The revelation of Prism this month by the Washington Post and Guardian newspapers has touched off the latest round in a decade-long debate over what limits to impose on government eavesdropping, which the Obama administration says is essential to keep the nation safe. But interviews with more than a dozen current and former government and technology officials and outside experts show that, while Prism has attracted the recent attention, the program actually is a relatively small part of a much more expansive and intrusive eavesdropping effort. Americans who disapprove of the government reading their emails have more to worry about from a different and larger NSA effort that snatches data as it passes through the fiber optic cables that make up the Internet's backbone. That program, which has been known for years, copies Internet traffic as it enters and leaves the United States, then routes it to the NSA for analysis.

Whether by clever choice or coincidence, Prism appears to do what its name suggests. Like a triangular piece of glass, Prism takes large beams of data and helps the government find discrete, manageable strands of information. The fact that it is productive is not surprising; documents show it is one of the major sources for what ends up in the president's daily briefing. Prism makes sense of the cacophony of the Internet's raw feed. It provides the government with names, addresses, conversation histories and entire archives of email inboxes.

The NSA is prohibited from spying on Americans or anyone inside the United States. That's the FBI's job and it requires a warrant. Despite that prohibition, shortly after the Sept. 11 terrorist attacks, President George W. Bush secretly authorized the NSA to plug into the fiber optic cables that enter and leave the United States, knowing it would give the government unprecedented, warrantless access to Americans' private conversations. Tapping into those cables allows the NSA access to monitor emails, telephone calls, video chats, websites, bank transactions and more. It takes powerful computers to decrypt, store and analyze all this information, but the information is all there, zipping by at the speed of light. "You have to assume everything is being collected," said Bruce Schneier, who has been studying and writing about cryptography and computer security for two decades. The New York Times disclosed the existence of this effort in 2005. In 2006, former AT&T technician Mark Klein revealed that the company had allowed the NSA to install a computer at its San Francisco switching center, a key hub for fiber optic cables.

I’ve been on the road for days, and a few more Clinton emails have thudded down from the Wikileaks heavens revealing deliberations about Israel inside the Clinton braintrust. Some day we will put together a leatherbound edition with morocco covers of Clinton’s Israel emails, but for now we’re just trying to chase the latest. And these three are stunners because they baldly expose the importance of Israel to donors and the party establishment. First, there was this amazing email thread among top strategists from May 2015 about revising Clinton’s talking points in her speeches at rallies and fundraisers in the weeks before she officially launched her candidacy. You just gotta read these comments as they fall. The conversation started out on a bunch of different talking points, but everyone quickly turned to Israel, and the public and private messaging.

Jake Sullivan, foreign policy aide: “Would add a sentence on standing up for our allies and our values, including Israel and other fellow democracies, and confronting terrorists and dictators with strength and cunning.” Mandy Grunwald, media advisor: “I thought this was largely for her TP [talking points] with public events not fundraisers. Do we need Israel etc for that?” Sullivan: “We def need the etc. I think good to have Israel too.” Joel Benenson, pollster and chief strategist: “Why would we call out Israel in public events now? The only voters elevating FP at all are Republican primary voters.” Robby Mook, campaign manager: “I’m w Joel. We shouldn’t have Israel at public events. Especially dem activists.” Sullivan: “I won’t fall on sword over Israel but we need more than climate in that paragraph.” Dan Schwerin, speechwriter: “What about this as a base, and then she can drop in Israel when she’s with donors: “Fourth and finally, we have to protect our country from the global threats that we see, from terrorists to dictators to diseases – and the ones that are still over the horizon. We have to assert confident American leadership to shape global events rather than be shaped by them. That includes taking on global warming and those who continue to deny that it exists. And it means always standing up for our allies and our values, especially our fellow democracies.” Mook: “I’m fine with that.” Benenson: “Good.”

That’s a smoking gun email. It says just what Stephanie Schriock of Emily’s List and J.J. Goldberg said at J Street earlier this year, the role of Jewish donors on the Democratic side is “gigantic” and “shocking.” And those Jewish donors are seen as pro-Israel all the time, by folks who study politics. But meantime, Robby Mook says just what we’ve been saying here for a couple of years: the lobby has lost the Democratic base on Israel. Young Dems, people of color, women — they’re more sympathetic to Palestinians than Israelis. Don’t mention Israel with dem activists. So the system really is rigged. They don’t want to hear from the people on this.

That lie – and that is what it was: a claim made with knowledge of its falsity or reckless disregard for its truth – was most aggressively amplified by MSNBC personalities such as Joy Ann Reid and Malcolm Nance, The Atlantic’s David Frum, and Newsweek’s Kurt Eichenwald.

