China stakes claim in Central and Southeast Europe | Business New Europe - 0 views

  • A Chinese agreement to finance a high-speed railway from Belgrade to Bucharest was one of around $10bn worth of investments, mainly in the energy and infrastructure sectors, signed during a China-Central and Eastern Europe summit this week. By funding the railway, Beijing hopes to establish a rapid connection from Greece’s Pireaus Port through the Balkans to the EU member states of Central Europe. Several agreements on the €1.5bn railway, which will be financed by soft loans from state-owned China Exim Bank, were signed between China, Hungary and Serbia on December 17. When the line is operational, the travel time between Belgrade and Budapest will be slashed from the current eight hours to just 2.4 hours. Macedonian counterpart Nikola Gruevski was also in attendance as there are plans to extend the line south to Macedonia and Greece in future. Chinese Prime Minister Li Keqiang, who headed a 200-strong delegation to Belgrade, said he expected the line would benefit both China and the countries of Central and Eastern Europe and the EU, according to a Serbian government statement.
  • Chinese shipping giant Cosco Pacific took over the management rights to half of Piraeus port and is now expanding two container terminals under a 35-year concession agreement, with the aim of turning the Greek port into one of Europe’s top five container ports. However, to take full advantage of Cosco’s investment in Piraeus and its potential to become a gateway to the CEE region, investments into transport links across the Balkans are needed. "We will propose construction of a rapid land and maritime route based on the Budapest-Belgrade railroad and the Greek port of Piraeus to improve regional connectivity," Li told journalists in advance of the summit, South China Morning Post reported. Investments into infrastructure to transport raw materials into China and Chinese manufactured goods to foreign markets is nothing new. Closer to home, Beijing is looking to fund a railway across Central Asia to create a direct rail link between its factories and the massive wholesale bazaars of Kyrgyzstan and Uzbekistan. Further afield, in May 2014, China signed an agreement in Kenya to build a new line from Mombasa to Nairobi that will extend to four other East African states in future.
  • While land rail routes across Eurasia to Europe are also being developed, sea shipping remains the cheapest route from the Far East to Europe, and Piraeus is a convenient entry point to the continent. While growth in the region has been patchy since the recent global economic crisis, in the longer-term the EU member states of Central and Eastern Europe and future entrants from the Balkans are expected to converge with longer-established EU members from Western Europe in terms of spending power. Since 2012, when the first China-CEE summit was held in Warsaw, Chinese attention on the region has steadily increased, with a focus on energy and infrastructure. Aside from the access to new markets, there are further commercial benefits for China, as Chinese companies are selected for lucrative construction contracts on projects funded by Chinese state-owned banks. On December 16, the opening day of the summit, Li told the 16 regional leaders to attend that China would launch a $3bn investment fund for the region.

  • Also on December 16 Albania signed a deal with Exim Bank on funding for the completion of construction works on the Arber motorway that links the capital Tirana with Macedonia. In the energy sector, Serbian and Chinese officials have signed a loan agreement for the second stage of the Kostolac B thermal power project, which includes the construction of a new 350MW plant and the expansion of the adjacent Drmno open-pit coal mine. The value of the project is expected to be $715mn, of which $608mn will come from a 20-year China Exim Bank loan. In neighbouring Bosnia, Eximbank has signed an agreement with the Bosnian Federation government for a €667.8mn credit to fund construction of the 450MW unit 7 at the thermal power plant Tuzla. China's Gezhouba Group is expected to build the unit.
  • The timing of the summit, amid a sharp falling off of Russia’s influence, may also have helped China extend its influence in the region. With some exceptions, notably Serbia, most of the would-be EU member states in Southeast Europe have opted to join EU and US sanctions against Russia over Ukraine. Tit for tat sanctions imposed by Moscow caused trade between Eastern Europe and Russia to drop, a trend that is likely to continue amid the new economic crisis in Russia. Meanwhile, in a further retrenchment from the region, Russian President Vladimir Putin announced on December 1 that Russia will scrap the planned South Stream pipeline that would have supplies numerous states across the region with gas. China, meanwhile, has no political axe to grind in Eastern Europe, but hopes to take advantage of Russia’s weakness to make further inroads commercially. Poland and other countries in the region are, for example, looking to China as a potential market for food products following the Russian embargo. This would add to already booming trade ties. According to Chinese Commerce Minister Gao Hucheng, trade between China and Eastern Europe may top $60bn in 2014 - five times its 2003 level, AFP reported.

  • the EU Parliament's Civil Liberties Committee published the draft of their report on the impact of dragnet surveillance by the NSA on EU citizens (PDF).

    Lengthy but truly amazing resolution now goes to Parliament for a vote. A lot of very tough love for the U.S. in there. Highly recommended reading if you have the time for a lengthy document. It's an action plan for what Parliament intends to do about privacy violations by the NSA, GCHQ, Norway, Sweden, and Germany. If this passes, the U.S. and U.K. will be forced to give major ground. Gist of the document: civil liberties including privacy rights in correspondence trump national security and anti-terrorism. The E.U. would bow out of an Orwellian future.

EU's Juncker Folds To Gazprom On South Stream Pipeline | Zero Hedge - 0 views

  • “European Commission President Jean-Claude Juncker has insisted the $40 billion South Stream natural gas pipeline can still go ahead and accused Russia of holding EU-member Bulgaria to ransom when it said it had abandoned the project.   Speaking after talks with Bulgarian Prime Minister Boiko Borisov, whose country South Stream would traverse making it a major beneficiary, Juncker rebutted Russia’s statement that EU competition rules had killed it. He told reporters issues relating to the pipeline were not insurmountable and he was working with Bulgaria to address them.   Russia said on Monday it had abandoned the pipeline, which would have bypassed Ukraine, Gazprom’s traditional transit route for Russian gas, citing EU competition requirements for a pipeline’s ownership to be divorced from its cargo. It said it was working on an alternative route via Turkey
  • A few remarks to the above: yes, the Bulgarians are understandably up in arms, but had it been up to them, the construction activities would never have been interrupted in the first place. As things stand, the previous Bulgarian government was badgered by the EU and visited by John McCain, whose primary mission was apparently to stop the pipeline from being built. The government announced that all construction on the pipeline would be stopped two hours after McCain left.
  • Juncker says the EU will do whatever it can to improve relations with Russia and it is certainly true that if there are disagreements it always “takes two to tango”. However, let us stop to think for a moment what this means in unambiguous, clear language. From the perspective of the EU (and especially the US) leadership, it means that Russia’s government must accede 100% to every demand they make. We already pointed out that this is an essentially fascist foreign policy. Nothing but complete surrender is acceptable. We don’t think it would be impossible to come to an agreement regarding the Ukraine crisis that everybody could in theory live with (the über-hawks in both the US and Russia excepted – basically the neo-cons in the US and assorted nationalists in Russia. We do have a tad more understanding for the paranoia of former Eastern Bloc countries). By now it should be rather glaringly obvious though that economic sanctions and demonizing the Russian leadership at every opportunity won’t do the trick.

