; the BATF (Bureau of Alcohol Tobacco and Firearms) began demanding to see her family's firearms in surprise audits of her and her husband's small gun dealership--which had done less than $200 in sales; OSHA (Occupational Safety Hazards Administration) began a surprise audit of their small family manufacturing business; and the EPA-affiliated TCEQ (Texas Commission on Environment Quality) did a surprise visit and audit due to "a complaint being called in."  The Democratic Party of Texas filed a lawsuit against her, as did an ACORN affiliated group. Both the FBI and the BATF continued to poke around her life, the lives of people in her Tea Party group, and her businesses."

  • When the greed, recklessness, and illegal behavior on Wall Street drove this country into the deepest recession since the 1930s, the largest financial institutions in the United States took every advantage of being American. They just loved their country - and the willingness of the American people to provide them with the largest bailout in world history. In 2008, Congress approved a $700 billion gift to Wall Street. Another $16 trillion in virtually zero interest loans and other financial assistance came from the Federal Reserve. America. What a great country. But just two years later, as soon as these giant financial institutions started making record-breaking profits again, they suddenly lost their love for their native country. At a time when the nation was suffering from a huge deficit, largely created by the recession that Wall Street caused, the major financial institutions did everything they could to avoid paying American taxes by establishing shell corporations in the Cayman Islands and other tax havens.
  • In 2010, Bank of America set up more than 200 subsidiaries in the Cayman Islands (which has a corporate tax rate of 0.0 percent) to avoid paying U.S. taxes. It worked. Not only did Bank of America pay nothing in federal income taxes, but it received a rebate from the IRS worth $1.9 billion that year. They are not alone. In 2010, JP Morgan Chase operated 83 subsidiaries incorporated in offshore tax havens to avoid paying some $4.9 billion in U.S. taxes. Citigroup has paid no federal income taxes for the last four years after receiving a total of $2.5 trillion in financial assistance from the Federal Reserve during the financial crisis. On and on it goes. Wall Street banks and large companies love America when they need corporate welfare. But when it comes to paying American taxes or American wages, they want nothing to do with this country. That has got to change.

They must not be able to continue hiding their profits offshore and shipping American jobs overseas to avoid taxes. Here's the simple truth. You can't be an American company only when you want a massive bailout from the American people.   • In a statement harkening back to the war against the Soviet Union 36 years ago in Afghanistan, fifty-five Saudi Wahhabi clerics have signed a call for jihad against Russia for its military intervention in Syria. America and the West are accused of colluding with Moscow by only pretending to support the Syrian opposition since 2011. The statement is not an official document of the Kingdom, but it undoubtedly has much support in the House of Saud. The statement calls on all Sunni Muslims to unite to defeat "tsars and Caesars" who have backed the "Christian regime" and its Alawi partners in Damascus. Russians, the "fanatical people of the cross," are warned to remember how the Afghan mujaheddin destroyed the Soviet Union in 1989 in Afghanistan. The Russian state will suffer the same fate. Iran is also targeted for the jihad. The Persians and their Iraqi Shiite allies—as well as Hezbollah—have aligned themselves with the Russian Orthodox Christians against Islam. All of the Safavids (the Persian dynasty that adopted Shiism as the state religion) are legitimate targets for the holy war, the statement says.

Nonetheless, the statement reflects the views of many Saudis about Russia's intervention to back up Bashar Assad and U.S. failure to depose him.     The Saudi govenment has been making lots of threat about increasing aid and weapons for Sunni fighters in Syria to fight Russia. I wonder which side of that issue the CIA is on? (Note that U.S. DoD  Secretary Ash Carter has been publicly warning Russia that its intervention in Syria will povoke Islamic militants across the region and into Russia itself.) The Saudis have also been threatening to arm jihadis in Syria MANPAD should-fired anti-aircraft missiles that are capable of taking down Russian and Syrian fighters that would have to be provided by U.S. manufacturers. I don't know whether the Saudis already have more than enough for the nation's military defense forces.

And, by design, this Fake News spread like wildfire all over the internet, hungrily clicked and shared by tens of thousands of people eager to believe it was true. As a result of this deliberate disinformation campaign, anyone reporting on the contents of the emails was instantly met with claims that the documents in the archive had been proven fake. The most damaging such claim came from MSNBC’s intelligence analyst Malcolm Nance. As I documented on October 11, he tweeted what he — for some bizarre reason — labeled an “Official Warning.” It decreed: “#PodestaEmails are already proving to be riddled with obvious forgeries & #blackpropaganda not even professionally done.” That tweet was re-tweeted by more than 4,000 people. It was vested with added credibility by Clinton-supporting journalists like Reid and Frum (“expert to take seriously”).

  • From the start, it was obvious that it was this accusation from Clinton supporters — not the WikiLeaks documents — that was a complete fraud, perpetrated on the public as deliberate disinformation. With regard to the claim about the Podesta emails, now we know exactly who created it in the first instance: a hard-core Clinton fanatic.
  • All of that, in turn, led to an article in something called the “Daily News Bin” with the headline: “MSNBC intelligence expert: WikiLeaks is releasing falsified emails not really from Hillary Clinton.” This classic fake news product — citing Nance and Reid among others — was shared more than 40,000 times on Facebook alone.

The derivatives market is now over a quadrillion dollars of  casino style gambling.  This is where Banksters make huge bets on things like whether or not interest rates will go up or down.  Then they take out insurance to cover their bets, which further compounds the cost.  Recent events like the Jon Corzine MF Global gamble that the Federal Reserve Bankster Cartel would backstop explosive European sovereign bankster debt are the first indications of collapse in the derivatives market.  We now know that JP Morgan placed similar bets on a European bailout by the Federal Reserve and World Bank, and lost big.  The only difference is that Corzine robbed his clients personal accounts to cover his bets.