That the emails in the Wikileaks archive were doctored or faked — and thus should be disregarded — was classic Fake News, spread not by Macedonian teenagers or Kremlin operatives but by established news outlets such as MSNBC, The Atlantic, and Newsweek. And, by design, this Fake News spread like wildfire all over the internet, hungrily clicked and shared by tens of thousands of people eager to believe it was true. As a result of this deliberate disinformation campaign, anyone reporting on the contents of the emails was instantly met with claims that the documents in the archive had been proven fake. The most damaging such claim came from MSNBC’s intelligence analyst Malcolm Nance. As I documented on October 11, he tweeted what he — for some bizarre reason — labeled an “Official Warning.” It decreed: “#PodestaEmails are already proving to be riddled with obvious forgeries & #blackpropaganda not even professionally done.” That tweet was re-tweeted by more than 4,000 people. It was vested with added credibility by Clinton-supporting journalists like Reid and Frum (“expert to take seriously”).

New York Post columnist John Crudele obliterates the despicable word-parsing. “Clinton was so careless when using her BlackBerry that the Russians stole her password,” he writes. “All Russian President Vladimir Putin’s gang had to do was log into Clinton’s account and read whatever they wanted.” When it comes to the DNC hack, “The Russians did it” is the theme-du-jour. Clinton campaign manager, Robby Mook stated Sunday that “experts are telling us that Russian state actors broke into the DNC, stole these emails, [and are] releasing these emails for the purpose of helping Donald Trump.” The campaign itself echoed that assertion. “This is further evidence the Russian government is trying to influence the outcome of the election.”

Retired U.S. Air Force Gen. Philip Breedlove, until recently the supreme commander of NATO forces in Europe, plotted in private to overcome President Barack Obama’s reluctance to escalate military tensions with Russia over the war in Ukraine in 2014, according to apparently hacked emails from Breedlove’s Gmail account that were posted on a new website called DC Leaks. Obama defied political pressure from hawks in Congress and the military to provide lethal assistance to the Ukrainian government, fearing that doing so would increase the bloodshed and provide Russian President Vladimir Putin with the justification for deeper incursions into the country. Breedlove, during briefings to Congress, notably contradicted the Obama administration regarding the situation in Ukraine, leading to news stories about conflict between the general and Obama. But the leaked emails provide an even more dramatic picture of the intense back-channel lobbying for the Obama administration to begin a proxy war with Russia in Ukraine. In a series of messages in 2014, Breedlove sought meetings with former Secretary of State Colin Powell, asking for advice on how to pressure the Obama administration to take a more aggressive posture toward Russia.

Breedlove attempted to influence the administration through several channels, emailing academics and retired military officials, including former NATO supreme commander Wesley Clark, for assistance in building his case for supplying military assistance to Ukrainian forces battling Russian-backed separatists.

Breedlove did not respond to a request for comment. He stepped down from his NATO leadership position in May and retired from service on Friday, July 1. Breedlove was a four-star Air Force general and served as the 17th Supreme Allied Commander of NATO forces in Europe starting on May 10, 2013. Phillip Karber, an academic who corresponded regularly with Breedlove — providing him with advice and intelligence on the Ukrainian crisis —  verified the authenticity of several of the emails in the leaked cache. He also told The Intercept that Breedlove confirmed to him that the general’s Gmail account was hacked and that the incident had been reported to the government.

Former Secretary of State Hillary Clinton’s use of a personal email account run through a private server was "not acceptable" and happened without officials’ knowledge, a top State Department record-keeper said on Wednesday. “I think the message is loud and clear that that is not acceptable,” Joyce Barr, the State Department’s assistant secretary for the Bureau of Administration, testified before the Senate Judiciary Committee.

“The actions that we’ve taken in the course of recovering these emails has made it very clear what the responsibilities are with regard to record-keeping,” she added in remarks at a Senate Judiciary Committee hearing on government transparency.Clinton’s use of the private email server has enraged Republicans and government transparency advocates, who fear it allowed one of the nation’s top officials to keep her messages secret. The behavior was not revealed just a few months ago, more than a year after Clinton left the State Department, and as she began laying the groundwork for a White House run.“These kinds of things just absolutely undermine the confidence of the American people,” said Sen. Thom Tillis (R-N.C.). “It was a bad decision. I hope that we go so far as to say that, if you do this in the future, you get fired.”Worse, he said, Clinton’s email practices were likely indicative of broader misuse of records preservation within the government.

