The use of the word “accomplices” appeared to suggest that the DNI views the journalists who possess and report on the Snowden documents as Snowden’s partners in crime, and even as criminals themselves. “Is it now the official view of the Obama administration that these journalists and media outlets are ‘accomplices’ in what they regard as Snowden’s crimes? If so, that is a rather stunning and extremist statement,” wrote Glenn Greenwald, who first reported on the Snowden releases last June.

Spies Infiltrate a Fantasy Realm of Online Games - NYTimes.com - 0 views

  • Not limiting their activities to the earthly realm, American and British spies have infiltrated the fantasy worlds of World of Warcraft and Second Life, conducting surveillance and scooping up data in the online games played by millions of people across the globe, according to newly disclosed classified documents.
  • Fearing that terrorist or criminal networks could use the games to communicate secretly, move money or plot attacks, the documents show, intelligence operatives have entered terrain populated by digital avatars that include elves, gnomes and supermodels. The spies have created make-believe characters to snoop and to try to recruit informers, while also collecting data and contents of communications between players, according to the documents, disclosed by the former National Security Agency contractor Edward J. Snowden. Because militants often rely on features common to video games — fake identities, voice and text chats, a way to conduct financial transactions — American and British intelligence agencies worried that they might be operating there, according to the papers.
  • Online games might seem innocuous, a top-secret 2008 N.S.A. document warned, but they had the potential to be a “target-rich communication network” allowing intelligence suspects “a way to hide in plain sight.” Virtual games “are an opportunity!” another 2008 N.S.A. document declared. Former American intelligence officials, current and former gaming company employees and outside experts said in interviews that they knew of little evidence that terrorist groups viewed the games as havens to communicate and plot operations.

  • In the 2008 N.S.A. document, titled “Exploiting Terrorist Use of Games & Virtual Environments,” the agency said that “terrorist target selectors” — which could be a computer’s Internet Protocol address or an email account — “have been found associated with Xbox Live, Second Life, World of Warcraft” and other games. But that document does not present evidence that terrorists were participating in the games. Still, the intelligence agencies found other benefits in infiltrating these online worlds. According to the minutes of a January 2009 meeting, GCHQ’s “network gaming exploitation team” had identified engineers, embassy drivers, scientists and other foreign intelligence operatives to be World of Warcraft players — potential targets for recruitment as agents.
  • The surveillance, which also included Microsoft’s Xbox Live, could raise privacy concerns. It is not clear exactly how the agencies got access to gamers’ data or communications, how many players may have been monitored or whether Americans’ communications or activities were captured. One American company, the maker of World of Warcraft, said that neither the N.S.A. nor its British counterpart, the Government Communications Headquarters, had gotten permission to gather intelligence in its game. Many players are Americans, who can be targeted for surveillance only with approval from the nation’s secret intelligence court. The spy agencies, though, face far fewer restrictions on collecting certain data or communications overseas.
  • “The Sigint Enterprise needs to begin taking action now to plan for collection, processing, presentation and analysis of these communications,” said one April 2008 N.S.A. document, referring to “signals intelligence.” The document added, “With a few exceptions, N.S.A. can’t even recognize the traffic,” meaning that the agency could not distinguish gaming data from other Internet traffic. By the end of 2008, according to one document, the British spy agency, known as GCHQ, had set up its “first operational deployment into Second Life” and had helped the police in London in cracking down on a crime ring that had moved into virtual worlds to sell stolen credit card information. The British spies running the effort, which was code-named Operation Galician, were aided by an informer using a digital avatar “who helpfully volunteered information on the target group’s latest activities.”
  • Even before the American government began spying in virtual worlds, the Pentagon had identified the potential intelligence value of video games. The Pentagon’s Special Operations Command in 2006 and 2007 worked with several foreign companies — including an obscure digital media business based in Prague — to build games that could be downloaded to mobile phones, according to people involved in the effort. They said the games, which were not identified as creations of the Pentagon, were then used as vehicles for intelligence agencies to collect information about the users. Eager to cash in on the government’s growing interest in virtual worlds, several large private contractors have spent years pitching their services to American intelligence agencies. In one 66-page document from 2007, part of the cache released by Mr. Snowden, the contracting giant SAIC promoted its ability to support “intelligence collection in the game space,” and warned that online games could be used by militant groups to recruit followers and could provide “terrorist organizations with a powerful platform to reach core target audiences.”

  • A bipartisan group of 26 US senators has written to intelligence chiefs to complain that the administration is relying on a "secret body of law" to collect massive amounts of data on US citizens.The senators accuse officials of making misleading statements and demand that the director of national intelligence James Clapper answer a series of specific questions on the scale of domestic surveillance as well as the legal justification for it.In their strongly-worded letter to Clapper, the senators said they believed the government may be misinterpreting existing legislation to justify the sweeping collection of telephone and internet data revealed by the Guardian."We are concerned that by depending on secret interpretations of the Patriot Act that differed from an intuitive reading of the statute, this program essentially relied for years on a secret body of law," they say.

    Veteran Intelligence Professionals for Sanity call on Obama to sack Director of National Intelligence James Clapper for perjured testimony to Congress and lying to the public, with a nice collection of Clapper's lies. And Sen. Diane Feinstein gets a share of their wrath.  In my book both Clapper and Gen. Keith Alexander must be fired in disgrace else the message to the intelligence community is that there is no penalty for lying to Congress and the People, which can only encourage further lies.  Moreover, it send a message to the People that the President is more loyal to his henchmen than he is to the public's interest.

