CONFIRMED: Russia sends S-300 advanced missile system to Syria, U.S. runs out of options - 0 views

  • Shortly before the US announcement of its decision to suspend talks with Russia on the ‘cessation of hostilities’ agreement reached by US Secretary State Kerry and Russian Foreign Minister Lavrov on 9th September 2016, a clearly well-sourced article setting out US options was published by Reuters. This article was clearly written on the basis of information provided by senior officials of the US government.  It confirms that “staff level” discussions are underway in the US in light of the collapse of the Kerry-Lavrov agreement and the Syrian army’s advances in Aleppo, though as of the date of publication of the Reuters article (29th September 2016) no suggestions of what to do had been made to Obama. Here is a list of the options apparently being considered (1) “supporting rebel counter attacks elsewhere with additional weaponry or even air strikes, which “might not reverse the tide of battle, but might cause the Russians to stop and think””; (2) “a U.S. air strike on a Syrian air base far from the fighting between Assad’s troops and rebel forces in the north” (the Syrian air base in question is probably the one at Deir Ezzor); (3) “sending more U.S. special operations forces to train and advise Kurdish and Syrian rebel groups”; (4) “deploying additional American and allied naval and airpower to the eastern Mediterranean, where a French aircraft carrier is already en route”.
  • Apparently the idea of supplying more shoulder held surface to air missiles to the Jihadis has been ruled out because “the Obama administration fears (they) could fall into the hands of Islamic State militants or al Qaeda-linked groups”. As for the idea of a no-fly zone (“a humanitarian airlift to rebel-held areas (NB: this almost certain refers to Aleppo – AM), which would require escorts by U.S. warplanes”) this has apparently been deemed “too risky” and has been “moved down the list”. This list of options exposes how completely out of options the US really is. 
  • Options (1) and (2) cannot influence the course of the fighting in Aleppo and US officials apparently admit as much.  On past experience option (1) is less likely to make the Russians “stop and think” than to make them more determined and more angry.  Option (3) is a case of more of the same.  The US has been doing this for years without achieving any results.  Option (4) is essentially symbolic unless it is intended to prepare the way for the declaration of a no-fly zone, which however US officials seem to be ruling out. If reports are to be believed the Russians may be taking more steps to guard against the possibility of the US declaring a no-fly zone.  Fox News is reporting US officials as saying that the Russians have reinforced the S400 anti aircraft missile system they have already deployed to Syria with a number of advanced S-300VM “Antey-2500″ anti aircraft systems.  Whilst the Russians have not confirmed this report, if it is true then it makes any US attempt to impose a no-fly zone even more risky.  A sign that the report probably is true is that the Kremlin is pointedly failing to deny it. The Russians have also pointedly reminded the US that they know the whereabouts of all US military personnel in Syria, including presumably those supposedly present in the various Jihadi headquarters (or “operations rooms”) existing in the country.

  • This looks frankly like a threat to retaliate against US military personnel if Russian military personnel in Syria are attacked by the US.  There have been unconfirmed reports that the Russians did exactly that by attacking a Jihadi “operations room” partly staffed by US and Western military personnel following the US attack on the Syrian military near Deir Ezzor.  If those reports are true then the implied threat the Russians are making to retaliate against US troops in the event of attacks upon their own military is not an empty one. One way or the other, it is not difficult to see why the US might conclude that imposing a no-fly zone is “too risky” and why this option has been “moved down the list”. Possibly because the US has no real options short of steps that might threaten a nuclear war with Russia, Kerry spoke twice by telephone to Lavrov over the weekend, presumably in an attempt to get the Russians to get the Syrians to pull back in Aleppo so as to preserve the US’s bluff.  However it is clear he found Lavrov immoveable.  Lavrov has instead been issuing a series of statements accusing the US of siding with Jabhat Al-Nusra (ie. Al-Qaeda), questioning whether President Obama is any longer in control of the US military, and calling into question Kerry’s good faith.

