  • The Iraqi popular forces who shot down a US helicopter carrying weapons for the ISIL forces in Al-Baqdadi region released the photos of the shot down chopper through the Internet. A group of Iraqi popular forces known as Al-Hashad Al-Shabi shot down the US Army helicopter that was carrying weapons for the ISIL in the western parts of Al-Baqdadi region in Al-Anbar province on Thursday.
  • Last week, Head of the Iraqi Parliament’s National Security and Defense Committee Hakem al-Zameli announced that the helicopters of the US-led anti-ISIL coalition were dropping weapons and foodstuff for the ISIL terrorists in the Southern parts of Tikrit. He underscored that he had documents and photos showing that the US Apache helicopters airdropped foodstuff and weapons for the ISIL.

The Iraqi lawmaker further noted the cause of such western aids to the terrorist group, and explained that the US prefers a chaotic situation in Anbar Province which is near the cities of Karbala and Baghdad as it does not want the ISIL crisis to come to an end. Earlier today, a senior Iraqi provincial official lashed out at the western countries and their regional allies for supporting Takfiri terrorists in Iraq, revealing that US and Israeli-made weapons have been discovered from the areas purged of ISIL terrorists.

He added that the US and the international coalition are “not serious in fighting against the ISIL organization, because they have the technological power to determine the presence of ISIL gunmen and destroy them in one month”. Gharawi added that “the US is trying to expand the time of the war against the ISIL to get guarantees from the Iraqi government to have its bases in Mosul and Anbar provinces.” Salahuddin security commission also disclosed that “unknown planes threw arms and ammunition to the ISIL gunmen Southeast of Tikrit city”. Also in Late December, a senior Iraqi lawmaker raised doubts about the seriousness of the anti-ISIL coalition led by the US, and said that the terrorist group still received aids dropped by unidentified aircraft.

Field sources in Iraq told al-Manar that the international coalition airplanes dropped aids to the terrorist militants in Balad, an area which lies in Salahuddin province North of Baghdad. In October, a high-ranking Iranian commander also slammed the US for providing aid supplies to ISIL, adding that the US claims that the weapons were mistakenly airdropped to ISIL were untrue.

Video footage later showed that some of the weapons that the US airdropped were taken by ISIL militants. The Iranian commander insisted that the US had the necessary intelligence about ISIL’s deployment in the region and that their claims to have mistakenly airdropped weapons to them are as unlikely as they are untrue.

  • Fighters from the Islamic State of Iraq and the Levant have vowed to march on Baghdad, as Iraq's parliament failed to agree the declaration of a nationwide state of emergency. "We will march toward Baghdad because we have an account to settle there," said the armed group's spokesman on Thursday in an audio recording posted on the internet. The statement could not be independently verified.
  • In a sign of ISIL's confidence, he even boasted that its fighters would take the southern Shia cities of Karbala and Najaf, which hold two of the holiest shrines for Shia Muslims, following the fall of cities in the Sunni north. Its boasts come as Iraq's parliament failed to reach a quorum on Thursday to vote on a nationwide state of emergency. Most of those boycotting parliament were from the country's Sunni and Kurdish factions, who oppose giving extraordinary powers to the Shia prime minister, Nouri al-Maliki.
  • The schism came even after days of advances had left ISIL in control of towns 50km from the capital. On Wednesday, the group seized Tikrit, 140km northwest of Baghdad, as Iraqi soldiers fled.  The day before, it captured Mosul, Iraq's second-largest city. ISIL and its allies among local tribesmen also hold the city of Fallujah and other pockets of the Sunni-dominated Anbar province to the west of Baghdad.

  • The rise of ISIL in Iraq has caused shockwaves across the region, with Syria saying on Wednesday it and Iraq faced a common enemy, Hassan Rouhani, the president of Iran, said on Thursday that the predominantly Shia Muslim country would act to combat the "violence and terrorism" of ISIL. Not every ISIL advance has been successful, however. On Thursday, Iraqi Kurds took control of the disputed Iraqi oil hub of Kirkuk to protect it from ISIL, officials said. "We tightened our control of Kirkuk city and are awaiting orders to move toward the areas that are controlled by ISIL," said Shirko Rauf, a brigadier general in the Kurdish peshmerga force.

