Secret Law Isn't the Public's Fault | Just Security - 0 views

  • Officials in this administration have a funny way of blaming the victim. Did the CIA spy on Senate intelligence committee staffers who were investigating the agency’s torture program? No. OK, yes, you caught us — but the staffers were poking their nose into the CIA’s business. Are communities in some cities suffering from an uptick in crime rates? That must be because they were critical of police practices, and so the police are afraid to do their job. Are American Muslims disproportionately singled out for law enforcement scrutiny? It wouldn’t be necessary if they did a better job of identifying and rooting out the terrorists in their midst. Did a drone strike kill a 16-year-old boy who wasn’t on any target list but happened to be the son of alleged al-Qaeda operative Anwar al-Aulaqi? I guess he “should have had a more responsible father,” as then-White House press secretary Robert Gibbs helpfully explained. At the annual conference of the American Bar Association’s Standing Committee on National Security Law, officials were at it again. Both the CIA’s General Counsel, Caroline Krass, and the acting head of the Justice Department’s Office of Legal Counsel (OLC), Karl Thompson, observed that agencies are issuing fewer requests for formal OLC opinions and are seeking “informal,” unwritten advice from OLC instead. This trend undermines the public’s ability to obtain OLC opinions through FOIA requests. And, according to Krass, we have no one to blame but ourselves:
  • I do think one reason is a focus the office has gotten [in] the past 10 years or so in the public which has now led to Freedom of Information Act requests pretty much anytime the administration adopts a position in the context of domestic law or national security that could be [or] seems a little bit edgy or slightly controversial, immediately the request for the OLC opinion comes. What were we thinking? Well, we might have had in mind OLC officials’ own acknowledgment that their opinions constitute the working law of the executive branch, and are binding on agencies in the same manner that a court’s decision would be. When the public expresses interest in a controversial court opinion, that isn’t cited as a reason to move the judicial system into the shadows. To the contrary, it’s well-understood that the public has a right to know how judges are interpreting the law. That’s true regardless of whether the law deals with the rights and obligations of private parties or (as is usually the case with OLC opinions) the authorities of the government.  It’s high time we stop pretending that OLC opinions are merely attorneys’ advice, and thereby entitled to confidentiality. A private person is free to accept or reject her attorney’s advice. By contrast, as Thompson recognized, OLC opinions — even informal, unwritten ones — are “binding by custom and practice . … People are supposed to and do follow [them].” Moreover, in ordinary circumstances, it is no defense to criminal charges that the defendant’s lawyer gave bad advice. OLC opinions, on the other hand, confer effective immunity, as the Justice Department will not prosecute any official who acted in reliance on OLC’s conclusions.
  • The government nonetheless argues, and many courts have agreed, that OLC opinions are exempt from disclosure under FOIA because they are “deliberative” and “pre-decisional.” This assessment conflates two distinct decisions: the decision of an agency whether to adopt a course of conduct, and OLC’s decision regarding how to interpret the law. The latter decision may be one factor — along with other, non-legal factors, such as political viability, financial cost, and the existence of competing priorities — in the agency’s “deliberations” on the former. The agency ultimately must decide whether to move forward with a policy. But on the question of how the law should be interpreted, it is OLC, not the agency, which has the final word. If the agency were to issue a different legal interpretation, there is no question that OLC’s would take precedence, and the agency would be courting legal jeopardy by adopting a course of action in tension with OLC’s reading of the law. Perhaps the solution is simply to require the government to abide by its own characterization. If OLC opinions are to be given the status of deliberative documents and/or legal advice, so be it; but in that case, they cannot be binding on any agency or official, nor can they mitigate any official’s criminal or civil liability (unless they genuinely negate a required state of mind). If, on the other hand, the government wishes to treat OLC opinions as authoritative and a shield against prosecution or civil suit, then they must be called what they are — law — and made available to the public. Until that happens, the public will remain a victim of secret law, and there will be no one but the administration to blame.

