BofA Said to Split Regulators Over Moving Merrill Derivatives to Bank Unit - Bloomberg - 0 views

(BAC), hit by a credit downgrade last month, has moved derivatives from its Merrill Lynch unit to a subsidiary flush with insured deposits, according to people with direct knowledge of the situation. The Federal Reserve and Federal Deposit Insurance Corp. disagree over the transfers, which are being requested by counterparties, said the people, who asked to remain anonymous because they weren’t authorized to speak publicly. The Fed has signaled that it favors moving the derivatives to give relief to the bank holding company, while the FDIC, which would have to pay off depositors in the event of a bank failure, is objecting, said the people. The bank doesn’t believe regulatory approval is needed, said people with knowledge of its position.

  • The Moody’s downgrade spurred some of Merrill’s partners to ask that contracts be moved to the retail unit, which has a higher credit rating, according to people familiar with the transactions. Transferring derivatives also can help the parent company minimize the collateral it must post on contracts and the potential costs to terminate trades after Moody’s decision, said a person familiar with the matter. Bank of America estimated in an August regulatory filing that a two-level downgrade by all ratings companies would have required that it post $3.3 billion in additional collateral and termination payments, based on over-the-counter derivatives and other trading agreements as of June 30. The figure doesn’t include possible collateral payments due to “variable interest entities,” which the firm is evaluating, it said in the filing.

The discount window has been open to banks as the lender of last resort since 1914. As a general rule, as long as transactions involve high- quality assets and don’t exceed certain quantitative limitations, they should be allowed under the Federal Reserve Act, Omarova said.

Section 23A “is among the most important tools that U.S. bank regulators have to protect the safety and soundness of U.S. banks,” Scott Alvarez, the Fed’s general counsel, told Congress in March 2008.

    So according to Bloomberg, JPMorgan's commercial bank was the recipient of 99 percent of JPMorgan's $79 trillion (face value of derivatives) in bad bets. So adding JPMorgan's $78 trillion or so to the $75 trillion in bad bets Bank of America unloaded on its FDIC insured subsidiary, we arrive at $153 trillion in bad bets moved by two investment banks alone under the FDIC umbrella. Meanwhile, FDIC has authority under Dodd-Frank to liquidate these insolvent banks but doesn't, despite several successful lawsuits to recover the value of toxic derivatives that they sold to smaller banks that failed (which implies that FDIC could tell JPMorgan and BoA's investment banksters that they've got to pay off the toxic assets they transferred to their commercial banks, rather than diluting the insurance for normal depositors. Problem: the two big investment banks don't have sufficient assets to absorb those losses, so the too-politically-connected-to-fail factor kicks in. Note that I have not done any legal research in regard to these issues and am basing these observations on what has been stated about legal requirements in various media articles.

Declaration For The Americas Moves Toward Signing Without US And Canada - 0 views

  • Negotiations held over the past 18 years toward resolving historic issues of land dispossession and conflicts over natural resources with indigenous peoples of the Americas are finally expected to reach consensus by May. “We were told there are some states very interested in getting the declaration done so we can move to another stage in the Organization of American States (OAS) and be able to enforce the rights recognized,” said Leonardo A. Crippa, a senior attorney for the Indian Law Resource Center in Washington. “It’s aiming to be completed by May so the text can be submitted for approval to the General Assembly of the OAS, which is meeting in D.C. in June.”
  • This process began in 1989, when the OAS General Assembly approved a resolution to ask the Inter-American Commission of Human Rights (IACHR) to prepare a declaration on the rights of indigenous people of North America, South America, Central America and the Caribbean. The IACHR submitted the first Draft American Declaration on the Rights of Indigenous Peoples in 1997. Also that year, the Indian Law Resource Center and other indigenous rights groups such as the Native American Rights Fund in Colorado petitioned the OAS to create a working group to discuss issues with member states and work toward reaching consensus on resolutions.