  • The list of those caught up in the global surveillance net cast by the National Security Agency and its overseas partners, from social media users to foreign heads of state, now includes another entry: American lawyers. A top-secret document, obtained by the former N.S.A. contractor Edward J. Snowden, shows that an American law firm was monitored while representing a foreign government in trade disputes with the United States. The disclosure offers a rare glimpse of a specific instance in which Americans were ensnared by the eavesdroppers, and is of particular interest because lawyers in the United States with clients overseas have expressed growing concern that their confidential communications could be compromised by such surveillance. It reports that the N.S.A.’s Australian counterpart, the Australian Signals Directorate, notified the agency that it was conducting surveillance of the talks, including communications between Indonesian officials and the American law firm, and offered to share the information.
  • The Australians told officials at an N.S.A. liaison office in Canberra, Australia, that “information covered by attorney-client privilege may be included” in the intelligence gathering, according to the document, a monthly bulletin from the Canberra office.   • The N.S.A.’s protections for attorney-client conversations are narrowly crafted, said Stephen Gillers, an expert on legal ethics at New York University’s School of Law. The agency is barred from sharing with prosecutors intercepted attorney-client communications involving someone under indictment in the United States, according to previously disclosed N.S.A. rules. But the agency may still use or share the information for intelligence purposes. Andrew M. Perlman, a Suffolk University law professor who specializes in legal ethics and technology issues, said the growth of surveillance was troubling for lawyers. He helped create the bar association’s ethics code revisions that require lawyers to try to avoid being overheard by eavesdroppers. “You run out of options very quickly to communicate with someone overseas,” he said. “Given the difficulty of finding anything that is 100 percent secure, lawyers are in a difficult spot to ensure that all of the information remains in confidence.” 
  • Still, the N.S.A. can intercept the communications of Americans if they are in contact with a foreign intelligence target abroad, such as Indonesian officials. The N.S.A. is then required to follow so-called minimization rules to protect their privacy, such as deleting the identity of Americans or information that is not deemed necessary to understand or assess the foreign intelligence, before sharing it with other agencies. An N.S.A. spokeswoman said the agency’s Office of the General Counsel was consulted when issues of potential attorney-client privilege arose and could recommend steps to protect such information. “Such steps could include requesting that collection or reporting by a foreign partner be limited, that intelligence reports be written so as to limit the inclusion of privileged material and to exclude U.S. identities, and that dissemination of such reports be limited and subject to appropriate warnings or restrictions on their use,” said Vanee M. Vines, the spokeswoman.

The U.S. Government's Secret Plans to Spy for American Corporations - The Intercept - 0 views

  • Throughout the last year, the U.S. government has repeatedly insisted that it does not engage in economic and industrial espionage, in an effort to distinguish its own spying from China’s infiltrations of Google, Nortel, and other corporate targets. So critical is this denial to the U.S. government that last August, an NSA spokesperson emailed The Washington Post to say (emphasis in original): “The department does ***not*** engage in economic espionage in any domain, including cyber.” After that categorical statement to the Post, the NSA was caught spying on plainly financial targets such as the Brazilian oil giant Petrobras; economic summits; international credit card and banking systems; the EU antitrust commissioner investigating Google, Microsoft, and Intel; and the International Monetary Fund and World Bank. In response, the U.S. modified its denial to acknowledge that it does engage in economic spying, but unlike China, the spying is never done to benefit American corporations.

The document, the 2009 Quadrennial Intelligence Community Review—provided by NSA whistleblower Edward Snowden—is a fascinating window into the mindset of America’s spies as they identify future threats to the U.S. and lay out the actions the U.S. intelligence community should take in response. It anticipates a series of potential scenarios the U.S. may face in 2025, from a “China/Russia/India/Iran centered bloc [that] challenges U.S. supremacy” to a world in which “identity-based groups supplant nation-states,” and games out how the U.S. intelligence community should operate in those alternative futures—the idea being to assess “the most challenging issues [the U.S.] could face beyond the standard planning cycle.”
  • One of the principal threats raised in the report is a scenario “in which the United States’ technological and innovative edge slips”— in particular, “that the technological capacity of foreign multinational corporations could outstrip that of U.S. corporations.” Such a development, the report says “could put the United States at a growing—and potentially permanent—disadvantage in crucial areas such as energy, nanotechnology, medicine, and information technology.” How could U.S. intelligence agencies solve that problem? The report recommends “a multi-pronged, systematic effort to gather open source and proprietary information through overt means, clandestine penetration (through physical and cyber means), and counterintelligence” (emphasis added). In particular, the DNI’s report envisions “cyber operations” to penetrate “covert centers of innovation” such as R&D facilities.

