Wyden Ponders Release of CIA Torture Report Without White House Consent | The World's G... - 0 views

  • A senior Senate Democrat is firing a warning shot at the White House against stalling the release of a report about the past use of torture by the U.S. intelligence community. Sen. Ron Wyden is talking with his colleagues about the possibility of using a seldom-invoked procedure to declassify an Intelligence Committee report on the use of torture in the event the White House does not move ahead quickly. Speaking with reporters on a variety of subjects Thursday, the Oregon Democrat referred to the Senate’s “Resolution 400″ — the Abraham A. Ribicoff-sponsored resolution that established the Intelligence Committee back in 1976. Wyden said he was discussing invoking the resolution “in order to move this along if we have to, through the committee process, to get it declassified.” Matt Bai of Yahoo! News reported earlier Thursday that Wyden mentioned the same procedure to him. And it was not the first time he’s discussed the possibility. Wyden previously explained the provision in October 2013, KATU reported. The Senate Intelligence Committee voted on April 3 to provide for declassification of the report into the use of harsh interrogation practices by the CIA during the administration of President George W. Bush. That action set the gears in motion for declassification review. The report is now in the hands of the White House.

    Senate Resolution 400 provides in relevant part that the Intelligence Committee can vote to declassify documents, giving the White House 5 days to object. If such an objection is made, then the full Senate votes on whether to declassify. It should be recognized, however, that senators' immunity from prosecution for statements made in Congress or in committee hearings in effect grants any member of Congress the ability to declassify documents simply by reading them into the Congressional Record.

Federal watchdogs complain of access woes - POLITICO.com - 0 views

  • A group of 47 official federal agency watchdogs sent a rare joint letter to Congress on Tuesday complaining that management at some agencies has delayed or denied access to government records that the watchdogs believe they are legally entitled to see on demand. In the letter to the bipartisan leadership of major committees across Capitol Hill, the inspectors general complain that the access issues have impeded investigations and threaten the ability of the fraud-waste-and-abuse hunters to do their work. "Refusing, restricting, or delaying an Inspector General’s access to documents leads to incomplete, inaccurate, or significantly delayed findings or recommendations, which in turn may prevent the agency from promptly correcting serious problems and deprive Congress of timely information regarding the agency’s performance," the IGs wrote in their letter (posted here).
  • The letter was made public by Sen. Chuck Grassley (R-Iowa), who said he was troubled by the problems the IGs were facing. "This is an Administration that pledged to be the most transparent in history. Yet, these non-partisan, independent agency watchdogs say they are getting stonewalled.  How are the watchdogs supposed to be able to do their jobs without agency cooperation?" Grassley asked in a statement. "I’ll continue working with the committees of jurisdiction to fix the access problems, through oversight and possibly legislation.” While the signers of Tuesday's letter represent a large majority of IGs, not all the federal watchdogs signed on. At least 21 IGs appear to have passed on joining the letter. Some of those represent small agencies, and a few represent congressional branch agencies that may not face the same kinds of access issues. However, the non-signatories include several large Cabinet agencies.

Let Congress Vote on Iraq War III - 0 views

  • the demand of Sens. Tim Kaine and Rand Paul — that before Obama takes us back to war in Iraq, or into a new war in Syria, Congress must debate and authorize this war — is a constitutional and political imperative. The questions Congress needs to answer are obvious and numerous. Who exactly is our enemy? ISIS only, or Assad, Hezbollah and Iran as well? Will our involvement be restricted to air power — fighter-bombers, gunships, cruise missiles, drones? Or should the president be authorized to send U.S. ground troops to fight? If we are to be restricted to air power, is it to be confined to Iraq, or can it be used in Syria — and against Assad as well as ISIS? If U.S. combat troops cannot be used, what are the prospects of expelling ISIS from Iraq? And if we should drive them out, what is the probability they will come back as soon as we leave, especially if we have left them in control of northern Syria? Is annihilation of ISIS the only permanent solution? How long and bloody a war would that require? Will the president be authorized to coordinate war planning with Tehran? And if Assad is to become our de facto ally, should we end our support for the Free Syrian Army and negotiate an armistice and amnesty for the FSA?
  • Congress must be forced to debate and vote on this war, first, so we can hold them accountable for what is to come. Second, so we can force them to come to consensus on just what kind of outcome in this region is acceptable, and attainable, and at what cost. What will victory look like? What will be the cost in blood and treasure? How long are we prepared to fight this war, an end to which does not today seem to be anywhere in sight? How reasonable is it to expect that the Kurdish peshmerga and an Iraqi Army that fled Kirkuk, Fallujah and Mosul, will be able to recapture the Sunni regions of Iraq? Finally, why is this our fight, 6,000 miles away, and not theirs?