  • The study also found that Brazil is the country with the greatest diversity of indigenous peoples in isolation, followed by Peru and Bolivia. The current version of the OAS declaration includes Article XXVI, agreed by consensus in 2005, specifically for indigenous peoples in voluntary isolation to have the right to remain in that condition and to live freely and in accordance with their cultures. “In most cases the key recommendation is to prevent contact either by state agencies, officials, non-government organizations or companies wanting to exploit resources of their lands,” Crippa said. Their ancestors lived on the land long before the current states even existed. Vulnerable and at risk of disappearing entirely, they cannot advocate for their own rights. The study cites the National Environment Commission of Peru’s findings that from 1950 to 1957 a total of 11 indigenous groups disappeared completely from the Amazon, and of those remaining, 18 are in grave danger of disappearing, as they each have fewer than 225 members.
  • “There are regional particulates that are unique and not defined in the U.N. Declaration [UNDRIP],” Crippa said. He used the example of people in the Americas living in voluntary isolation, emphasizing, “We need to protect these peoples from internal armed conflicts, such as in Colombia, where they’re caught in the middle of military, paramilitary and guerrilla forces. It’s a situation of a government of a country trying to control land of indigenous peoples without respect to their rights.” Indigenous peoples in voluntary isolation are groups or individuals who remain untouched by non-indigenous populations. They do not maintain contact with non-indigenous populations, may reject any type of contact, or may have chosen to return to their traditional culture and break relations with non-native societies in favor of maintaining their own ways of life. A provision to protect indigenous communities living in isolation has been approved in the OAS draft declaration, which has no corresponding provision in UNDRIP.
  • When efforts to resolve issues have failed to find remedy in their own country, the IACHR can be appealed to. All 35 member states of the OAS are under the jurisdiction of the IACHR, headquartered in Washington. No country can be a part of the OAS process without ratifying the OAS Charter. “All 35 member countries have signed the Declaration on the Rights and Duties of Man of 1948,” said Maria Isabel Rivera, director of Press and Publications for the IACHR. “This means the Commission analyzes all cases and petitions and monitors human rights situations in those countries under the light of the rights recognized in the Declaration.” Countries that have not ratified the convention include the Bahamas, Belize, Canada, Cuba, Guyana, St Kitts and Nevis, St. Lucia, St. Vincent and the Grenadines, and the U.S. Thus, cases originating in these countries cannot be brought to the Inter-American Court of Human Rights, but they can be brought to IACHR in a petition of injustice.

It also calls for limiting commercial tourism in the territories of people living in voluntary isolation and urges companies, organizations and governments to work in coordination with indigenous groups which aim to protect indigenous rights toward free and prior consent. “Indigenous peoples have the right to maintain, express, and freely develop their cultural identity in all respects, free from any external attempt at assimilation,” the draft also states. “The States shall not carry out, adopt, support, or favor any policy to assimilate the indigenous peoples or to destroy their cultures.”

  • Al Jazeera America will shutter its cable TV and digital operations by April 30 of this year, the company announced Wednesday. The decision by the AJAM board was “driven by the fact that our business model is simply not sustainable in light of the economic challenges in the U.S. media marketplace,” said AJAM CEO Al Anstey.
  • The announcement of AJAM’s closure coincides with a decision by its global parent company to commit to a significant expansion of its worldwide digital operations into the U.S. market. “As audiences increasingly turn to multiple platforms, including mobile devices, for news and information, this expansion will allow U.S. and non-U.S. consumers alike to access the network’s journalism and content wherever and whenever they want,” the Al Jazeera Media Network said in a statement. “By expanding its digital content and distribution services to now include the U.S., the network will be better positioned to innovate and compete in an overwhelmingly digital world to serve today’s 24-hour digitally focused audience.”

    This is good news to me. Al Jazeera America ("AJAM") was a big disappointment and was coupled with geo-blocking the U.S. from internet access to Al Jazeera English, which is a stunningly great news operation.  Blame the cable television companies, who made it a condition of carrying AJAM that all of its content had to originate in the U.S., preventing AJAM from showing the content generated by Al Jazeera English.  It was pure censorship, almost undoubtedly as the result of pressure from the U.S. government on the cable companies. AJAM hired staff away from other cable news competitors in the U.S., resulting in journalism that was far more like CNN than that of Al Jazeera English, just more mainstream media mush rather than having any unique editorial policy.    The Al Jazeera international organization is headquartered in Doha, Qatar and is partially subsidized by the Qatar ruling family. The Al Jazeera English news organization produces content in the finest hard-hitting British journalism style. Unfettered by the need to attract and keep advertisers, its staff has been left remarkably free to pursue stories that they want to write, with an understandable residual avoidance of criticism for the Qatar government. But as to any government in the world, they are cut no slack at Al Jazeera English. Al Jazeera English is unique in my mind because it qualifies both as mainstream media and as a source of consistently hard-hitting journalism. That is not true of any other mainstream media outlet that I know of. I'm looking forward to not having to fire up the Tor browser to evade the geoblocking and access Al Jazeera English.

