As concern mounted over the sweeping nature of US surveillance, the director of national intelligence, James Clapper, confirmed revelations by the Guardian that the National Security Agency uses companies such as Google, Facebook and Apple to obtain information that includes the content of emails and online files.

How Congress unknowingly legalized PRISM in 2007 - 0 views

  • On Sept. 11, 2007, the National Security Agency signed up Microsoft as its first partner for PRISM, a massive domestic surveillance program whose existence was reported by the Washington Post today. That’s barely a month after Congress passed, and President George W. Bush signed, the Protect America Act.
  • The Bush Administration portrayed the PAA as a technical fix designed to close a gap in America’s surveillance capabilities that had been opened by a then-recent ruling of the secretive Foreign Intelligence Surveillance Court (FISC). It proved to be much more than that. While the details are still classified, reports suggested that the FISC had ruled that it was illegal for the government to intercept communications between two foreign endpoints if the communications happened to pass through the United States. Warning that the U.S. would suddenly lose the ability to continue its surveillance of terrorists, the administration pushed the PAA through Congress in a matter of days.
  • In reality, the PAA represented a sweeping change to American surveillance law. Before conducting surveillance, the PAA only required executive branch officials to “certify” that there were “reasonable procedures” in place for ensuring that surveillance “concerns” persons located outside the United States and that the foreign intelligence is a “significant purpose” of the program. A single certification could cover a broad program intercepting the communications of numerous individuals. And there was no requirement for judicial review of individual surveillance targets within a “certified” program.

To comply with the requirement that the government not target Americans, PRISM searches are reportedly “designed to produce at least 51 percent confidence in a target’s ‘foreignness’” — the lowest conceivable standard. PRISM training materials reportedly instruct users that if searches happen to turn up the private information of Americans, “it’s nothing to worry about.”

    Excellent history of how America lost it's Constitutional Republic.  The author tags the first progressive (marxist/socialist) President, Woodrow Wilson, as the culprit.  In 1913 Wilson shoved through the 16th and 17th Amendments.  He also pushed through the midnight express known as the Federal Reserve.  And as if that was not enough damage, he pushed for the "League of Nations" - a precursor to the present day United Nations Globalist New World Order. Oh yeah, the first progressive president also jacked us into humanities first World War.     I agree that Colmes is far from the sharpest knife in the drawer. In my opinion, he was largely a Fox News invention to give Shawn Hannity a far weaker opponent to argue against that Hannity's idiocy could still overcome. There are in reality liberals that Hannity could never have gone toe-to-toe with. (That's not an endorsement of liberalism; it's commentary on the quality of Hannity's arguments.) The show was mostly a variant of the straw man logical fallacy; the fact that Colmes lacked the ability to think critically or communicate effectively made Hannity "win" the pseudo-debate in the eyes of those unable to think critically themselves. I have some criticism of Casey's remarks that apply more generally to my experience of strict Libertarians and perhaps even farther to strict adherents to any "ism." My criticism boils down to a couple of examples of hard issues usually avoided by strict Libertarians. -- The Disabled: When discussing Social Security disability benefits, Casey changes the subject from the genuinely disabled to a short rant about those whose disability claims are bogus and the "ambulance chasing" lawyers who pursue their claims. But if pressed to the wall and forced to answer, I strongly suspect that Casey would admit that there are people, likely the majority of Social Security disability benefits, whose claims are genuine. The net effect of his relevant argument: an impression that he has a Darwinian view that he would leave the disabled dying in the streets without sustenance or medical care. That kind of society is unacceptable to me. Perhaps it is to Casey too, but if so I think it was incumbent on him to offer a solution for the genuinely disabled. (In fairness, I'll note that at one point Casey hinted but did not forthrightly say that he would favor financial assistance for single mothers in Harlem.) -- Medical Care: I agree that our health care system is badly broken. But again Casey is long on criticism but short on realistic idea

    I needed some background regarding the founding documents and their position on individual property rights.  Google came back with this gem!   The basic argument i'm pursuing is that socialism is unconstitutional because it's based on the selective seizure and redistribution of wealth.  Meaning, not all citizens are equal before the law.  The complaints lodged against King George in the Declaration of Independence are very much about the colonist not having the same rights of Englishmen as those whom the King favors. excerpt: the purpose of the Declaration of Independence. "Not to find out new principles, or new arguments, never before thought of, not merely to say things which had never been said before; but to place before mankind the common sense of the subject . . . ."1 The "common sense of the subject" expressed in the Declaration of Independence was that a national civil government must be based upon the "Laws of Nature and of Nature's God." The laws of nature and of nature's God dictate that all men are equally endowed by their Creator with unalienable rights to "Life, Liberty and the pursuit of Happiness." In Jefferson's day, the common sense of the subject was that the pursuit of happiness included the unalienable right of the individual to acquire, possess, protect and dispose of property. Because the purpose of civil governments was to secure unalienable rights, violations of one's unalienable right of property were subject to civil sanction. Today, however, the common sense of the subject is quite the opposite. The modern idea is that civil government properly possesses all power over all subjects of property. Any rights that may exist are derived from the civil government. Any rights to property that a person has may be regulated, limited or revoked by the civil government in order to satisfy the "public interest." It is the only system that has lifted all of mankind, at every level, to a higher standard of living. It continues to advance the prosperity of all individuals unless destroyed from within, like Greece and Rome when they moved towards totalitarianism and away from democracy!

Some quick comments:  Libertarianism differs from Conservatism in that conservatives champion conservative-judeo-christian social values.  The kind you think of when you hear God, Country, Community and Family.  The Libertarian champions the founding documents; the Declaration and the Constitution.  Here the only "value" the founding fathers desired to be embedded in the governing structure was that of "individual liberty".  Making the governing structure a Republic focused entirely on the objective of "ordered liberty". socialist are also focused on social values, but their primary objective is the welfare of the group.  More often than not, the individual's liberty is sacrificed to the welfare of the group.  In fact, in knee jerk socialism, the individual only exist to benefit the greater society.  When the individual becomes a drag, euthanasia is the tool of choice for a socialist.  Not though that as long as the individual is a voting and consuming member of the group that is overturning the Constitutional Republic, and clamoring to replace the Republic with mobocracy democracy, the

    n a chapter titled "Breaking the Back of Crony Capitalism," Schweizer lays out some much needed reforms that he hopes are undertaken. Here are some of his proposals: * Create a legal code that makes trading on nonpublic government information illegal both for those who pass the information and for those who trade on it.  * Corporate insiders trading their own company's stock are required to disclose these transactions to the SEC within two days. Why not apply the same standard to Congress?  * Members of Congress should not be allowed to trade stock in companies that are overseen by their committees. * Apply whistleblower laws to Congress. If it's good enough for federal workers and corporate employees, it should be good enough for Congress.  * Disallow "sweetheart" IPOs. Unless the initial public offering goes through a public auction, in which people can openly compete for shares in a bidding contest, members of Congress should not be allowed to participate. * Family members of legislators should not be allowed to become lobbyists. * The federal government needs to get out of the business of offering grants and taxpayer-backed loans.  Americans who have suspected that Washington does not have their interests at heart and wonder on their trips to the nation's capital how it is such a gilded boomtown will get answers in this book.  The country is at the beginning stages of a citizen revolt against the permanent political class whose interests are tied to the crony capitalistic system that benefits their own self-interest.