Congress Is Irrelevant on Mass Surveillance. Here's What Matters Instead. - The Intercept - 0 views

  • The “USA Freedom Act”—the proponents of which were heralding as “NSA reform” despite its suffocatingly narrow scope—died in the august U.S. Senate last night when it attracted only 58 of the 60 votes needed to close debate and move on to an up-or-down vote. All Democratic and independent senators except one (Bill Nelson of Florida) voted in favor of the bill, as did three tea-party GOP Senators (Ted Cruz, Mike Lee, and Dean Heller). One GOP Senator, Rand Paul, voted against it on the ground that it did not go nearly far enough in reining in the NSA. On Monday, the White House had issued a statement “strongly supporting” the bill. The “debate” among the Senators that preceded the vote was darkly funny and deeply boring, in equal measure. The black humor was due to the way one GOP senator after the next—led by ranking intelligence committee member Saxby Chambliss of Georgia (pictured above)—stood up and literally screeched about 9/11 and ISIS over and over and over, and then sat down as though they had made a point.
  • So the pro-NSA Republican senators were actually arguing that if the NSA were no longer allowed to bulk-collect the communication records of Americans inside the U.S., then ISIS would kill you and your kids. But because they were speaking in an empty chamber and only to their warped and insulated D.C. circles and sycophantic aides, there was nobody there to cackle contemptuously or tell them how self-evidently moronic it all was. So they kept their Serious Faces on like they were doing The Nation’s Serious Business, even though what was coming out of their mouths sounded like the demented ramblings of a paranoid End is Nigh cult. The boredom of this spectacle was simply due to the fact that this has been seen so many times before—in fact, every time in the post-9/11 era that the U.S. Congress pretends publicly to debate some kind of foreign policy or civil liberties bill. Just enough members stand up to scream “9/11″ and “terrorism” over and over until the bill vesting new powers is passed or the bill protecting civil liberties is defeated.
  • Eight years ago, when this tawdry ritual was still a bit surprising to me, I live-blogged the 2006 debate over passage of the Military Commissions Act, which, with bipartisan support, literally abolished habeas corpus rights established by the Magna Carta by sanctioning detention without charges or trial. (My favorite episode there was when GOP Sen. Arlen Specter warned that “what the bill seeks to do is set back basic rights by some nine hundred years,” and then voted in favor of its enactment.) In my state of naive disbelief, as one senator after the next thundered about the “message we are sending” to “the terrorists,” I wrote: “The quality of the ‘debate’ on the Senate floor is so shockingly (though appropriately) low and devoid of substance that it is hard to watch.” So watching last night’s Senate debate was like watching a repeat of some hideously shallow TV show. The only new aspect was that the aging Al Qaeda villain has been rather ruthlessly replaced by the show’s producers with the younger, sleeker ISIS model. Showing no gratitude at all for the years of value it provided these senators, they ignored the veteran terror group almost completely in favor of its new replacement. And they proceeded to save a domestic surveillance program clearly unpopular among those they pretend to represent.

