  • The U.S. Supreme Court came out in favor of contractor accountability this week, rejecting attempts by KBR and its former parent company, Halliburton, to dismiss three lawsuits accusing them of harming service members and civilians in Iraq and Afghanistan. (KBR, one of the largest reconstruction and logistics contractors in Iraq and Afghanistan, was part of Halliburton until 2007.) The Supreme Court, which denied the companies’ petitions without comment, left intact lower court rulings allowing these lawsuits to proceed to trial:
  • Metzgar v. KBR Dozens of U.S. military personnel and civilian employees claim they suffered harm as a result of KBR’s waste disposal and water treatment practices on military bases in Iraq and Afghanistan. The case involves KBR’s Logistics Civil Augmentation Program (LOGCAP) III contract. The plaintiffs allege that the company burned large quantities of solid waste in toxin-spewing open-air burn pits and provided contaminated water. Harris v. KBR Cheryl Harris seeks to hold KBR and Halliburton accountable for the death of her son, Staff Sergeant Ryan Maseth, who was electrocuted in 2008 while showering at his base in Iraq. KBR’s responsibility for maintaining the shower facilities was also part of the LOGCAP III contract.
  • McManaway v. KBR American and British soldiers allege KBR knowingly exposed them to the hazardous chemical sodium dichromate while they were posted at the Qarmat Ali water treatment facility in Iraq in 2003. The soldiers were protecting KBR employees who were restoring the facility. This case involves the Restore Iraqi Oil (RIO) contract, which contained a provision requiring the government to indemnify KBR for any property damage, injury, or death occurring on the contract and all related legal expenses. The government is refusing to indemnify KBR for Qarmat Ali litigation, which has already resulted in an $81 million judgment against the company in a case filed in Oregon. Both the indemnification decision and the Oregon judgment are still mired in appeals, despite Congress urging the Pentagon last year to “take control of the litigation process” and hasten its conclusion. “With KBR’s immunity petitions rejected by the Supreme Court in three separate cases, the wait for the veterans’ cases to proceed to trial has finally ended,” attorney Michael Doyle, who represents the plaintiffs in in the Metzgar and McManaway cases, told the Project On Government Oversight. “There can’t be a place in American law for blanket immunity for military contractor misconduct harming our troops and others, and we look forward to the next trial soon.”

  • The plaintiffs are suing the contractors because the government is generally immune from personal injury lawsuits. Contingency operation contractors like KBR and Halliburton argue they are also immune because they function essentially as an extension of the military. Ever since the first bombs fell on Afghanistan more than 13 years ago, contractor civil and criminal liability in war zones has been a hotly debated and litigated issue. However, recent decisions by the Supreme Court and the federal circuit courts give us hope that this area of law is becoming more settled and contractor accountability cases will have an easier time getting to trial.