  • In a graphic describing an “illustrative example,” the report heralds “technology acquisition by all means.” Some of the planning relates to foreign superiority in surveillance technology, but other parts are explicitly concerned with using cyber-espionage to bolster the competitive advantage of U.S. corporations. The report thus envisions a scenario in which companies from India and Russia work together to develop technological innovation, and the U.S. intelligence community then “conducts cyber operations” against “research facilities” in those countries, acquires their proprietary data, and then “assesses whether and how its findings would be useful to U.S. industry” (click on image to enlarge):

In May, the U.S. Justice Department indicted five Chinese government employees on charges that they spied on U.S. companies. At the time, Attorney General Eric Holder said the spying took place “for no reason other than to advantage state-owned companies and other interests in China,” and “this is a tactic that the U.S. government categorically denounces.” But the following day, The New York Times detailed numerous episodes of American economic spying that seemed quite similar. Harvard Law School professor and former Bush Justice Department official Jack Goldsmith wrote that the accusations in the indictment sound “a lot like the kind of cyber-snooping on firms that the United States does.” But U.S. officials continued to insist that using surveillance capabilities to bestow economic advantage for the benefit of a country’s corporations is wrong, immoral, and illegal.

The CIA Just Declassified the Document That Supposedly Justified the Iraq Invasion | VI... - 0 views

  • Thirteen years ago, the intelligence community concluded in a 93-page classified document used to justify the invasion of Iraq that it lacked "specific information" on "many key aspects" of Iraqi President Saddam Hussein's weapons of mass destruction (WMD) programs.But that's not what top Bush administration officials said during their campaign to sell the war to the American public. Those officials, citing the same classified document, asserted with no uncertainty that Iraq was actively pursuing nuclear weapons, concealing a vast chemical and biological weapons arsenal, and posing an immediate and grave threat to US national security. Congress eventually concluded that the Bush administration had "overstated" its dire warnings about the Iraqi threat, and that the administration's claims about Iraq's WMD program were "not supported by the underlying intelligence reporting." But that underlying intelligence reporting — contained in the so-called National Intelligence Estimate (NIE) that was used to justify the invasion — has remained shrouded in mystery until now.
  • The CIA released a copy of the NIE in 2004 in response to a Freedom of Information Act (FOIA) request, but redacted virtually all of it, citing a threat to national security. Then last year, John Greenewald, who operates The Black Vault, a clearinghouse for declassified government documents, asked the CIA to take another look at the October 2002 NIE to determine whether any additional portions of it could be declassified.The agency responded to Greenewald this past January and provided him with a new version of the NIE, which he shared exclusively with VICE News, that restores the majority of the prewar Iraq intelligence that has eluded historians, journalists, and war critics for more than a decade.   • A still-classified report on the CIA's interrogation program established in the wake of 9/11 sparked a furious row last week between the agency and Senate Intelligence Committee chairwoman Dianne Feinstein. Al Jazeera has learned from sources familiar with its contents that the committee's report alleges that at least one high-value detainee was subjected to torture techniques that went beyond those authorized by George W. Bush's Justice Department. Two Senate staffers and a U.S. official, who spoke on the condition of anonymity because the information they disclosed remains classified, told Al Jazeera that the committee's analysis of 6 million pages of classified records also found that some of the harsh measures authorized by the Department of Justice had been applied to at least one detainee before such legal authorization was received. They said the report suggests that the CIA knowingly misled the White House, Congress and the Justice Department about the intelligence value of detainee Zain Abidin Mohammed Husain Abu Zubaydah when using his case to argue in favor of harsher interrogation techniques.
  • Even before accessing the documents, committee staffers received crucial information in a briefing from former FBI agent Ali Soufan in early 2008, according to Al Jazeera’s sources.   • Soufan described his briefing of Intelligence Committee researchers in his memoir, “The Black Banners.” “In early 2008, in a conference room that is referred to as a sensitive compartmented information facility (SCIF), I gave a classified briefing on Abu Zubaydah to staffers of the Senate Select Committee on Intelligence,” Soufan wrote. “The staffers present were shocked. What I told them contradicted everything they had been told by Bush administration and CIA officials. When the discussion turned to whether I could prove everything I was saying, I told them, ‘Remember, an FBI agent always keep his notes.’ ”  The committee tried to gain access to Soufan’s notes — then in possession of the CIA and FBI — after it launched a review of the agency’s detention and interrogation program in 2009. But Senate investigators were told, according to Al Jazeera’s sources, that Soufan’s notes were missing and could not be found in either the FBI’s or CIA’s computer system, where other classified records about the interrogation program were stored. More than a year later, the notes ended up with the Senate Intelligence Committee, although it's not clear whether they were turned over to committee investigators by the CIA or FBI or if they were in the cache of documents taken by investigators from the secure facility in Northern Virginia in 2010, which Senate staffers refer to as the Panetta review.
  • A few weeks before the 2009 announcement of the Senate Intelligence Committee’s investigation, Abu Zubaydah’s attorney Brent Mickum was invited to meet with committee staffers in a secure conference room in the Senate Hart Office Building in Washington. Mickum recalled in an interview with Al Jazeera that committee staffers were interested in Abu Zubaydah’s recollections. “The committee was talking about torture and whether it was effective,” Mickum said. “I was able to relate to them what Abu Zubaydah told me. We talked about where he was tortured. I told them where we thought he was. I told them that the government confirmed he was never a member of Al-Qaeda. The drawings were then passed around the room.” Mickum and his co-counsel, Amy Jacobsen, presented to the committee staffers a set of ink drawings on yellow legal paper marked top secret by the CIA. Abu Zubaydah, they said, made the sketches to depict his torture and the torture of two other high-value detainees. One of the highly detailed drawings, according to knowledgeable intelligence officials, depict Abu Zubaydah being waterboarded.