  • Ever since the Snowden reporting began and public opinion (in both the U.S. and globally) began radically changing, the White House’s strategy has been obvious. It’s vintage Obama: Enact something that is called “reform”—so that he can give a pretty speech telling the world that he heard and responded to their concerns—but that in actuality changes almost nothing, thus strengthening the very system he can pretend he “changed.” That’s the same tactic as Silicon Valley, which also supported this bill: Be able to point to something called “reform” so they can trick hundreds of millions of current and future users around the world into believing that their communications are now safe if they use Facebook, Google, Skype and the rest. In pretty much every interview I’ve done over the last year, I’ve been asked why there haven’t been significant changes from all the disclosures. I vehemently disagree with the premise of the question, which equates “U.S. legislative changes” with “meaningful changes.” But it has been clear from the start that U.S. legislation is not going to impose meaningful limitations on the NSA’s powers of mass surveillance, at least not fundamentally. Those limitations are going to come from—are now coming from —very different places:
  • All of that illustrates what is, to me, the most important point from all of this: the last place one should look to impose limits on the powers of the U.S. government is . . . the U.S. government. Governments don’t walk around trying to figure out how to limit their own power, and that’s particularly true of empires. The entire system in D.C. is designed at its core to prevent real reform. This Congress is not going to enact anything resembling fundamental limits on the NSA’s powers of mass surveillance. Even if it somehow did, this White House would never sign it. Even if all that miraculously happened, the fact that the U.S. intelligence community and National Security State operates with no limits and no oversight means they’d easily co-opt the entire reform process. That’s what happened after the eavesdropping scandals of the mid-1970s led to the establishment of congressional intelligence committees and a special FISA “oversight” court—the committees were instantly captured by putting in charge supreme servants of the intelligence community like Senators Dianne Feinstein and Chambliss, and Congressmen Mike Rogers and “Dutch” Ruppersberger, while the court quickly became a rubber stamp with subservient judges who operate in total secrecy.
  • There is a real question about whether the defeat of this bill is good, bad, or irrelevant. To begin with, it sought to change only one small sliver of NSA mass surveillance (domestic bulk collection of phone records under section 215 of the Patriot Act) while leaving completely unchanged the primary means of NSA mass surveillance, which takes place under section 702 of the FISA Amendments Act, based on the lovely and quintessentially American theory that all that matters are the privacy rights of Americans (and not the 95 percent of the planet called “non-Americans”). There were some mildly positive provisions in the USA Freedom Act: the placement of “public advocates” at the FISA court to contest the claims of the government; the prohibition on the NSA holding Americans’ phone records, requiring instead that they obtain FISA court approval before seeking specific records from the telecoms (which already hold those records for at least 18 months); and reducing the agency’s “contact chaining” analysis from three hops to two. One could reasonably argue (as the ACLU and EFF did) that, though woefully inadequate, the bill was a net-positive as a first step toward real reform, but one could also reasonably argue, as Marcy Wheeler has with characteristic insight, that the bill is so larded with ambiguities and fundamental inadequacies that it would forestall better options and advocates for real reform should thus root for its defeat.

American Democracy is Owned by the Rich | Al Jazeera America - 1 views

  • Two new studies by political scientists offer compelling evidence that the rich use their wealth to control the political system and that the U.S. is a democratic republic in name only. In a study of Senate voting patterns, Michael Jay Barber found that “senators’ preferences reflect the preferences of the average donor better than any other group.” In a similar study of the House of Representatives, Jesse H. Rhodes and Brian F. Schaffner found that, “millionaires receive about twice as much representation when they comprise about 5 percent of the district’s population than the poorest wealth group does when it makes up 50 percent of the district.” In fact, the increasing influence of the rich over Congress is the leading driver of polarization in modern politics, with the rich using the political system to entrench wealth by pushing for tax breaks and blocking redistributive policies.
  • At the turn of the decade, political scientists Larry Bartels, Jacob Hacker and Martin Gilens wrote several incredibly influential important books arguing, persuasively, that the preferences of the rich were better represented in Congress than the poor. After the books were published, there was a flurry of research arguing that they had overstated their case. Critics alleged two key defects in Bartels’ and Gilens’ arguments. First, because polling data on the super-wealthy were sparse, it was difficult to prove that there were large differences in opinion. Political scientists often rely on composite measures of policy liberalism, but since the poor tend to be more economically liberal but socially conservative, the differences between the poor and moderately rich can often be obscured. Second, there was no way to show that influence of the wealthy was caused directly by the influence of money. It might well be that the rich are simply opinion leaders or are more likely to vote.
  • Recent research offers compelling answers to these criticisms. The new evidence adds credence to the Bartels-Gilens-Hacker view that money is corrupting American politics. By using a massive database of ideology that includes the super wealthy, Schaffner and Rhodes found that “members of Congress are much more responsive to the wealthy than to their poor constituents.” However, this difference is not equal between both parties; rather, Democrats are far more responsive to the poor than Republicans. (This is not surprising; other research supports this claim.) They find that both parties strongly favor the upper-middle class, those with $100,000 to $300,000 in wealth. But Republicans are not only more responsive to the rich, but particularly to rich donors. Schaffner and Rhodes argue that, “campaign donations, but not voter registration or participation in primary or general election, may help explain the disproportionate influence of the wealthy among Republican representatives.” Barber’s study is the first to directly examine the policy preferences of the donor class. Barber sent 20,500 letters to people who contributed to 22 Senate elections in 2012 and asked about various policy questions. This allowed Barber to examine the differences in representation between donors and non-donors. His finding: Donors’ preferences tend to be far better represented than non-donors’. The chart below measures the ideological differences between various groups, with 0 indicating a perfect fit. The data show that Senators are almost perfectly aligned with their donors, but rather distant from voters.