    There's an error in the article where it states that "the government is generally immune from personal injury lawsuits." In fact the federal government generally can be sued for personal injury under the Federal Tort Claims Act, but there is an exception created by the Supreme Court in Feres v. United States: the federal government has no liabllity for personal injuries to members of the armed forces sustained while on active duty and not on furlough and resulting from the negligence of others in the armed forces. Military contractors are very fond of trying to piggy-back onto the Feres Doctrine but it rarely works. I've read a fair bit about KBR's conduct involved. KBR even had multi-million-dollar incinerators there for waste disposal that the government paid for (and their transport to the war zones) to safely dispose of wastes without endangering soldiers, but never set them up. That is pretty solid evidence that they knew of the hazard from using open burn pits. And it's also pretty strong proof that our military auditors in charge of checking contract compliance gave KBR a pass. Did money change hands between KBR and the auditors?   • Former Fed Chairman Alan Greenspan told CNBC on Friday the U.K. vote to leave the European Union ushers in a period that's even worse than the darkest days of October 1987. Britons voted by 51.9 percent to quit the 28-country union, shocking markets that had priced in a win for the remain camp. "This is the worst period I recall since I've been in public service," Greenspan said on "Squawk on the Street." "There's nothing like it, including the crisis — remember October the 19th, 1987, when the Dow went down by a record amount, 23 percent? That I thought was the bottom of all potential problems. This has a corrosive effect which is not easy to go away."
  • The former Fed chairman said that the root of the "British problem is far more widespread." He said the result of the referendum will "almost surely" lead to the Scottish National Party trying to "resurrect Scottish Independence." Greenspan said the "euro currency is the immediate problem." While the euro and the euro zone were major steps in a movement toward European political integration, "it's failing," he said. "Brexit is not the end of the set of problems, which I always thought were going to start with the euro because the euro is a very serious problem in that the southern part of the euro zone is being funded by the northern part and the European Central Bank," Greenspan said.
  • Even with that in mind, the European Central Bank is limited in what it can do because these fundamental problems like the stagnation of real incomes don't have easy solutions, Greenspan told CNBC. "There's a certain amount that monetary policy can do, but our problem is fundamentally fiscal," he said, adding that this is true in the United States as well as "every major country in Europe." Part of the problem is that the "developed countries are all aging very rapidly," which is leading to a higher ratio of government spending in the form of entitlements, Greenspan said. The 90-year-old Greenspan presided over the Federal Reserve for 19 years, starting with the administration of President Ronald Reagan through that of George W. Bush.

  • While Edward Snowden was trapped in the transit zone of Moscow’s Sheremetyevo Airport last year, U.S. officials were confronting their own dearth of options in the White House Situation Room. For weeks, senior officials from the FBI, the CIA, the State Department and other agencies assembled nearly every day in a desperate search for a way to apprehend the former intelligence contractor who had exposed the inner workings of American espionage then fled to Hong Kong before ending up in Moscow.
  • “The best play for us is him landing in a third country,” Monaco said, according to an official who met with her at the White House. The official, who like other current and former officials interviewed for this article discussed internal deliberations on the condition of anonymity, added, “We were hoping he was going to be stupid enough to get on some kind of airplane, and then have an ally say: ‘You’re in our airspace. Land.’ ” U.S. officials thought they saw such an opening on July 2 when Bolivian President Evo Morales, who expressed support for Snowden, left Moscow aboard his presidential aircraft. The decision to divert that plane ended in embarrassment when it was searched in Vienna and Snowden was not aboard.

Back on December 21, 2009, a Federal Communications Commission (FCC) power-grab, illegally imposed strict, job-killing restrictions on the Internet. The move was no doubt fueled by Tea Party successes, and a growing fear among liberals that conservatives needed to be silenced. That said, the FCC move wasn't widely reported. In fact, many are unsure as to what the new Net Neutrality rules actually mean. What is certain, however, is that in seizing the Internet Obama has also muzzled the greatest mechanism of growth in our history (under the guise of promoting "freedom" for all), and taken one giant step closer to controlling the unfettered access to news and information that we read. The Action:  Without the support of the American people and requiring no votes in Congress, the so-called Net Neutrality rules didn't require any Congressional action. Now with the federal government seizing control, Grassfire Nation is moving quickly to amass at least 150,000 petitions demanding Congress to reverse the Net Neutrality ruling through legislation.

Essentially, the Beijing leadership finally got fed up with trying to manage a possible reset of the China-US strategic relationship, and be treated as an equal. Exceptionalists don’t do equality. So Beijing came up with its own response to the Obama administration’s political/military “pivot to Asia” – originally announced, and that’s quite significant, at the Pentagon. Thus, in late November 2014, during the Central Foreign Affairs Work Conference in Beijing, President Xi Jinping made an earth-shattering announcement; from now on China would stop treating the US – and the EU – as its main strategic priority. The new focus is on the fellow BRICS group of emerging powers, especially Russia; Asian neighbors; and top nations of the Global South, referred to as “major developing powers” (kuoda fazhanzhong de guojia). This is not as much a Chinese pivot to Asia as a Chinese pivot to selected nations in the Global South. And based on a “new type of international relations centered on ‘win-win’ cooperation” – not the bully-or-bomb exceptionalist approach.