“What really bothers me is when people plan, in a premeditated and deliberate sort of way, to avoid the Freedom of Information Act and federal government requirements that require them to make public information available to the public,” Sen. John Cornyn (R-Texas) said on Wednesday.Barr told lawmakers she had “no information” about how Clinton used the private server and was “not aware of the practice” ahead of time.Clinton has said that she had determined that roughly half of the 60,000 emails sent through her personal account were official government business and should be turned over to the government for safekeeping. The rest of them were deleted, she said. However, that determination was made by Clinton’s team alone, Barr acknowledged, and federal officials essentially have to take her word that all relevant communications are in the government's hands. “We have been told that she has provided those to us,” she said.

As pressure builds on Hillary Clinton to explain her official use of personal email while serving as secretary of state, she faced new complications Tuesday. It was disclosed her top aides are being drawn into a burgeoning federal inquiry and that two emails on her private account have been classified as “Top Secret.”The inspector general for the Intelligence Community notified senior members of Congress that two of four classified emails discovered on the server Clinton maintained at her New York home contained material deemed to be in one of the highest security classifications - more sensitive than previously known. The notice came as the State Department inspector general’s office acknowledged that it is reviewing the use of “personal communications hardware and software” by Clinton’s former top aides after requests from Congress.

The expanding inquiry threatens to further erode Clinton’s standing as the front-runner for the Democratic presidential nomination. Since her reliance on private email was revealed in March, polls in crucial swing states show that increasing numbers of voters say Clinton is not honest and trustworthy, in part, because of her use of private emails.

Sen. Chuck Grassley, the Republican chairman of the Judiciary Committee, wants Clinton and her aides to “come clean and cough up” information about their personal email use. “Both the State Department and Intelligence Community inspectors general should be looking into the staff use of the Clinton private server for official State Department business. This means giving both inspectors general access and custody of all emails that haven’t already been deleted,” said Grassley of Iowa. “From what is publicly known, it appears that the investigation thus far has focused so much on the former secretary of state, that it’s gotten lost that high-level staff apparently also used this server too.” State Department spokesman John Kirby referred to the Intelligence Community’s disclosure as a recommendation to “upgrade” the two emails’ classification to “Top Secret.” In a statement, he said that “while we work with the Director of National Intelligence to resolve whether, in fact, this material is actually classified, we are taking steps to ensure the information is protected and stored appropriately.”

During an investigation of President Barack Hussein Obama’s political appointees and White House aides, FBI agents discovered secret government email accounts they say were used as primary means for Obama’s staff to interact with IRS officials for day-to-day business.

Another burst of sunlight permeated the National Security Agency's black box of domestic surveillance last week.According to the New York Times, the NSA is searching the content of virtually every email that comes into or goes out of the United States without a warrant. To accomplish this astonishing invasion of Americans' privacy, the NSA reportedly is making a copy of nearly every international email. It then searches that cloned data, keeping all of the emails containing certain keywords and deleting the rest – all in a matter of seconds.

The NSA appears to believe this general monitoring of our electronic communications is justified because the entire process takes, in one official's words, "a small number of seconds". Translation: the NSA thinks it can intercept and then read Americans' emails so long as the intrusion is swift, efficient and silent.That is not how the fourth amendment works.Whether the NSA inspects and retains these messages for years, or only searches through them once before moving on, the invasion of Americans' privacy is real and immediate. There is no "five-second rule" for fourth amendment violations: the US constitution does not excuse these bulk searches simply because they happen in the blink of an eye.The government claims that this program is authorized by a surveillance statute passed in 2008 that allows the government to target foreigners for surveillance. Although the government has frequently defended that law as a necessary tool in gathering foreign intelligence, the government has repeatedly misled the public about the extent to which the statute implicates Americans' communications.

There should no longer be any doubt: the US government has for years relied upon its authority to collect foreigners' communications as a useful cover for its sweeping surveillance of Americans' communications. The surveillance program revealed last week confirms that the interception of American communications under this law is neither "targeted" at foreigners (in any ordinary sense of that word) nor "inadvertent", as officials have repeatedly claimed.Last week's revelations are a disturbing harbinger of future surveillance. Two months ago, this newspaper reported that the US government has been forcing American telecommunications companies to turn over the call records of every one of their customers "on an ongoing daily basis", to allow the NSA to later search those records when it has a reason to do so. The government has since defended the program, in part on the theory that Americans' right to privacy is not implicated by the initial acquisition of their phone records, only by their later searching.That legal theory is extraordinarily dangerous because it would allow the NSA to acquire virtually all digital information today simply because it might possibly become relevant tomorrow. The surveillance program revealed by the New York Times report goes one step further still. No longer is the government simply collecting information now so that the data is available to search, should a reasonable suspicion arise at some point in the future; the NSA is searching everything now – in real time and without suspicion – merely on the chance that it finds something of interest.

