Egypt’s Court of Cassation, on Thursday, acquitted ousted ex-president Hosni Mubarak on all charges related to the death of protesters on January 25, 2011.

With its ruling, the Court of Cassation acquitted Hosni Mubarak on all charges related to the death of 239 people, and injuries suffered by another 1,588 across eleven of Egypt’s governorates during the so-called January 25, 2011 revolution. Mubarak had been sentenced to life in prison in 2012 for the killing of protesters before appealing the sentence. In November 2014 Mubarak, in a rare comment to the press, described the charges and especially the so-called “Arab Spring” in 2011 as “weird” and rejected that he was guilty of killing anyone. It is widely known that Egypt, under Mubarak, was plagued by corruption and that its human rights record was alarming. Egypt under the Mubarak regime was among others involved in the United States illegal extraordinary rendition program. That is, Egypt “officially” made “black sites” available for the USA and was involved in torturing rendered captives vicariously for the USA. The more surprising then, that the US administration of Barack Obama and the Secretary of State Hillary Clinton were involved in “stage managing” the so-called Arab Spring in 2011, that led to the overthrow of Mubarak and the January 25 “revolution” being coopted by the Muslim Brotherhood and Mohammed Morsi. It is worth recalling that current Egyptian President Abdel Fatah al-Sisi, in a 2013 interview with Larry Weissman “The people of Egypt are aware of the fact that the USA has stabbed Egypt in the back with the Muslim Brotherhood and Morsi. It is nothing that Egypt will easily forget, or forgive”.

CAIRO: Former President Hosni Mubarak and his former Prime Minister Ahmed Nazif will be investigated for serving as a proxy to torture U.S. prisoners, Youm7 reported Wednesday. Attorney General Hisham Barakat referred the case, filed by lawyer Samir Sabry, to the Supreme State Security prosecution. Sabry noted in his litigation that Egypt was cited in the December Senate CIA report as having tortured detainees in extraordinary rendition under the Mubarak regime. In his 2007 book The Guantanamo Files, British investigative journalist Andy Worthington wrote that a Libyan was rendered in 2003 to Egypt where he was tortured to make “a false confession that two al-Qaeda operatives had been receiving information from Saddam Hussein about the use of chemical and biological weapons, which was subsequently used to justify the invasion of Iraq in March 2003.”

In 2009, a former Pakistani Guantanamo detainee detailed his torture in Egypt after the CIA sent him to Cairo. Muhammad Saad Iqbal was arrested in Jakarta in 2002 over supporting an Islamic group, but he was transported days after being arrested to Egypt where he were beaten, shackled, received electroshocks and was sleep-deprived for six months, the New York Times reported in 2009. Iqbal, who was released in 2008, confessed under torture that he had met with Osama bin Laden. Mubarak, who is still jailed, was acquitted of graft, and charges of murdering January 25 Revolution protesters were dropped in November. His appeal over a three-year sentence for embezzling funds was accepted earlier in January. His two sons, Gamal and Alaa, walked free late January pending an embezzlement lawsuit, after serving the maximum remand period of two years.

Al Jazeera English has once again removed an article by Columbia University professor Joseph Massad hours after publishing it. The article, “The Dahlan Factor,” appeared for several hours on the Qatar-based broadcaster’s website this morning at this link, but was later removed without explanation (the full article is republished below). The article had been extremely popular, appearing in the fifth spot on the website’s “What’s Hot” section.

The recent resurrection of Mohammad Dahlanby several Arab governments, Israel and the US is a most important development for the future of the Palestinian cause, Palestinian Authority (PA)-Israel negotiations, and Hamas-ruled Gaza. Dahlan is viewed, by many Palestinians, as the most corrupt official in the history of the Palestinian national movement (and there are many contenders for that title). Dahlan, it would be recalled, was the PA man in charge of Gaza after the Oslo Accords were signed, where he commanded 20,000 Palestinian security personnel who were answerable to the CIA and to Israeli intelligence. His forces would torture Hamas members in PA dungeons throughout the 1990s. His corruption, at the time, was such that he allegedly diverted over 40 percent of taxes levied against the Palestinians to his personal account in what became known as the Karni Crossing Scandal in 1997. Dahlan, who has been accused repeatedly by both Hamas and Fatah of being an agent of US, Israeli, Egyptian, and Jordanian intelligence, would attempt to stage a US-organised coup against the democratically elected Hamas government in 2007 in Gaza, an attempt that backfired on him and ended with his eviction from the Strip (I had forewarned about the coup several months before it occurred).