French and Spanish intelligence aided NSA spying - report - RT News - 0 views

  • Electronic surveillance which the European media and politicians blamed on the NSA was also carried out by their own intelligence services, as part of a wide-ranging allied security effort, according to US officials. European spy agencies collected phone records in war zones and areas outside their borders and shared information with the NSA, US officials said on Tuesday, as part of wider efforts to protect allied soldiers and civilians, according to a report in the Wall Street Journal. This is a markedly different version of events to what has been reported in Europe and throws up questions about the level of European involvement in global surveillance.
  • However, these efforts are separate to the US program which targeted foreign leaders, including Angela Merkel. There has so far been no comment from either the French or Spanish authorities or from the NSA.
  • But James Clapper, the director of National Intelligence said that the notion that the NSA had eavesdropped on the phone calls of 70 million French citizens was false and that the allegations were based on “inaccurate and misleading information regarding US foreign intelligence activities.” But he didn’t provide any other explanation. US intelligence officials have, according to the Wall Street Journal, privately said that the disclosures by the European press put them in a difficult position. They are keen to put the record straight but to do so would expose the activities of their allies’ intelligence activities. US officials also say that the leaked documents that the Le Monde story was based on were not supplied by the NSA, but rather were NSA data received from French intelligence. The US reached the conclusion that the phone records the French had collected were from outside France and were then shared with the NSA. There was a similar story for the documents citied in El Mundo, the officials said. There are considerable diplomatic sensitivities of outing partner services, which the NSA relies on for a considerable amount of intelligence. A public exposure of European complicity may spark domestic outrage in Europe and threaten co-operation with the US in future.

In an unusual statement, James Clapper said he had spoken Wednesday evening with Trump, five days after the spy chief and some of his counterparts met with the incoming president to discuss U.S. intelligence assessments that Russia tried to interfere in the 2016 election, possibly to help him win.Story Continued Below The assessment has badly aggravated existing tensions between the intelligence community and Trump. On Tuesday, CNN, BuzzFeed and other media outlets reported that, during Friday’s briefing, the intelligence officials told Trump about an unsubstantiated private report that detailed how Russia's government allegedly had salacious information about him. In addition, BuzzFeed published the apparent dossier, which Trump has since denounced as “fake news.” "I expressed my profound dismay at the leaks that have been appearing in the press, and we both agreed that they are extremely corrosive and damaging to our national security," Clapper said of the information that has come out since last week's intelligence briefing.
  • Clapper’s statement represented a dramatic turn of events only 24 hours after initial leaks about the intelligence leaders having told Trump of the dossier. And while Clapper’s statement indirectly confirmed the media reports of the briefing, it also could be viewed as a concession of sorts from an intelligence community that has come under repeated, direct fire from the president-elect. Trump had compared the leak from his briefing to “Nazi Germany” on Twitter on Wednesday morning, writing, “Intelligence agencies should never have allowed this fake news to "leak" into the public. One last shot at me. Are we living in Nazi Germany?” In a news conference, also held Wednesday, Trump defended the comparison and elaborated further, saying, “A thing like that should have never been written, it should never have been had, and it certainly should never have been released.” Clapper, however, said he did not believe the leaks to the press came from the intelligence community. At the same time, he indicated that the intelligence community decided to share the material with Trump because its mere existence was important for the incoming president to know about.

Germany Opens Criminal Investigation On Alleged NSA Merkel Phone Tap - 0 views

  • German prosecutors have opened an investigation into the alleged monitoring of Chancellor Angela Merkel’s cellphone by the U.S. National Security Agency, officials said Wednesday, in a move that could again complicate diplomatic relations between the two allies. It was not immediately clear what the new investigation might mean in terms of possible prosecutions of Americans. Documents provided by National Security Agency leaker Edward Snowden indicated in October that the U.S. was monitoring Merkel’s cellphone conversations, as well as those of 35 other foreign leaders. Merkel expressed outrage and accused Washington of a grave breach of trust. In the ensuing diplomatic fallout, President Barack Obama acknowledged Germany’s anger and promised that new guidelines would cut back on such monitoring, except in the case of a national security interest. “The leaders of our close friends and allies deserve to know that if I want to learn what they think about an issue, I will pick up the phone and call them rather than turning to surveillance,” Obama said at the time.

  • In his Wednesday announcement, Range’s office said he was not opening a formal investigation of wider allegations of blanket surveillance of telecommunications data in Germany by U.S. and British intelligence, saying that there was not yet sufficient factual evidence of concrete crimes. His office said that will remain under consideration. Merkel’s spokesman, Steffen Seibert, declined to comment on Range’s decision or on whether the government fears it will weigh on relations with the U.S. The government didn’t exert any influence on the prosecutor, Seibert told reporters. “I am not going to evaluate here the decision he has made,” he said. Separately, the German Parliament earlier this year set up a committee to investigate the scope of spying by the NSA and other intelligence services in Germany.