  • In fact, politicians are almost perfectly aligned with donors, but less aligned with partisans (people who voted for the Senator and share party affiliation), supporters (people who voted for the Senator) and voters in general. He Barber also finds that donors tend to be far more extreme in their views (see chart below). For instance, while about sixty percent of non-donor Republicans oppose the Affordable Care Act, opposition among donors is “almost unanimous.” Barber also notes that donors tend to be far more extreme than non-donors (see chart). (This is supported by other studies).
  • Such data could explain the rising polarization of Congress, as politicians increasingly respond to their donors, rather than to voters. Political scientists Walter J. Stone and Elizabeth N. Simas have found that challengers raise more money when they take extreme positions, which helps explain why incumbent representatives tend to be more partisan than departing representatives. It certainly explains the intransigence of the last two Congresses: Republicans, who are responding to their rich donor base, are incentivized to oppose any action, particularly those supporting Obama, lest they lose funding. Since Senators have to raise approximately $3,300 a day every year for six years to remain viable, they will inevitably have to succumb to the power of money if they wish to be reelected. This research raises the disturbing thought that our political system is no longer representative. As Barber notes, about half of all donors are from out of state, meaning that politicians are no longer responsive to their voters (though they are slightly more during election years). Given that only .22 percent of Americans made a donation of more than $200 (the level Barber studies) in 2014, we have power evidence that America is now a government of the one percent — indeed, of the one-fifth of one percent.
  • This disturbing trend affects politics at all levels. At the state level, political scientists Gerald Wright and Elizabeth Rigby found that state party platforms are far more influenced by the rich than the poor. Elsewhere, Barber found evidence that presidents are more responsive to donors than non-donors. Recently Griffin and Newman found representation gaps between whites and people of color as well as low-income voters. This finding is supported by Christopher Ellis, who found that donors were better represented than non-donors (although using a less comprehensive method than Barber). In a frank moment, U.S. Sen. Chris Murphy (D – Conn.) said, “I talked a lot more about carried interest inside of that call room than I did in the supermarket.” He’s correct: Donors tending to be far richer and wealthier than non-donors (see chart).
  • There are still unanswered questions. It is possible that politicians cast ideological votes to appease donors and partisans (for instance, the vain attempt to repeal the Affordable Care Act dozens of times), while also working to benefit the poor and middle class through less visible means. This might explain why political journalists, who often focus on major legislation, miss the distributional impacts of political appointments and regulatory action. It may be that politicians work to maximize votes, and then political donations follow (though there is strong evidence this isn’t the case). Either way, the most up-to-date evidence strongly suggests that money is distorting our system, and that evidence appears to be growing stronger by the day.
  • The solution, as a recent Demos report suggests, is to help reformist candidates gather donations with a public matching system. Since voters who are non-donors are less ideological, the solution is to balance out the political distortions from the donor class by turning these non-donors into donors. Citizens United has only increased the stranglehold of moneyed interests on our political system, and is daily choking the life of our democracy. Only by restoring influence to all voters will our republic be restored.