A recent article written by this writer for Global Research posted last Saturday – “The Benghazi Scandal Is Obama’s Watergate But Worse” – was written in an effort to seek and uncover the truth. Accurate reporting on major world events is a challenge in today’s world where propaganda and disinformation are mainstream media norms and where virtually all major players in American politics simply lie through their teeth every time they open their mouths in constant effort to look good and cover up the truth. The American public knows this pathetic and sobering fact that deception has come to rule in the world of both politics and the media. People today neither believe their newscasters nor their political leaders. That is why examining the content of the tidal wave of assertions and opinions spewing forth from politicians and pundits in the aftermath of the latest Benghazi revelations must be taken with a grain of salt. Again, truth in today’s world is hard to come by. But as an investigative reporter, presenting a brief overview of recent comments and statements for any informed citizen to process and digest seems a worthwhile and important enterprise.

A timeline of recently unfolding events: On 10/12/12 exactly one month after the Benghazi incident, the legal conservative group Judicial Watch filed a Freedom of Information Act request seeking documents related to the Benghazi attack on September 11th, 2012 that killed the US Ambassador to Libya Christopher Stevens and three other Americans. Obama, who had campaigned on a promise of transparency in the criminal wake of the Bush regime, has proven to be anything but open and transparent. Having to sue the US government for access to the records, on April 18th, 2014, a full year and a half later, the Obama administration’s stonewalling ultimately failed and Judicial Watch successfully got hold of 41 State Department Benghazi related documents. Emails between high level White House officials discussing damage control strategies in the immediate aftermath of the Benghazi assault were released last week. Jubilant Republicans are now calling one of those emails their “smoking gun,” believing it is so incriminating that it will do in their would-be opponent Hillary Clinton from potentially competing in the 2016 presidential election.

The newly declassified email written by Obama’s then Deputy Strategic Communications Adviser Ben Rhodes specifically directed then UN Ambassador Susan Rice in preparation for her Sunday morning talk show appearances on September 16th, 2012 to explain the administration’s take on what it knew of the Benghazi murders. Rhodes advised Rice to attribute the Benghazi uprising as “rooted in an Internet video, and not a failure of policy,” pushing talking points designed to bolster Obama’s presidential image as a cool-as-a-cucumber-under-fire kind of wise and benevolent leader and statesman. The major emphasis of the email instructed Rice to blame the bogus anti-Moslem video as inciting a spontaneous protest like in other countries in the region that apparently grew violently out of control, of course all the while knowing that that was a boldface lie. This crucial piece of evidence proves that President Obama and Secretary of State Hillary Clinton both knew that the video did not cause the attack but that they chose to willfully deceive the American public in order to protect their own political careers and hence was born the infamously never ending Benghazi cover-up. Obama and Hillary withheld this damning email evidence even from the House Oversight Committee led by Congressman Darrel Issa (R-CA) requesting all documents pertaining to Benghazi more than a year ago. With the presidential election less than two months away at the time of the attack, Obama and Hillary were determined at all cost to keep hidden from Americans the real truth of criminal Benghazi activity they were guilty of engaging in during the months leading up to the attack. Last Thursday an angry Issa subpoenaed current Secretary of State John Kerry to appear before the committee on May 21st to further explain why those critical State Department records recently given to Judicial Watch were not among the 3200 documents originally handed over to his committee well over a year ago.

Hillary Clinton’s email problems are already causing headaches for her presidential campaign. But within American counterintelligence circles, there’s a mounting sense that the former secretary of state may not be the only Obama administration official in trouble. This is a scandal that has the potential to spread to the White House, as well. The Federal Bureau of Investigation can be expected to be tight-lipped, especially because this highly sensitive case is being handled by counterintelligence experts from Bureau headquarters a few blocks down Pennsylvania Avenue from the White House, not by the FBI’s Washington Field Office. That will ensure this investigation gets the needed “big picture” view, since even senior FBI agents at any given field office may only have a partial look at complex counterintelligence cases.

And this most certainly is a counterintelligence matter. There’s a widely held belief among American counterspies that foreign intelligence agencies had to be reading the emails on Hillary’s private server, particularly since it was wholly unencrypted for months. “I’d fire my staff if they weren’t getting all this,” explained one veteran Department of Defense counterintelligence official, adding: “I’d hate to be the guy in Moscow or Beijing right now who had to explain why they didn’t have all of Hillary’s email.” Given the widespread hacking that has plagued the State Department, the Pentagon, and even the White House during Obama’s presidency, senior counterintelligence officials are assuming the worst about what the Russians and Chinese know.