The War Party wants the Air Force over Iraq immediately, to be followed quickly by American boots on the ground.  It seems they're upset that ISIL has captured a whole bunch of that high-tech weaponry that the War Party made sure was given to the Iraq government.  Pundits are screaming about a looming global economic crisis if ISIL stops the extraction of oil from northern Iraq. But of course no one is saying anything about the Gulf oil states that are bankrolling ISIL.  Syria and Iran have announced intent to send in their own troops to battle ISIL in Iraq. Russia's Foreign Minister Lavrov had a pithy statement reminding that Russia had warned the U.S. and U.K. that their "adventurism" in Iraq and Afghanistan would turn out badly.  For some reason, the words of Charles de Montesquieu come to mind: "An empire founded by war has to maintain itself by war."

  • On Thursday, the Senate Foreign Relations Committee approved a draft authorization for the use of military force (AUMF) against ISIL (full text) by a margin of 10-8 along party lines. The text also includes an amendment that would sunset the 2001 AUMF in three-years. Most of today’s news headlines will be focused on the authorization to fight ISIL—and we will have plenty of discussion about it at Just Security. But the sunset of the 2001 AUMF is highly significant in its own right – and it should be welcome news to a wide range of national security law experts across the political spectrum, as Jack Goldsmith, Steve Vladeck, and I discussed in an  Op-Ed in the Washington Post. (Indeed, a sunset of the 2001 AUMF is endorsed by the Principles for drafting an ISIL AUMF published at Just Security and a proposed AUMF published at Lawfare.)
  • The action on the 2001 sunset was a bit of a surprise because  Sen. Menendez’s draft ISIL AUMF did not originally include a provision to sunset the 2001 AUMF. Nor did Sen. Tim Kaine’s similar draft AUMF. Both Senators Menendez and Kaine, however, spoke strongly in favor of the amendment today (and I applaud them for that). The action on the 2001 AUMF is significant as a potential turning point in the armed conflict with Al Qaeda. In his National Defense University speech in May 2013, President Obama called for refining and eventually repealing the 2001 AUMF when conditions permit. He stated: “I look forward to engaging Congress and the American people in efforts to refine, and ultimately repeal, the [2001] AUMF’s mandate.” Placing a sunset on the 2001 AUMF has been a key plank in Harold Koh’s position, in testimony and in Just Security posts (here and here), outlining how the President can bring an eventual end to the “Forever War.” Another part of that roadmap includes disengaging from Afghanistan. It is notable that today’s decision on the 2001 sunset also comes on the heels of yesterday’s news of the closure of the detention facility at the Bagram Airfield in Afghanistan. At least these aspects of the armed conflict with Al Qaeda and the Taliban may be winding down or narrowing, albeit while the conflict with ISIL heats up.
  • Increase transparency. Neither Congress nor the American public has a clear idea whom the United States is fighting or where, especially when it comes to forces associated with al-Qaeda. Any new AUMF should require the president to identify the groups against which force is used, along with related details, regularly in a report to Congress and, unless strictly required by national security, the American people. The president should also share with Congress, and the public to the extent possible, the administration’s legal rationales for using force. Such transparency rules should also be imposed on the 2001 AUMF … Congress should also consider imposing these transparency requirements on uses of force against terrorists under the president’s Article II powers. 3) Geographic limits on ISIL AUMF Sen. Rand Paul proposed an amendment to limit the ISIL AUMF so that the authorization to use force does not apply “outside of the geographic boundaries of Iraq and Syria.” He explained that if ISIL moves some of its forces outside of Iraq and Syria, the administration could return to Congress for additional authorities. That amendment was defeated in a separate vote. With a group of seven other national security law experts, I have supported geographic limits on an ISIL AUMF, but not as restrictive as the limits that Sen. Paul proposes. Our set of Principles recommend Congress to authorize force in Iraq and Syria as well as “any other locations from which ISIL forces actively plan and/or launch attacks against the United States or Iraq.” As Sen. Paul noted, a recent study found that 60 percent of congressional force authorizations have contained geographic limitations.

  • Three points deserve special mention: 1) A caveat: “revise” not “repeal” Senators who spoke during the Committee’s meeting in favor of the amendment to sunset the 2001 AUMF did not describe the provision as an opportunity to repeal the AUMF but to “refine,” “reevaluate,” or reconsider it three years from now. 2. A missed opportunity for transparency? The ISIL AUMF includes a robust set of transparency and reporting requirements. This is good news. But, while we are in the business of applying such reporting requirements to the fight with ISIL, what’s the possible justification for not applying them to the fight with Al-Qaeda as well? As Jack Goldsmith, Steve Vladeck and I wrote in our Op-Ed (emphasis added):
  • Although Congress will likely not vote on today’s initiative before the end of the current term, there is no mistaking today’s historically significant moment with respect to both the limit on the 2001 AUMF and the authority to use force against ISIL more broadly. Today’s approval of the draft ISIL AUMF places an important marker for discussions in the 114th Congress.

