Gazprom Threatens to Halt Gas Supplies to Ukraine if Not Paid in Two Days / Sputnik Int... - 0 views

  • Ukraine's tardiness in making its prepayment for Russian gas deliveries could lead to a full shutdown within two days and threaten the transit delivery of fuel to European consumers, Gazprom CEO Alexei Miller said Tuesday. "Ukraine has not made its gas prepayment on time. As of today, there is only 219 million cubic meters of gas paid for. It takes about two days for [Ukraine's] Naftogaz to transfer funds to [Russia's] Gazprom," Miller said. Miller said that Ukraine's request for 114 million cubic meters of gas to be delivered in two days would lead to a full shutdown of fuel deliveries if payment is not received."Therefore, the delivery of gas to Ukraine in the volume of 114 million cubic meters of gas in the next two days already would bring the delivery of Russian gas to Ukraine to a full stop, which will create serious risks for transit gas to Europe," Miller added. On Monday, Ukraine's state energy company Naftogaz accused Gazprom of failing to deliver the gas for which Kiev has paid in advance. According to a statement by the company's press service, Gazprom has supplied only 47 million cubic meters of the requested 114 million cubic meters of gas.
  • The issue of gas supplies is among the most acute in Russian-Ukrainian relations. In the summer of 2014, Russia's Gazprom has cut off gas deliveries to Ukraine due to Kiev's massive debt that at the time surpassed $5 billion. Gas deliveries resumed in December, after months of negotiations mediated by the European Union. The so-called winter package stipulated that Ukraine repay $3.1 billion of its gas debt before the end of 2014 and pay in advance for future gas supplies. It also included a temporary discount of $100 per 1,000 cubic meters, granted by Russia to Ukraine, that expires on April 1, 2015.

Venezuela Moves Forward with Special Economic Zones to Attract Investment in Developmen... - 0 views

  • The Venezuelan government will unveil its comprehensive plan for the creation of Special Economic Zones (SEZ) by the end of the month. The plan, as presented by Vice-President of Planning Ricardo Menendez on Monday, will outline strategic areas of the country where policy incentives will attract foreign and national investment with the aim of promoting export-oriented production and "integral development". The SEZ represent an important dimension of the economic development strategy laid out by late president Hugo Chávez and President Nicolas Maduro, which seeks to fortify Venezuela's vital infrastructure, particularly in the areas of telecommunications, electricity, and water and land transport.
  • So far 47 firms have committed to setting up operations in the SEZ, and a further 100 have requested more information regarding potential projects. Chinese firms constitute the bulk of the foreign partners, with $2 billion in contracts already desisgnated to manufacturing and construction projects, The Bolivarian government has imposed a series of regulations governing the SEZs which include a minimum 50% Venezuelan share in all projects as well as a mandate obliging all firms to open accounts with the National Public Banking System.

POGO Provides Statement for House Hearing on VA Whistleblowers - 0 views

  • In the spring of 2014, the Project On Government Oversight (POGO) put out the call to whistleblowers within the Department of Veterans Affairs (VA) to provide an inside perspective on the issues the Department was facing. In our 34-year history, POGO has never received as many submissions on a single issue. Nearly 800 current and former VA employees and veterans from 35 states and the District of Columbia contacted us. POGO reviewed each of the submissions, and found that concerns about the VA go far beyond long or falsified wait times for medical appointments; they extend to the quality of health care services veterans receive. A recurring and fundamental theme became clear: VA employees across the country fear they will face repercussions if they dare to raise a dissenting voice. POGO wrote a letter to Acting VA Secretary Sloan Gibson in July last year, highlighting three specific cases of current or former employees who agreed to share details about their personal experiences of retaliation.[1] In California, a VA inpatient pharmacy supervisor was placed on administrative leave and ordered not to speak out after protesting “inordinate delays” in delivering medication to patients and “refusal to comply with VHA regulations.” In one case, he said, a veteran’s epidural drip of pain control medication ran dry, and another veteran developed a high fever after he was administered a chemotherapy drug after its expiration point.
  • In Pennsylvania, a former VA doctor told POGO that he had been removed from clinical work and forced to spend his days in an office with nothing to do. This action occurred after he complained that, in medical emergencies, physicians who were supposed to be on call were failing or refusing to report to the hospital. The Office of Special Counsel (OSC) shared his concerns, writing “[w]e have concluded that there is a substantial likelihood that the information that you provided to OSC discloses a substantial and specific danger to public health and safety.”[2] In Appalachia, a former VA nurse told POGO she was intimidated by management and forced out of her job after she raised concerns that patients with serious injuries were being neglected. In one case she was reprimanded for referring a patient to the VA’s patient advocate after weeks of being unable to arrange transportation for a medical test to determine if he was in danger of sudden death. “Such an upsetting thing for a nurse just to see this blatant neglect occur almost on a daily basis. It was not only overlooked but appeared to be embraced,” she said. She also pointed out that there is “a culture of bullying employees….It’s just a culture of harassment that goes on if you report wrongdoing,” she said.
  • That culture doesn’t appear to be limited to just one or two VA clinics. Some people, including former employees who are now beyond the reach of VA management, were willing to be interviewed by POGO and to be quoted by name, but others said they contacted us anonymously because they are still employed at the VA and are worried about retaliation. One put it this way: “Management is extremely good at keeping things quiet and employees are very afraid to come forward.” This kind of fear and suppression of whistleblowers who report wrongdoing often culminates in the larger problems, as the VA is currently experiencing. By now it is well known that employees who recently raised concerns about veteran wait times faced reprisal. But whistleblower retaliation in the VA is nothing new. In 1992 a congressional report detailed the experiences of VA employees who were harassed or fired after reporting problems.[3] Throughout the 1990s there were several congressional hearings conducted on the quality of care at VA hospitals and on reprisal against VA employees who exposed inadequate care.[4] Despite then-Secretary Togo D. West’s declaration that such reprisals would not be tolerated, a House hearing in 1999 found that the reprisal problems still existed.[5] A Government Accountability Report from 2000 found that many VA employees were unaware of their rights to protections against retaliation for blowing the whistle on wrongdoing.[6] The report also found that the majority of employees feared retaliation and were therefore unwilling to report misconduct.