The U.S. Government's Secret Plans to Spy for American Corporations - The Intercept - 0 views

  • Throughout the last year, the U.S. government has repeatedly insisted that it does not engage in economic and industrial espionage, in an effort to distinguish its own spying from China’s infiltrations of Google, Nortel, and other corporate targets. So critical is this denial to the U.S. government that last August, an NSA spokesperson emailed The Washington Post to say (emphasis in original): “The department does ***not*** engage in economic espionage in any domain, including cyber.” After that categorical statement to the Post, the NSA was caught spying on plainly financial targets such as the Brazilian oil giant Petrobras; economic summits; international credit card and banking systems; the EU antitrust commissioner investigating Google, Microsoft, and Intel; and the International Monetary Fund and World Bank. In response, the U.S. modified its denial to acknowledge that it does engage in economic spying, but unlike China, the spying is never done to benefit American corporations.
  • In a graphic describing an “illustrative example,” the report heralds “technology acquisition by all means.” Some of the planning relates to foreign superiority in surveillance technology, but other parts are explicitly concerned with using cyber-espionage to bolster the competitive advantage of U.S. corporations. The report thus envisions a scenario in which companies from India and Russia work together to develop technological innovation, and the U.S. intelligence community then “conducts cyber operations” against “research facilities” in those countries, acquires their proprietary data, and then “assesses whether and how its findings would be useful to U.S. industry” (click on image to enlarge):
  • One of the principal threats raised in the report is a scenario “in which the United States’ technological and innovative edge slips”— in particular, “that the technological capacity of foreign multinational corporations could outstrip that of U.S. corporations.” Such a development, the report says “could put the United States at a growing—and potentially permanent—disadvantage in crucial areas such as energy, nanotechnology, medicine, and information technology.” How could U.S. intelligence agencies solve that problem? The report recommends “a multi-pronged, systematic effort to gather open source and proprietary information through overt means, clandestine penetration (through physical and cyber means), and counterintelligence” (emphasis added). In particular, the DNI’s report envisions “cyber operations” to penetrate “covert centers of innovation” such as R&D facilities.

  • Director of National Intelligence James Clapper, for instance, responded to the Petrobras revelations by claiming: “It is not a secret that the Intelligence Community collects information about economic and financial matters…. What we do not do, as we have said many times, is use our foreign intelligence capabilities to steal the trade secrets of foreign companies on behalf of—or give intelligence we collect to—U.S. companies to enhance their international competitiveness or increase their bottom line.” But a secret 2009 report issued by Clapper’s own office explicitly contemplates doing exactly that. The document, the 2009 Quadrennial Intelligence Community Review—provided by NSA whistleblower Edward Snowden—is a fascinating window into the mindset of America’s spies as they identify future threats to the U.S. and lay out the actions the U.S. intelligence community should take in response. It anticipates a series of potential scenarios the U.S. may face in 2025, from a “China/Russia/India/Iran centered bloc [that] challenges U.S. supremacy” to a world in which “identity-based groups supplant nation-states,” and games out how the U.S. intelligence community should operate in those alternative futures—the idea being to assess “the most challenging issues [the U.S.] could face beyond the standard planning cycle.”

At the time, Attorney General Eric Holder said the spying took place “for no reason other than to advantage state-owned companies and other interests in China,” and “this is a tactic that the U.S. government categorically denounces.” But the following day, The New York Times detailed numerous episodes of American economic spying that seemed quite similar. Harvard Law School professor and former Bush Justice Department official Jack Goldsmith wrote that the accusations in the indictment sound “a lot like the kind of cyber-snooping on firms that the United States does.” But U.S. officials continued to insist that using surveillance capabilities to bestow economic advantage for the benefit of a country’s corporations is wrong, immoral, and illegal.
  • Yet this 2009 report advocates doing exactly that in the event that ”that the technological capacity of foreign multinational corporations outstrip[s] that of U.S. corporations.” Using covert cyber operations to pilfer “proprietary information” and then determining how it ”would be useful to U.S. industry” is precisely what the U.S. government has been vehemently insisting it does not do, even though for years it has officially prepared to do precisely that.

Europe Votes To Impose Visas On Americans | Zero Hedge - 0 views

  • Donald Trump may soon find himself on the receiving end of a "visa war" that could have dire consequences for trans-Atlantic travel and European tourism. On Thuesday, EU lawmakers voted to force Americans to apply for visas when traveling to Europe in response to Washington refusing to allow all Europeans to travel to the States visa-free.
  • he vote by show of hands was the latest in an ongoing “visa war” between Brussels and Washington DC, which now looks set to come to a head after MEPs today agreed that US nationals crossing the Atlantic should require additional travel documents as long as citizens from five EU countries (Bulgaria, Croatia, Cyprus, Poland and Romania) are kept from entering America without a visa. A European Parliament source told Telegraph Travel this was a “serious negative step in the EU-USA visa war”. Following today's vote, the EU Commission now has two months to reintroduce visas for Americans wishing to travel to Europe, after MEPs agreed the EU is now “legally obliged” to suspend the Visa Waiver Programme (VWP) with the US for a year after the US administration failed to meet a deadline to respond something called visa reciprocity. Parliament and the European Council will have the chance to object to anything put forward by the Commission according to the Telegraph. The resolution passed despite warnings from the European Travel Commission (ETC) of the damage a visa war with the US might have on the continent’s tourism industry.
  • As we reported at the time, it was in April 2014 that the European Commission was first made aware that the US - along with Australia, Brunei, Canada and Japan - was failing to ensure the same visa waiver rights for its citizens that Europe offered in return. The Commission then gave the countries a deadline of two years before retaliating. Since, Australia, Brunei and Japan have all lifted their visa requirements, with Canada set to do the same by the end of the year, but the US has failed to act. There has not yet been a response to today’s vote from the US but the State Department’s Bureau of Consular Affairs has said in the past that Bulgaria, Croatia, Cyprus, Poland and Romania do not yet meet security requirements for the US VWP. Canada also imposes visa requirements on Bulgarian and Romanian citizens, but it has announced that they will be lifted in December. Since the imposition of a visa regime is perceived as a major hurdle to free travel, the implementation of the MEP vote would likely lead to a dramatic drop in airline travel across the US and Europe, coupled with a plunge in tourism and associated reveue. As a country looking to boost its tourism industry will often look at loosening any existing visa requirements, the opposite may suggest that the European decision may have political overtones and be in response to Trump's aggressive anti-immigration regime.