  • f, as seems likely, President Barack Obama retains enough support to complete the nuclear deal with Iran, it will be largely because enough members of the House and Senate are persuaded by his argument that the only other real option is war.This was the rhetorical gauntlet the president threw down at his press conference last week. Equally significant, Mr. Obama omitted the until-now obligatory warning that "all options, including the military one, remain on the table."
  • Since then, Israeli media have been pressing hard to restore the military option to its accustomed place "on the table." Flying to Israel Sunday night for a handholding mission with top Israeli officials, U.S. Defense Secretary Ashton Carter tried to make his reception in Tel Aviv less frosty, telling accompanying journalists that the nuclear deal with Iran "does nothing to prevent the military option." The context, however, seemed to be one in which Iran was caught cheating on the nuclear deal.That this kind of rhetoric, even when it is not from the president, is still poison to Tehran was clear in the immediate reaction by Iran's Foreign Minister, Mohammad Javad Zarif, who insisted Monday: "Applying force ... is not an option but an unwise and dangerous temptation."
  • Looking for changes in official public statements was my bread and butter during a long tenure as a Kremlinologist. So on Wednesday, as I watched Mr. Obama defend the deal with Iran, I leaned way forward at each juncture — and there were several — where the timeworn warning about all options being "on the table" would have been de rigueur. He avoided saying it. "All options on the table?" The open-ended nature of this Bush/Cheney-esque bully-type warning is at odds with Western international understandings spanning more than three and half centuries — from the treaties of Westphalia (1648), to the Kellogg-Briand Pact (1928) to the post-World War II Nuremberg Tribunal to the UN Charter (1945). Try raising that with Establishment Washington, though, and be prepared to be dismissed as "picky-picky," or as quaint and as obsolete as the Geneva Conventions. Undergirding all this is the chauvinism reflected in President Obama's repeated reminders that the U.S. "is the sole indispensable country in the world."But in the wake of last week's accord with Iran in Vienna, it is possible now to hope that the "military option" is finally off the table — in reality, if not in occasional rhetorical palliatives for Israel.

Nor do they know of the essential role played by courageous managers of intelligence who, for the first time on the Iran nuclear issue, supervised a strictly evidence-based, from-the-bottom-up National Intelligence Estimate (NIE) that concluded in November 2007 that Iran had stopped working on a nuclear weapon at the end of 2003 and had not resumed that work. That key judgment issued unanimously and "with high confidence" by all 16 U.S. intelligence agencies played a huge role in strengthening the hand of Mike Mullen, then-chairman of the Joint Chiefs of Staff, and other reasonable national security leaders in dissuading President Bush from following Vice President Cheney's prompting to launch a war that would have made the war in Iraq look like a volleyball match between the Quaker School and Ursuline Academy.The juggernaut toward war with Iran was already rolling downhill. Recall that then-CENTCOM commander Adm. William Fallon was abruptly cashiered after saying "we're not going to do Iran on my watch." And Mr. Cheney later admitted churlishly that Mr. Bush had been a big disappointment in giving in to intelligence and military officials on Iran.In Mr. Bush's memoir "Decision Points," he complains bitterly that the NIE "tied my hands on the military side. ... After the NIE, how could I possibly explain using the military to destroy the nuclear facilities of a country the intelligence community said had no active nuclear weapons program?"

Investigation Finds World's Largest Coal Company Misled Public On Climate Change | Thin... - 0 views