  • The Office of Special Counsel (OSC) has been working to investigate claims of retaliation and get favorable actions for many of the VA whistleblowers who have come forward. Since April 2014, the OSC has successfully obtained corrective actions for over 25 whistleblowers.[7] But the OSC still has over 100 pending VA reprisal cases to investigate, among the highest of any government agency, according to Special Counsel Carolyn Lerner.[8] Although the VA has been cooperative with the OSC and their recommendations, merely addressing isolated incidents is not enough.[9] The VA has been struggling with a culture problem for decades and something more must be done.
  • VA employees who have concerns about management or fear retaliation are supposed to be able to turn to the VA’s Office of Inspector General (OIG). But whistleblowers have come to doubt the VA IG’s willingness to hold wrongdoers accountable. Since 2014, the IG Office has not yet publically released any investigation into employee retaliation, making it difficult to assess how seriously the IG’s office is taking this issue. Furthermore, the VA IG’s office issued an administrative subpoena to POGO in May 2014 that was little more than an invasive fishing expedition for whistleblowers. The IG demanded “All records that POGO has received from current or former employees of the Department of Veterans Affairs, and other individuals or entities.”[10] Though POGO did not comply with the subpoena, such an action was cause for concern for many of the whistleblowers who had shared information with us. POGO remains concerned that there is not a permanent VA IG in place and that the position has been vacant for over a year.[11] Our own investigations have found that the absence of permanent leadership can have a serious impact on the effectiveness of an IG office.[12] Acting IGs do not undergo the same kind of extensive vetting process required of permanent IGs, and as a consequence usually lack the credibility of a permanent IG. Acting IGs also often seek appointment to the permanent position, which can compromise their independence by giving them an incentive to curry favor with the White House and the leadership of their agency.[13] Perhaps most worrisome, given the significant challenges facing the VA IG, a 2009 study found that vacancies in top agency positions promote agency inaction, create confusion among career employees, make an agency less likely to handle controversial issues, result in fewer enforcement actions by regulatory agencies and decrease public trust in government.[14]
  • It appears the VA IG may be subject to this dangerous lack of independence. For example, the VA OIG has failed to release the results of 140 health care investigations since 2006.[15] Furthermore, the Department of Treasury IG sent a letter to this Committee just last month raising concerns about another VA IG investigation. After speaking to witnesses familiar with the situation, the Treasury IG concluded that their testimony, “calls into question the integrity of the VA OIG’s actions in this particular manner.” The Treasury IG’s investigation also found that multiple witnesses stated a VA employee boasted about his ability to influence the VA OIG’s investigations.[16]
  • In POGO’s 2014 letter, we recommended concrete steps for incoming VA Secretary McDonald to take in order to demonstrate an agency-wide commitment to changing the VA’s culture of fear, bullying, and retaliation. Neither Acting Secretary Sloan Gibson nor Secretary McDonald have responded to our multiple requests for a meeting. Clearly, an important first step will be for the President to nominate a permanent IG for the VA. Hopefully strong and committed leadership in that office will correct its current course. POGO recommended that Secretary McDonald make a tangible and meaningful gesture to support those whistleblowers who have been trying to fix the VA from the inside. Once the OSC has identified meritorious cases, Secretary McDonald should personally meet with those whistleblowers and elevate their status from villain to hero. These employees should be publicly celebrated for their courage, and should receive positive recognition in their personnel files, including possibly receiving the types of bonuses that have been provided to wrongdoers in the past. Retaliation against whistleblowers is already a prohibited personnel practice, but it will be up to the senior-most VA leadership to ensure that this rule is enforced by the agency. This should not be an isolated event done in response to recent criticisms but an ongoing effort. Whistleblowing must be encouraged and celebrated or wrongdoing will continue.
  • But it’s not just the VA Secretary who can work to fix this problem. Congress should enact legislation that codifies accountability for those who retaliate against whistleblowers. The definition of “wrongdoing” must include retaliation. The cultural shift that is required inside the Department of Veterans Affairs must be accompanied by statutory mandates that protect whistleblowers and witnesses inside the agency from retaliation. Legislation should ensure that whistleblowers are able to be confident that stepping forward to expose wrongdoing will not result in retaliation, and should provide a system to hold retaliators within the VA accountable. Congress should also extend whistleblower protections to contractors and veterans who raise concerns about medical care provided by the VA. POGO’s investigation found that both of these groups also fear retaliation that prevents them from coming forward. While federal employees working at the VA enjoy whistleblower protections, contractors do not. Congress should extend the same protections to contractors in order to promote internal oversight in an increasingly contractor-heavy landscape.
  • In addition, a veteran who is receiving poor care should be able to speak to his or her patient advocate without fear of retaliation, including a reduction in the quality of health care. Without this reassurance, there is a disincentive to report poor care, allowing it to continue uncorrected. Congress should extend whistleblower protections to veteran whistleblowers. The VA and Congress must work together to end this culture of fear and retaliation. Whistleblowers who report concerns that affect veteran health must be lauded, not shunned. And the law must protect them.

Documents Reveal Canada's Secret Hacking Tactics - The Intercept - 0 views

  • Canada’s electronic surveillance agency has secretly developed an arsenal of cyberweapons capable of stealing data and destroying adversaries’ infrastructure, according to newly revealed classified documents. Communications Security Establishment, or CSE, has also covertly hacked into computers across the world to gather intelligence, breaking into networks in Europe, Mexico, the Middle East and North Africa, the documents show. The revelations, reported Monday by CBC News in collaboration with The Intercept, shine a light for the first time on how Canada has adopted aggressive tactics to attack, sabotage and infiltrate targeted computer systems. The latest disclosures come as the Canadian government debates whether to hand over more powers to its spies to disrupt threats as part of the controversial anti-terrorism law, Bill C-51.
  • Christopher Parsons, a surveillance expert at the University of Toronto’s Citizen Lab, told CBC News that the new revelations showed that Canada’s computer networks had already been “turned into a battlefield without any Canadian being asked: Should it be done? How should it be done?” According to documents obtained by The Intercept from National Security Agency whistleblower Edward Snowden, CSE has a wide range of powerful tools to perform “computer network exploitation” and “computer network attack” operations. These involve hacking into networks to either gather intelligence or to damage adversaries’ infrastructure, potentially including electricity, transportation or banking systems. The most well-known example of a state-sponsored “attack” operation involved the use of Stuxnet, a computer worm that was reportedly developed by the United States and Israel to sabotage Iranian nuclear facilities. One document from CSE, dated from 2011, outlines the range of methods the Canadian agency has at its disposal as part of a “cyber activity spectrum” to both defend against hacking attacks and to perpetrate them. CSE says in the document that it can “disable adversary infrastructure,” “control adversary infrastructure,” or “destroy adversary infrastructure” using the attack techniques. It can also insert malware “implants” on computers to steal data.
  • According to one top-secret NSA briefing paper, dated from 2013, Canada is considered an important player in global hacking operations. Under the heading “NSA and CSEC cooperate closely in the following areas,” the paper notes that the agencies work together on “active computer network access and exploitation on a variety of foreign intelligence targets, including CT [counter terrorism], Middle East, North Africa, Europe, and Mexico.” (The NSA had not responded to a request for comment at time of publication. The agency has previously told The Intercept that it “works with foreign partners to address a wide array of serious threats, including terrorist plots, the proliferation of weapons of mass destruction, and foreign aggression.”) Notably, CSE has gone beyond just adopting a range of tools to hack computers. According to the Snowden documents, it has a range of “deception techniques” in its toolbox. These include “false flag” operations to “create unrest,” and using so-called “effects” operations to “alter adversary perception.” A false-flag operation usually means carrying out an attack, but making it look like it was performed by another group — in this case, likely another government or hacker. Effects operations can involve sending out propaganda across social media or disrupting communications services. The newly revealed documents also reveal that CSE says it can plant a “honeypot” as part of its deception tactics, possibly a reference to some sort of bait posted online that lures in targets so that they can be hacked or monitored.

  • The apparent involvement of CSE in using the deception tactics suggests it is operating in the same area as a secretive British unit known as JTRIG, a division of the country’s eavesdropping agency, Government Communications Headquarters, or GCHQ. Last year, The Intercept published documents from Snowden showing that the JTRIG unit uses a range of effects operations to manipulate information online, such as by rigging the outcome of online polls, sending out fake messages on Facebook across entire countries, and posting negative information about targets online to damage their reputations.

Never charged with a crime, al-Alwi, now 35 years old, is one of many detainees at the camp who have gone on a prolonged hunger strike. As described in a recent petition submitted to the Inter-American Commission on Human Rights (IACHR) by his lawyers, al-Alwi’s mental and physical state is seriously deteriorating after two years on hunger strike, and subsequent force-feeding.  Since commencing his strike in February 2013, al-Alwi alleges that he has been subjected to escalating physical and psychological abuse from guards, as well as increasingly brutal force-feeding procedures administered by medical personnel at the camp. Human rights organizations have described the force-feeding procedure employed at Guantánamo as torture, and the U.S. government has fought to keep video footage of the force-feeding of al-Alwi and other hunger-striking detainees from public view.