Senator blasts CIA for censoring 'torture' report - 0 views

  • Sen. Ron Wyden says the CIA is trying to blunt the impact of an upcoming Senate report examining the harsh treatment of al-Qaida detainees by insisting on censoring the pseudonyms used for agency officers mentioned in the document. "The intelligence leadership doing everything they can to bury the facts," said Wyden, D-Ore., a Senate Intelligence Committee member who has been a frequent critic of the spy agency.
  • President Barack Obama and other senior officials have said the CIA's use of waterboarding, stress positions, sleep deprivation and other harsh techniques on some detainees constituted torture. Many current and former CIA officers dispute that. The Senate report asserts that the harsh treatment didn't work and that CIA officials misled Congress and other government agencies about it. Also to be released is a CIA response, and a separate one by Senate Republicans, which challenge the report's conclusions. CIA officials say they fear the publication of officer pseudonyms — often just a first name such as "Roger"— would lead to the unmasking of undercover officers. Readers could track the same person in different jobs and places, making it easier to discover their identity. Without the pseudonyms, Wyden says, the report would be much harder to understand because readers wouldn't be able to distinguish different CIA officers. Readers wouldn't know, for example, whether same CIA official had been accused of lying multiple times.
  • Wyden pointed out that the 9/11 Commission Report and a 2004 report into abuses at Iraq's Abu Ghraib prison used pseudonyms for CIA officers. "I think it is appropriate to redact specific identifying information so the identities of undercover officers are not publicly exposed," Wyden told The Associated Press. Wyden said the Senate report documents "falsehoods, misdeeds and mistakes" by the CIA. Asked about Wyden's remarks, CIA spokesman Dean Boyd said, "Pseudonyms are redacted to keep individual intelligence officers from being identified and potentially harmed. Making public those pseudonyms associated with individual officers, as well as dates, locations and other identifying information related to those officers, dramatically increases the likelihood that they will be exposed and potentially subject to threats or violence."

Lincoln Chafee Says He'll Push Hillary Clinton on Privacy, Hound Her on Iraq - US News - 0 views

  • Lincoln Chafee, the former Rhode Island governor and senator, says the Democratic Party needs a presidential candidate who will champion Americans’ constitutional rights and scorn unnecessary wars – and that he may be the right person for the job. Chafee unexpectedly launched a presidential exploratory committee Thursday and tells U.S. News he intends to make civil liberties a major part of his likely campaign, with an anti-mass surveillance message similar to those trumpeted by Republican candidates Sens. Rand Paul and Ted Cruz. The National Security Agency’s dragnet collection of phone records violates Americans’ Fourth Amendment rights, Chafee says, offering a sharp contrast to the difficult-to-discern and vague positions of other prospective Democratic candidates. “The words of the Fourth Amendment are very clear: You need a warrant. That’s strict language, and ‘no warrants shall issue, but upon probable cause,’” he says. “It’s not complicated.”
  • If he jumps into the race, Chafee says he will seek to pressure front-runner Hillary Clinton – expected to announce her candidacy on Sunday – to bend toward pro-civil liberties positions, though he says he wants to be fair and credits Clinton for previously opposing immunity for companies who allegedly complied with government surveillance. Chafee, from a prominent political family, was a liberal Republican in the U.S. Senate from 1999 to 2007. He was elected Rhode Island governor in 2010 as an independent and became a Democrat in 2013. He did not seek a second term and left office in January. As a senator, Chafee voted for the USA Patriot Act in 2001 (as did Clinton) and to renew expiring provisions of the act in 2006. He says he, like Patriot Act author Rep. Jim Sensenbrenner, R-Wis., was shocked to learn from whistleblower Edward Snowden that the executive branch interpreted the law as allowing the bulk collection of U.S. phone records. “I don't believe it granted any power to tap phones or any other surveillance without a warrant. That’s a definite stretch,” he says.
  • Chafee says he plans to announce a position on pardoning Snowden in the near future and says he’s also considering his position on marijuana legalization. Most Americans favor legalization, polls show, but few mainstream politicians do. “That’s another issue that will evolve during the campaign,” he says.

  • One issue about which Chafee has firmly made up his mind is the 2003 U.S. invasion of Iraq. He voted against the invasion in 2002, while Clinton voted in favor – a move she later described as a mistake. Her vote helped Barack Obama rally progressives to his side and against Clinton in 2008, and Chafee says it still should make her an unacceptable pick. “It’s not a dead issue because we live with the effects of that vote today," he says. "The turmoil in the Middle East and North Africa is all because of that mistake we made in authorizing President Bush in 2002 to invade Iraq. Even though it was a long time ago, we live with the damage today.”