U.S. Dropped 23,144 Bombs on Muslim Countries in 2015 | Global Research - Centre for Re... - 0 views

  • Council of Foreign Relations resident skeptic Micah Zenko recently tallied up how many bombs the United States has dropped on other countries and the results are as depressing as one would think. Zenko figured that since Jan. 1, 2015, the U.S. has dropped around 23,144 bombs on Iraq, Syria, Afghanistan, Pakistan, Yemen, and Somalia, all countries that are majority Muslim. The chart, provided by the generally pro-State Department think tank, puts in stark terms how much destruction the U.S. has leveled on other countries. Whether or not one thinks such bombing is justified, it’s a blunt illustration of how much raw damage the United States inflicts on the Muslim world:
  • It does not appear to be working either. Despite the fact that the U.S. dropped 947 bombs in Afghanistan in 2015, a recent analysis in Foreign Policy magazine found that the Taliban control more territory in Afghanistan than at any point since 2001. The U.S. has entered its 16th year of war in Afghanistan despite several promises by the Obama administration to withdraw. In October of last year, President Obama reversed his position and decided to keep American troops in Afghanistan until the end of 2017. The last four U.S. presidents have bombed Iraq, and that includes the current one since airstrikes were launched on Aug. 7, 2014. The war against ISIS was originally framed as a “limited,” “humanitarian“ intervention. Since then, former Defense Secretary Leon Panetta has insisted it will be a “30-year war” and the White House has spoken vaguely of a “long-term effort” in both Iraq and Syria. Another red flag Zenko noted was the complete lack of civilian deaths being tallied as a result of those 23,144 bombs. Remarkably, they also claim that alongside the 25,000 fighters killed, only 6 civilians have “likely” been killed in the seventeen-month air campaign. At the same time, officials admit that the size of the group has remained wholly unchanged. In 2014, the Central Intelligence Agency (CIA) estimated the size of the Islamic State to be between 20,000 and 31,000 fighters, while on Wednesday, Warren again repeated the 30,000 estimate. To summarize the anti-Islamic State bombing calculus: 30,000 – 25,000 = 30,000.
  • So after more than 20,000 bombs, the U.S. Defense Department only cops to the deaths of six civilians. This is a position largely accepted by the media, which rarely asks who is actually being extinguished by the airstrikes in Syria and Iraq. In October, 30 civilians died after the U.S. bombed a hospital in Kunduz, Afghanistan. The incident is still being investigated, but it has already been revealed that many elements of the original story were either false or deliberately misleading.

US plans to use fake chemical weapons attack to strike Syria - Russian MoD - RT World News - 0 views

  • The US may have plans to use a fake chemical attack in Syria to hit government forces with airstrikes, the Russian Defense Ministry has said. Washington is already building up strike capability in the Middle East, it said. The warning comes a day after the Russian military said it had information about a looming provocation in Syria’s Idlib governorate, which would involve a staged chemical weapons attack. The US earlier warned it would respond to a chemical weapons attack by Syrian government forces with retaliatory strikes, which would be stronger than those conducted by the US, the UK and France in April.
  • In a statement published on Monday, the Russian MoD said it noted the deployment to the Mediterranean last weekend of the missile destroyer USS Ross carrying 28 Tomahawk cruise missiles on board. It came after a similar move of the USS The Sullivans to the Persian Gulf and the rebasing of a B-1B Lancer strategic bomber to an air base in Qatar. The Russian ministry said the “preparations are the latest evidence of the US intention to use the” expected provocation.The statement reiterated that the Hay’at Tahrir al-Sham militant group, previously known as Al-Nusra Front, was preparing a staged chlorine attack in a city in Idlib. It alleged that a group of jihadists, trained in the handling of chemical weapons by the British private military contractor Olive Group, has already arrived in Jisr al-Shughur. The group will “stage decontamination of victims of a staged chemical weapons attack posing as members of the notorious White Helmets group,” the ministry claimed.“The implementation of this provocation, which is being conducted with the assistance of the British intelligence services, is meant to serve as the latest pretext for the US, Britain and France to deliver a missile strike against state and economic facilities in Syria,” said General Igor Konashenkov, spokesman for the Russian Defense Ministry.On August 22, US National Security Advisor John Bolton stated that “if the Syrian regime uses chemical weapons, we will respond very strongly and they really ought to think about this a long time.”