  • The world’s largest private coal company misled its investors and the public about the financial risks of climate change, New York state’s attorney general announced on Monday. In a press release, Attorney General Eric Schneiderman said Peabody Energy violated New York laws prohibiting “false and misleading conduct” in public statements about its business. Specifically, Schneiderman found that Peabody failed to tell its investors about how regulations to fight climate change could hurt the coal industry. Instead, Peabody insisted it had no idea how climate regulations would affect its business, and provided its investors with “incomplete and one-sided discussions” of the future of coal in a climate-concerned world, Schneiderman said.
  • “As a publicly traded company whose core business generates massive amounts of carbon emissions, Peabody Energy has a responsibility to be honest with its investors and the public about the risks posed by climate change, now and in the future,” Schneiderman said in a statement. “I believe that full and fair disclosures by Peabody and other fossil fuel companies will lead investors to think long and hard about the damage these companies are doing to our planet.” The state laws Peabody was found to have violated are the Martin Act and Executive Law, both of which “prohibit false and misleading conduct in connection with securities transactions,” the attorney general said. Peabody did not admit or deny those findings, but signed a document on Sunday agreeing to revise its shareholder disclosures with the Securities and Exchange Commission. Per that document, Peabody will have to correct its financial statements to be honest about how a global climate deal or other carbon regulation could hurt its business.   • Peabody’s violations will not result in financial punishment, as both laws only allow monetary penalties if shareholders need to be reimbursed for financial losses. It’s difficult to know what, if any, financial harm was passed on to shareholders due to Peabody’s misleading statements, since this particular situation was about the future risks of climate change. If in the future, however, investors find that Peabody’s misleading statements cost them money, they would likely have the option to sue. The settlement comes just a few days after the two-year investigation became public. On Friday, Scheiderman announced that his office had issued subpoenas to both Peabody and oil company ExxonMobil, both related to the fossil fuel giants’ public statements on climate change.

  • Environmentalists and Democratic politicians have accused ExxonMobil of engaging in a cover-up to mislead the public about the risks of human-caused climate change in order to sell more of its carbon-intensive product. Exxon has vehemently denied the accusation. Either way, Schneiderman’s two investigations are sparking serious legal discussion about how honest fossil fuel companies must be when it comes to the carbon emissions they create — especially if honesty might mean knowingly lowering profits. Should coal companies be forced to admit that their coal is creating a climate risk? If so, should they be allowed to fund politicians who advocate against climate action? Are these corporate activities protected free speech? Bloomberg View columnist Matt Levine offered a nuanced discussion of those questions on Friday. And ultimately, he said, it may just come down to whether these companies lied to their own investors — even if the lie was in their investors’ financial interest. “If you lie to the public about the risks that fossil fuel use poses to life on earth, you are just exercising your right as a citizen,” Levine wrote. “But if you lie to your investors about the risks that fossil fuel regulation poses to your stock price, you are committing fraud and will get in bad trouble.”

Powell assures the president: ‘The UK will follow our lead’.The classified document also discloses that Blair agreed to act as a glorified spin doctor for the president by presenting ‘public affairs lines’ to convince a skeptical public that Saddam had Weapons of Mass Destruction - when none existed.In return, the president would flatter Blair’s ego and give the impression that Britain was not America’s poodle but an equal partner in the ‘special relationship’.

It has infected surrounding countries to this day and created the vacuum into which Islamic State has stepped.This may well be the Iraq ‘smoking gun’ we have all been looking for.