There are several brief points worth noting about all of this: (1) For those who ask “what should be done?,” has the hideous aftermath of the NATO intervention in Libya – hailed as a grand success for “humanitarian interventions” – not taught the crucial lessons that (a) bombing for ostensibly “humanitarian” ends virtually never fulfills the claimed goals but rather almost always makes the situation worse; (b) the U.S. military is not designed, and is not deployed, for “humanitarian” purposes?; and (c) the U.S. military is not always capable of “doing something” positive about every humanitarian crisis even if that were really the goal of U.S. officials? The suffering in Iraq is real, as is the brutality of ISIS, and the desire to fix it is understandable. There may be some ideal world in which a superpower is both able and eager to bomb for humanitarian purposes. But that is not this world. Just note how completely the welfare of Libya was ignored by most intervention advocates the minute the fun, glorious, exciting part – “We came, we saw, he died,” chuckled Hillary Clinton – was over.

(2) It is simply mystifying how anyone can look at U.S. actions in the Middle East and still believe that the goal of its military deployments is humanitarianism. The U.S. government does not oppose tyranny and violent oppression in the Middle East. To the contrary, it is and long has been American policy to do everything possible to subjugate the populations of that region with brutal force – as conclusively demonstrated by stalwart U.S. support for the region’s worst oppressors. Or, as Hillary Clinton so memorably put it in 2009: “I really consider President and Mrs. Mubarak to be friends of my family.” How can anyone believe that a government whose overt, explicit policy is “regime continuity” for Saudi Arabia, and who continues to lend all sorts of support to the military dictators of Egypt, is simultaneously driven by humanitarian missions in the region? (3) “Humanitarianism” is the pretty packaging in which all wars – even the most blatantly aggressive ones – are wrapped, but it is almost never the actual purpose. There are often numerous steps the U.S. could take to advance actually humanitarian goals, but those take persistence and resources, and entail little means of control, and are thus usually ignored in favor of blowing things and people up with Freedom Bombs.

(4) Note how even the pretenses of constitutional democracy are now dispensed with: there is a reasonable legal debate over legality, but in essence: the President has the power to order bombing of Iraq because he decides it should happen. (5) Perhaps having Israel and the U.S. simultaneously bombing Arabs in different countries – yet again – will create some extremely negative consequences?

Britel survived what the US calls rendition, an extrajudicial process of transferring a detainee for “interrogation” in a foreign country. Allies of the US beat Britel with a cricket bat, shoved a bottle into his anus, denied him access to lawyers and Italian diplomats and unceremoniously released him in 2011, as if nothing ever happened. “Rendition is a series of shocking events, one worse than the other,” he said. The latest shock comes from Washington, in the form of a long-delayed Senate intelligence committee report into the CIA’s post-9/11 torture. Britel and nine other rendition survivors want to see their names in it, a measure they consider necessary both for accountability and for their own closure. In an open letter to Barack Obama on Thursday, coordinated by human rights group Reprieve, they urge the report’s thorough and prompt declassification.

Three of the Middle East’s most brutal and hated dictators participated fulsomely in pre- and post-9/11 renditions: Gaddafi, Hosni Mubarak of Egypt and Bashar al-Assad of Syria. Though the CIA cultivated robust relationships with their security services, cemented around counter-terrorism, the US would later abandon Mubarak, aid in Gaddafi’s overthrow and killing, and come within a hair’s breadth last year of attacking Assad. Through those alliances, the US secretly permitted the architecture of rendition to encompass their partners’ enemies. Documents recovered by Human Rights Watch in the aftermath of Gaddafi’s overthrow showed the US capturing and interrogating Gaddafi’s opponents in the Libyan Islamic Fighting Group, whose ties to al-Qaida were nuanced and transactional, and then rendering them to Gaddafi. “Interrogation” entailed, among other things, being sealed inside a small “confinement box,” repeated beatings and waterboarding – all within CIA custody, and all before transference to Gaddafi’s prisons for even more brutal treatment. “At that time, there was an agreement between Gaddafi and the US and UK to return political opponents to him,” Belhadj said.

In 2006, an AT&T technician named Mark Klein discovered a secret room inside the company’s windowless “Folsom Street Facility” in downtown San Francisco that was bristling with Narus machines. The now notorious Room 641A was controlled by the NSA, which was using it to collect AT&T customer data for data mining and real-time analysis. Thanks to the powerful NarusInsight system, the NSA was able to monitor 108 billion emails from AT&T customers per day.