  • According to the petition, al-Alwi’s nostril passages have now swelled shut due to the extra large tubes prison authorities have repeatedly forced down his nasal cavity during this feeding process. He also maintains that the force-feeding sessions have led to heavy vomiting and daily blood loss. Shackled to a chair for hours each day during the force-feeding sessions, al-Alwi now suffers severe back pain and other debilitating physical injuries. In his petition, al-Alwi describes his life in Guantánamo as “an endless horror story.” In April 2013, a delegation from the International Committee of the Red Cross conducted a visit to Guantánamo to meet with detainees and assess conditions there. On the day immediately following their departure, armed guards raided a cellblock housing al-Alwi and several other hunger-striking detainees while they prepared for communal prayers.
  • The complaint further alleges that prisoners were physically assaulted by guards during this raid, some of whom fired rubber-coated steel bullets at them. Al-Alwi was among those wounded, with bullets hitting him in his thigh, elbow and back as he tried to flee from guards firing at him; those shots were allegedly fired from the other side of a chain-link fence. Al-Alwi says that he has never received adequate medical treatment for these wounds; he was handcuffed and left to bleed for 20 minutes by guards before a doctor arrived. A few of his wounds were rubbed with anti-infection cream while the remainder have remained wholly untreated to this day. As a result, al-Alwi says that he suffers chronic and debilitating pain and swelling from these injuries.
  • The circumstances leading to al-Alwi’s detention at Guantánamo are obscure. One of hundreds of young Arab men who were captured by Pakistani bounty hunters following the Sept. 11 attacks, al-Alwi was not a known or wanted terrorist, but was nonetheless turned over to U.S. troops by locals in Pakistan for a cash reward later that year. On Jan. 16, 2002, he arrived at Guantánamo Bay where he has remained ever since. A 2006 report by Amnesty International found that cash bounties offered for turning over “terrorists” to U.S. forces had effectively created a lucrative cash market for capturing young Arab men in Pakistan and Afghanistan. Fliers distributed by the U.S. government in the region offered “millions of dollars” in exchange for turning over purported Al-Qaeda and Taliban members, promising those who were able to render suspects to American custody “enough money to take care of your family, your village, your tribe for the rest of your life.”

Despite having now spent over a decade in custody, with no foreseeable prospect of release, he has not been charged with any crime. Describing his brutal treatment by riot guards who come to restrain him for force-feedings, al-Alwi told his lawyers in the petition:  “I weigh less than 100 pounds. I wear braces on both ankles, and both wrists, and one around my lower back. I am five foot five … and they claim that I am ‘resisting’ … How can I possibly resist anyone, let alone these men?”

CFPB Determined to Regulate Billion Dollar Payday Loan Industry - Top US & World News |... - 0 views

  • The Consumer Financial Protection Bureau (CFPB) has a new set of rules aimed at preventing payday loan operations from targeting low-income borrowers who will be buried by high fees and rising debt loads. Payday loans are traditionally a loan of $500 or less wherein the borrower “provides a personal check dated on their next payday for the full balance or give the lender permission to debit their bank accounts. The total includes charges often ranging from $15 to $30 per $100 borrowed. Interest-only payments, sometimes referred to as rollovers, are common.” Using these lenders to make ends meet, borrowers are taken advantage of which has traditionally been a state regulatory issue. However now the federal government will be stepping in to curb this extortive multibillion dollar industry. Fees from payday loans can quickly accumulate, causing some borrowers to “lose their bank accounts and cars, or even risk prison time”.
  • Richard Corday, director of the CFPB, said: “Extending credit to people in a way that sets them up to fail and ensnares considerable numbers of them in extended debt traps, is simply not responsible lending.” These new rules cover payday loans, vehicle loans, loans using a car as collateral and various other forms of high-cost lending. Enders will be responsible for making sure debtors can repay the loan in full on time before extending the loan by checking their income, borrowing history, previous financial obligations and any other indicators that the borrower would most likely default or roll over the loan. • A 60 day respite between loans • Lenders must provide affordable repayment options • Loans cannot exceed $500 • Loans cannot have multiple finance charges • Loans cannot use a vehicle as collateral Regulations on interest rates and repayments as a share of income include mandatory capping off to prevent run-a-way fees.
  • Back in February, the CFPB warned about the payday loan industry which is largely unregulated and functions outside of proper oversight and accountability. The CFPB estimates that the $46 billion payday loan or cash advance industry has no oversight, refuses to give full disclosures of interest and fees involved, and takes an annual percentage of an excess of 300% against borrowers. The Consumer Federation of America (CFA) counts 32 states in the US that “permit payday loans at triple-digit interest rates, or with no rate cap at all.” Shockingly 80% of payday loans are rolled over within 14 days while an estimated 50% of these loans are “in a sequence at least 10 loans long.”

On Wednesday, the organization representing 134 nations of the global South voiced its blanket rejection of the White House decree and called for its immediate repeal in accordance with "international principles of respect for sovereignty and national determination". The group went on to express solidarity with Venezuela, recognizing the Bolivarian nation's contributions to "South-South cooperation". The 33 nations comprising the CELAC also condemned this Thursday the "unilateral coercive measures" taken by the Obama administration, which it described as "contrary to international law", calling for dialogue between the two nations based on "principles of respect for sovereignty and noninterference in the internal affairs of other states". in the internal affairs of other states".

Non-Gulf states have also showed their support to “Operation Decisive Storm.” Jordan deployed six fighter jets, Morocco, who expressed “complete solidarity” to Saudi Arabia provided six fighter jets while Sudan supplied three. On Thursday, an army media site confirmed that Sudan took part in the Saudi-led military operation. There were no further details but the site said the army spokesman would soon comment.
  • Al Arabiya News Channel said Egypt and Pakistan would dispatch jet fighters and warships to take part in the campaign. On Thursday, Egypt confirmed it will join the Saudi-led coalition. “Coordination is under way with Saudi Arabia and the Gulf states to prepare for participation by the Egyptian air force and Egyptian navy, and a ground force if the situation warrants, as part of the coalition action,” the Egyptian foreign ministry said in a statement. Another Egyptian military source said that Egypt participated in the military operation with both its naval and air forces. Saleh was the author of the city’s previous humiliation in 1994, when as president he crushed a southern secessionist uprising in a short but brutal war.

Running for Cover: A Sham Air Force Summit Can't Fix the Close Air Support Gap Created ... - 0 views