EU to Label Products Made in Illegal Settlements - International Middle East Media Center - 0 views

  • The European Union (EU) will soon begin to mark the products of Israeli settlements, according to the Associated Press.
  • According to Al Ray, the EU had frozen its decision to put marks on settlements products under the pressure of the United States, in 2013, but this move was restored again and approved by 13 European countries. The report added that 16 foreign ministers of EU demanded in less than two months, to go forward with procedures to mark settlement products in European marketing networks. The foreign ministers assured that the continued expansion of illegal settlements in the occupied Palestinian territories, and in other areas occupied by "Israel" in 1967, threatens the chances of reaching a final and fair peace deal. European diplomats said that "after the Israeli elections, and in the light of Prime Minister Benjamin Netanyahu's latest statements against two-state solution, it was decided to renew the initiative of marking the Israeli products ." The Belgian Foreign Minister, Dedea Rendr, is the initiator of the draft letter, according to the diplomats.

Blowback Begins: EU To Ditch Dollar In Payments For Iranian Oil | Zero Hedge - 0 views

  • The dollar’s collapse is nearing.  The European Union is planning to switch it’s payments to the Euro for its oil purchases from Iran, eliminating United States dollar transactions.
  • it is highly likely that the US dollar will collapse as nations distance themselves from the United States’ often disastrous foreign policies.  As RTreported, dozens of contracts signed between European businesses and the Islamic Republic could be at risk of cancellation if Brussels obeys Washington’s sanctions. This would damage Iran’s economy and European firms would lose a huge market in the Middle East. Switching to alternative settlement currencies allows both sides to continue trading despite US sanctions and will damage the dollar in the process.  Earlier this week, EU foreign policy chief Federica Mogherini said that the foreign ministers of the UK, France, Germany, and Iran had agreed to work out practical solutions in response to Washington’s move in the next few weeks. The bloc is reportedly planning to maintain and deepen economic ties with Iran, including in the area of oil and gas supplies.

  • Just one more nail to the US dollar’s coffin.  Its collapse is all but imminent at this point. The EU has successfully found a way to scoff at potential future sanctions on Iran by openly defying the US; and as an “added bonus,” they’ve helped seal the dollar’s fate.  According to RT, a diplomatic source with the EU has told a news outlet of the decision.   “I’m privy to the information that the EU is going to shift from dollar to euro to pay for crude from Iran,” said the diplomatic source.  Brussels has been at odds with Washington over the US’s decision to withdrawal from the Iran nuclear deal, which was reached during the administration of Barack Obama. President Donald Trump has pledged to re-impose sanctions against the Islamic Republic as soon as he is able to do so. The Trump administration also has had plans to topple the current regime in Iran, according to leaked documents, and it looks like they’ve just given themselves the go-ahead:

Transatlantic Trade and Investment Partnership (TTIP) Negotiations Fall Apart Following... - 0 views

  • Back in January the EU Commission published their response to the consultation on TTIP and it was found that 97% of the 150,000 responses opposed the trade deal. These respondents represented the general public. The biggest petition in the EU’s history was then presented that contained the signatures of 2 million citizens (now nearly 3 million) opposed to TTIP. Both were rejected as were proposals even for a simple hearing of the European Citizens Initiative. Then in April this year, thousands of protestors took to the streets of cities all over Europe as unelected officials of the EU Commission continue to ignore the concerns of its citizens. In June, fellow MEPs from many political parties who are also opposed to TTIP joined Ukip in standing, shouting, booing and clapping to show their dissatisfaction with proceedings. MEPs were due to set out their first formal position on TTIP since negotiations started two years ago and the meeting descended into chaos (video). The meeting was then stopped by the commissioners. Meanwhile David Cameron has persistently attempted to call out those working to derail the deal. Cameron has accused critics of inventing false scare stories whilst urging business chiefs to help make the case to overcome sustained attacks from left-wing opponents and warned Britain would “rue the day if we miss this opportunity” to open up transatlantic markets.

  • Fekl, the Minister of State for Foreign Trade called on the United States to show “reciprocity” in the negotiations. “American members of parliament have access to a much higher number of documents than we do in Europe,” he said. The German people are now taking a stand and now it is being reported in the USA that sentiment is going against the deal – “It is entirely possible that the U.S. could seek to conclude the deal in the next few years only to find that European governments are unwilling to risk the ire of their voters”. Matthias Fekl, explained that, ever since the negotiations began in 2013, “These negotiations have been and are being conducted in a total lack of transparency,” and that France has, as of yet, received “no serious offer from the Americans.” The reasons for this stunning public rejection had probably already been accurately listed more than a year ago. Jean Arthuis, a member of the European Parliament, and formerly France’s Minister of Economy and Finance, headlined in Le Figaro, on 10 April 2014, “7 good reasons to oppose the transatlantic treaty”. There is no indication that the situation has changed since then, as regards the basic demands that President Obama is making. Arthuis said at that time, that he was opposed to;

  • Cameron, who (increasingly) seldom listens to the general public or elected members of parliament representing the electorate will no doubt use all his powers to get this deal though to redeem himself after being called incompetent by his own military generals and by the Obama administration over Syria. In sharp comparison, both Paris and Berlin want the Investor State Dispute Settlement mechanism (ISDS) of TTIP removed from the transatlantic trade treaty currently being negotiated with Washington. This is a game changer. Matthias Fekl, the French Secretary of State for Foreign Trade, told EurActiv France that he would “never allow private tribunals in the pay of multinational companies to dictate the policies of sovereign states, particularly in certain domains like health and the environment”. That was back in January. Nine months later and France has now reinforced that message and gone one big step forward. In an interview with Sud-Ouest, Matthias Fekl threatened to “call a complete halt” to the TTIP negotiations if things do not change. EurActiv France reports. America has shown no desire to change any of the major issues that have been challenged. Fekl told the French newspaper that he believes the “total lack of transparency” in the Transatlantic Trade and Investment Partnership (TTIP) negotiations poses a “democratic problem”.