WHO ARE SYRIA'S WHITE HELMETS (terrorist linked)? - 0 views

  • The White Helmets have been demonstrated to be a primarily US and NATO funded organisation embedded in Al Nusra and ISIS held areas exclusively. This is an alleged “non-governmental” organisation, the definition of an NGO, that thus far has received funding from at least three major NATO governments, including $23 million from the US Government and $29 million (£19.7 million) from the UK Government, $4.5 million (€4 million) from the Dutch Government. In addition, it receives material assistance and training funded and run by a variety of other EU Nations. A request has been put into the EU Secretary General to provide all correspondence relating to the funding and training of the White Helmets. By law this information must be made transparent and available to the public. There has been a concerted campaign by a range of investigative journalists to expose the true roots of these Syria Civil Defence operatives, known as the White Helmets.  The most damning statement, however, did not come from us, but from their funders and backers in the US State Department who attempted to explain the US deportation of the prominent White Helmet leader, Raed Saleh, from Dulles airport on the 18th April 2016.

Far more than traditional approachesto battle, swarming clearly depends upon robust information flows. Securing these flows, therefore, can be seen as a necessary condition for successful swarming.”

Do we really want to look back and be “judged by history” for enabling conflict and state terrorism, violating international law and invading sovereign nations.  Are we prepared to accept the consequences of such actions, consequences that should be taken by our governments alone but are now being diffused outwards to the general public.  Is this an attempt by our government to disassociate themselves from their criminal actions?

Weekly Update: JW Sues for Unmasking Targeting Trump Team - 0 views

  • Much Needed New Scrutiny of the Clinton Foundation   Will there ever be a serious investigation and prosecution of the Clinton cash machine? Maybe. Micah Morrison, our chief investigative reporter, has an important update in his latest Investigative Bulletin:   Rumors have been floating up from Little Rock for months now of a new investigation into the Clinton Foundation. John Solomon advanced the story recently in a January report for The Hill. FBI agents in the Arkansas capital, he wrote, “have taken the lead” in a new Justice Department inquiry “into whether the Clinton Foundation engaged in any pay-to-play politics or other illegal activities while Hillary Clinton served as secretary of state.” Solomon reports that the probe “may also examine whether any tax-exempt assets were converted for personal or political use and whether the foundation complied with applicable tax laws.”   Main Justice also is “re-examining whether there are any unresolved issues from the closed case into Clinton’s transmission of classified information through her personal email server,” Solomon notes.   Solomon is not alone. The Wall Street Journal is tracking the story. And earlier this month, investigative journalist Peter Schweizer cryptically told SiriusXM radio that federal authorities should “convene a grand jury” in Little Rock “and let the American people look at the evidence” about the Clinton Foundation.   Judicial Watch continues to turn up new evidence of Clinton pay-to-play and mishandling of classified information. In recent months, through FOIA litigation, Judicial Watch has forced the release of more than 2,600 emails and documents from Mrs. Clinton and her associates, with more to come. The emails include evidence of Clinton Foundation donors such XL Keystone lobbyist Gordon Griffin, futures brokerage firm CME Group chairman Terrence Duffy, and an associate of Shangri La Entertainment mogul Steve Bing seeking special favors from the State Department. Mrs. Clinton and her former State Department deputy chief of staff, Huma Abedin, sent and received classified information through unsecure channels. The emails and documents involved sensitive information about President Obama, the Middle East, Africa, Afghanistan, Mexico, Burma, India, intelligence-related operations and world leaders. But mishandling of classified information is a serious matter. And the tax angle is intriguing, even if you’re not Al Capone. The tenacious financial expert Charles Ortel, who has been digging deep into Clinton finances for years, told us back in 2015 that there are “epic problems” with the entire Clinton Foundation edifice, which traces its origins back to Arkansas. He noted that independent accounting firms may have been “duped by false and materially misleading representations” made by Clinton charitable entities. Down in Arkansas, law enforcement may be finally catching up with Ortel’s insights.