Ted Cruz's National Security Plan Features War Crimes | ThinkProgress - 0 views

  • In Thursday night’s GOP debate, the final matchup before the Iowa caucus, Sen. Ted Cruz (R-TX) repeated his promise to conduct “carpet bombing” in the Middle East to combat ISIS forces. Yet he did not acknowledge that carpet bombing is a war crime under the international Geneva Conventions. The Fox News moderators challenged Cruz on his voting record not lining up with his “tough talk” on national security. “You opposed giving President Obama authority to enforce his red line in Syria,” they asked. “You have voted against the Defense Authorization Act for three years. How do you square your rhetoric with your record, sir?” Instead of addressing the discrepancies in his voting record, Cruz defended his past promises of “carpet bombing” and “saturation bombing” parts of Iraq and Syria, saying it was a successful strategy for the United States during the Persian Gulf War.
  • The Geneva Conventions, which the U.S. joined decades ago along with nearly every other country in the world, explicitly forbids carpet bombing. “Area bombardments and other indiscriminate attacks are forbidden,” the agreement reads. “An indiscriminate attack affecting the civilian population or civilian objects and resulting in excessive loss of life, injury to civilians or damage to civilian objects is a grave breach of the Geneva Conventions.” When Cruz said Thursday that the U.S. should “lift the rules of engagement” in wartime, he did not explain whether that included rejecting the Geneva Conventions. Cruz is also incorrect to cite the Gulf War as a positive example of carpet bombing. The U.S. used laser-guided precision bombing during that conflict, which “substantially reduced the accidental damage that would otherwise have befallen civilian buildings.” Even so, thousands of innocent civilians were killed. Cruz, who is poised to win or take second place in the Iowa caucus, has previously offered incorrect information about carpet bombing.
  • Cruz is also not the first GOP candidate to advocate for a practice that violates international law. In December, Republican frontrunner Donald Trump called for the ability to assassinate the family members of terrorists. Such intentional killing of civilians would consitute a war crime.

  • Russian military intervention in Syria has turned the course of that country’s civil war against U.S.-backed rebel groups, increasing the likelihood that Syrian President Bashar al-Assad and his loyalists will remain in power, U.S. intelligence officials testified Tuesday. The assessment amounts to an acknowledgment by U.S. spy agencies that Russian airstrikes have derailed the Obama administration’s aims of pushing Assad aside as part of a political settlement to the nearly five-year old conflict. “The Russian reinforcement has changed the calculus completely,” Lt. Gen. Vincent R. Stewart, head of the Defense Intelligence Agency, said in Senate testimony. Assad is “in a much stronger negotiating position than he was just six months ago,” Stewart said. “I’m more inclined to believe that he is a player on the stage longer term than he was six months to a year ago.” As recently as last summer, U.S. intelligence officials were openly talking about an “endgame” for the Syrian leader, who is also supported by Iran.
  • Stewart’s remarks came during a pair of Senate hearings on Tuesday that served as a grim survey of the security problems — including cyberattacks, terror threats and failing states — that seem certain to confront the next occupant of the White House. Among those testifying were Director of National Intelligence James R. Clapper Jr., FBI Director James B. Comey and CIA Director John Brennan, who was making his first public appearance before the Senate Intelligence Committee since the panel issued a scathing 2014 report on the agency’s use of brutal interrogation methods on terrorism suspects. The lingering tensions behind that Senate probe erupted during a heated exchange Tuesday between Brennan and Sen. Ron Wyden (D-Ore.), who demanded an admission from the CIA chief that his staff had improperly accessed files of Senate investigators combing through agency records. As Wyden made his case, Brennan bristled, saying, “This is the annual threat assessment, is it not.”
  • Brennan seemed to be chiding Wyden for raising the computer intrusion issue during a hearing that is annually devoted to examining security threats. But the confrontation only continued, with both men raising their voices. Ultimately, Brennan admitted “very limited inappropriate actions” by CIA staff but accused Senate investigators of comparable transgressions and came close to shouting at Wyden: “Do not say that we spied on Senate computers or your files! Do not say that!”

Bulk Collection Under Section 215 Has Ended… What's Next? | Just Security - 0 views