  • “I can’t wait to be relieved of the burdens of close air support,” Major General James Post, the vice commander of Air Combat Command (ACC), allegedly told a collection of officers at a training session in August 2014. As with his now notorious warning that service members would be committing treason if they communicated with Congress about the successes of the A-10, Major General Post seems to speak for the id of Air Force headquarters’ true hostility towards the close air support (CAS) mission. Air Force four-stars are working hard to deny this hostility to the public and Congress, but their abhorrence of the mission has been demonstrated through 70 years of Air Force headquarters’ budget decisions and combat actions that have consistently short-changed close air support. For the third year in a row (many have already forgotten the attempt to retire 102 jets in the Air Force’s FY 2013 proposal), the Air Force has proposed retiring some or all of the A-10s, ostensibly to save money in order to pay for “modernization.” After failing to convince Congress to implement their plan last year (except for a last minute partial capitulation by retiring Senate and House Armed Services Committee chairmen Senator Carl Levin (D-MI) and Representative Buck McKeon (R-CA)) and encountering uncompromising pushback this year, Air Force headquarters has renewed its campaign with more dirty tricks.
  • First, Air Force headquarters tried to fight back against congressional skepticism by releasing cherry-picked data purporting to show that the A-10 kills more friendlies and civilians than any other U.S. Air Force plane, even though it actually has one of the lowest fratricide and civilian casualty rates. With those cooked statistics debunked and rejected by Senate Armed Services Chairman Senator John McCain (R-AZ), Air Force headquarters hastily assembled a joint CAS “Summit” to try to justify dumping the A-10. Notes and documents from the Summit meetings, now widely available throughout the Air Force and shared with the Project On Government Oversight’s Center for Defense Information (CDI), reveal that the recommendations of the Summit working groups were altered by senior Air Force leaders to quash any joint service or congressional concerns about the coming gaps in CAS capabilities. Air Force headquarters needed this whitewash to pursue, yet again, its anti-A-10 crusade without congressional or internal-Pentagon opposition.
  • The current A-10 divestment campaign, led by Air Force Chief of Staff Mark Welsh, is only one in a long chain of Air Force headquarters’ attempts by bomber-minded Air Force generals to get rid of the A-10 and the CAS mission. The efforts goes as far back as when the A-10 concept was being designed in the Pentagon, following the unfortunate, bloody lessons learned from the Vietnam War. For example, there was a failed attempt in late-1980s to kill off the A-10 by proposing to replace it with a supposedly CAS-capable version of the F-16 (the A-16). Air Force headquarters tried to keep the A-10s out of the first Gulf War in 1990, except for contingencies. A token number was eventually brought in at the insistence of the theater commander, and the A-10 so vastly outperformed the A-16s that the entire A-16 effort was dismantled. As a reward for these A-10 combat successes, Air Force headquarters tried to starve the program by refusing to give the A-10 any funds for major modifications or programmed depot maintenance during the 1990s. After additional combat successes in the Iraq War, the Air Force then attempted to unload the A-10 fleet in 2004.

  • To ground troops and the pilots who perform the mission, the A-10 and the CAS mission are essential and crucial components of American airpower. The A-10 saves so many troop lives because it is the only platform with the unique capabilities necessary for effective CAS: highly maneuverable at low speeds, unmatched survivability under ground fire, a longer loiter time, able to fly more sorties per day that last longer, and more lethal cannon passes than any other fighter. These capabilities make the A-10 particularly superior in getting in close enough to support our troops fighting in narrow valleys, under bad weather, toe-to-toe with close-in enemies, and/or facing fast-moving targets. For these reasons, Army Chief of Staff General Ray Odierno has called the A-10 “the best close air support aircraft.” Other Air Force platforms can perform parts of the mission, though not as well; and none can do all of it. Senator Kelly Ayotte (R-NH) echoed the troops’ combat experience in a recent Senate Armed Services committee hearing: “It's ugly, it's loud, but when it comes in…it just makes a difference.”
  • In 2014, Congress was well on the way to roundly rejecting the Air Force headquarters’ efforts to retire the entire fleet of 350 A-10s. It was a strong, bipartisan demonstration of support for the CAS platform in all four of Congress’s annual defense bills. But in the final days of the 113th Congress, a “compromise” heavily pushed by the Air Force was tucked into the National Defense Authorization Act for FY 2015. The “compromise” allowed the Air Force to move A-10s into virtually retired “backup status” as long as the Cost Assessment and Program Evaluation (CAPE) office in DoD certified that the measure was the only option available to protect readiness. CAPE, now led by former Assistant Secretary of the Air Force for Financial Management and Comptroller Jamie Morin, duly issued that assessment—though in classified form, thus making it unavailable to the public. In one of his final acts as Secretary of Defense, Chuck Hagel then approved moving 18 A-10s to backup status.
  • The Air Force intends to replace the A-10 with the F-35. But despite spending nearly $100 billion and 14 years in development, the plane is still a minimum of six years away from being certified ready for any real—but still extremely limited—form of CAS combat. The A-10, on the other hand, is continuing to perform daily with striking effectiveness in Afghanistan, Iraq, and Syria—at the insistence of the CENTCOM commander and despite previous false claims from the Air Force that A-10s can’t be sent to Syria. A-10s have also recently been sent to Europe to be available for contingencies in Ukraine—at the insistence of the EUCOM Commander. These demands from active theaters are embarrassing and compelling counterarguments to the Air Force’s plea that the Warthog is no longer relevant or capable and needs to be unloaded to help pay for the new, expensive, more high-tech planes that Air Force headquarters vastly prefers even though the planes are underperforming.
  • So far, Congress has not been any more sympathetic to this year’s continuation of General Welsh’s campaign to retire the A-10. Chairman McCain rejected the Air Force’s contention that the F-35 was ready enough to be a real replacement for the A-10 and vowed to reverse the A-10 retirement process already underway. Senator Ayotte led a letter to Defense Secretary Ashton Carter with Senators Tom Cotton (R-AR), Lindsey Graham (R-SC), Thom Tillis (R-NC), Roger Wicker (R-MS), Mike Crapo (R-ID), Johnny Isakson (R-GA), and Richard Burr (R-NC) rebuking Hagel’s decision to place 18 A-10s in backup inventory. Specifically, the Senators called the decision a “back-door” divestment approved by a “disappointing rubber stamp” that guts “the readiness of our nation’s best close air support aircraft.” In the House, Representative Martha McSally (R-AZ) wrote to Secretary Carter stating that she knew from her own experience as a former A-10 pilot and 354th Fighter Squadron commander that the A-10 is uniquely capable for combat search and rescue missions, in addition to CAS, and that the retirement of the A-10 through a classified assessment violated the intent of Congress’s compromise with the Air Force:
  • Some in the press have been similarly skeptical of the Air Force’s intentions, saying that the plan “doesn’t add up,” and more colorfully, calling it “total bullshit and both the American taxpayer and those who bravely fight our wars on the ground should be furious.” Those reports similarly cite the Air Force’s longstanding antagonism to the CAS mission as the chief motive for the A-10’s retirement.
  • By announcing that pilots who spoke to Congress about the A-10 were “committing treason,” ACC Vice Commander Major General James Post sparked an Inspector General investigation and calls for his resignation from POGO and other whistleblower and taxpayer groups. That public relations debacle made it clear that the Air Force needed a new campaign strategy to support its faltering A-10 divestment campaign. On the orders of Air Force Chief of Staff General Mark Welsh, General Herbert “Hawk” Carlisle—the head of Air Combat Command—promptly announced a joint CAS Summit, allegedly to determine the future of CAS. It was not the first CAS Summit to be held (the most recent previous Summit was held in 2009), but it was the first to receive so much fanfare. As advertised, the purpose of the Summit was to determine and then mitigate any upcoming risks and gaps in CAS mission capabilities. But notes, documents, and annotated briefing slides reviewed by CDI reveal that what the Air Force publicly released from the Summit is nothing more than a white-washed assessment of the true and substantial operational risks of retiring the A-10.
  • Just prior to the Summit, a working group of approximately 40 people, including CAS-experienced Air Force service members, met for three days at Davis-Monthan Air Force Base to identify potential risks and shortfalls in CAS capabilities. But Air Force headquarters gave them two highly restrictive ground rules: first, assume the A-10s are completely divested, with no partial divestments to be considered; and second, assume the F-35 is fully CAS capable by 2021 (an ambitious assumption at best). The working groups included A-10 pilots, F-16 pilots, and Joint Terminal Attack Controllers (JTACs), all with combat-based knowledge of the CAS platforms and their shortfalls and risks. They summarized their findings with slides stating that the divestment would “cause significant CAS capability and capacity gaps for 10 to 12 years,” create training shortfalls, increase costs per flying hour, and sideline over 200 CAS-experienced pilots due to lack of cockpits for them. Additionally, they found that after the retirement of the A-10 there would be “very limited” CAS capability at low altitudes and in poor weather, “very limited” armor killing capability, and “very limited” ability to operate in the GPS-denied environment that most experts expect when fighting technically competent enemies with jamming technology, an environment that deprives the non-A-10 platforms of their most important CAS-guided munition. They also concluded that even the best mitigation plans they were recommending would not be sufficient to overcome these problems and that significant life-threatening shortfalls would remain.
  • General Carlisle was briefed at Davis-Monthan on these incurable risks and gaps that A-10 divestment would cause. Workshop attendees noted that he understood gaps in capability created by retiring the A-10 could not be solved with the options currently in place. General Carlisle was also briefed on the results of the second task to develop a list of requirements and capabilities for a new A-X CAS aircraft that could succeed the A-10. “These requirements look a lot like the A-10, what are we doing here?” he asked. The slides describing the new A-X requirements disappeared from subsequent Pentagon Summit presentations and were never mentioned in any of the press releases describing the summit.
  • At the four-day Pentagon Summit the next week, the Commander of the 355th Fighter Wing, Davis-Monthan Air Force Base, Col. James P. Meger, briefed lower level joint representatives from the Army and the Marine Corps about the risks identified by the group at Davis-Monthan. Included in the briefing was the prediction that divestment of the A-10 would result in “significant capability and capacity gaps for the next ten to twelve years” that would require maintaining legacy aircraft until the F-35A was fully operational. After the presentation, an Army civilian representative became concerned. The slides, he told Col. Meger, suggested that the operational dangers of divestment of the A-10 were much greater than had been previously portrayed by the Air Force. Col. Meger attempted to reassure the civilian that the mitigation plan would eliminate the risks. Following the briefing, Col. Meger met with Lt. Gen. Tod D. Wolters, the Deputy Chief of Staff for Operations for Air Force Headquarters. Notably, the Summit Slide presentation for general officers the next day stripped away any mention of A-10 divestment creating significant capability gaps. Any mention of the need to maintain legacy aircraft, including the A-10, until the F-35A reached full operating capability (FOC) was also removed from the presentation.
  • The next day, Col. Meger delivered the new, sanitized presentation to the Air Force Chief of Staff. There was only muted mention of the risks presented by divestment. There was no mention of the 10- to 12-year estimated capability gap, nor was there any mention whatsoever of the need to maintain legacy aircraft—such as the A-10 or less capable alternatives like the F-16 or F-15E—until the F-35A reached FOC. Other important areas of concern to working group members, but impossible to adequately address within the three days at Davis-Monthan, were the additional costs to convert squadrons from the A-10 to another platform, inevitable training shortfalls that would be created, and how the deployment tempos of ongoing operations would further exacerbate near-term gaps in CAS capability. To our knowledge, none of these concerns surfaced during any part of the Pentagon summit.
  • Inevitably, the Air Force generals leading the ongoing CAS Summit media blitz will point congressional Armed Services and Appropriations committees to the whitewashed results of their sham summit. When they do, Senators and Representatives who care about the lives of American troops in combat need to ask the generals the following questions: Why wasn’t this summit held before the Air Force decided to get rid of A-10s? Why doesn’t the Air Force’s joint CAS summit include any statement of needs from soldiers or Marines who have actually required close air support in combat? What is the Air Force’s contingency plan for minimizing casualties among our troops in combat in the years after 2019, if the F-35 is several years late in achieving its full CAS capabilities? When and how does the Air Force propose to test whether the F-35 can deliver close support at least as combat-effective as the A-10’s present capability? How can that test take place without A-10s? Congress cannot and should not endorse Air Force leadership’s Summit by divesting the A-10s. Instead, the Senate and House Armed Services Committees need to hold hearings that consider the real and looming problems of inadequate close support, the very problems that Air Force headquarters prevented their Summit from addressing. These hearings need to include a close analysis of CAPE’s assessment and whether the decision to classify its report was necessary and appropriate. Most importantly, those hearings must include combat-experienced receivers and providers of close support who have seen the best and worst of that support, not witnesses cherry-picked by Air Force leadership—and the witnesses invited must be free to tell it the way they saw it.
  • If Congress is persuaded by the significant CAS capability risks and gaps originally identified by the Summit’s working groups, they should write and enforce legislation to constrain the Air Force from further eroding the nation’s close air support forces. Finally, if Congress believes that officers have purposely misled them about the true nature of these risks, or attempted to constrain service members’ communications with Congress about those risks, they should hold the officers accountable and remove them from positions of leadership. Congress owes nothing less to the troops they send to fight our wars.