Following a lawsuit filed against AT&T by the Electronic Freedom Foundation, Congress passed the FISA Amendments Act in July 2008, giving retroactive immunity to telecom corporations that assisted the NSA, and relieving them of any consequences for spying on Americans. Cass Sunstein, an informal advisor to Barack Obama’s 2008 presidential campaign who now heads the Office of Information and Regulatory Affairs, and who has urged federal law enforcement to “cognitively infiltrate” anti-government groups, was an outspoken supporter of the retroactive immunity bill. With Sunstein by his side, Obama reversed his initial objections to the NSA’s domestic spying operations, voting as a Senator for retroactive immunity. The vote allowed the NSA to expand its domestic spying operations, clearing the legal hurdles obstructing the creation of PRISM. The stage was set for the second term scandal that would leave Obama reeling.

Binney told me that throughout the United States there are currently as many as 20 NSA black sites like Room 641A. Narus devices, he said, have been placed at fiber-optic convergence points, allowing the NSA to retrieve about 80 percent of data carried through telecom and online service providers. Binney emphasized that the devices do not only retrieve so-called metadata, which only offers general records of data, but that they gather the actual content of emails and calls. (“We can reconstruct all of their e-mails along with attachments, see what web pages they clicked on; we can reconstruct their (Voice Over Internet) calls,” said Steve Bannerman, the marketing director of Narus). Thanks to PRISM, the NSA bas been able to “fill in the gaps,” Binney explained, gathering bulk data from communications the NSA might have missed with the NarusInsight system, especially those made between Americans and foreign countries.

The US is strongly pushing the Ukraine EU integration just as it had been behind the 2004 failed “Orange Revolution” to split Ukraine from Russia in a  bid to isolate and weaken Russia. Now Ukrainians have found evidence of direct involvement of the Belgrade US-financed training group, CANVAS behind the carefully-orchestrated Kiev protests. A copy of the pamphlet that was given out to opposition protestors in Kiev has been obtained. It is a word-for-word and picture-for-picture translation of the pamphlet used by US-financed Canvas organizers in the 2011 Cairo Tahrir Square protests that toppled Hosni Mubarak and opened the door to the US-backed Muslim Brotherhood.[1] The photo below is a side-by-side comparison:

Canvas, formerly Otpor, received significant money from the US State Department in 2000 to stage the first successful Color Revolution against Slobodan Milosovic in then-Yugoslavia. Since then they have been transformed into a full-time “revolution consultancy” for the US, posing as a Serbian grass-root group backing “democracy.” [2]

The recent protests in Ukraine have the stench of a foreign-orchestrated attempt to destabilize the government of Viktor Yanukovych after he walked away from signing an EU Association Agreement that would have driven a deep wedge between Russia and Ukraine. Glamor-star boxer-turned political guru, Vitaly Klitschko, has been meeting with the US State Department and is close to Angela Merkel’s CDU political machine in Germany.

This month, the United States District Court for the District of Columbia ruled that the Department of Homeland Security must make its plan to shut off the Internet and cellphone communications available to the American public. You, of course, may now be thinking: What plan?! Though President Barack Obama swiftly disapproved of ousted Egyptian President Hosni Mubarak turning off the Internet in his country (to quell widespread civil disobedience) in 2011, the US government has the authority to do the same sort of thing, under a plan that was devised during the George W. Bush administration. Many details of the government’s controversial “kill switch” authority have been classified, such as the conditions under which it can be implemented and how the switch can be used. But thanks to a Freedom of Information Act lawsuit filed by the Electronic Privacy Information Center (EPIC), DHS has to reveal those details by December 12 — or mount an appeal. (The smart betting is on an appeal, since DHS has fought to release this information so far.) Yet here’s what we do know about the government’s “kill switch” plan:

What are the constitutional problems? Civil liberties advocates argue that kill switches violate the First Amendment and pose a problem because they aren’t subject to rigorous judicial and congressional oversight. “There is no court in the loop at all, at any stage in the SOP 303 process,” according to the Center for Democracy and Technology. ”The executive branch, untethered by the checks and balances of court oversight, clear instruction from Congress, or transparency to the public, is free to act as it will and in secret.” David Jacobs of EPIC says, “Cutting off communications imposes a prior restraint on speech, so the First Amendment imposes the strictest of limitations…We don’t know how DHS thinks [the kill switch] is consistent with the First Amendment.” He adds, “Such a policy, unbounded by clear rules and oversight, just invites abuse.”