  • A federal appeals court on Monday dealt a blow to the Justice Department's efforts to punish big banks for contributing to the financial crisis nearly a decade ago by overturning a massive penalty against Bank of America. The U.S. Court of Appeals for the Second Circuit ruled that the federal government had not proven its case against the nation's second-largest bank -- and, accordingly, the North Carolina-based company does not have to pay the $1.27 billion penalty that stemmed from the case. The Department of Justice investigated and claimed that Bank of America had sold shoddy mortgages that contributed to the financial crisis of 2008-09. Investigators said BoA's Countrywide Financial Corp. and a program called "Hustle" focused on distributing a large number of mortgages but were careless with the quality of the loans. The company then misrepresented the mortgage loans when they were subsequently sold to Fannie May and Freddie Mac, Justice officials claimed. A jury found Bank of America liable for fraud in 2013 and ordered them to pay the massive fine. A $1 million civil penalty leveled against Countrywide executive Rebecca Mairone, one of the few individuals punished for the crisis, was also overturned by the appellate court.

And when warrior cops want a straight-outta-Baghdad toy, it's increasingly and unnecessarily simple for them to use a federally enabled slush-fund to wreak havoc – particularly against minorities, and even at a pumpkin festival. It's also pretty simple to start accounting for all the high-tech violence."Before another small town's police force gets a $700,000 gift from the Defense Department that it can't maintain or manage," Rep Hank Johnson of Georgia told me this week, "we need to press pause and revisit the merits of a militarized America."
  • The ACLU released a devastating report this week examining more than 800 incidents of Swat team deployments conducted by 20 law enforcement agencies between 2010 and 2013. It's a small sample of the estimated 45,000 deployments that occur in the US each year (up from 1,400% from the '80s), but the report reveals a picture of law enforcement as flash-bang assault unit, with hardly an actual suspect in harm's way: pandemonium in a baby's crib; a grandfather of 12 killed by a discharged gun; Swat officers gunning down a mother as she died, child in her arms. According to the ACLU study, 79% of the incidents surveyed involved a Swat team searching a person's home, and more than 62% of the cases involved searches for drugs. That's not what Swat teams were made for.America is winding down wars abroad – depending on what the hell happens in Iraq, of course – but we are fueling an addiction to armed conflict here at home.As Balko notes in his book, The Rise of the Warrior Cop, "America's cops have increasingly come to resemble ground troops."
  • But the federal government has been enabling even more localized branches of law enforcement to get its hands on heavy-duty artillery for the last 20 years, when the Reagan administration formalized the Pentagon's so-called 1033 Program. It sends "excess" military equipment to local police departments, and combined with the Homeland Security operation that provides grants to purchase such equipment, we've got a veritable firearms sale funnelling from Washington on down to the local station house. And when local law enforcement is making hundreds of thousands of dollars off seized drug money – sometimes illegally – you've got the makings of a War Zone on Main Street.Rep Johnson has plans to introduce a bill that would reform the 1033 Program, which donated at least $500bn per year in military gear to virtually every police department in the country. "We not only lack serious oversight and accountability," Johnson wrote me in an email on Tuesday, "but we need some parameters put in place for what is appropriate." His legislation would put limitations on the transfer of certain kinds of military-grade equipment, and require the Pentagon to account for transfers of all such equipment in an annual report to Congress.

America Is Guilty if We Don't Prosecute Obama Washington's Blog - 0 views

  • I write both as a Democrat (which Barack Obama merely claims to be, but shows by his actions that he is not) and as an American (which he, unfortunately, actually is, but which Republicans often deny), in the hope of preserving the honor not just of my Country, but of my Party, both of which he violates routinely. When President Obama refused to allow the prosecution of George W. Bush and Dick Cheney for their manifest crimes, after they had been in office (their having lied this country into invading a country that was no imminent threat to the United States, tortured people, violated the 4th Amendment by unleashing the NSA against the American public, unleashed Wall Street crooks against the American people via MBS frauds, etc.), Obama thereby took upon himself Bush’s and Cheney’s crimes, as being his own. Those crimes still need to be prosecuted — now by America prosecuting Obama himself, for his covering them up: he still does it, after all of these years. Those crimes are no less heinous and, indeed, no less treasonous, now that a so-called “Democrat” is hiding them, than they were when his self-acknowledged Republican predecessors, and now in some cases even the fake “Democrat” Obama himself, were and have been and still are perpetrating them.