EmailGate has barely touched the White House directly, although it’s clear that some senior administration officials beyond the State Department were aware of Hillary’s unorthodox email and server habits, given how widely some of the emails from Clinton and her staff were forwarded around the Beltway. Obama’s inner circle may not be off-limits to the FBI for long, however, particularly since the slipshod security practices of certain senior White House officials have been a topic of discussion in the Intelligence Community for years. Hillary Clinton was far from the only senior Obama appointee to play fast and loose with classified materials, according to Intelligence Community insiders. While most counterspies agree that Hillary’s practices—especially using her own server and having her staffers place classified information into unclassified emails, in violation of federal law—were especially egregious, any broad-brush investigation into security matters are likely to turn up other suspects, they maintain. “The whole administration is filled with people who can’t shoot straight when it comes to classified,” an Intelligence Community official explained to me this week. Three U.S. officials suggested that Susan Rice, the National Security Adviser, might be at particular risk if a classified information probe goes wide. But it should be noted that Rice has made all sorts of enemies on the security establishment for her prickly demeanor, use of coarse language, and strategic missteps.

ne new email service promising "end-to-end" encryption launched on Friday, and others are being developed while major services such as Google Gmail and Yahoo Mail have stepped up security measures.A major catalyst for email encryption were revelations about widespread online surveillance in documents leaked by Edward Snowden, the former National Security Agency contractor."A lot of people were upset with those revelations, and that coalesced into this effort," said Jason Stockman, a co-developer of ProtonMail, a new encrypted email service which launched Friday with collaboration of scientists from Harvard, the Massachusetts Institute of Technology and the European research lab CERN.Stockman said ProtonMail aims to be as user-friendly as the major commercial services, but with extra security, and with its servers located in Switzerland to make it more difficult for US law enforcement to access.

"Our vision is to make encryption and privacy mainstream by making it easy to use," Stockman told AFP. "There's no installation. Everything happens behind the scenes automatically."Even though email encryption using special codes or keys, a system known as PGP, has been around for two decades, "it was so complicated," and did not gain widespread adoption, Stockman said.After testing over the past few months, ProtonMail went public Friday using a "freemium" model a basic account will be free with some added features for a paid account.

By locating in Switzerland, ProtonMail hopes to avoid the legal woes of services like Lavabit widely believed to be used by Snowden which shut down rather than hand over data to the US government, and which now faces a contempt of court order.Even if a Swiss court ordered data to be turned over, Stockman said, "we would hand over piles of encrypted data. We don't have a key. We never see the password."

The State Department cannot find in its records all or part of 15 work-related emails from Hillary Rodham Clinton's private server that were released this week by a House panel investigating the 2012 attack in Benghazi, Libya, officials said Thursday. The emails all predate the Sept. 11 assault on the U.S. diplomatic facility and include scant words written by Clinton herself, the officials said. They consist of more in a series of would-be intelligence reports passed to her by longtime political confidant Sidney Blumenthal, the officials said. Nevertheless, the fact that the State Department says it can't find them among emails she provided surely will raise new questions about Clinton's use of a personal email account and server while secretary of state and whether she has provided the agency all of her work-related correspondence, as she claims. Rep. Trey Gowdy, chairman of the Select Committee on Benghazi, released a statement Thursday saying, "This confirms doubts about the completeness of Clinton's self-selected public record and raises serious questions about her decision to erase her personal server — especially before it could be analyzed by an independent, neutral third-party arbiter." When asked about the discrepancy, Nick Merrill, a Clinton campaign spokesman, said, "She has turned over 55,000 pages of materials to the State Department, including all emails in her possession from Mr. Blumenthal."

As for 46 other, previously unreleased Libya-related Blumenthal emails published by the committee, officials said all are in the department's records. They weren't handed over to congressional investigators because they had no relevance to events in Benghazi and did not correspond to the committee's request, the officials said. The officials added that they are willing to provide emails outside the committee's initial request, but warned that doing so would require more time. The emails missing from the State Department's records include missives from Blumenthal in which he sends media accounts about the killing of one of Libyan dictator Moammar Gadhafi's sons, various reports on internal politics among Libya's rebels and news of the assassination of a former Gadhafi minister in Vienna. The last email was sent Aug. 28, 2012, two weeks before the Benghazi attack, and none focus particularly on the eastern Libyan city.