SAMANTHA POWER, U.S. AMBASSADOR TO THE UNITED NATIONS: Well, let me say that Secretary Kerry just convened a meeting of the Security Council on Friday which showcased just how much support there is on the Security Council and in the broader international community for the anti-ISIL effort. STEPHANOPOULOS: But the Russia veto.

The Iraqis have appealed to the international community to come to their defense not only in Iraq, but also to go after safe havens in foreign countries.     Context: U.S. Ambassador to the U.N., Samantha Power, holds the U.N. Security Council's rotating chair this month. Powers'  claims a right for the U.S. to wage war against ISIL in Syria on grounds of the collective security exception to the U.N. Charter's prohibition; that is, that the U.S. has a collective security agreement with the nation of Iraq, that makes it lawful for the U.S. to strike ISIL. True enough as a matter of international law, ignoring the fact that Obama has yet to obtain permission from the U.S. Congress, which the U.S. Constitution requires him to do. But ISIL is not the nation of Syria; hence to attack ISIL in Syria, an additional exception is necessary for both Iraq and the U.S. The only other recognized exception that might seem to do deals with the situation when a nation in which a private organization inflicting harm on another nation  is "unwilling or unable" to protect the second nation (Iraq) from the depradations of the private organization. And that is where Powers' legal analysis dissembles because the U.S. has been actively attempting to overthrow the Syrian government via proxy terrorist organizations including ISIL. So the U.S. lacks clean hands in claiming any lawful right to invade Syria on the theory that the Syrian government is unwilling or unable to put down the ISIL organization. The Syrian government is certainly willing and has been attempting to do so. But its inability to do so thus far is entirely due to the U.S., its Gulf Coast state allies, and its ally Turkey continuing to supply ISIL and other terrorist groups in Syria with weapons, training, and supplies, aimed at overthrowing the Syrian government. The doctrine of unclean hands has limited applicability in international law governing human rights.   • To further justify expanding across the border and into Syria already ongoing US military operations in Iraq, the Western media has begun claiming that ISIS leadership, “fearing” US airstrikes, are fleeing to safety in neighboring Syria. The Wall Street Journal in its article, “Iraqis Say Some Commanders of Insurgency in Iraq Retreat to Syria,” claimed: According to the Iraqis, the commanders went to eastern Syria, where Islamic State has built an operational base amid the chaos of civil war over the past few years.   • Clearly, the answer, left for readers to arrive at on their own, is that these “successful” US airstrikes in Iraq must be carried over into Syria – where mission creep can do the rest, finally dislodging the Syrian government from power after an ongoing proxy war has failed to do so since 2011. After arming and aiding the Kurds in fighting ISIS in Iraq, the US will attempt to make a similar argument regarding the arming of terrorists in Syria and providing them direct US air support to defeat ISIS – and of course – Damascus. It should be remembered that ISIS itself is a creation of the United States, Saudi Arabia, Israel, Qatar, and has been harbored and provided material assistance by NATO-member Turkey for years. Portrayed by various names by the Western media – ISIS, al-Nusra, the “Free Syrian Army” – in reality it is a conglomerate of Western-backed mercenary forces raised as early as 2007 to overthrow the government in Damascus  and confront Iranian influence across the entire region, including in Lebanon and in Iraq.

Then, it's arranged for the commanders of four Iraq Army divisions to depart when only 1,000 or so ISIL troops attacked Mosul. Left without commanders and softened up by massive psychological warfare operations broadcasting how ISIL was beheading Iraqi troops that they caught, and the four divisions of troops fled south, leaving even their heavy weapons behind.   Out of nowhere, a new Islamic menace is manufactured, spanning about a third each of Syria and Iraq. But Barack Obama to the rescue with the combined  propaganda power of the War Party and Israel Lobby, the U.S. bombers and drones are sent in on their humanitarian mission to rescue about 40,000 Yahidzi (sp?) trapped by ISIL (now the Islamic Caliphate) on a mountaintop.   Then the U.S. expands its bombing to win back the Mosul Dam because it's such a threat to the U.S. Embassy in Baghdad if the dam breaks. Terrorized by the U.S. bombing, ISIL commanders are now said by the NYT and Wall St. J. to be retreating into Syria. Voila! Now the U.S. can send bombs and missiles to Syria ostensibly to kill ISIL leadership and troops, but in reality to bomb the heck out of the Syrian government forces. The road to Tehran still runs through Damascus, as a neocon would say.