  • Our government bankers print money today like loons in an asylum spew absurdity. Glib media shills lure us every night into a disgraceful indolence. And our corporations lust like spoiled children after mega-billions of illicit lucre. Cataclysm is coming. No one with a minimal awareness of history, politics and proper economics today has faith that our society can continue much longer at its present level of government privilege and debt accumulation. There is a Grand Piper that must be paid, and he will manifest in any number of scenarios, none of which will be pleasant. One thing is for sure: The next two decades are going to be tumultuous and tragic. The events that unfold will be far more radical than we dare envision today. Paradigms in banking, politics and philosophy will be overturned. Wrenching lifestyle shifts will be forced upon millions. Something akin to what happened in the Soviet Union after the fall of communism in 1991 will take place in America. Our ruling regime will collapse and bring Russian-style economic hardship to us all. How exactly things unfold will depend upon whether the nation's intelligentsia bring themselves to seriously question the shams of statism, or whether the government-media-academy triad is able to continue bamboozling them. What is extremely unnerving is that whoever wins this battle to control the destiny of our country will determine the fate of freedom on the planet for hundreds, perhaps thousands of years. A monumental clash of ideology and propriety looms up ahead.
  • Why We Are Disintegrating as a Society
  • America's dilemma is this: We are being propelled toward an Orwellian style despotism that's purpose is to centralize government power in Washington, phase out American sovereignty and move our country as much as possible into subordination to the United Nations and eventually alignment with Canada, Mexico and Central America into a regional government. The world is moving toward the nightmare of Oceana, Eurasia and East Asia in Orwell's Nineteen Eighty-Four, which will extinguish freedom and merge mankind into a tyrannical egalitarianism. Why is this happening? Such is the influential force of ideology. We are being destroyed because of what historian Clarence Carson called a "collectivist curvature of the mind" that took over our intellectuals back in the early twentieth century. This curvature of the mind functions as the grand fueling mechanism for the goals of government centralization and ending our national sovereignty. It's horrifying, but every year our schools form the "best and the brightest minds" into collectivist apparatchiks to go out in the world and work their way into the power centers of society. The schools do this via false teachings in philosophy, economics, political science and history. This "ideological indoctrination" teaches every new generation that capitalism is an evil, exploitative, racist, warmongering system and must be phased out of modern societies. It teaches that national sovereignty is anachronistic and must be given up. Such indoctrination is being done very subtly and sophisticatedly, but it is a powerful, pervasive theme instilled into all our children from the first grade on.

  • This is why we have so many bankers, corporate moguls, political statesmen, authors, pundits, artists, publishers and priests working today to undercut the country. Being "the best and the brightest," they were taught in their youth that capitalist America is an evil nation. They, thus, have gone out and risen to positions of power with a globalist worldview that believes economic freedom can't work in the modern day, that American sovereignty is an anachronism belonging to the nineteenth century. Since they are the nation's intelligentsia, they are immensely influential. Their socialist-collectivist worldview is spread to the masses which then elect legislators sympathetic to such irrationality to Congress and the White House.
  • Every one of us has to choose whether we will try to make a difference or give in to indifference. Will we fight to inform our neighbors or succumb to the easy road of apathy? Will we opt for principle or popularity? Will we succumb to the statist thugs on the far left, or fall for the anarchic screwballs on the far right? The "mean" of constitutional sanity beckons to the percipient among us. Will it survive the tumult ahead?
  • All quite clear and horrifying. But how are we, as mere laymen with no access to national media or huge fortunes, to confront this destruction of freedom and sanity in America and throughout the West?
  • We must take a page from the story of the old man and the starfish. After a huge storm had brought a mini-tidal wave to his beach community one night, there were tens of thousands of starfish washed up on the shore that next morning. Amidst the masses of starfish the old man could be seen patiently picking them up and tossing them back into the sea. Along came a young lad in his twenties with green hair, eyebrow rings and a scornful face. He started laughing and mocked the old man with cynical derision. "You have to be crazy, old timer. You can't possibly save those starfish; there's thousands of them. You're wasting your time, you fool. YOU CAN'T MAKE A DIFFERENCE!" The old man looked up at the insolent youth and smiled. He then reached down and picked up one of the struggling starfish and winged it far out into the water, replying to his tormentor, "Made a difference with that one, didn't I?"