The chairman of the House Select Committee on Benghazi says Hillary Clinton had an obligation to preserve all of the emails from the private server she used while serving as secretary of State. "Secretary Clinton had a statutory duty to preserve records from her time in office, she had a legal duty to cooperate and tell the truth with congressional investigators requesting her records, and she was personally subpoenaed the moment the Benghazi Committee became aware of her exclusive use of personal email and a server, and that the State department was not the custodian of her official record,” Rep. Trey Gowdy (R-S.C.) said in a statement. His remarks came hours after Clinton defended using a personal email account and argued the unique arrangement did not break any existing laws or regulations. ADVERTISEMENT"Everything I did was permitted," Clinton said in an interview with CNN. "There was no law, no regulation, there was nothing that did not give me the full authority to decide how I was going to communicate.”

Gowdy and other Republicans have demanded Clinton turn the server, which her attorney says has been wiped clean of data, over to a neutral third-party who can conduct a forensic analysis and determine if any information can still be salvaged. "For more than two years, Clinton never availed herself of the opportunity, even in response to a direct congressional inquiry, to inform the public of her unusual email arrangement designed to evade public transparency,” Gowdy said. He said the State Department “should have informed congressional investigators years ago” about Clinton’s server. "The fact of the matter is it took the Benghazi Committee to uncover Secretary Clinton's use of personal email and a server to conduct official State Department business,” Gowdy said.

“And it was Benghazi Committee inquiries that led the State Department to confirm Clinton failed to turn over all emails that should be part of her public record; that Clinton's personal emails and server in fact do contain classified information; that her emails from Sidney Blumenthal were solicited; and that she used more than one device for electronic communication, undercutting her 'convenience' claim,” he added. Gowdy said that following Clinton’s comments, “the committee does not know why or when she chose to wipe clean her personal server, but we do know her way of doing things provided an incomplete public record."

A federal judge on Tuesday scolded Obama administration lawyers for dragging their feet in handing over documents from top aides to Hillary Clinton.Judge Emmet Sullivan of the U.S. District Court for The District of Columbia suggested that the State Department needs to divert resources to deal with the onslaught of lawsuits seeking to get a hold of emails from Clinton, Huma Abedin and Cheryl Mills.“There has to be some reallocation of resources. There has to be,” he told a pair of government lawyers. “Because these are atypical cases.”ADVERTISEMENTThe State Department, he added, is treating the demands as if “it’s business as usual.”“This case is important to the public,” Sullivan added. “The public is clamoring for the information. Everybody is clamoring for the information.“You have to find the resources.”

The case is one of dozens of lawsuits against the department that seek information that involves Clinton’s emails.In the case, launched by conservative advocacy group Citizens United, government lawyers had attempted to delay the deadline for them to hand over documents until at least December.Though even that was merely a “hope date,” Department of Justice Lawyer Caroline Anderson said.The government wouldn’t be able to send out the documents until it had a chance to fully upload them into its digital system, search for the requested terms and then do a line-by-line search to see whether the emails were relevant or needed to be classified for one reason or the other.But the case has lingered for months, and lawyers representing Citizens United accused the government of doing little to speed up the process.“The government knew in the summer of this year that they had a problem, but they waited,” Matthew McGill told the judge.

Citizens United's case asked for correspondence between Clinton's former chief of staff Mills, longtime aide Abedin and officials from the Clinton Foundation as well as correspondence about Abedin's part-time work for a consulting firm while also working in the State Department.There are more than 30 lawsuits pending against the State Department seeking to enforce Freedom of Information Act (FOIA) requests for some combination of the tens of thousands of emails from Clinton and other top aides during their time at the State Department.The email requests have been complicated by the revelation earlier this year that Clinton relied exclusively on a personal email address housed on a private server during her tenure as secretary of State. Abedin, Mills and other top aides also used personal email accounts during their time assisting Clinton.In response, the emails have grown to consume a larger and larger portion of work for the 63 full-time employees and one part-timer that the State Department employs to respond to FOIA requests. The department has also brought on the part-time help of 40 Foreign Service officers to assist in the search.

Judicial Watch announced today that on April 18, 2014, it obtained 41 new Benghazi-related State Department documents. They include a newly declassified email showing then-White House Deputy Strategic Communications Adviser Ben Rhodes and other Obama administration public relations officials attempting to orchestrate a campaign to “reinforce” President Obama and to portray the Benghazi consulate terrorist attack as being “rooted in an Internet video, and not a failure of policy.”  Other documents show that State Department officials initially described the incident as an “attack” and a possible kidnap attempt. The documents were released Friday as result of a June 21, 2013, Freedom of Information Act (FOIA) lawsuit filed against the Department of State (Judicial Watch v. U.S. Department of State (No. 1:13-cv-00951)) to gain access to documents about the controversial talking points used by then-UN Ambassador Susan Rice for a series of appearances on television Sunday news programs on September 16, 2012.  Judicial Watch had been seeking these documents since October 18, 2012. The Rhodes email was sent on sent on Friday, September 14, 2012, at 8:09 p.m. with the subject line:  “RE: PREP CALL with Susan, Saturday at 4:00 pm ET.”  The documents show that the “prep” was for Amb. Rice’s Sunday news show appearances to discuss the Benghazi attack.