    There's a bit of comedy beneath the surface here. When Edward Snowden was in Hong Kong and news of the NSA leak hit, the U.S. Dept. of Justice promptly filed a criminal espionage charge against Snowden and attempted to extradite him from Hong Kong. Snowden left Hong Kong before the extradition paperwork was processed enough to result in his arrest.  Now with a pending criminal investigation of the NSA's espionage activities aimed at Germany's chancellor, the Obama White House says it wants dialog, not a criminal investigation. Would the U.S. honor its extradition treaty with Germany if NSA officials or the Director of Intelligence were charged with espionage in Germany? One might suspect that a dual-standard would be deployed, in effect saying that only espionage charges that the U.S. lodges can justify extradition. Or at least that's the way it worked when Italy tried and convicted in absentia several CIA officials and an Air Force officer of espionage activities, relating to the kidnapping and "extraordinary rendition" of a gentleman in Italy.       But this incident serves as a reminder that when the NSA officials conduct foreign intelligence activities, they will in most cases be deliberately violating the criminal laws of other nations. And the same activity aimed at U.S. citizens is also criminal, which is undoubtedly why Sen. Ron Wyden asked Director of Intelligence Clapper if the NSA had taken account of the Computer Fraud and Abuse Act in its processing of domestic digital communications. Clapper said he would get back to Wyden on that in writing. So far as I'm aware, Wyden is still waiting for that answer. There are lots of comedians in Washington, D.C. Most of them have no idea that they are comedians.

    The records of the mid-1970s Church Committee investigation into covert government surveillance and illegal repression of political rights are now online. The revelations of this investigation led directly to passage of the Foreign Intelligence Surveillance Act and other legislation aimed at confining the U.S. military to surveillance of foreign targets and to dismantling of J. Edgar. Hoover's COINTEL program of political repression in the U.S., including blackmailing of elected officials and assassination of dissident political activists. The more recent NSA revelations should be viewed with knowledge that the NSA was already told decades earlier by Congress to butt out of domestic surveillance in no uncertain terms. Yet here we have the NSA gathering the entire "haystack" of U.S. citizens' domestic communications. In any event, this is a historical treasure trove of  prior misbehavior by the U.S. clandestine services, an overpowering  testimony that government officials cannot  be trusted with secret surveillance powers.

New Intel Doc: Do Not Be 'Led Astray' By 'Commonly Understood Definitions' - The Intercept - 0 views

  • New evidence of the intelligence community’s intentionally deceptive use of the English language was released today in the form of a Defense Intelligence Agency document that instructs analysts to use words that do not mean what they appear to mean. The section of the DIA’s “intelligence law handbook” on the “Collection of Information about United States Persons” opens like this: To begin the journey, it is necessary to stop first and adjust your vocabulary. The terms and words used in DoD 5240.1-R have very specific meanings, and it is often the case that one can be led astray by relying on the generic or commonly understood definitions of a particular word. DoD 5240.1-R — entitled “Procedures Governing the Activities of DOD Intelligence Components that Affect United States Persons” – is the Department of Defense document that implements Executive Order 12333, the unilateral presidential directive first signed by President Reagan that authorizes government agencies to covertly sweep up vast amounts of private data from overseas communications. The plainspoken employee handbook was one several documents about Executive Order 12333 the ACLU obtained through a Freedom of Information Act lawsuit and released today.   • Here is the handbook explaining how not to be led astray: For example, “collection of information” is defined in the Dictionary of the United States Army Terms (AR 310- 25) as: “The process of gathering information for all available sources and agencies. ” But, for the purposes of DoD 5240 .1-R, information is “collected” – only when it has been received for use by an employee of a DoD intelligence component in the course of his official duties… (and) an employee takes some affirmative action that demonstrates an intent to use or retain the information. So, we see that “collection of information” for DoD 5240.1-R purposes is more than “gathering” – it could be described as “gathering, plus … “. For the purposes of DoD 5240.1-R, “collection” is officially gathering or receiving information, plus an affirmative act in the direction of use or retention of that information.

Analysts can even gather information and keep it for up to six months without it counting as having been “collected”, as long as it’s being “held or forwarded to a supervisory authority, solely for the purpose of making a determination about its collectability.” Although the intelligence community’s astonishing abuse of words has been frequently noted, particularly in the context of surveillance, this may be the first time we’ve actually seen an instruction manual.

Ultimately, the committee was not allowed to, and now we know one reason why. The NBC News investigative reporter Matthew Cole has pieced together a remarkable story revealing that a single senior officer, who is still in a position of high authority over counterterrorism at the C.I.A.—a woman who he does not name—appears to have been a source of years’ worth of terrible judgment, with tragic consequences for the United States. Her story runs through the entire report. She dropped the ball when the C.I.A. was given information that might very well have prevented the 9/11 attacks; she gleefully participated in torture sessions afterward; she misinterpreted intelligence in such a way that it sent the C.I.A. on an absurd chase for Al Qaeda sleeper cells in Montana. And then she falsely told congressional overseers that the torture worked.
  • Had the Senate Intelligence Committee been permitted to use pseudonyms for the central characters in its report, as all previous congressional studies of intelligence failures, including the widely heralded Church Committee report in 1975, have done, it might not have taken a painstaking, and still somewhat cryptic, investigation after the fact in order for the American public to hold this senior official accountable. Many people who have worked with her over the years expressed shock to NBC that she has been entrusted with so much power. A former intelligence officer who worked directly with her is quoted by NBC, on background, as saying that she bears so much responsibility for so many intelligence failures that “she should be put on trial and put in jail for what she has done.” Instead, however, she has been promoted to the rank of a general in the military, most recently working as the head of the C.I.A.’s global-jihad unit. In that perch, she oversees the targeting of terror suspects around the world. (She was also, in part, the model for the lead character in “Zero Dark Thirty.”)