EU spy chief rules out Russian military presence in Ukraine - RT News - 0 views

  • There is no large Russian military presence in East Ukraine, head of EU intelligence, Commodore Georgij Alafuzoff, has said. The spy chief has dismissed multiple accusations from the West alleging Russian involvement in the unrest in the region. In an interview with Finnish national news broadcaster, Yle, Alafuzoff said the Russian military had nothing to do with the seizing of government buildings in eastern Ukraine. “In my opinion, it’s mostly people who live in the region who are not satisfied with the current state of affairs,” said Alafuzoff, referring to the situation in East Ukraine. He went on to say that the people are worried for the welfare of those who speak Russian as their first language in the region. Alafuzoff echoed the words of the Russian government which has categorically denied interfering in the ongoing unrest. Russian Foreign Minister Sergey Lavrov said in a press conference on Monday that Moscow is not interested in destabilizing Ukraine and wants the country to remain united. Anti-Kiev activists in the southeast of Ukraine have seized local government buildings as a mark of protest against the coup-appointed Ukrainian government. In response to the unrest, Ukraine’s interim President Aleksandr Turchinov announced the beginning of an “anti-terrorist” operation in eastern Ukraine.
  • On Tuesday, military hardware and troops began to mass on the outskirts of the eastern city of Slavyansk. Sightings of groups of military vehicles have been reported in the neighboring Kharkov and Lugansk regions, where pro-Russian and anti-Kiev sentiment is high. Moscow has condemned Kiev’s operation as “anti-constitutional” and “criminal” and indicative of the government’s unwillingness to open dialogue with the regions. “We are deeply concerned over the military operation launched by the Ukrainian Special Forces with support by the army. There have already been victims,” the Russian Foreign Ministry said in a statement on Tuesday. Anti-Kiev sentiment is, meanwhile, spreading across Ukraine. On Wednesday the anti-Maidan movement in the city of Odessa called for a day of protests and declared the creation of a “people’s republic” in the region.

    This report is in stark contrast to the barrage of propaganda coming out of Washington, D.C. and NATO HQ claiming that Russian forces are massed on the Ukraine border for invasion, propaganda Moscow has denied. Russia has also said that 22 satellite photos purporting to show Russian troops poised on the Ukraine border were taken last August during routine military training exercises, not in recent days as claimed.  An independent news team that toured the Russian border area reported that it could find no signs of the claimed build-up of Russian troops in the locations identified by NATO. Therefore, there is a strong suspicion that the NATO/White House claims are no more than pro-war propaganda or fear-mongering.

  • EU officials proposed sanctions on Tuesday to starve Russian firms of cash as punishment for Moscow's role in Ukraine, where rebels said they were storming Donetsk airport, potentially their biggest prize since turning the war's tide last week.

Ukrainian forces abandoned the airport at the other rebel stronghold, Luhansk, on Monday.

    On the proposed EU sanctions, from other reports Slovakia and Czechoslovakia are expected to veto them. The major news here is that the turning of the tide in the Ukraine civil war is finally making it into mainstream media, although they continue to include in each article the U.S. propaganda that Russia has invaded, but clearly identified as U.S. "accusations," which hints that MSM is not convinced the U.S. is telling the truth here. The normal journalistic practice is to simply quote a person, add a comma followed by "said," a neutral point of view grammatical construct. "Accuse" is far less neutral, flagging that the reporter is not convinced of the statement's truth.

N.S.A. Spied on Allies, Aid Groups and Businesses - NYTimes.com - 0 views

  • Secret documents reveal more than 1,000 targets of American and British surveillance in recent years, including the office of an Israeli prime minister, heads of international aid organizations, foreign energy companies and a European Union official involved in antitrust battles with American technology businesses.
  • While the names of some political and diplomatic leaders have previously emerged as targets, the newly disclosed intelligence documents provide a much fuller portrait of the spies’ sweeping interests in more than 60 countries. Britain’s Government Communications Headquarters, working closely with the National Security Agency, monitored the communications of senior European Union officials, foreign leaders including African heads of state and sometimes their family members, directors of United Nations and other relief programs, and officials overseeing oil and finance ministries, according to the documents. In addition to Israel, some targets involved close allies like France and Germany, where tensions have already erupted over recent revelations about spying by the N.S.A.
  • Details of the surveillance are described in documents from the N.S.A. and Britain’s eavesdropping agency, known as GCHQ, dating from 2008 to 2011. The target lists appear in a set of GCHQ reports that sometimes identify which agency requested the surveillance, but more often do not. The documents were leaked by the former N.S.A. contractor Edward J. Snowden and shared by The New York Times, The Guardian and Der Spiegel. The reports are spare, technical bulletins produced as the spies, typically working out of British intelligence sites, systematically tapped one international communications link after another, focusing especially on satellite transmissions. The value of each link is gauged, in part, by the number of surveillance targets found to be using it for emails, text messages or phone calls. More than 1,000 targets, which also include people suspected of being terrorists or militants, are in the reports. It is unclear what the eavesdroppers gleaned. The documents include a few fragmentary transcripts of conversations and messages, but otherwise contain only hints that further information was available elsewhere, possibly in a larger database.