    $1 Trillion in Spending Cuts!  Ron Paul has announced his financial and budgetary plan.  The details have yet to be released, but the summary came out today an dimmediately got the full support of ruxh Limbaugh! summary:  He'll propose immediately freezing spending by numerous government agencies at 2006 levels, the last time Republicans had complete control of the federal budget, and drastically reducing spending elsewhere. The EPA would see a 30 percent cut, the Food and Drug Administration would see one of 40 percent and foreign aid would be zeroed out immediately. He'd also take an ax to Pentagon funding for wars. Medicaid, the children's health insurance program, food stamps, family support programs and the children's nutrition program would all be block-granted to the states and removed from the mandatory spending column of the federal budget. Some functions of eliminated departments, such as Pell Grants, would be continued elsewhere in the federal bureaucracy. And in a noticeable nod to seniors during an election year when Social Security's become an issue within the Republican primary, the campaign says that plan "honors our promise to our seniors and veterans, while allowing young workers to opt out." The federal workforce would be reduced by 10 percent, and the president's pay would be cut to $39,336 - a level that the Paul document notes is "approximately equal to the median personal income of the American worker."

  • Since 2006, the US dollar has experienced a one-quarter to one-third drop in value to the Chinese yuan, depending on the choice of base.   Now China is going to let the dollar decline further in value.  China also says it is considering undermining the petrodollar by pricing oil futures on the Shanghai Futures Exchange in yuan. This on top of the growing avoidance of the dollar to settle trade imbalances means that the dollar’s role as reserve currency is coming to an end, which means the termination of the US as financial bully and financial imperialist.  This blow to the dollar in addition to the blows delivered by jobs offshoring and the uncovered bets in the gambling casino created by financial deregulation means that the US economy as we knew it is coming to an end. The US economy is already in shambles, with bond and stock markets propped up by massive and historically unprecedented Fed money printing pouring liquidity into financial asset prices.  This month at the IMF annual conference, former Treasury Secretary Larry Summers said that to achieve full employment in the US economy would require negative real interest rates.  Negative real interest rates could only be achieved by eliminating cash, moving to digital money that can only be kept in banks, and penalizing people for saving. The future is developing precisely as I have been predicting. As the dollar enters its death throes, the lawless Federal Reserve and the Wall Street criminals will increase their shorting of gold in the paper futures market, thereby driving the remnants of the West’s gold into Asian hands.
  • The People’s Bank of China said the country does not benefit any more from increases in its foreign-currency holdings, adding to signs policymakers will rein in dollar purchases that limit the yuan’s appreciation. “It’s no longer in China’s favor to accumulate foreign-exchange reserves,” Yi Gang, a deputy governor at the central bank, said in a speech organized by China Economists 50 Forum at Tsinghua University yesterday. The monetary authority will “basically” end normal intervention in the currency market and broaden the yuan’s daily trading range, Governor Zhou Xiaochuan wrote in an article in a guidebook explaining reforms outlined last week following a Communist Party meeting.

  • Citing the need to preserve evidence related to pending lawsuits, the Obama administration is asking for permission to keep data on billions of U.S. phone calls indefinitely instead of destroying it after five years. In a motion filed Tuesday with the Foreign Intelligence Surveillance Court, the Justice Department says the series of lawsuits over the program — including one filed by Sen. Rand Paul (R-Ky.) — create a duty for the government to hang on to the so-called metadata currently in the National Security Agency’s computer systems. “Based upon the issues raised by Plaintiffs in the … lawsuits and the Government’s potential defenses to those claims, the United States must ensure that all potentially relevant evidence is retained which includes the [business record] metadata obtained in bulk from certain telecommunications service providers pursuant to this Court’s production orders,” Justice Department lawyers write in a motion (posted here).
  • The motion was released Wednesday on the court’s public web page. There was no immediate indication of a ruling from the surveillance court. The NSA’s call metadata program is aimed at detecting terrorist plots affecting the U.S., but evidence of the effort’s success is murky. President Barack Obama has proposed ending the NSA’s collection of the data. Officials are considering storing it with the telephone companies themselves, creating a new entity to hold it, or reconstructing the program in some other way. The Wall Street Journal reported last week that U.S. officials were considering making the request submitted on Tuesday.