  • According to sources in the law-enforcement community who I have interviewed over the years, and who I spoke to again this week, this woman—whose name the C.I.A. has asked the news media to withhold—had supervision over an underling at the agency who failed to share with the F.B.I. the news that two of the future 9/11 hijackers had entered the United States prior to the terrorist attacks.
  • As NBC recounts, this egregious chapter was apparently only the first in a long tale, in which the same C.I.A. official became a driving force in the use of waterboarding and other sadistic interrogation techniques that were later described by President Obama as “torture.” She personally partook in the waterboarding of Khalid Sheikh Mohammed, the architect of the 9/11 attacks, at a black site in Poland. According to the Senate report, she sent a bubbly cable back to C.I.A. headquarters in 2003, anticipating the pain they planned to inflict on K.S.M. in an attempt to get him to confirm a report from another detainee, about a plot to use African-American Muslims training in Afghanistan for future terrorist attacks. “i love the Black American Muslim at AQ camps in Afghanuistan (sic). … Mukie (K.S.M.) is going to be hatin’ life on this one,” she wrote, according to the report. But, as NBC notes, she misconstrued the intelligence gathered from the other detainee. Somehow, the C.I.A. mistakenly believed that African-American Muslim terrorists were already in the United States. The intelligence officials evidently pressed K.S.M. so hard to confirm this, under such physical duress, that he eventually did, even though it was false—leading U.S. officials on a wild-goose chase for black Muslim Al Qaeda operatives in Montana. According to the report, the same woman oversaw the extraction of this false lead, as well as the months-long rendition and gruesome interrogation of another detainee whose detention was a case of mistaken identity. Later, in 2007, she accompanied then C.I.A. director Michael Hayden to brief Congress, where she insisted forcefully that the torture program had been a tremendous and indispensable success.
  • Readers can speculate on how the pieces fit together, and who the personalities behind this program are. But without even pseudonyms, it is exceedingly hard to connect the dots. It seems entirely possible—though, again, one can only speculate—that the C.I.A. overcompensated for its pre-9/11 intelligence failures by employing overly harsh measures later. Once they’d made a choice that America had never officially made before—of sanctioning torture—it seems possible that they felt they had to defend its efficacy, despite mounting evidence to the contrary. If so, this would be worth learning. But without names, or even pseudonyms, it is almost impossible to piece together the puzzle, or hold anyone in the American government accountable. Evidently, that is exactly what the C.I.A. was fighting for during its eight-month-long redaction process, behind all those closed doors.

  • In the United States and Europe, it is unchallenged in political and media circles that intelligence documents purporting to be from a covert Iranian nuclear weapons program for which the IAEA long demanded an Iranian explanation are genuine.   But evidence has continued to accumulate that the documents - sometimes called the “laptop documents” because they were said to have been on a laptop computer belonging to one of the participants in the program - were fabricated by Israel’s foreign intelligence agency (Mossad).  We now know that the documents did not come from an Iranian participant in the alleged project, as the media were led to believe for years; they were turned over to German intelligence by the anti-regime Iranian terrorist organisation, Mujahedeen E Khalq, (MEK). I first reported this in 2008 and have now confirmed from an authoritative German source in my book on the Iran nuclear issue. The MEK was well known to have been a client of the Mossad, serving to launder Israeli intelligence claims that the Israelis did not want attributed to themselves.
  • Although it has never been mentioned in news media, former International Atomic Energy Agency (IAEA) Director General, Mohamed El Baradei recalled in his memoirs that he was doubtful of the authenticity of the documents. “No one knew if any of this was real,” he wrote in reference to the laptop documents. Another former senior IAEA official told me, “It just really didn’t add up.  It made more sense that this information originated in another country.”  And as I have detailed in articles and in my book, key documents in the collection bear clear indications of fabrication. Support for that virtually unknown part of the Iran nuclear story has come from a surprising source: a popular Israeli account, celebrating the successes of the Mossad’s covert operations. “Mossad: The Greatest Missions of the Israeli Secret Service,” first published in Hebrew in 2010, and then published in English in 2012, was Israel’s best-selling book for months in 2010. But not only does it acknowledge that it was indeed the MEK that delivered the documents, it also suggests that at least some of the documents came from the Mossad.  
  • The co-authors of the book are far from critics of Israel’s policy toward Iran; One of the co-authors, Michael Bar-Zohar, is a well-connected former member of the Israeli Knesset and former paratrooper, who had previously written an authorised biography of Shimon Peres, as well as the biography of Isser Harel, the Mossad chief who presided over the kidnapping of Adolph Eichmann in Argentina. Much of what Bar-Zohar chronicled in the book had already been reported earlier by Israeli journalists - especially Ronen Bergman of the daily Yedioth Ahronoth.  In fact, Bergman accused Bar-Zohar of plagiarising his articles for much of the book, while changing only a few words.  But one thing that Bar-Zohar and co-author Nisham Mishal did not get from other Israeli journalists, was the role of the Mossad in regard to the laptop documents.