  • Ms. Hansen, the spokeswoman for the European Commission, said that it was already engaged in talks with the United States that were “needed to restore trust and confidence in the trans-Atlantic relationship.” She added that “the commission will raise these new allegations with U.S. and U.K. authorities.”
  • Also appearing on the surveillance lists is Joaquín Almunia, vice president of the European Commission, which, among other powers, has oversight of antitrust issues in Europe. The commission has broad authority over local and foreign companies, and it has punished a number of American companies, including Microsoft and Intel, with heavy fines for hampering fair competition. The reports say that spies intercepted Mr. Almunia’s communications in 2008 and 2009. Mr. Almunia, a Spaniard, assumed direct authority over the commission’s antitrust office in 2010. He has been involved in a three-year standoff with Google over how the company runs its search engine. Competitors of the online giant had complained that it was prioritizing its own search results and using content like travel reviews and ratings from other websites without permission. While pushing for a settlement with Google, Mr. Almunia has warned that the company could face large fines if it does not cooperate.
  • Some condemned the surveillance on Friday as unjustified and improper. “This is not the type of behavior that we expect from strategic partners,” Pia Ahrenkilde Hansen, a spokeswoman for the European Commission, said on the latest revelations of American and British spying in Europe. Some of the surveillance relates to issues that are being scrutinized by President Obama and a panel he appointed in Washington that on Wednesday recommended tighter limits on the N.S.A., particularly on spying of foreign leaders, especially allies.
  • “We do not use our foreign intelligence capabilities to steal the trade secrets of foreign companies on behalf of — or give intelligence we collect to — U.S. companies to enhance their international competitiveness or increase their bottom line,” said Vanee Vines, an N.S.A. spokeswoman. But she added that some economic spying was justified by national security needs. “The intelligence community’s efforts to understand economic systems and policies, and monitor anomalous economic activities, are critical to providing policy makers with the information they need to make informed decisions that are in the best interest of our national security,” Ms. Vines said.
  • The surveillance reports show American and British spies’ deep appetite for information. The French companies Total, the oil and gas giant, and Thales, an electronics, logistics and transportation outfit, appear as targets, as do a French ambassador, an “Estonian Skype security team” and the German Embassy in Rwanda.
  • Multiple United Nations Missions in Geneva are listed as targets, including Unicef and the United Nations Institute for Disarmament Research. So is Médecins du Monde, a medical relief organization that goes into war-ravaged areas. Leigh Daynes, an executive director of the organization in Britain, responded to news about the surveillance by saying: “There is absolutely no reason for our operations to be secretly monitored.” More obvious intelligence targets are also listed, though in smaller numbers, including people identified as “Israeli grey arms dealer,” “Taleban ministry of refugee affairs” and “various entities in Beijing.” Some of those included are described as possible members of Al Qaeda, and as suspected extremists or jihadists.
  • While few if any American citizens appear to be named in the documents, they make clear that some of the intercepted communications either began or ended in the United States and that N.S.A. facilities carried out interceptions around the world in collaboration with their British partners. Some of the interceptions appear to have been made at the Sugar Grove, W.Va., listening post run by the N.S.A. and code-named Timberline, and some are explicitly tied to N.S.A. target lists in the reports.
  • Strengthening the likelihood that full transcripts were taken during the intercepts is the case of Mohamed Ibn Chambas, an official of the Economic Community of West African States, known as Ecowas, a regional initiative of 15 countries that promotes economic and industrial activity. Whether intentionally or through some oversight, when Mr. Chambas’s communications were intercepted in August 2009, dozens of his complete text messages were copied into one of the reports.

The Money Trail: How the US Fostered Yemen's Separatist Movement / Sputnik International - 0 views

  • As Saudi Arabia and its allies have begun the bombing campaign against Yemen, in the south, a separatist movement calling for a "State of South Arabia" is emerging. Fostered by the US, it will leave the Houthis with two hostile states at their borders and locked access to the sea, if it succeeds.
  • Welcome to phase two of US regime change operations. After Yemen's 2011 revolution failed and Houthi militias overthrew President Hadi, forces trained and sponsored by the US government are being activated as a separatist movement. The Southern People's Committees (SPC), founded around 2007 although USAID has been conducting political workshops as part of a $695,000 project and actively grooming leadership in Yemen since 2005. (Also in 2007, weekly protests began, organized by women's organizations, fostered by the workshops.) The SPC were similar to many color revolution movements such as Serbia's Otpor in that they did not have a central leadership, but rather an autonomous cell-based organization. In addition, they were very capable in the use of social media technologies, text messaging and the circumventing the government's internet censorship to organize protests.
  • Meanwhile, the Yemen Center for Human Rights Studies, which received $193,000 from the EU and US-funded Foundation for the Future in 2009, conducted a poll in January 2010, which found that 70 percent of southern Yemenis favored secession. Another USAID-funded project, the $43 million Responsive Governance Project (RGP), launched in May 2010, conducted "New Social Media training for Youth leaders to equip Yemeni youth groups in the use of media to enhance their participation in formulating public issues." The project focuses on establishing contacts with the Yemeni government and providing "leadership and civic education training to youth NGOs."

  • At the same time, USAID funded a $3.58 million project called Promoting Youth for Civic Engagement (PYCE) to train Aden youth " in PACA [political activity training], first aid, self-defense, photography, calligraphy and various other topics," including "media skills," according to an evaluation report of the PYCE Project, conducted in 2012. The project was constrained to Aden and did not conduct workshops in the northern capital, Sanaa, after reportedly receiving threats.
  • The project is presented as a youth "sports program," and although it does include basketball, handball and chess, these were not the primary goal, as the report shows. At the same time, first aid, self-defense, photography and calligraphy (making protest signs) sound a lot more like protest tactics than sports. The program, initially planned to last for two years, did not make any progress reports after March 2012, when President Hadi assumed power. After the 2011 revolution, the SPC became more of a military outfit and took part in a fight against al-Qaeda in Yemen, which coincided with the CIA's expanded drone campaign in the area. This is also where the organization fades from public view when it comes to USAID expense reports, as the organization appeared to lose interest in developing democracy in the country. In a June 4, 2012 a field commander of the People's Committees gave an interview to the Yemen Times, in which he described the group's fight against the Ansar al-Sharia Islamists together with the government.
  • However, the group reappeared in public view on September 23 2014, two days after Houthis took control of Sanaa, and issued a statement in which they call on security forces to "undertake its historical role in providing security and maintaining people's property because it is in order to preserve the revolution, which is the most important accomplishment achieved by the Yemeni people." At the same time, in southern Yemen, the People's Committee has been very active on Facebook and Twitter since around October 2014. The Facebook and Twitter pages publish slick anti-Houthi propaganda and call for separatism and a "State of South Arabia," within the bounds of former South Yemen, and using South Yemen's flag
  • Since mid-March, the SPC have been fighting against Houthis and see Saudi Arabia as an ally of convenience, although some of their social media accounts, Saudi Arabia's King Salman and other royal family figures are glorified. However, the splitting of Yemen benefits Saudi Arabia, as it secludes the Houthis to a smaller Northern Yemen, which would be surrounded by two hostile states, with Saudi Arabia to the north and the new South Arabia to the south, which would also control access to the sea at the Gulf of Aden. The current situation has considerable parallels with Ukraine, which has led the Russian Foreign Minister Sergei Lavrov to call the situation one of "obvious double standards, but we clearly did not want neither what is happening in Ukraine, nor what is happening in Yemen."
  • Indeed, while Russia has been repeatedly accused of helping Donbas independence supporters, the US has openly fostered the south Yemen separatist movement. At the same time, while Ukraine's President Yanukovych was called illegitimate by the US after fleeing the country, Yemen's Hadi has remained "legitimate" and has even called for a Saudi Arabian military operation against the people who ousted him. The ongoing conflict in Yemen is currently at the second phase of US regime change operations, rebel conflict. The first stage, the color revolution, has failed, and now the last stop, foreign intervention and ground invasion remains. Saudi Arabia and its Gulf allies have already begun the airstrikes, and the South Arabia movement has begun its separatist campaign.