  • The United States has called for an effective no-fly zone over Syria after a spate of airstrikes on humanitarian convoys by Russian and Syrian aircraft left the country’s future “hanging by a thread.” John Kerry, the US Secretary of State told a session of the United Nations Security Council on Wednesday that only a grounding of all aircraft could protect civilians from Bashar al-Assad’s regime and said Vladimir Putin must face a “moment of truth” over the bombing of a UN aid convoy on Monday. “The future of Syria is hanging by a thread,” Mr Kerry said. “We cannot go back to business as usual.” Halting flight would offer a “chance for humanitarian assistance to flow unimpeded," he added.

  • Russia dispatched an aircraft carrier to reinforce its flotilla off the Syrian coast on Wednesday, in a deepening of its military commitment there.    The Admiral Kuznetsov, Russia’s only carrier and the flagship of the Russian navy, will join an existing flotilla of six war ships and  four support vessels, Sergei Shoigu, the Russian defence minister, said.   The Soviet- built vessel carries MiG-29 jets and Ka-52 attack helicopters that are expected to take part in combat operations over Syria.

  • Through the 1033 program, the federal government has geared America's local police departments with military-grade equipment — ranging from airplanes to bayonets — worth hundreds of millions of dollars. NPR combed through the transaction data for the program to find out where the equipment went and what kind of gear was involved. Since 2006, the Pentagon distributed more than 79,000 assault rifles, 205 grenade launchers, nearly 12,000 bayonets, nearly 4,000 combat knives, 50 airplanes, 479 bomb detonator robots, and much more to America's local cops.   • It's not immediately clear why some of these places would need so much military-grade equipment. With the notable exception of Starr County, Texas, the counties and states on the list have modest crime rates, and they aren't hotbeds for drug or terrorist activity — the two main targets of the federal government's police militarization schemes.* The proliferation of such weapons could soon come to an end. Following outcry against police militarization during the August protests in Ferguson, Missouri, the Obama administration ordered a review that will consider whether local police should have the equipment, whether they need to receive more training if they obtain the gear, and how the federal government can better oversee the equipment's use. The Pentagon said it could even take back some of the equipment if it's deemed necessary.
  • The federal government has been arming local police departments with military-grade equipment for decades through multiple federal schemes, particularly the 1033 program. The 1033 program transfers surplus military-grade equipment from the Pentagon to local police. It does not, however, provide training or oversight for the equipment's use. The program is also loaded with what many experts view as a perverse incentive: to keep the equipment, local police must use it within a year. This incentive, some experts argue, might encourage police to use the weapons even when they're not necessary.