  • The law requires lobbyists for foreign interests to plainly and conspicuously identify themselves as such in any materials distributed in the course of their lobbying—for example, emails, other correspondence, or publications. We found that many documents filed with the Justice Department lack this identification statement; furthermore, many lobbyists admitted that they did not comply with this requirement. More than half (51 percent) of the registrants we examined in a sample from 2010 checked a box on a the semi-annual Justice Department questionnaire saying they had filed informational materials, and checked another box saying they had not met the legal requirement that they identify themselves in those materials as working on behalf of foreign interests. Toby Moffett, a former Member of Congress from Connecticut who is now Chairman of the Moffett Group and one of its registered lobbyists, told POGO that “Around the edges there’s a lot of loosey-goosey stuff going on. People representing foreign interests and not reporting.”[4] But even when lobbyists do report to the Justice Department, the information they provide is not easily accessible to the public. Astonishingly, informational materials are not available online, despite the fact that the Justice Department has an electronic filing system. Instead, these documents are kept in an office at the Justice Department that is only open for four hours each weekday. Hard copies of the documents are kept in folders that are often disorganized and susceptible to misfiling. This archaic system undermines the intended transparency of the law.
  • We set out to determine the extent to which lobbyists for foreign interests were filing lobbying materials at the Justice Department within the required time frame. Based on a review of filings made in 2012, in those instances where it was possible to answer the question, POGO estimates that almost half—46 percent—were filed late. Fifteen percent were filed more than 30 business days after they were distributed, and 12 percent were filed more than 100 business days after they were distributed. In many instances, the Justice Department would be hard pressed to enforce the filing deadline. Based on the records the Department maintains to enforce the law, we found that in more than a quarter (26 percent) of the 2012 filings, it was impossible to determine whether the lobbyists complied. For example, in many cases, the records did not show when the lobbyists disseminated the materials to the targets of their lobbying. In a glaring omission, the law does not require lobbyists to provide that information. Without it, there may be no way for the government or the public to know whether lobbying materials were filed on time.
  • Though federal law bars foreign money from U.S. political campaigns, there appears to be a gray area in the law that can let in such money indirectly. POGO found many instances in which members of lobbying firms made political contributions to Members of Congress on the same day that those firms were lobbying the Members of Congress or their legislative staffs on behalf of foreign clients.[1] Lobbyists who fail to comply with certain FARA requirements may have little to fear from the Justice Department. “The cornerstone of the Registration Unit’s enforcement efforts is encouraging voluntary compliance,” a Justice Department website says.[2] When lobbyists do not voluntarily comply, the Justice Department rarely uses one of the key tools at its disposal to enforce the law—seeking a court injunction. A representative of the Department’s FARA unit told POGO: “While the FARA statute and regulations authorize the pursuit of formal legal proceedings, such as injunctive remedy options, the FARA Unit [has] not pursued injunctive remedy options recently and has instead utilized other mechanisms to achieve compliance.”[3] It appears that some registered foreign agents have been distributing materials but not filing them with the Justice Department. It’s unclear the extent to which that illustrates a lack of compliance with the law or loopholes in the law. In the process of researching this report, POGO noticed that many more lobbyists were registering as foreign agents than had filed informational materials that we could locate at the FARA office. To determine what was happening, we looked at a sampling of questionnaires that the Justice Department requires registered agents to complete every six months. Some checked one box indicating they had distributed materials and another box stating they did not file them with the FARA office.
  • The Project On Government Oversight examined thousands of these materials spanning four years, as well as additional public records related to the Justice Department’s oversight of lobbyists for foreign interests. We found that lobbyists for foreign interests have routinely failed to comply with the law—a failure that prevents journalists and watchdogs from scrutinizing the lobbying activities while foreign interests are trying to influence U.S. policy. We found a pattern of lax enforcement of FARA requirements by the Justice Department. We found that the Justice Department office responsible for administering the law is a record-keeping mess. And we found loopholes in the law that often makes it difficult if not impossible for the government to police compliance or to discipline lobbyists who fail to comply. Here are some highlights of our investigation:
  • When lobbyists for foreign interests do not follow the law, when the U.S. government fails to enforce it, and when the Justice Department makes it difficult for the American people to access records to which they are legally entitled, the public is left in the dark. To bring more transparency to this opaque realm, POGO has made four years of informational materials available for the first time online with our Foreign Influence Database, allowing the public to see how lobbyists attempt to influence American policies on behalf of their foreign clients.
  • With the release of the Foreign Influence Database, the Project On Government Oversight (POGO) is making years of documents from this key set of FARA filings electronically available for the first time. The materials were previously only available in hard copy at the FARA Registration Unit in Washington, DC, which is only open to the public from 11am to 3pm on weekdays.[12] In this digital age it is surprising that these materials could not be read online and are instead stored in file folders, where they are disorganized and susceptible to misfiling. Even those that were electronically filed by the registrants are not available to the public in an electronic format. POGO’s database includes informational materials filed in 2009, 2010, 2011, and 2012.[13]