EU court says Hamas should be removed from terror list | Reuters - 0 views

  • (Reuters) - The Palestinian Islamist group Hamas should be removed from the European Union's terrorist list, an EU court ruled on Wednesday, saying the decision to include it was based on media reports not considered analysis. However, in its ruling, the bloc's second highest tribunal said member states could maintain their freeze on Hamas's assets for three months to give time for further review or for an appeal to be launched.The EU's foreign policy arm said the bloc continued to view Hamas as a terrorist group. "This was a legal ruling of the court based on procedural grounds. We will look into this and decide on appropriate remedial action," spokeswoman Maja Kocijanic said.Israel, which has clashed repeatedly with Europe in recent years over Palestinian statehood ambitions, demanded Hamas remain blacklisted and said the ruling showed "staggering hypocrisy" toward a Jewish state founded after the Holocaust.

  • It’s hard to overestimate the value of planning in advance, especially when it comes to getting reservations in popular restaurants and invading countries by military force. In the week of the May 9th Victory Day two significant failures took place  each one remarkable in its own way. Each event went completely unreported by the Western corporate and government media, but discussed on Social Media.
  • In the following three weeks after the incident with the USS Florida, while Russia was preparing for Victory Day celebrations and all eyes were on Moscow, attention of Ukrainians was fully concentrated on the visit of Victoria Nuland to Kiev on April 26th allegedly to discuss the implementation of the Minsk II Agreement and the future elections in Donetsk and Lugansk republics. Since the day when President Putin said that the republics can have their elections anytime they want, the question of these elections ceased to be a subject of blackmail toward the Kremlin.   It appeared that the true reason for Nuland’s visit could be located to the west of Kiev, rather than the east. Just recently, Robert D. Kaplan, a former Stratfor’s Chief Geopolitical Analyst, and currently a senior fellow at the Center for a New American Security (CNAS) has published a book “In Europe’s Shadow” where he lays out a plan to reunite Romania with “its lost province of Moldova.” Nuland visited Moldova back in January, with the task to coerce Moldova’s government and its oligarchs to change the country’s Constitution provision of neutrality. Before she left, she gave a short speech at the American Embassy in Bucharest after a private dinner with PM Ciolos and President Klaus. “We powerfully support the desire of the people in Moldova to have responsible leaders who can implement reforms. This is the best way to assure the future of Moldova. Romania and the United States, in conjunction with NATO, have support programs in place to assure the security of Moldova but the government has to work to implement these programs.”
  • Moldova is one of the poorest countries in Eastern Europe, and its economy heavily relies on Russia. According to the CIA Fact Book: Moldova’s annual remittances of about $1.12 billion comes from the roughly one million Moldovans working in Europe, Russia, and other former Soviet Bloc countries; Moldova imports almost all of its energy supplies from Russia and Ukraine; Moldova’s dependence on Russian energy is underscored by a more than $5 billion debt to Russian natural gas supplier Gazprom; Moldova signed an Association Agreement and a Deep and Comprehensive Free Trade Agreement with the EU during fall 2014, however its biggest trade partner remains Russia. Everyone understands that a NATO membership will cut all economic ties with Russia, including jobs, and it will turn Moldova into a failed state, or in the CIA doublespeak, the country would stop being vulnerable to “Russian pressure.” Apparently, the failure of Moldova as a state, and its disappearance as a nation is also what the EU wants. On January 6, the new Moldovan Ambassador to Germany was presenting his credentials when, out of the blue, the German president asked the new ambassador what the procedure was for Republic of Moldova to formally unite with Romania. On May 4th, the Katehon reported on Vladimir Plahotniuc’s (the infamous Moldavian oligarch and mafia boss) visit to the US and his meeting with Victoria Nuland there. As the Victory Day celebration was approaching, we all fully anticipated from the US to conduct terror acts, military excursions/drills, and political and legal attacks on Russia as the US and the EU always do to harass Russia during its major national and Church holidays.

  • Starting with April 21st,  we saw a flurry of “news” about Ukraine and Romania joining NATO Black Sea flotilla and the organization of Romanian-Ukrainian-Bulgarian brigade similar to that created by Poland. On April 26, Georgia (Gruzia) pitched in via the Georgia Today: “creation of NATO Black Sea Fleet Gains US Support” and praising Turkey, Bulgaria and Romania for calls to expand the Western military. All what Russia said to all this NATO generated noise was a brief statement of  Russia’s envoy to NATO Alexander Grushko. “NATO should be in a position to know that all necessary steps will be taken from our side to neutralize the emerging threats.” With all these  preparations for the war on Russia going on, NATO also planned military drills in neutral Moldova, chosen to start on May 2nd, the day of remembrance for the victims of the Odessa Massacre. Meanwhile, the patriots of Moldavia who worked together regardless of their political views, discovered something interesting and saved Moldova. NATO reported that for drills they would be entering Moldova in four formations, and that the total of motorized units will be 50+. However, the very first formation that made an attempt to enter the territory of Moldova contained 100+ unites. This was just one formation. And there was expected three more formations.
  • The plan of NATO was to enter the country with too large for this tiny country forces, to stage a bloody false flag attack during the Victory Day celebration in Moldova with the participation of Ukrainian Right Sector terrorists masquerading as “pro-Russia separatists.” This plot worked in Ukraine, so it should work in Moldova, right? That’s the true reason why Nuland was in Kiev two weeks prior. After this false flag attack, a Romanian fleet was planned to enter Ukrainian territorial waters “by invitation of the Ukrainian government” and arrive to Odessa in order to block Russian fleets from interfering and helping Transnistria. But… Coming back to the bizarre incident near Gibraltar, when one NATO member’s tiny 20 tone Costal Guards’ boat was attacked by another NATO member for interfering with the 18,000 tones behemoth of a submarine  of the third NATO member. The NATO plan apparently was to stealthy and quietly position the Ohio-class ballistic guided-missile submarine USS Florida (SSGN 728) in the Mediterranean or even in the Black Sea so it would be able to shoot into Moldova to overwhelm Moldovan minuscule defense forces. We have to remember that it was the USS Florida “that opened up the Libya intervention,” firing more than 90 cruise missiles to destroy Libya’s air defenses and clearing the way for NATO air strikes. “Never before in the history of the United States of America has one ship conducted that much land attack strikes, conventionally, in one short time period,” Rear Adm. Rick Breckenridge had said.
  • However, thanks to Spanish Costal Guards the submarine was discovered and talked about all around the world via social media and the press. The USS Florida had no other options but to retreat and return to home base. In fact, there were TWO incidents on the same April 16th  day involving the USS Florida. First, it was  the Spanish patrol boat belonged to the Servicio de Vigilancia Aduanera, at whom the British Navy opened  fire.  A bit later,  the Guardia Civil vessel Rio Cedeña tried to cut across the submarine’s bow and was photographed  by multiple witnesses.