  • Not everyone, naturally, has the time and mental wherewithal to forcefully fight the "ideological indoctrination" destroying our country today. But many of us do. Our power lies in our minds and the strength of our personalities. We who possess this inner strength feel compelled to spread the word in any way we can for as long as we live. We feel compelled to wing as many starfish back to life as we can. The apathetic and cynical will scorn all this as senseless, just as the green-haired youth did. They will choose to remain wards of the state and sanction their enslavers. This has always been the nature of most humans. When such wards see others fighting valiantly against seemingly insurmountable odds for the freedom they have scorned, they are subconsciously humiliated because they are not deep in the thick of the fight themselves. They have chosen to avoid the fight and sanction the tyrants who are destroying our way of life. Thus, they must find a way to salve their consciences. That way is to caustically mock the Davids who go up against the Goliaths, to smear the Rolands of Roncesvalles that history hands down to us as heroic exemplars.
  • You the reader have a paramount decision to make regarding all this. It is High Noon for the cause of freedom. Will you fight with the heroic exemplars? If you choose to fight, then your first necessity is to become aware of WHAT is happening and WHY it is happening. That awareness can only be found via fervent curiosity and a commitment to the study of libertarian and conservative literature.
  • Your second duty is to emulate Paul Revere and warn all those in your sphere of influence. You do this by making a diplomatic nuisance of yourself, by pleasantly pestering your comrades to wake up to the elite's usurpations growing by leaps and bounds in our lives. You do it by convincing them that there are grander values in life than shiny new SUVs and country club memberships. There is something called the American way of life that requires personal independence.
  • Time is short. Collectivism steals over us like crack cocaine filters into a ghetto. It devastates everything of worth in its path. All the stoic traditions of strength, all the great lessons of logic, all the revered truths of Nature that have been handed down to us throughout the centuries are being assailed. The weasel-tyrants and their unctuous lackeys have gained control of the intellectual, political and banking power centers of our country, but they can't control the ultimate factor – the truth – because they can't control our minds unless we let them.   • What the elites fear is a populace with the strength of William Wallace fighting King Edward at Sterling Bridge in 1297, the daring of Washington's band crossing the Delaware in the dead of winter. You cannot help truth and freedom by watching moronic TV shows at night. That is how the elites control you. They flood the airwaves with mindless entertainment. It's today's version of Brave New World's "soma for the masses." Today's TV is for zombies and dullards. The same applies to our movies. Next time you're in the theater, look around you at all the hoi polloi stuffing their faces with popcorn and their psyches with over-the top-violence and trashy sex.
  • Aldous Huxley was the first to point out that modern totalitarian regimes leave the "activities of sex" alone, but regiment the "activities of production." This allows those who are servile to think they are still free as they vote away their REAL freedom – their freedom to acquire and keep wealth, to associate with whom they please, to speak and worship as they please. The nature of human existence is complexity, wrapped up in mystery, contained in inconceivability, subsumed under the power of Truth. We will never create a free society by denying this and ignoring the results of logic and the record of history. This is what statists and anarchists do. REAL freedom is impossible without a grasp of logic and a deep knowledge of history, which teach us that the cornerstones of freedom are equal rights, strictly limited government, gold money and self-reliant people. The statists violate logic and ignore history because they are callous brutes who place power above all and simply don't care. The anarchists violate logic and ignore history because logic and history show their political system to be unworkable.

  • I sat in the first class section of the Acela Express once from New York to Washington. I was on a book tour and the publisher was whisking me from New York to DC for events. Thomas Freidman sat diagonally from me. His single seat backed up to where the First Class Stewards worked. As the train pulled into DC, the overworked steward hadn’t taken Friedman’s tray. Friedman yelled angrily about this being why the nation was collapsing. I kid you not. I was the tipster. First Class of the Acela Express has more to do with what is wrong with America than the Steward who works there. The New York-Washington bubble remains largely disconnected from the rest of the country. When last I made that point, Dylan Byers of the Politico tweeted along the lines of this being as preposterous as the French claiming Paris truly wasn’t France. Of course, de Gaulle popularized the notion of La France profounde — that Paris really wasn’t indicative of the rest of the country.

      I din't agree with this statement!!  Jefferson fully supported the Madison Constitutional design.  If anything though, Jefferson was concerned about the sovereignty and power of the States as a limiting force on the Federal government.  This belief was excercized in 1798 when Jefferson and Madison took their opposition to the horrid  Adams-Federalist "Alien and Sediton Act" directly to the State legislatures.  Jefferson and Madison did not turn to to the federal Congress, that had passed the Act. they went straight to the States legislatures to marshal opposition and counter this first assault on  the Constitution and Bill of Rights (first andammendment).