    POGO does thorough work and doesn't let up until it gets results. Forcing DoJ to puts its foreign agents registration materials online should be a fairly trivial battle. The real war, though, will be forcing better enforcement. The new database is at http://www.pogo.org/tools-and-data/foreign-influence-database/ I punched up the word "Israel" and came up with 113 documents in the search results. Each search hit lists the name of the nation involved that the lobbying was done for. Of those 113 document hits, only two were for the nation of Israel, both for its Ministry of Tourism. The rest were by other nations who had mentioned Israel in their lobbying materials.  Now that is fairly incredible, given that Israel outright controls Congress when it comes to Middle East policy.  The last administration to attempt to do something about Israeli lobbyists not registering was the the Kennedy Administration. The result was that the major Israeli lobbying group disbanded and was promptly reformed under a new corporate charter and name. That was the very last attempt at enforcing the Foreign Agents Registration Act against Israel's lobbyists in the U.S., despite the fact that the reformed group, AIPAC, has even been caught more than once being passed highly classified U.S. documents by double agents working inside the U.S. military establishment. Time for the Nuclear Option: Raining Money on Main Street | WEB OF DEBT BLOG - 0 views

  • Predictions are that we will soon be seeing the “nuclear option” — central bank-created money injected directly into the real economy. All other options having failed, governments will be reduced to issuing money outright to cover budget deficits. So warns a September 18 article on ZeroHedge titled “It Begins: Australia’s Largest Investment Bank Just Said ‘Helicopter Money’ Is 12-18 Months Away.” Money reformers will say it’s about time. Virtually all money today is created as bank debt, but people can no longer take on more debt. The money supply has shrunk along with people’s ability to borrow new money into existence. Quantitative easing (QE) attempts to re-inflate the money supply by giving money to banks to create more debt, but that policy has failed. It’s time to try dropping some debt-free money on Main Street. The Zerohedge prediction is based on a release from Macqurie, Australia’s largest investment bank. It notes that GDP is contracting, deflationary pressures are accelerating, public and private sectors are not driving the velocity of money higher, and central bank injections of liquidity are losing their effectiveness. Current policies are not working. As a result:
  • There are several policies that could be and probably would be considered over the next 12-18 months. If private sector lacks confidence and visibility to raise velocity of money, then (arguably) public sector could. In other words, instead of acting via bond markets and banking sector, why shouldn’t public sector bypass markets altogether and inject stimulus directly into the ‘blood stream’? Whilst it might or might not be called QE, it would have a much stronger impact and unlike the last seven years, the recovery could actually mimic a conventional business cycle and investors would soon start discussing multiplier effects and positioning in areas of greatest investment.  Willem Buiter, chief global economist at Citigroup, is also recommending “helicopter money drops” to avoid an imminent global recession, stating: A global recession starting in 2016 led by China is now our Global Economics team’s main scenario. Uncertainty remains, but the likelihood of a timely and effective policy response seems to be diminishing. . . . Helicopter money drops in China, the euro area, the UK, and the U.S. and debt restructuring . . . can mitigate and, if implemented immediately, prevent a recession during the next two years without raising the risk of a deeper and longer recession later.
  • In the UK, something akin to a helicopter money drop was just put on the table by Jeremy Corbyn, the newly-elected Labor leader. He proposes to give the Bank of England a new mandate to upgrade the economy to invest in new large scale housing, energy, transport and digital projects. He calls it “quantitative easing for people instead of banks” (PQE). The investments would be made through a National Investment Bank set up to invest in new infrastructure and in the hi-tech innovative industries of the future. Australian blogger Prof. Bill Mitchell agrees that PQE is economically sound. But he says it should not be called “quantitative easing.” QE is just an asset swap – cash for federal securities or mortgage-backed securities on bank balance sheets. What Corbyn is proposing is actually Overt Money Financing (OMF) – injecting money directly into the economy. Mitchell acknowledges that OMF is a taboo concept in mainstream economics. Allegedly, this is because it would lead to hyperinflation. But the real reasons, he says, are that: It cuts out the private sector bond traders from their dose of corporate welfare which unlike other forms of welfare like sickness and unemployment benefits etc. has made the recipients rich in the extreme. . . . It takes away the ‘debt monkey’ that is used to clobber governments that seek to run larger fiscal deficits.