  • Although they do not flatly state that the Mossad was the source of the documents, they certainly lead the reader to that conclusion. They begin by establishing the fact that the MEK was fronting for the Mossad in its revelation in August 2002 of Iran’s first enrichment facility at Natanz. The CIA, they write, “appeared to believe that the Mossad and the British MI6 were feeding MEK intelligence they had obtained, using the Iranian opposition as a hopefully credible source”.  And they explicitly confirm CIA’s suspicions. “According to Israeli sources,” they write, “It was, in fact, a watchful Mossad officer who had discovered the mammoth centrifuge installation at Natanz.”  Other sources, including Seymour Hersh and Connie Bruck have reported that the MEK got the intelligence on Natanz from the Israelis, but theirs is the first explicit acknowledgement attributed to an Israeli source that the MEK had revealed Natanz on the basis of Mossad intelligence.  What the Israeli co-authors do not say is that the Mossad was simply guessing at the purpose of Natanz, which the MEK mistakenly called a “fuel fabrication” facility, rather than a centrifuge enrichment facility.
  • Bar-Zohar and Mishal are little concerned with whether the Mossad’s laptop caper involved fraud or not. They obviously view the Israeli intelligence agency’s use of an Iranian exile group to get out documents that had been central to the international sanctions regime against Iran as a great triumph. But whatever their reasons, their book adds another layer to the growing body of evidence showing that the Bush administration and its allies hoodwinked the rest of the world with those documents.
  • The authors further suggest that the Mossad was behind information later released by the MEK on Mohsen Fakhrizadeh, the Iranian physics professor said to be shown in the laptop documents as the man in charge of that purported Iranian nuclear weapons research program. The MEK disclosed such personal details as Fakhrizadeh’s passport number and his home telephone number. But the Mossad chroniclers write: “This abundance of detail and means of transmission leads one to believe that, again, “a certain secret service” ever suspected by the West of pursuing its own agenda, painstakingly collected these facts and figures about the Iranian scientists and passed them to the Iranian resistance.” I asked Bar-Zohar’s research assistant, Nilly Ovnat, whether he had Israeli sources for those statements relating to the MEK and the laptop documents. She responded by          e-mail: “Professor Bar Zohar had other sources for most of the material concerning MEK and Natanz [and the] laptop, yet they could not be mentioned and cannot be discussed.”
  • Turning to the laptop documents, they make it clear that western intelligence had indeed obtained the documents from the MEK and suggest that the MEK got them from somewhere else. “The dissidents wouldn’t say how they had gotten hold of the laptop,” they write. They again frame the question of the origins of those documents in terms of CIA suspicions. “[T]he skeptical Americans suspected that the documents had been only recently scanned into the computer,” they write. “They accused the Mossad of having slipped in some information obtained from our own sources - and passing it to the MEK leaders for delivery to the West." Bar-Zohar and Mishal steer clear of any suggestion that the Mossad fabricated any documents, but their account leaves little doubt that they are convinced that the Mossad should be credited for the appearance of the documents. Their approach of referring to US suspicions, rather than stating it directly, appears to be a way of avoiding problems with Israeli military censors, who often clamp down on local reporting on sensitive issues while allowing references to foreign reports.

N.S.A. Report Outlined Goals for More Power - NYTimes.com - 0 views

  • Officials at the National Security Agency, intent on maintaining its dominance in intelligence collection, pledged last year to push to expand its surveillance powers, according to a top-secret strategy document.
  • In a February 2012 paper laying out the four-year strategy for the N.S.A.’s signals intelligence operations, which include the agency’s eavesdropping and communications data collection around the world, agency officials set an objective to “aggressively pursue legal authorities and a policy framework mapped more fully to the information age.” Written as an agency mission statement with broad goals, the five-page document said that existing American laws were not adequate to meet the needs of the N.S.A. to conduct broad surveillance in what it cited as “the golden age of Sigint,” or signals intelligence. “The interpretation and guidelines for applying our authorities, and in some cases the authorities themselves, have not kept pace with the complexity of the technology and target environments, or the operational expectations levied on N.S.A.’s mission,” the document concluded. Using sweeping language, the paper also outlined some of the agency’s other ambitions. They included defeating the cybersecurity practices of adversaries in order to acquire the data the agency needs from “anyone, anytime, anywhere.” The agency also said it would try to decrypt or bypass codes that keep communications secret by influencing “the global commercial encryption market through commercial relationships,” human spies and intelligence partners in other countries. It also talked of the need to “revolutionize” analysis of its vast collections of data to “radically increase operational impact.”
  • The N.S.A. document, titled “Sigint Strategy 2012-2016,” does not make clear what legal or policy changes the agency might seek. The N.S.A.’s powers are determined variously by Congress, executive orders and the nation’s secret intelligence court, and its operations are governed by layers of regulations. While asserting that the agency’s “culture of compliance” would not be compromised, N.S.A. officials argued that they needed more flexibility, according to the paper. Senior intelligence officials, responding to questions about the document, said that the N.S.A. believed that legal impediments limited its ability to conduct surveillance of terrorism suspects inside the United States. Despite an overhaul of national security law in 2008, the officials said, if a terrorism suspect who is under surveillance overseas enters the United States, the agency has to stop monitoring him until it obtains a warrant from the Foreign Intelligence Surveillance Court. “N.S.A.’s Sigint strategy is designed to guide investments in future capabilities and close gaps in current capabilities,” the agency said in a statement. “In an ever-changing technology and telecommunications environment, N.S.A. tries to get in front of issues to better fulfill the foreign-intelligence requirements of the U.S. government.”