     Though not touched on in the article, the real problem is that the A10 has no proponents at the higher ranks of the Air Force because it is already bought and paid for; there's nothing in the A10 for the big Air Force aircraft manufacturing defense contractors. The F35, on the other hand is, is a defense contractor wet dream. It's all pie in the sky and big contracts just to get the first one in the air, let alone outfit it with the gear and programming needed to use it to inflict harm. It's been one cost-overrun after another and delay after delay. It's a national disgrace that has grown to become the most expensive military purchase in history. And it will never match the A10 for the close air support role. It's minimum airspeed is too high and its close-in maneuverability will be horrible. The generals, of course, don't want to poison the well for their post-military careers working for the defense contractors by putting a halt to the boondobble. Their answer: eliminate the close air support mission for at least 10-12 years and then attempt it with the F35.   As a former ground troop, that's grounds for the Air Force generals' court-martial and dishonorable discharge. I would not be alive today were it not for close air support. And there are tens of thousands of veterans who can say that in all truth. The A10 wasn't available back in my day, but by all reports its the best close air support weapons platform ever developed. It's a tank killer and is heavily armored, with redundant systems for pilot and aircraft survivability. The A10 is literally built around a 30 mm rotary cannon that fires at 3,900 rounds per minute. It also carries air to ground rockets and is the only close air support aircraft still in the U.S. arsenal. Fortunately, John McCain "get it" on the close air support mission and has managed to mostly protect the A10 from the generals. US May Be Complicit in War Crimes in Yemen | Al Jazeera America - 0 views

  • Eight months after Saudi Arabia and its Gulf allies began an aerial campaign against the Houthi rebels, the civilian death toll continues to mount. More than 5,600 people, including 2,615 civilians and 500 children, have been killed since March. The vast majority of civilian deaths are attributable to coalition airstrikes.  Human rights groups have warned about war crimes and the continued humanitarian calamity in Yemen. “Yemen in five months is like Syria after five years,” Peter Maurer, president of the International Committee of the Red Cross, said in August. “The humanitarian situation is nothing short of catastrophic. Every family in Yemen has been affected by this conflict.” Complicit in the growing humanitarian disaster is the United States and its unchecked arms sales to Saudi Arabia and other Gulf allies. The Barack Obama administration agreed to transfer more than $64 billion in weapons and services to members of the Gulf Cooperation Council (GCC) during its first five years. On Oct. 20, the U.S. government approved an $11.25 billion deal to sell warships to Saudi Arabia, ignoring calls from human rights activists to refrain from selling certain military equipment in light of the civilian toll it is inflicting. In continuing to provide weapons, intelligence and logistical support to Riyadh, including precision rockets and internationally banned cluster munitions, the U.S. is contributing to Yemen’s suffering.