Pyakin, a political analyst with the Concept Technologies Foundation, a think tank located in St. Petersburg, NATO was in a process of conducting a full-scale invasion of Moldova with the annexation of a Southern part of Ukraine including Odessa to construct a NATO Navy base there. Moldova was supposed to become a part of Romania automatically with the US military forces arriving to the capital and taking  over the government of Moldova. That’s why NATO needed all those military “drills” in the Black Sea region and in the Baltics simultaneously. When the patriotic forces of Moldavia discovered that NATO was about to enter the territory of Moldova in four formations, 100+ motorized units each, they protested loudly and blocked the entrance of NATO troops on the border. Meanwhile, the biggest political fraction in Moldova threatened with the impeachment of the president for treason, if  NATO troops would be allowed to enter the country. Reports from Moldova at the time disclosed that American troops stopped at the border crossing didn’t have proper ID and other papers. Moldovans came to greet them with the banners “Moldova is a neutral country” and “Stop bases of NATO,” “Stop NATO” and “NATO go home.” As the result, on April 28th only about 60 units and 200 servicemen the U.S. Army 2nd Cavalry Regimental Engineer Squadron were allowed to enter the country.
  • When a formation of American military crossed the Romanian-Moldova border allegedly to take part in  Dragon Pioneer 2016 NATO military drills, Moldavian opposition leaders expressed protests. Several members of the Parliament blocked the road.  They reported to Russian and international media and news outlets that the US troops didn’t have an international agreement signed by the defense ministers of Moldova and USA. They also lacked a legal government agreement on the entrance of the heavy military equipment and weaponry to the territory of the country. 60% of American servicemen didn’t have valid military IDs. According to a TASS report,  “To prevent collisions, officers from the Fulger (Lightning) police battalion of special purpose intervened, which were specially delivered from Chisinau. After checking the documents, a column of military vehicles followed the US to the place of temporary location at the site of Negresht,” said the inspectorate.” “The initiative to invite the US troops into the country and hold the exhibition of American technology belongs to the Minister of Defense of Moldova Anatol Șalaru, who is famous for the organization of the “Museum of Soviet occupation” in Chisinau, calls to repeal neutrality and make the country a member of NATO, and the fight against monuments of the Soviet era.” This move was harshly criticized by Igor Dodon, whose party has the largest faction in Parliament and controls a quarter of the seats.
  • He stated: “We believe military exercises involving US troops on Moldovan territory is a flagrant violation of the constitutional principle of neutrality of Moldova. In this regard, the deputies from the Party of socialists have already initiated a number of procedures. They will continue, and this will be one of the reasons for introducing in May the initiative to dismiss the government.” By Victory Day it became apparent that the Nuland-Kogan-NATO plan for invasion of Moldova was foiled. All Americans could do was   to “crush” a Victory Day parade in the center of Moldova’s capital by coming uninvited and bringing their motorized vehicles to it. And that’s where NATO troops and Moldovan patriots came face to face. WHO ARE SYRIA'S WHITE HELMETS (terrorist linked)? - 0 views

  • The White Helmets have been demonstrated to be a primarily US and NATO funded organisation embedded in Al Nusra and ISIS held areas exclusively. This is an alleged “non-governmental” organisation, the definition of an NGO, that thus far has received funding from at least three major NATO governments, including $23 million from the US Government and $29 million (£19.7 million) from the UK Government, $4.5 million (€4 million) from the Dutch Government. In addition, it receives material assistance and training funded and run by a variety of other EU Nations. A request has been put into the EU Secretary General to provide all correspondence relating to the funding and training of the White Helmets. By law this information must be made transparent and available to the public. There has been a concerted campaign by a range of investigative journalists to expose the true roots of these Syria Civil Defence operatives, known as the White Helmets.  The most damning statement, however, did not come from us, but from their funders and backers in the US State Department who attempted to explain the US deportation of the prominent White Helmet leader, Raed Saleh, from Dulles airport on the 18th April 2016.

The New Snowden? NSA Contractor Arrested Over Alleged Theft Of Classified Data - 0 views

  • A contractor working for the National Security Agency (NSA) was arrested by the FBI following his alleged theft of “state secrets.” More specifically, the contractor, Harold Thomas Martin, is charged with stealing highly classified source codes developed to covertly hack the networks of foreign governments, according to several senior law enforcement and intelligence officials. The Justice Department has said that these stolen materials were “critical to national security.” Martin was employed by Booz Allen Hamilton, the company responsible for most of the NSA’s most sensitive cyber-operations. Edward Snowden, the most well-known NSA whistleblower, also worked for Booz Allen Hamilton until he fled to Hong Kong in 2013 where he revealed a trove of documents exposing the massive scope of the NSA dragnet surveillance. That surveillance system was shown to have targeted untold numbers of innocent Americans. According to the New York Times, the theft “raises the embarrassing prospect” that an NSA insider managed to steal highly damaging secret information from the NSA for the second time in three years, not to mention the “Shadow Broker” hack this past August, which made classified NSA hacking tools available to the public.
  • Snowden himself took to Twitter to comment on the arrest. In a tweet, he said the news of Martin’s arrest “is huge” and asked, “Did the FBI secretly arrest the person behind the reports [that the] NSA sat on huge flaws in US products?” It is currently unknown if Martin was connected to those reports as well.
  • It also remains to be seen what Martin’s motivations were in removing classified data from the NSA. Though many suspect that he planned to follow in Snowden’s footsteps, the government will more likely argue that he had planned to commit espionage by selling state secrets to “adversaries.” According to the New York Times article on the arrest, Russia, China, Iran, and North Korea are named as examples of the “adversaries” who would have been targeted by the NSA codes that Martin is accused of stealing. However, Snowden revealed widespread US spying on foreign governments including several US allies such as France and Germany. This suggests that the stolen “source codes” were likely utilized on a much broader scale.

Israeli Banks flipping out over looming European boycott - Mondoweiss - 0 views

  •      The Israeli newspaper Ma’ariv (Hebrew) has a splashing headline today warning that Israeli banks are preparing for a “political-economic tsunami”  due to the possibility of an impending European boycott. Unsurprisingly, the banks – Israel’s largest – have been holding meetings amongst themselves to prepare for this tsunami, albeit “quietly and under the radar”. According to Ma’ariv there is “increasing evidence in recent weeks” that the European Union is considering recommendations published in a policy paper last month by the European Council on Foreign Relations (ECFR). Heavily reported at the time (our coverage here), ECFR’s policy paper warned that transactions between European states and Israeli financial institutions are obligated to adhere to EU policies based on international law when providing loans and financing to Israeli businesses, institutions and individuals in transaction with the illegal Israeli settlements enterprise. An unnamed senior banking official told Ma’ariv, “Beneath the surface this is a mega-event” and if this should happen the economic implications on the banks will have a “massive” impact on the Israeli economy.