  • Critics, including some congressional leaders, say that the role of N.S.A. surveillance in thwarting terrorist attacks — often cited by the agency to justify expanded powers — has been exaggerated. In response to the controversy about its activities after Mr. Snowden’s disclosures, agency officials claimed that the N.S.A.’s sweeping domestic surveillance programs had helped in 54 “terrorist-related activities.” But under growing scrutiny, congressional staff members and other critics say that the use of such figures by defenders of the agency has drastically overstated the value of the domestic surveillance programs in counterterrorism. Agency leaders believe that the N.S.A. has never enjoyed such a target-rich environment as it does now because of the global explosion of digital information — and they want to make certain that they can dominate “the Sigint battle space” in the future, the document said. To be “optimally effective,” the paper said, “legal, policy and process authorities must be as adaptive and dynamic as the technological and operational advances we seek to exploit.” Intent on unlocking the secrets of adversaries, the paper underscores the agency’s long-term goal of being able to collect virtually everything available in the digital world. To achieve that objective, the paper suggests that the N.S.A. plans to gain greater access, in a variety of ways, to the infrastructure of the world’s telecommunications networks.
  • Yet the paper also shows how the agency believes it can influence and shape trends in high-tech industries in other ways to suit its needs. One of the agency’s goals is to “continue to invest in the industrial base and drive the state of the art for high performance computing to maintain pre-eminent cryptanalytic capability for the nation.” The paper added that the N.S.A. must seek to “identify new access, collection and exploitation methods by leveraging global business trends in data and communications services.” And it wants to find ways to combine all of its technical tools to enhance its surveillance powers. The N.S.A. will seek to integrate its “capabilities to reach previously inaccessible targets in support of exploitation, cyberdefense and cyberoperations,” the paper stated. The agency also intends to improve its access to encrypted communications used by individuals, businesses and foreign governments, the strategy document said. The N.S.A. has already had some success in defeating encryption, The New York Times has reported, but the document makes it clear that countering “ubiquitous, strong, commercial network encryption” is a top priority. The agency plans to fight back against the rise of encryption through relationships with companies that develop encryption tools and through espionage operations. In other countries, the document said, the N.S.A. must also “counter indigenous cryptographic programs by targeting their industrial bases with all available Sigint and Humint” — human intelligence, meaning spies.
  • Above all, the strategy paper suggests the N.S.A.’s vast view of its mission: nothing less than to “dramatically increase mastery of the global network.” Other N.S.A. documents offer hints of how the agency is trying to do just that. One program, code-named Treasure Map, provides what a secret N.S.A. PowerPoint presentation describes as “a near real-time, interactive map of the global Internet.” According to the undated PowerPoint presentation, disclosed by Mr. Snowden, Treasure Map gives the N.S.A. “a 300,000 foot view of the Internet.”  Relying on Internet routing data, commercial and Sigint information, Treasure Map is a sophisticated tool, one that the PowerPoint presentation describes as a “massive Internet mapping, analysis and exploration engine.” It collects Wi-Fi network and geolocation data, and between 30 million and 50 million unique Internet provider addresses — code that can reveal the location and owner of a computer, mobile device or router — are represented each day on Treasure Map, according to the document. It boasts that the program can map “any device, anywhere, all the time.”  The documents include addresses labeled as based in the “U.S.,” and because so much Internet traffic flows through the United States, it would be difficult to map much of the world without capturing such addresses.
  • The program takes advantage of the capabilities of other secret N.S.A. programs. To support Treasure Map, for example, the document states that another program, called Packaged Goods, tracks the “traceroutes” through which data flows around the Internet. Through Packaged Goods, the N.S.A. has gained access to “13 covered servers in unwitting data centers around the globe,” according to the PowerPoint. The document identifies a list of countries where the data centers are located, including Germany, Poland, Denmark, South Africa and Taiwan as well as Russia, China and Singapore.

  • It is no secret that U.S. spy agencies historically have collected and analyzed information related to economic affairs - in public briefings to Congress, top intelligence officials have discussed assessments of economic issues.But a former senior U.S. intelligence official said that the Obama Administration had put greater emphasis and resources than predecessors into collecting and assessing economic information.In February 2009, shortly after Obama entered the White House, the Central Intelligence Agency began producing a new "Economic Intelligence Brief" for him to review along with the regular President's Daily Brief on international security and threats.Leon Panetta, Obama's first CIA director, said at the time the change was aimed at understanding the implications of the global economic crisis, and that the agency was considering hiring more economic analysts.The former U.S. intelligence official noted that insider detail on economic policy developments - for example, financial crises affecting the economies of European countries such as Greece, Italy and Spain, and the stability of the Euro - is the type of critical information U.S. policymakers welcome.

  • The desire by U.S. policymakers for such information could help explain why NSA collected information on foreign leaders such as Merkel. Her cellphone number was listed in a NSA targeting document, which German media outlets apparently obtained from Snowden's cache. U.S. officials have now indicated that much NSA eavesdropping on Merkel and other allied leaders is likely to be curtailed if not halted.

Another peril to U.S. citizens are FISA Courts (Foreign Intelligence Surveillance Court) which can order the transfer of domestic intelligence data but have no way of validating the intelligence being given to them, he continued.