Baghdad's appeal to Moscow has irked the US, which reportedly told the Iraqi government that it would have to choose between the US and Russia in the fight against ISIL. In a visit to Baghdad last week, US Chief of General Staff Gen. Joseph Dunford told Iraqi officials that possible Russian air operation would make it almost impossible for the US to continue its military campaign.

But when Americans rose as one to demand that we stay out of Syria, Obama hastily erased his "red line" and announced a new policy of not getting involved in "somebody else's civil war." Now, after videos of the beheadings of two U.S. journalists have set the nation on fire, the president, reading the polls, has flipped again. Now Obama wants to lead the West and the Arab world straight into Syria's civil war. Only this time we bomb ISIL, not Assad.

  • Now, with the Islamic State holding hostage 49 Turkish diplomats and their families in Mosul, Ankara is even more reluctant to intervene. Nor is there any indication Turkey will let the United States use its air base at Incirlik to attack ISIS. In Iraq, too, thousands of ground troops will be needed to dig the Islamic State out of the Sunni cities and towns. Where will these soldiers come from? We are told the Iraqi army, Shia militia, Kurds and Sunni tribesmen will join forces to defeat and drive out the Islamic State. But these Shia militia were, not long ago, killing U.S. soldiers. And, like the Iraqi army, they are feared and hated in Sunni villages, which is why many Sunni welcomed ISIL. Because ISIL looked like the best bet to bring down Assad, whom many Sunni loathe as an Arab and Alawite ally of Iran in the heart of the "Shia Crescent" of Tehran, Baghdad, Damascus and Hezbollah. For many Sunni Arabs, the greater fear is of Shia hegemony in the Gulf and a new Persian empire in the Middle East. Among all the nations involved here, the least threatened is the United States. Our intelligence agencies, Obama, says, have discovered no evidence of any planned or imminent attack from ISIL. As the threat is not primarily ours, the urgency to go to war is not ours. And upon the basis of what we heard Wednesday night, either this war has not been thought through by the president, or he is inhibited from telling us the whole truth about what victory will look like and what destroying the Islamic State will require in blood, treasure and years.

  • The "spymaster" of a key moderate Syrian rebel group has accused the CIA of failing to act on reams of detailed intelligence his network has been supplying the US on Isil since 2013 - including GPS coordinates of its leaders and headquarters. The Free Syrian Army’s spy chief insisted proper use of the intelligence his agents provided from within Isil’s ranks, and often at grave risk to their life, could have critically damaged the jihadist group on several occasions. Speaking to Le Monde in Turkey, “M”, as the French newspaper dubbed the man for security reasons, said: “From the moment Daesh (the Arab acronym for Isil) had 20 members to when it had 20,000, we have shown everything to the Americans. When we asked them what they did with this information, they always gave evasive answers, saying it was up to their decision-makers”. The Free Syrian Army, or FSA, was founded by a group of defected Syrian Armed Forces officers and soldiers in July 2011, and received backing from Britain and the US for its moderate line.

  • The ISIL’s funding father is Erdogan’s personal friend The name of the Saudi businessman Yassin al-Qadi has been linked to organizations classified as terrorist internationally. In particular, the foreign press and the Turkish opposition media describe him as “al-Qaeda’s funding father”. After the events of September 11/2001, al-Qadi- along with other figures- has been included in the world’s list of terrorists, and his name was stereotyped as a terrorist man. This made several countries ban him from entering into their territories, Turkey was one of them. Earlier, the Turkish media documented a photo scandal: Erdogan’s meetings with Yassin al-Qadi as well as long meetings with his son Bilal Recep Tayyip Erdogan. The scandal that was leaked by Turkish security elements came in the context of the case of corruption of which the son of the former Turkish Prime Minister has been accused. Based upon this, a large number of elements of the security corps were arrested being accused of plotting a coup against the government.

  • The Turkish newspaper, after publishing Erdogan’s utterances before the Turkish judiciary, revealed that the Turkish police monitored 12 visits made by the Saudi man to Turkey. Seven out of these visits have been made with the help of Erdogan, the period when he was banned from entering Turkey, because his name was added as one of the world wanted terrorists in the list of the American FBI. The newspaper commented saying: “When the Turkish police was looking for al-Qadi, he was holding meetings with the Prime Minister”. Also, it published a photograph that showed separately the aforesaid man, Erdogan, and the Turkish intelligence chief Hakan Fidan, when they were going to a meeting that gathered them. The newspaper noted that Fidan himself met with al-Qadi 5 times when Al-Qadi has been banned from entering the Turkish territory.