  • The first (and thus far only) roll-back of post-9/11 surveillance authorities was implemented over the weekend: The National Security Agency shuttered its program for collecting and holding the metadata of Americans’ phone calls under Section 215 of the Patriot Act. While bulk collection under Section 215 has ended, the government can obtain access to this information under the procedures specified in the USA Freedom Act. Indeed, some experts have argued that the Agency likely has access to more metadata because its earlier dragnet didn’t cover cell phones or Internet calling. In addition, the metadata of calls made by an individual in the United States to someone overseas and vice versa can still be collected in bulk — this takes place abroad under Executive Order 12333. No doubt the NSA wishes that this was the end of the surveillance reform story and the Paris attacks initially gave them an opening. John Brennan, the Director of the CIA, implied that the attacks were somehow related to “hand wringing” about spying and Sen. Tom Cotton (R-Ark.) introduced a bill to delay the shut down of the 215 program. Opponents of encryption were quick to say: “I told you so.”
  • But the facts that have emerged thus far tell a different story. It appears that much of the planning took place IRL (that’s “in real life” for those of you who don’t have teenagers). The attackers, several of whom were on law enforcement’s radar, communicated openly over the Internet. If France ever has a 9/11 Commission-type inquiry, it could well conclude that the Paris attacks were a failure of the intelligence agencies rather than a failure of intelligence authorities. Despite the passage of the USA Freedom Act, US surveillance authorities have remained largely intact. Section 702 of the FISA Amendments Act — which is the basis of programs like PRISM and the NSA’s Upstream collection of information from Internet cables — sunsets in the summer of 2017. While it’s difficult to predict the political environment that far out, meaningful reform of Section 702 faces significant obstacles. Unlike the Section 215 program, which was clearly aimed at Americans, Section 702 is supposedly targeted at foreigners and only picks up information about Americans “incidentally.” The NSA has refused to provide an estimate of how many Americans’ information it collects under Section 702, despite repeated requests from lawmakers and most recently a large cohort of advocates. The Section 215 program was held illegal by two federal courts (here and here), but civil attempts to challenge Section 702 have run into standing barriers. Finally, while two review panels concluded that the Section 215 program provided little counterterrorism benefit (here and here), they found that the Section 702 program had been useful.
  • There is, nonetheless, some pressure to narrow the reach of Section 702. The recent decision by the European Court of Justice in the safe harbor case suggests that data flows between Europe and the US may be restricted unless the PRISM program is modified to protect the information of Europeans (see here, here, and here for discussion of the decision and reform options). Pressure from Internet companies whose business is suffering — estimates run to the tune of $35 to 180 billion — as a result of disclosures about NSA spying may also nudge lawmakers towards reform. One of the courts currently considering criminal cases which rely on evidence derived from Section 702 surveillance may hold the program unconstitutional either on the basis of the Fourth Amendment or Article III for the reasons set out in this Brennan Center report. A federal district court in Colorado recently rejected such a challenge, although as explained in Steve’s post, the decision did not seriously explore the issues. Further litigation in the European courts too could have an impact on the debate.

  • The US intelligence community’s broadest surveillance authorities are enshrined in Executive Order 12333, which primarily covers the interception of electronic communications overseas. The Order authorizes the collection, retention, and dissemination of “foreign intelligence” information, which includes information “relating to the capabilities, intentions or activities of foreign powers, organizations or persons.” In other words, so long as they are operating outside the US, intelligence agencies are authorized to collect information about any foreign person — and, of course, any Americans with whom they communicate. The NSA has conceded that EO 12333 is the basis of most of its surveillance. While public information about these programs is limited, a few highlights give a sense of the breadth of EO 12333 operations: The NSA gathers information about every cell phone call made to, from, and within the Bahamas, Mexico, Kenya, the Philippines, and Afghanistan, and possibly other countries. A joint US-UK program tapped into the cables connecting internal Yahoo and Google networks to gather e-mail address books and contact lists from their customers. Another US-UK collaboration collected images from video chats among Yahoo users and possibly other webcam services. The NSA collects both the content and metadata of hundreds of millions of text messages from around the world. By tapping into the cables that connect global networks, the NSA has created a database of the location of hundreds of millions of mobile phones outside the US.
  • Given its scope, EO 12333 is clearly critical to those seeking serious surveillance reform. The path to reform is, however, less clear. There is no sunset provision that requires action by Congress and creates an opportunity for exposing privacy risks. Even in the unlikely event that Congress was inclined to intervene, it would have to address questions about the extent of its constitutional authority to regulate overseas surveillance. To the best of my knowledge, there is no litigation challenging EO 12333 and the government doesn’t give notice to criminal defendants when it uses evidence derived from surveillance under the order, so the likelihood of a court ruling is slim. The Privacy and Civil Liberties Oversight Board is currently reviewing two programs under EO 12333, but it is anticipated that much of its report will be classified (although it has promised a less detailed unclassified version as well). While the short-term outlook for additional surveillance reform is challenging, from a longer-term perspective, the distinctions that our law makes between Americans and non-Americans and between domestic and foreign collection cannot stand indefinitely. If the Fourth Amendment is to meaningfully protect Americans’ privacy, the courts and Congress must come to grips with this reality.