Wikimedia v. NSA: Another Court Blinds Itself to Mass NSA Surveillance | Electronic Fro... - 0 views

  • We all know justice is blind. But that is supposed to mean that everyone before it is treated equally, not that the justice system must close its eyes and refuse to look at important legal issues facing Americans.  Yet the government continues to convince courts that they cannot consider the constitutionality of its behavior in national security cases and, last week, in an important case for anyone who has ever used Wikipedia, another judge agreed with that position.  A federal district judge in Maryland dismissed Wikimedia v. NSA, a case challenging the legality of the NSA’s “upstream” surveillance—mass surveillance of Internet communications as they flow through the Internet backbone. The case was brought by our friends at the ACLU on behalf of nine plaintiffs, including human rights organizations, members of the media, and the Wikimedia Foundation.1 We filed a brief in the case, too, in support of Wikimedia and the other plaintiffs. The judge dismissed the case based on a legal principle called standing. Standing is supposed to ensure, among other things, that the party bringing the lawsuit has suffered a concrete harm, caused by the party being sued, and that the court can resolve the harm with a favorable ruling.
  • But the U.S. government has taken this doctrine, which was intended to limit the cases federal courts hear to actual live controversies, and turned it into a perverse shell game in surveillance cases—essentially arguing that because aspects of the surveillance program are secret, plaintiffs cannot prove that their communications were actually, in fact, intercepted and surveilled. And without that proof, the government argues, there’s no standing, because plaintiffs can’t show that they’ve suffered harm. Sadly, like several other courts before it, the judge agreed to this shell game and decided that it couldn’t decide whether the constitutional rights of Wikimedia and the other plaintiffs were violated.  This game is mighty familiar to us at EFF, but that doesn’t make it any less troubling. In our system, the courts have a fundamental obligation to conclusively determine the legality of government action that affects individuals’ constitutional rights. For years now, plaintiffs have tried to get the courts to simply issue a ruling on the merits of NSA surveillance programs. And for years, the government has successfully persuaded the courts to rely on standing and related doctrines to avoid doing so. That is essentially what happened here. The court labeled as “speculative” Wikimedia’s claim that, at a minimum, even one of its approximately one trillion Internet communications had been swept up in the NSA’s upstream surveillance program. Remember, this is a program that, by the government’s own admission, involves the searching and scanning of vast amounts of Internet traffic at key Internet junctures on the Internet’s backbone. Yet in court’s view, Wikimedia’s allegations describing upstream—based on concrete facts, taken from government documents— coupled with a plaintiff that engages in a large volume of internet communications were not enough to state a “plausible” claim that Wikimedia had been surveilled.

The Government’s Automated Eyes Are Still Government Eyes First, it appears the court fundamentally misunderstood Wikimedia’s claim about upstream surveillance and, in particular, “about surveillance.” As Wikimedia alleged, “about surveillance” (a specific aspect of upstream surveillance that searches the content of communications for references to particular email addresses or other identifiers) amounts to “the digital analogue of having a government agent open every piece of mail that comes through the post to determine whether it mentions a particular word or phrase.” The court held, however, that this type of “about” surveillance was “targeted insofar as it makes use of only those communications that contain information matching the tasked selectors,” like email addresses. But what the government "makes use of" is entirely beside the point—it is the scanning of the communications for the tasked selectors in the first place that is the problem.  To put it into a different context, the government conducts a search when it enters into your house and starts rifling through your files—not just when it finds something it wants to keep. The government's ultimate decision to “make use of” the communications it finds interesting is irrelevant. It is the search of the communications that matters.

  • Back of the Envelope Gymnastics Another troubling aspect of the court’s decision was its attack on the probabilities Wikimedia assigned to the likelihood of its communications being intercepted. Given that Wikimedia engages in a large volume of Internet communications, Wikimedia alleged that—even assuming a .00000001% chance that any one particular communication is intercepted—it would still have a 99.9999999999% of having one of its communications intercepted. The statistic was used to illustrate that, even assuming very low probabilities for interception, there was still a near-certainty that Wikipedia’s traffic was collected. But the court attacked Wikimedia’s simple statistical analysis (and the attack tracked, to a great degree, arguments made in the government’s declarations that the court purportedly did not consider). The court seemed to believe it had seized upon a great flaw in Wikimedia’s case by observing that, if the probability of any given communication being intercepted were decreased 100% or 1000%, the probability of one of Wikimedia’s communications being intercepted would similarly drop. The “mathematical gymnastics” the court believed it had unearthed were nothing more than Wikimedia using an intentionally small (and admittedly arbitrary) probability to illustrate the high likelihood that its communications had been swept up. But even if the court disagreed with the probabilities Wikimedia relied on, it’s not at all clear why that would justify dismissing the case at the outset. If it turned out, after development of the record, that the probabilities were off, then dismissal might be appropriate. But the court cut the case off before Wikimedia had the opportunity to introduce evidence or other facts that might support the probability they assigned.
  • Someone Else Probably Has Standing, Right? Perhaps most troubling was the court’s mistaken belief that the legality of upstream surveillance could be challenged in other ways, beyond civil cases like Wikimedia or our ongoing case, Jewel v. NSA. The court asserted its decision would not insulate upstream from judicial review, which—according to the court—could still receive judicial scrutiny through (1) review from the Foreign Intelligence Surveillance Court (FISC), (2) a challenge by a criminal defendant, or (3) a challenge from an electronic service provider. None of these options is truly a viable alternative, however. First, the FISC (until very recently) did not have adversarial proceedings—it only heard from the government, and its proceedings remain both far more limited and more secretive than a regular court’s. Second, a challenge from a criminal defendant won’t work either, because, to date, the government has explicitly refused to disclose—even where defendants are notified of the use of FISA surveillance—whether their communications were obtained using upstream surveillance. And, finally, in the nearly 15 years (or more) the government has conducted upstream surveillance, we’re not aware of any service provider that has challenged the legality of the practice. Indeed, given that upstream is done with the cooperation of telecoms like AT&T and Verizon—the same telcos that did not challenge the NSA’s bulk collection of Americans’ call records for over a decade—we're not holding our breath for a challenge anytime soon. Instead, we need the courts to tackle these cases. Upstream surveillance presents unique constitutional issues that no federal court has seriously addressed. It's time the federal courts stepped up to the challenge.

A key reason is because a perennially paranoid House of Saud feels betrayed by their American protectors who, under the Obama administration, seem to have given up on isolating Iran.
  • From the House of Saud’s point of view, three factors are paramount. 1) A general sense of ‘red alert’ as they have been deprived from an exclusive relationship with Washington, thus becoming incapable of shaping US foreign policy in the Middle East; 2) They have been mightily impressed by Moscow’s swift counter-terrorism operation in Syria; 3) They fear like the plague the current Russia-Iran alliance if they have no means of influencing it.