  • Tim Worstall, writing in the UK Register, objects to Corbyn’s PQE (or OMF) on the ground that it cannot be “sterilized” the way QE can. When inflation hits, the process cannot be reversed. If the money is spent on infrastructure, it will be out there circulating in the economy and will not be retrievable. Worstall writes: QE is designed to be temporary, . . . because once people’s spending rates recover we need a way of taking all that extra money out of the economy. So we do it by using printed money to buy bonds, which injects the money into the economy, and then sell those bonds back once we need to withdraw the money from the economy, and simply destroy the money we’ve raised. . . . If we don’t have any bonds to sell, it’s not clear how we can reduce [the money supply] if large-scale inflation hits.
  • The problem today, however, is not inflation but deflation of the money supply. Some consumer prices may be up, but this can happen although the money supply is shrinking. Food prices, for example, are up; but it’s because of increased costs, including drought in California, climate change, and mergers and acquisitions by big corporations that eliminate competition. Adding money to the economy will not drive up prices until demand is saturated and production has hit full capacity; and we’re a long way from full capacity now. Before that, increasing “demand” will increase “supply.” Producers will create more goods and services. Supply and demand will rise together and prices will remain stable. In the US, the output gap – the difference between actual output and potential output – is estimated at about $1 trillion annually. That means the money supply could be increased by at least $1 trillion annually without driving up prices.
  • If PQE does go beyond full productive capacity, the government does not need to rely on the central bank to pull the money back. It can do this with taxes. Just as loans increase the money supply and repaying them shrinks it again, so taxes and other payments to the government will shrink a money supply augmented with money issued by the government. Using 2012 figures (drawing from an earlier article by this author), the velocity of M1 (the coins, dollar bills and demand deposits spent by ordinary consumers) was then 7. That means M1 changed hands seven times during 2012 – from housewife to grocer to farmer, etc. Since each recipient owed taxes on this money, increasing M1 by one dollar increased the tax base by seven dollars. Total tax revenue as a percentage of GDP in 2012 was 24.3%. Extrapolating from those figures, $1.00 changing hands seven times could increase tax revenue by $7.00 x 24.3% = $1.70. That means the government could, in theory, get more back in taxes than it paid out. Even with some leakage in those figures and deductions for costs, all or most of the new money spent into the economy might be taxed back to the government. New money could be pumped out every year and the money supply would increase little if at all.
  • Besides taxes, other ways to get money back into the Treasury include closing tax loopholes, taxing the $21 trillion or more hidden in offshore tax havens, and setting up a system of public banks that would return the interest on loans to the government. Net interest collected by U.S. banks in 2014 was $423 billion. At its high in 2007, it was $725 billion. Thus there are many ways to recycle an issue of new money back to the government. The same money could be spent and collected back year after year, without creating price inflation or hyperinflating the money supply. This not only could be done; it needs to be done. Conventional monetary policy has failed. Central banks have exhausted their existing toolboxes and need to explore some innovative alternatives.