  • As the hysteria about Russia’s alleged interference in the U.S. election grows, a key mystery is why U.S. intelligence would rely on “circumstantial evidence” when it has the capability for hard evidence, say U.S. intelligence veterans. Veteran Intelligence Professionals for Sanity MEMORANDUM Allegations of Hacking Election Are Baseless A New York Times report on Monday alluding to “overwhelming circumstantial evidence” leading the CIA to believe that Russian President Vladimir Putin “deployed computer hackers with the goal of tipping the election to Donald J. Trump” is, sadly, evidence-free. This is no surprise, because harder evidence of a technical nature points to an inside leak, not hacking – by Russians or anyone else.
  • We have gone through the various claims about hacking. For us, it is child’s play to dismiss them. The email disclosures in question are the result of a leak, not a hack. Here’s the difference between leaking and hacking: Leak: When someone physically takes data out of an organization and gives it to some other person or organization, as Edward Snowden and Chelsea Manning did. Hack: When someone in a remote location electronically penetrates operating systems, firewalls or any other cyber-protection system and then extracts data. All signs point to leaking, not hacking. If hacking were involved, the National Security Agency would know it – and know both sender and recipient. In short, since leaking requires physically removing data – on a thumb drive, for example – the only way such data can be copied and removed, with no electronic trace of what has left the server, is via a physical storage device.
  • These collection resources are extensive [see attached NSA slides 1, 2, 3, 4, 5]; they include hundreds of trace route programs that trace the path of packets going across the network and tens of thousands of hardware and software implants in switches and servers that manage the network. Any emails being extracted from one server going to another would be, at least in part, recognizable and traceable by all these resources. The bottom line is that the NSA would know where and how any “hacked” emails from the DNC, HRC or any other servers were routed through the network. This process can sometimes require a closer look into the routing to sort out intermediate clients, but in the end sender and recipient can be traced across the network. The various ways in which usually anonymous spokespeople for U.S. intelligence agencies are equivocating – saying things like “our best guess” or “our opinion” or “our estimate” etc. – shows that the emails alleged to have been “hacked” cannot be traced across the network. Given NSA’s extensive trace capability, we conclude that DNC and HRC servers alleged to have been hacked were, in fact, not hacked. The evidence that should be there is absent; otherwise, it would surely be brought forward, since this could be done without any danger to sources and methods. Thus, we conclude that the emails were leaked by an insider – as was the case with Edward Snowden and Chelsea Manning. Such an insider could be anyone in a government department or agency with access to NSA databases, or perhaps someone within the DNC.

  • As for the comments to the media as to what the CIA believes, the reality is that CIA is almost totally dependent on NSA for ground truth in the communications arena. Thus, it remains something of a mystery why the media is being fed strange stories about hacking that have no basis in fact. In sum, given what we know of NSA’s existing capabilities, it beggars belief that NSA would be unable to identify anyone – Russian or not – attempting to interfere in a U.S. election by hacking.   • A recent public opinion poll asked Americans which of two options they would favour if a two-state solution to the Israel-Palestine conflict was no longer on the table. (It is in the rhetoric of leaders and diplomats but not in reality.) The two options were: The continuation of Israel’s Jewish majority [presumably this assumes permanent Israeli occupation of the West Bank and continuing ethnic cleansing of it by stealth] even if it means that Palestinians will not have citizenship and full rights. One democratic state for all in which Jews and Arabs would be equal.   Only 24 per cent supported the continuation of things as they are.
  •  According to the poll,  65 per cent of those asked for their opinion preferred the one-state option. What explains this? Is it that an apparent majority of Americans are at last understanding and supporting the need and rights of the Palestinians for justice, or is it something else – an indication that while they are not much concerned about the rights of the Palestinians, an apparent majority of Americans are fed up with an Israel they rightly perceive to be the obstacle to peace?
  • Whatever the reason for it – empathy with the Palestinian claim for justice or not – a significant shift in American public opinion really does seem to be underway. Staying with Gideon Levy’s analogy, this might explain why President Obama felt free enough to suggest to occupation addict Netanyahu that he and Israel should consider rehab.

  • We do not know whether or not Obama had the balls to say this to Netanyahu face to face, but even if he didn’t, Netanyahu would still have got the message. Akiva Eldar’s interpretation of Obama’s message to Netanyahu via Goldberg was that he, the president, “is sick and tired of fighting on Netanyahu’s behalf vis-a-vis the Europeans and automatically vetoing (in the UN Security Council) their proposals condemning the settlements”.

Bush, called Executive Order 12333.

And why they just decided to give other agencies including law enforcement access to raw search results. And why Gen. Keith Alexander personally put together a program to ruin people's reputations including a "U.S. person." And why Russell Tice said that he personally had Obama's NSA dossier in his hands when Obama was running for the U.S. Senate. And why Tice says NSA had similar dossiers on members of Congress and the justices of the U.S. Supreme Court and targeted "lots of lawyers." On and on.  Ms. Richards appears to have become a quick study in NSA's hallmark skill of lying to the public.