"I would like to remind you that not too long ago, Turkish President announced his readiness to resign if it is proven that oil deliveries by Ankara or with the help of the government of Ankara from the terrorist group [are taking place], that ‘if this fact is proven, I’ll leave this chair,’ Erdogan told journalists on the sidelines of the climate summit in Paris.   • Since the U.S.-led NATO invasion of Afghanistan in 2001, the production of opium in the country has increased by 40 times according to Russia’s Federal Drug Control Service, fueling organized crime and widespread death. The head of the FSKN, Viktor Ivanov, explained the staggering trend at a March U.N. conference on drugs in Afghanistan. Opium growth in Afghanistan increased 18 percent from 131, 000 hectares to 154, 000, according to Ivanov’s estimates. “Afghan heroin has killed more than one million people worldwide since the ‘Operation Enduring Freedom’ began and over a trillion dollars has been invested into transnational organized crime from drug sales,” said Ivanov according to Counter Current News.   Prior to the invasion of Afghanistan, opium production was banned by the Taliban, although it still managed to exist. The U.S. and its allies have been accused of encouraging and aiding in the opium production and the ongoing drug trafficking within the region. Ivanov claimed that only around 1 percent of the total opium yield in Afghanistan was destroyed and that the “international community has failed to curb heroin production in Afghanistan since the start of NATO’s operation.”
  • Afghanistan is thought to produce more than 90 percent of the world’s supply of opium, which is then used to make heroin and other dangerous drugs that are shipped in large quantities all over the world. Opium production provides many Afghan communities with an income, in an otherwise impoverished and war-torn country. The opium trade contributed around $US 2.3 billion or around 19 percent of Afghanistan’s GDP in 2009 according to the U.N.

    Since early in the Viet Nam War, the U.S. Central Intelligence Agency has dominated the production and smuggling of opium. After the Viet Nam War, that operation was largely transferred from Southeast Asia's "Golden Triangle" to Afghanistan, with primary shipment initially through Pakistan. That production center was threatened when the Taliban came to power in Afghanistan in 1996, as the Taliban began shutting down the growing of opium poppies in that nation. So it was no surprise that Afghan production of opium skyrocketed after the U.S. invaded Afghanistan. Indeed, there are reasonable grounds for suspecting that al-Qaeda was blamed for the 9-11 attack precisely to justify invasion of Afghanistan to block the Taliban's interference with the CIA's production of opium. Opium, like cocaine production in South America, provides enormous amounts of off-the-books financing for CIA covert activities. For such reasons, there are strong reasons to suspect that ISIL would not be taking over opium production in Afghanistan without the CIA's acquiescence and participation. (For example, ISIL would need to use the CIA's shipment and marketing capabilities in Pakistan to bring their product to market. So I regard ISIL's rise in opium production as further evidence that the CIA and ISIL are joined at the hip, that ISIL is a CIA operation.

    Pelosi calling for Congression to decide whether to authorize airstrikes and military action against ISIL is a bit of a puzzler. Many members of Congress do not want to face that issue before the fall election. Obama has been careful to signal his intent to decide the question himself on grounds that ISIL constitutes an imminent threat to the U.S. But Pelosi's voice is a hard one to ignore for a Democratic president. Recent polls show a bump in public support for foreign wars, but that was to be expected after the War Party's shock and awe propaganda campaign about ISIL. They will probably sink again fairly soon because articles by cooler heads are just beginning to roll.   • TEHRAN (FNA)- Iraqi Special Forces said they have arrested several ISIL's foreign military advisors, including American, Israeli and Arab nationals in an operation in Mosul in the Northern parts of the country.The Iraqi forces said they have retrieved four foreign passports, including those that belonged to American and Israeli nationals and one that belonged to the national of a Persian Gulf Cooperation Council (PGCC) member-state, from ISIL's military advisors. The foreign advisors were arrested in a military operation in Tal Abta desert near Mosul city. Last year, a senior aide to Russian President Vladimir Putin accused Mossad of training ISIL terrorists operating in Iraq and Syria. Alexander Prokhanov said that Mossad is also likely to have transferred some of its spying experiences to the ISIL leadership, adding that Israel’s military advisors could be assisting the Takfiri terrorists. Prokhanov said ISIL is a byproduct of US policies in the Middle East.