The document lists as a “Goal”: “To underscore that these protests are rooted in and Internet video, and not a broader failure or policy.” Rhodes returns to the “Internet video” scenario later in the email, the first point in a section labeled “Top-lines”: [W]e’ve made our views on this video crystal clear. The United States government had nothing to do with it. We reject its message and its contents. We find it disgusting and reprehensible. But there is absolutely no justification at all for responding to this movie with violence. And we are working to make sure that people around the globe hear that message. Among the top administration PR personnel who received the Rhodes memo were White House Press Secretary Jay Carney, Deputy Press Secretary Joshua Earnest, then-White House Communications Director Dan Pfeiffer, then-White House Deputy Communications Director Jennifer Palmieri, then-National Security Council Director of Communications Erin Pelton, Special Assistant to the Press Secretary Howli Ledbetter, and then-White House Senior Advisor and political strategist David Plouffe. The Rhodes communications strategy email also instructs recipients to portray Obama as “steady and statesmanlike” throughout the crisis. Another of the “Goals” of the PR offensive, Rhodes says, is “[T]o reinforce the President and Administration’s strength and steadiness in dealing with difficult challenges.” He later includes as a PR “Top-line” talking point: I think that people have come to trust that President Obama provides leadership that is steady and statesmanlike. There are always going to be challenges that emerge around the world, and time and again, he has shown that we can meet them.

The documents Judicial Watch obtained also include a September 12, 2012, email from former Deputy Spokesman at U.S. Mission to the United Nations Payton Knopf to Susan Rice, noting that at a press briefing earlier that day, State Department spokesperson Victoria Nuland explicitly stated that the attack on the consulate had been well planned.  The email sent by Knopf to Rice at 5:42 pm said: Responding to a question about whether it was an organized terror attack, Toria said that she couldn’t speak to the identity of the perpetrators but that it was clearly a complex attack. In the days following the Knopf email, Rice appeared on ABC, CBS, NBC, Fox News and CNN still claiming the assaults occurred “spontaneously” in response to the “hateful video.” On Sunday, September 16 Rice told CBS’s “Face the Nation:” But based on the best information we have to date, what our assessment is as of the present is in fact what began spontaneously in Benghazi as a reaction to what had transpired some hours earlier in Cairo where, of course, as you know, there was a violent protest outside of our embassy–sparked by this hateful video. The Judicial Watch documents confirm that CIA talking points, that were prepared for Congress and may have been used by Rice on “Face the Nation” and four additional Sunday talk shows on September 16, had been heavily edited by then-CIA deputy director Mike Morell. According to one email: The first draft apparently seemed unsuitable….because they seemed to encourage the reader to infer incorrectly that the CIA had warned about a specific attack on our embassy.  On the SVTS, Morell noted that these points were not good and he had taken a heavy hand to editing them. He noted that he would be happy to work with [then deputy chief of staff to Hillary Clinton]] Jake Sullivan and Rhodes to develop appropriate talking points.

When the National Security Agency’s bulk collection of records about Americans’ emails came to light in 2013, the government conceded the program’s existence but said it had shut down the effort in December 2011 for “operational and resource reasons.” While that particular secret program stopped, newly disclosed documents show that the N.S.A. had found a way to create a functional equivalent. The shift has permitted the agency to continue analyzing social links revealed by Americans’ email patterns, but without collecting the data in bulk from American telecommunications companies — and with less oversight by the Foreign Intelligence Surveillance Court.

The disclosure comes as a sister program that collects Americans’ phone records in bulk is set to end this month. Under a law enacted in June, known as the U.S.A. Freedom Act, the program will be replaced with a system in which the N.S.A. can still gain access to the data to hunt for associates of terrorism suspects, but the bulk logs will stay in the hands of phone companies.The newly disclosed information about the email records program is contained in a report by the N.S.A.’s inspector general that was obtained by The New York Times through a lawsuit under the Freedom of Information Act. One passage lists four reasons that the N.S.A. decided to end the email program and purge previously collected data. Three were redacted, but the fourth was uncensored. It said that “other authorities can satisfy certain foreign intelligence requirements” that the bulk email records program “had been designed to meet.”The report explained that there were two other legal ways to get such data. One was the collection of bulk data that had been gathered in other countries, where the N.S.A.’s activities are largely not subject to regulation by the Foreign Intelligence Surveillance Act and oversight by the intelligence court. Because of the way the Internet operates, domestic data is often found on fiber optic cables abroad.