  • One of the untold stories of the recent Syria-driven diplomatic flurry is how Moscow has been silently working on mollifying both Saudi Arabia and Turkey behind the scenes. That was already the case when the foreign ministers of US, Russia, Turkey and Saudi Arabia met before Vienna.Vienna was crucial not only because Iran was on the table for the first time but also because of the presence of Egypt – incidentally, fresh from recent discovery of new oil reserves, and engaging in a reinforced relationship with Russia.The absolute key point was this paragraph included in Vienna’s final declaration: “This political process will be Syrian-led and Syrian-owned, and the Syrian people will decide the future of Syria.”It’s not by accident that only Russian and Iranian media chose to give the paragraph the appropriate relevance. Because this meant the actual death of the regime change obsession, much to the distress of US neocons, Erdogan and the House of Saud.
  • The main point is the death of the regime change option, brought about by Moscow. And that leaves Putin free to further project his extremely elaborate strategy. He called Erdogan on Wednesday to congratulate him on his and the AKP’s election landslide. This means that now Moscow clearly has someone to talk to in Ankara. Not only about Syria. But also about gas.Putin and Erdogan will have a crucial energy-related meeting at the G20 summit on November 15 in Turkey; and there’s an upcoming visit by Erdogan to Moscow. Bets are on that the Turk Stream agreement will be – finally – reached before the end of the year. And on northern Syria, Erdogan has been forced to admit by Russian facts on the ground and skies that his no-fly zone scheme will never fly.
  • That leaves us with the much larger problem: the House of Saud.There’s a wall of silence surrounding the number one reason for Saudi Arabia to bomb and invade Yemen, and that is to exploit Yemen’s virgin oil lands, side by side with Israel – no less. Not to mention the strategic foolishness of picking a fight with redoubtable warriors such as the Houthis, which have sowed panic amidst the pathetic, mercenary-crammed Saudi army.Riyadh, following its American reflexes, even resorted to recruiting Academi – formerly Blackwater - to round up the usual mercenary suspects as far away as Colombia.It was also suspected from the beginning, but now it's a done deal that the responsible actor for the costly Yemen military disaster is none other than Prince Mohammad bin Salman, the King’s son who, crucially, was sent by his father to meet Putin face-to-face.
  • Meanwhile, Qatar will keep crying because it was counting on Syria as a destination point for its much-coveted gas pipeline to serve European customers, or at least as a key transit hub on the way to Turkey.Iran on the other hand needed both Iraq and Syria for the rival Iran-Iraq-Syria gas pipeline because Tehran could not rely on Ankara while it was under US sanctions (this will now change, fast). The point is Iranian gas won’t replace Gazprom as a major source for the EU anytime soon. If it ever did, or course, that would be a savage blow to Russia.
  • In oil terms, Russia and the Saudis are natural allies. Saudi Arabia cannot export natural gas; Qatar can. To get their finances in order – after all even the IMF knows they are on a highway to hell - the Saudis would have to cut back around ten percent of production with OPEC, in concert with Russia; the oil price would more than double. A 10 percent cutback would make a fortune for the House of Saud.So for both Moscow and Riyadh, a deal on the oil price, to be eventually pushed towards $100 a barrel, would make total economic sense. Arguably, in both cases, it might even mean a matter of national security.But it won’t be easy. OPEC’s latest report assumes a basket of crude oil to be quoted at only $55 in 2015, and to rise by $5 a year reaching $80 only by 2020. This state of affairs does not suit either Moscow or Riyadh.
  • Meanwhile, fomenting all sorts of wild speculation, ISIS/ISIL/Daesh still manages to collect as much as $50 million a month from selling crude from oilfields it controls across “Syraq”, according to the best Iraq-based estimates.The fact that this mini-oil caliphate is able to bring in equipment and technical experts from “abroad” to keep its energy sector running beggars belief. “Abroad” in this context means essentially Turkey – engineers plus equipment for extraction, refinement, transport and energy production.One of the reasons this is happening is that the US-led Coalition of the Dodgy Opportunists (CDO) – which includes Saudi Arabia and Turkey - is actually bombing the Syrian state energy infrastructure, not the mini oil-Caliphate domains. So we have the proverbial “international actors” in the region de facto aiding ISIS/ISIL/Daesh to sell crude to smugglers for as low as $10 a barrel.Saudis – as much as Russian intel - have noted how ISIS/ISIL/Daesh is able to take over the most advanced US equipment that takes months to master, and instead integrate it into their ops at once. This implies they must have been extensively trained. The Pentagon, meanwhile, sent and will be sending top military across “Syraq” with an overarching message: if you choose Russia we won’t help you.ISIS/ISIL/Daesh, for their part, never talks about freeing Jerusalem. It’s always about Mecca and Medina.

  • Propping Up the Derivatives Scheme Dodd-Frank states in its preamble that it will “protect the American taxpayer by ending bailouts.” But it does this under Title II by imposing the losses of insolvent financial companies on their common and preferred stockholders, debtholders, and other unsecured creditors. That includes depositors, the largest class of unsecured creditor of any bank.
  • Title II is aimed at “ensuring that payout to claimants is at least as much as the claimants would have received under bankruptcy liquidation.” But here’s the catch: under both the Dodd Frank Act and the 2005 Bankruptcy Act, derivative claims have super-priority over all other claims, secured and unsecured, insured and uninsured.
  • The over-the-counter (OTC) derivative market (the largest market for derivatives) is made up of banks and other highly sophisticated players such as hedge funds. OTC derivatives are the bets of these financial players against each other. Derivative claims are considered “secured” because collateral is posted by the parties. For some inexplicable reason, the hard-earned money you deposit in the bank is not considered “security” or “collateral.” It is just a loan to the bank, and you must stand in line along with the other creditors in hopes of getting it back. State and local governments must also stand in line, although their deposits are considered “secured,” since they remain junior to the derivative claims with “super-priority.”

The difference with the “bail-in” is that the order of creditor seniority is changed. In the end, it amounts to the cronies (other banks and government) and non-cronies. The cronies get 100% or more; the non-cronies, including non-interest-bearing depositors who should be super-senior, get a kick in the guts instead. . . . In principle, depositors are the most senior creditors in a bank. However, that was changed in the 2005 bankruptcy law, which made derivatives liabilities most senior. Considering the extreme levels of derivatives liabilities that many large banks have, and the opportunity to stuff any bank with derivatives liabilities in the last moment, other creditors could easily find there is nothing left for them at all.
  • A study involving the cost to taxpayers of the Dodd-Frank rollback slipped by Citibank into the “cromnibus” spending bill last December found that the rule reversal allowed banks to keep $10 trillion in swaps trades on their books. This is money that taxpayers could be on the hook for in another bailout; and since Dodd-Frank replaces bailouts with bail-ins, it is money that creditors and depositors could now be on the hook for.

  • The Dodd Frank Act and the Bankruptcy Reform Act both need a radical overhaul, and the Glass-Steagall Act (which put a fire wall between risky investments and bank deposits) needs to be reinstated.
  • Meanwhile, local legislators would do well to set up some publicly-owned banks on the model of the state-owned Bank of North Dakota – banks that do not gamble in derivatives and are safe places to store our public and private funds.

The mutations are a probable precursor of what is in store for Japanese people who are being resettled in allegedly de-contaminated towns and villages.
  • Japanese scientists are reluctant to comment on the record. Several attempts by nsnbc to reach out resulted in off-protocol confirmations of suspicions and references to Japanese law that makes revealing of unauthorized information about the Fukushima disaster a criminal offense that can be punishable with up to ten years in prison. The official line is that Japanese scientists are trying to figure out whether there is a causal relation between the wave of mutations and the still ongoing release of radiation and radionucleides into the environment. Studies focus primarily on hos radioactive cesium spread in forests and forest soil after the catastrophic triple meltdown at the TEPCO operated Fukushima Daiichi NPP after it was struck by an earthquake and a subsequent tsunami in 2011. Results of a 2013 study already revealed that levels of the radioactive isotope cesium from the crippled Fukushima Daiichi power plant in northern Japanese forests had almost doubled within one year and that it will continue increasing as the forests bioaccumulate the isotope. The 2013 study and ongoing studies have major ramifications even though these studies largely ignore a cohort of other, potentially more dangerous isotopes such as plutonium.
  • The wave of mutations in insects, fir trees and other animals is according to Japanese experts who are relutant to speak on the record a precursor for what populations who live within a 100 km radius of the crippled power-plant can expect to see in human populations. The Japanese government’s push for resettling populations that were evacuated to so-called de-contaminated villages and towns is particularly problematic and controversial. The Japanese government’s definition of a de-contaminated village, for example, means that the village itself and an area of a few hundred meters leading to these villages have been de-contaminated by e.g. top-sol removal. Water and airborne isotopes will, however, move with the waters and winds and easily re-contaminate these so-called safe zones. Evacuees who refuse to be resettled risk losing government support. Another serious issue is that radioactive contaminated waste from the region is incinerated in facilities throughout Japan, thus spreading airborne contamination throughout the entire country. Some critics stress that this program may aim at making it extremely difficult to conduct epidemiological studies.