The timing of the article is somewhat intriguing given there was no information provided indicating what this “increasing evidence” is. Russia Reveals "Plan B": Gazprom Says Gas Transit Via Ukraine May Be Stopped Completely... - 0 views

  • A few days ago, when we wrote our "explainer" on the need for Russia to have an alternative pathway for its gas, one which bypasses Ukraine entirely and as the current "South Stream" framework is set up, crosses the Black Sea and enters Bulgaria before passing Serbia and Hungary on the way to the Central European energy hub located in Baumgarten, Austria, we said that "one short month after Putin concluded the Holy Grail deal with Beijing, he not only managed to formalize his conquest of Europe's energy needs with yet another pipeline, one which completely bypasses Ukraine (for numerous reasons but mostly one: call it a Plan B), but scored a massive political victory by creating a fissure in the heart of the Eurozone, after Austria openly defied its European peers and sided with Putin."
  • As Itar-Tass reports, citing Gazprom CEO Alexei Miller, "Russia’s gas giant Gazprom does not rule out gas transit via Ukraine may be stopped completely." "What happened once is a tendency, nothing happens incidentally. In 2009, gas supplies were stopped completely — so, we know precedents,” Miller told a briefing on Friday. Clearly, this is bad news for Ukraine: Gazprom not interested in participation in Ukraine’s gas transportation system (GTS), “train has departed”, CEO said. “The train has already departed. It seems it departed yesterday,” Miller said. “It belongs to no one. The GTS has no owner,” he said. “The GTS of Ukraine does not belong to Naftogaz but to the Ukrainian government. Before discussing things with someone regarding modernization and cooperation, it should appear on the balance sheet of this or that economic entity.”   “Property and legal issues should be resolved first,” Miller said. In fact, the civil war torn country may soon lose all leverage it had with both Europe and Russia as a transit hub for natural gas, which also means that it is quite likely that Ukraine is about to be abandoned by its western allies who will no longer have any practical use for it. 
  • The Gazprom chief added that “a dozen Ukrainian laws need to be changed to be able to do something with the GTS.”  Confirming that Ukraine's leverage at least with Russia is now effectively zero, Gazprom's CEO also said that “As for the continuation of negotiations with Ukraine, today there is no subject for talks. First, they must repay their debts." “The gas price for Ukraine is fair - this price is fixed in the contract,” he stressed. There have been no requests on the part of Ukraine’s national oil and gas company Naftogaz Ukrainy on a change of the transit deal with Russia, Alexei Miller said. Miller told journalists that it would be bad news if such requests had been received. At least we now know what the Ukraine endgame will look like: as Russian transit through the country is completely cut off, the nation will lose all strategic importance first to Russia and then to Europe, which is still over-reliant on Russian gas (see map below), but which will increasingly turn its attention to the countries which the South Stream passes through.

    So much for Ukraine's proposal to pump natural gas back to Ukraine from the EU. About 30 percent of the EU's natural gas supply is currently pumped from Russia through the Ukraine. Because of Russia's new alliance a gas contracts with China, the threat to cut off gas to the EU is at least credible.

Microsoft to host data in Germany to evade US spying | Naked Security - 0 views

  • Microsoft's new plan to keep the US government's hands off its customers' data: Germany will be a safe harbor in the digital privacy storm. Microsoft on Wednesday announced that beginning in the second half of 2016, it will give foreign customers the option of keeping data in new European facilities that, at least in theory, should shield customers from US government surveillance. It will cost more, according to the Financial Times, though pricing details weren't forthcoming. Microsoft Cloud - including Azure, Office 365 and Dynamics CRM Online - will be hosted from new datacenters in the German regions of Magdeburg and Frankfurt am Main. Access to data will be controlled by what the company called a German data trustee: T-Systems, a subsidiary of the independent German company Deutsche Telekom. Without the permission of Deutsche Telekom or customers, Microsoft won't be able to get its hands on the data. If it does get permission, the trustee will still control and oversee Microsoft's access.

But as Diginomica reports, Microsoft EVP of Cloud and Enterprise Scott Guthrie followed up his boss’s comments by saying that yes, the driver behind the new datacenters is to let customers keep data close: We can guarantee customers that their data will always stay in the UK. Being able to very concretely tell that story is something that I think will accelerate cloud adoption further in the UK.

  • Microsoft and T-Systems' lawyers may well think that storing customer data in a German trustee data center will protect it from the reach of US law, but for all we know, that could be wishful thinking. Forrester cloud computing analyst Paul Miller: To be sure, we must wait for the first legal challenge. And the appeal. And the counter-appeal. As with all new legal approaches, we don’t know it is watertight until it is challenged in court. Microsoft and T-Systems’ lawyers are very good and say it's watertight. But we can be sure opposition lawyers will look for all the holes. By keeping data offshore - particularly in Germany, which has strong data privacy laws - Microsoft could avoid the situation it's now facing with the US demanding access to customer emails stored on a Microsoft server in Dublin. The US has argued that Microsoft, as a US company, comes under US jurisdiction, regardless of where it keeps its data.
  • Running away to Germany isn't a groundbreaking move; other US cloud services providers have already pledged expansion of their EU presences, including Amazon's plan to open a UK datacenter in late 2016 that will offer what CTO Werner Vogels calls "strong data sovereignty to local users."     The European Community's Court of Justice decision in the Safe Harbor case --- and Edward Snowden --- are now officially downgrading the U.S. as a cloud data center location. NSA is good business for Europeans looking to displace American cloud service providers, as evidenced by Microsoft's decision. The legal test is whether Microsoft has "possession, custody, or control" of the data. From the info given in the article, it seems that Microsoft has done its best to dodge that bullet by moving data centers to Germany and placing their data under the control of a European company. Do ownership of the hardware and profits from their rent mean that Microsoft still has "possession, custody, or control" of the data? The fine print of the agreement with Deutsche Telekom and the customer EULAs will get a thorough going over by the Dept. of Justice for evidence of Microsoft "control" of the data. That will be the crucial legal issue. The data centers in Germany may pass the test. But the notion that data centers in the UK can offer privacy is laughable; the UK's legal authority for GCHQ makes it even easier to get the data than the NSA can in the U.S.  It doesn't even require a court order.