The N.S.A. had long barred analysts from using Americans’ data that had been swept up abroad, but in November 2010 it changed that rule, documents leaked by Edward J. Snowden have shown. The inspector general report cited that change to the N.S.A.’s internal procedures.The other replacement source for the data was collection under the FISA Amendments Act of 2008, which permits warrantless surveillance on domestic soil that targets specific noncitizens abroad, including their new or stored emails to or from Americans.“Thus,” the report said, these two sources “assist in the identification of terrorists communicating with individuals in the United States, which addresses one of the original reasons for establishing” the bulk email records program.

Another leaked email has emerged showing Democratic National Committee boss and former CNN contributor Donna Brazile sharing a debate question in advance with the Hillary Clinton campaign -- despite Brazile's persistent claims to the contrary. CNN announced in a statement soon after the email became public Monday that Brazile had tendered her resignation and the network accepted it on Oct. 14, days after the controversy over Brazile tipping off the Clinton campaign initially broke. According to documents released Monday by WikiLeaks, Brazile sent Clinton Communications Director Jennifer Palmieri an email titled, “One of the questions directed to HRC tomorrow is from a woman with a rash,” the night before the March 6 CNN primary debate in Flint, Mich.  “Her family has lead poison and she will ask what, if anything, will Hillary do as president to help the ppl of Flint,” Brazile wrote.

The following night, Lee-Anne Walters, a mom whose twin boys stopped growing and whose daughter lost her hair during the Flint water contamination crisis, posed a question to both Clinton, the eventual Democratic presidential nominee, and her primary opponent Vermont Sen. Bernie Sanders. 

After my family, the city of Flint and the children in D.C. were poisoned by lead, will you make a personal promise to me right now that, as president, in your first 100 days in office, you will make it a requirement that all public water systems must remove all lead service lines throughout the entire United States, and notification made to the — the citizens that have said service lines?” Walters asked. Clinton responded with a lengthy answer that moderator Anderson Cooper had to twice interrupt in an attempt to keep to the agreed-upon time limit. Clinton’s remarks drew applause from the crowd, though she wound up ultimately losing the state’s primary to Sanders two days later.  The apparent email tip-off was included in the latest trove of messages hacked from Clinton Campaign Chairman John Podesta’s Gmail account and posted by WikiLeaks. Brazile had been under fire over an earlier email chain appearing to show her tipping off the campaign before a town hall event later that same month. That exchange began with Brazile sending Palmieri the text of a question about the death penalty in an email with the subject line: “From time to time I get the questions in advance.” After Palmieri responded, Brazile wrote back: “I’ll send a few more.” Roland Martin asked the death penalty question verbatim the next night during a CNN town hall.  Brazile's role as a CNN contributor was suspended when she took over as interim DNC head in July, but on Oct. 14, in light of the email revelations, CNN said it accepted her full resignation.

A committee of British lawmakers issued a damning assessment on Wednesday of the 2011 intervention in Libya led by Britain and France, concluding that the military action had lacked a coherent strategy, had been based on poor intelligence and had led to a political collapse that aided the rise of the Islamic State in North Africa.

The report from the foreign affairs committee of the House of Commons directly blamed the former prime minister, David Cameron, saying he “was ultimately responsible for the failure to develop a coherent Libya strategy.”In echoing many criticisms from another inquiry, published this year, into Britain’s role in the Iraq war under one of Mr. Cameron’s predecessors, Tony Blair, the report suggested that lessons from that conflict had not been learned.Fearing civilian deaths, an international coalition assembled by Britain and France launched air and missile strikes in March 2011, after Col. Muammar el-Qaddafi’s forces threatened to attack the rebel-held city of Benghazi.Libya descended into chaos, and a power vacuum ensued after the Qaddafi government collapsed, allowing fighters for the Islamic State, also known as ISIS or ISIL, to gain a significant foothold in the country, and the report suggested that Britain had lost interest in the country after Colonel Qaddafi lost power. In many ways, the report mirrored the assessment of President Obama, who offered a candid appraisal of the intervention in an interview published in The Atlantic this year. “It didn’t work,” Mr. Obama said, citing what he described as his misplaced faith that “the Europeans” in general would be invested in the follow-up. He also said that Mr. Cameron had soon become “distracted by other things” and that Mr. Sarkozy had been voted out of office the next year.The report by the 11-person committee, which included six lawmakers from Mr. Cameron’s Conservative Party, criticized the British strategy as flawed from its inception, concluding that it “was founded on erroneous assumptions and an incomplete understanding of the evidence.”