  • In November 2015 the former Japanese Ambassador to Switzerland, Mitshei Murata, called on the President of the International Olympic Committee to move the 2020 Olympics from Tokyo or to cancel the games. Murata noted that he, as many others feel the Olympic Summer Games under these circumstances should be canceled and the preparations abandoned. Murata wrote: Not only do we have a continued contamination of the groundwater and the Pacific Ocean by the unstable plant, but the brittle structure of the damaged plant represents itself a serious threat, in particular in our earthquake prone region. Given the relative proximity of Tokyo, just some 200km South of Fukushima, represents in my view an ongoing risk for our largest city, for its citizens and all visitors. You might agree that one more alarming development as the recent earthquake of magnitude 8.1 just some weeks ago might indeed increase the pressure to stop the planning process of the 2020 games all together.

A large number of hotels and companies operating in the tourist sector face mounting debt problems, with the fallout from the Russian Su-24 incident driving hotel owners to sell their property, real estate agent Ismail Ozer said, according to the report.

Either the Pentagon supports the Syrian Kurds or Erdogan’s invasion of northern Syria; schizophrenia does not apply here.A desperate Erdogan may be foolish enough to confront the Russian Air Force during his purported “invasion”. Putin is on the record saying response to any provocation will be immediate, and lethal. To top it off, the Russians and Americans are actually coordinating airspace action in northern Syria.

  • The powerful Syrian Kurdish YPG militia and its local allies have drawn up plans for a major attack to seize the final stretch of the Syrian-Turkish border held by Islamic State fighters, a YPG source familiar with the plan said on Thursday.Such an offensive could deprive Islamic State fighters of a logistical route that has been used by the group to bring in supplies and foreign recruits.But it could lead to confrontation with Turkey, which is fighting against its own Kurdish insurgents and sees the Syrian Kurds as an enemy. After a year of military gains aided by U.S.-led air strikes, the Kurds and their allies already control the entire length of Syria's northeastern Turkish frontier from Iraq to the banks of the Euphrates river, which crosses the border west of the town of Kobani.Other Syrian insurgent groups control the frontier further west, leaving only around 100 km (60 miles) of border in the hands of Islamic State fighters, running from the town of Jarablus on the bank of the Euphrates west to near the town of Azaz.But Turkey says it will not allow the Syrian Kurds to move west of the Euphrates.
  • The source confirmed a report on Kurdish news website Xeber24 which cited a senior YPG leader saying the plan includes crossing the Euphrates to attack the Islamic State-held towns of Jarablus and Manbij, in addition to Azaz, which is held by other insurgent groups.The source did not give a planned date, but said a Jan. 29 date mentioned in the Xeber24 report might not be accurate.The YPG has been the most important partner on the ground of a U.S.-led air campaign against Islamic State, and is a major component of an alliance formed last year called the Syria Democratic Forces, which also includes Arab and other armed groups. The alliance is quietly backed by Washington, even as its NATO ally in the region, Turkey, is hostile. The political party affiliated with the YPG, the PYD, has been excluded from Syria peace talks the United Nations plans to hold in Geneva on Friday. The PYD and its allies say their exclusion undermines the process and have blamed Turkey.Ankara fears further expansion by the YPG will fuel separatist sentiment among its own Kurdish minority. It views the Syrian Kurdish PYD as a terrorist group because of its affiliation to Turkish Kurdish militants.

Hillary Clinton, With Little Notice, Vows to Embrace an Extremist Agenda on Israel - 0 views

  • Photo: Alex Brandon/APFormer President Bill Clinton on Monday met in secret (no press allowed) with roughly 100 leaders of South Florida’s Jewish community, and, as the Times of Israel reports, “He vowed that, if elected, Hillary Clinton would make it one of her top priorities to strengthen the U.S.-Israel alliance.” He also “stressed the close bond that he and his wife have with the State of Israel.” It may be tempting to dismiss this as standard, vapid Clintonian politicking: adeptly telling everyone what they want to hear and making them believe it. After all, is it even physically possible to “strengthen the U.S.-Israel alliance” beyond what it already entails: billions of dollars in American taxpayer money transferred every year, sophisticated weapons fed to Israel as it bombs its defenseless neighbors, blindly loyal diplomatic support and protection for everything it does? But Bill Clinton’s vow of even greater support for Israel is completely consistent with what Hillary Clinton herself has been telling American Jewish audiences for months. In November, she published an op-ed in The Forward in which she vowed to strengthen relations not only with Israel, but also with its extremist prime minister, Benjamin Netanyahu.
  • Her comments on Israel have similarly contained implicit criticisms of Obama’s foreign policy: namely, that he has created or at least allowed too much animosity with Netanyahu. In her Forward op-ed, she wrote that the Israeli prime minister’s “upcoming visit to Washington is an opportunity to reaffirm the unbreakable bonds of friendship and unity between the people and governments of the United States and Israel.” She pointedly added: “The alliance between our two nations transcends politics. It is and should always be a commitment that unites us, not a wedge that divides us.” And in case her message is unclear, she added this campaign promise: “I would also invite the Israeli prime minister to the White House in my first month in office.” Last month, Clinton wrote an even more extreme op-ed in the Jewish Journal, one that made even clearer that she intends to change Obama’s policy to make it even more “pro-Israel.” It begins: “In this time of terrorism and turmoil, the alliance between the United States and Israel is more important than ever. To meet the many challenges we face, we have to take our relationship to the next level.”
  • “With every passing year, we must tie the bonds tighter,” she wrote. Tie those bonds tighter. Thus: As part of this effort, we need to ensure that Israel continues to maintain its qualitative military edge. The United States should further bolster Israeli air defenses and help develop better tunnel detection technology to prevent arms smuggling and kidnapping. We should also expand high-level U.S.-Israel strategic consultations. As always, there is not a word about the oppression and brutality imposed on Palestinians as part of Israel’s decadeslong occupation. She does not even acknowledge, let alone express opposition to, Israel’s repeated, civilian-slaughtering bombing of the open-air prison in Gaza. That’s because for Clinton — like the progressive establishment that supports her — the suffering and violence imposed on Palestinians literally do not exist. None of this is mentioned, even in passing, in the endless parade of pro-Clinton articles pouring forth from progressive media outlets.

  • Clinton partisans — being Clinton partisans — would, if they ever did deign to address Israel/Palestine, undoubtedly justify Clinton’s hawkishness on the ground of political necessity: that she could never win if she did not demonstrate steadfast devotion to the Israeli government. But for all his foreign policy excesses, including on Israel, Obama has proven that a national politician can be at least mildly more adversarial to Israeli leaders and still retain support. And notably, there is at least one politician who rejects the view that one must cling to standard pro-Israel orthodoxy in order to win; just yesterday, Donald Trump vowed “neutrality” on Israel/Palestine. As I noted a couple of weeks ago, Clinton advocates are understandably desperate to manufacture the most trivial controversies because the alternative is to defend her candidacy based on her prior actions and current beliefs (that tactic was actually pioneered by then-Clinton operative Dick Morris, who had his client turn the 1996 election into a discussion of profound topics such as school uniforms). If you were a pro-Clinton progressive, would you want to defend her continuous vows to “strengthen” U.S. support for the Netanyahu government and ensure that every year “we must tie the bonds tighter”?