CIA SUCCESSFULLY CONCEALS BAY OF PIGS HISTORY - 0 views

  • May 21, 2014 – The U.S. Court of Appeals for the D.C. Circuit yesterday joined the CIA's cover-up of its Bay of Pigs disaster in 1961 by ruling that a 30-year-old volume of the CIA's draft "official history" could be withheld from the public under the "deliberative process" privilege, even though four of the five volumes have previously been released with no harm either to national security or any government deliberation. "The D.C. Circuit's decision throws a burqa over the bureaucracy," said Tom Blanton, director of the National Security Archive (www.nsarchive.org), the plaintiff in the case. "Presidents only get 12 years after they leave office to withhold their deliberations," commented Blanton, "and the Federal Reserve Board releases its verbatim transcripts after five years. But here the D.C. Circuit has given the CIA's historical office immortality for its drafts, because, as the CIA argues, those drafts might 'confuse the public.'" "Applied to the contents of the National Archives of the United States, this decision would withdraw from the shelves more than half of what's there," Blanton concluded.
  • The 2-1 decision, authored by Judge Brett Kavanaugh (a George W. Bush appointee and co-author of the Kenneth Starr report that published extensive details of the Monica Lewinsky affair), agreed with Justice Department and CIA lawyers that because the history volume was a "pre-decisional and deliberative" draft, its release would "expose an agency's decision making process in such a way as to discourage candid discussion within the agency and thereby undermine the agency's ability to perform its functions." Williams, who has senior status on the court.
  • On the 50th anniversary of the Bay of Pigs invasion in 2011, the National Security Archive's Cuba project director, Peter Kornbluh, requested, through the FOIA, the complete release of "The Official History of the Bay of Pigs Operation" — a massive, five-volume study compiled by a CIA staff historian, Jack Pfeiffer, in the 1970s and early 1980s. Volume III had already been released under the Kennedy Assassination Records Act; and a censored version of Volume IV had been declassified years earlier pursuant to a request by Pfeiffer himself. The Archive's FOIA request pried loose Volumes I and II of the draft history, along with a less-redacted version of Volume IV, but the CIA refused to release Volume V, so the Archive filed suit under FOIA in 2012, represented by the expert FOIA litigator, David Sobel. In May 2012, U.S. District Judge Gladys Kessler held that Volume V was covered by the deliberative process privilege, and refused to order any segregation of "non-deliberative" material, as required by FOIA.

  • The Archive appealed the lower court's decision, and with representation from the distinguished firm of Skadden Arps Meagher Slate & Flom, brought the case to the D.C. Circuit, with oral argument in December 2013. The National Coalition for History, including the American Historical Association and other historical and archival professional organizations, joined the case with an amicus curiae brief authored by the Jones Day law firm arguing for release of the volume. Titled "CIA's Internal Investigation of the Bay of Pigs Operation," Volume V apparently contains Pfeiffer's aggressive defense of the CIA against a hard-hitting 1961 internal review, written by the agency's own Inspector General, which held the CIA singularly responsible for the poor assumptions, faulty planning and incompetence that led to the quick defeat of the paramilitary exile brigade by Fidel Castro's military at the Bahia de Cochinos between April 17 and April 20, 1961. The Archive obtained under FOIA and published the IG Report in 1998. The CIA has admitted in court papers that the Pfeiffer study contains "a polemic of recriminations against CIA officers who later criticized the operation," as well as against other Kennedy administration officials who Pfeiffer contended were responsible for this foreign policy disaster. In the dissenting opinion from the D.C. Circuit's 2-1 decision yesterday, Judge Judith Rogers (appointed by Bill Clinton) identified multiple contradictions in the CIA's legal arguments. Judge Rogers pointed out that the CIA had failed to justify why release of Volume V would "lead to public confusion" when CIA had already released Volumes I-IV. She noted that neither the CIA nor the majority court opinion had explained "why release of the draft of Volume V 'would expose an agency's decision making process,'" and discourage future internal deliberations within the CIA's historical office any more than release of the previous four volumes had done.
  • Prior to yesterday's decision, the Obama administration had bragged that reducing the government's invocation of the b-5 exemption was proof of the impact of the President's Day One commitment to a "presumption of disclosure." Instead, the bureaucracy has actually increased in the last two years its use of the b-5 exemption, which current White House counselor John Podesta once characterized as the "withhold if you want to" exemption. The majority opinion also left two openings for transparency advocates. It invites Congress to set a time limit for applying the b-5 exemption, as Congress has done in the Presidential Records Act. Second, it concludes that any "factual material" contained in the draft should be reachable through Freedom of Information requests.

  • Once again focusing on escalations of tensions with Russia, State Department spokesman Mark Toner today said that in addition to the “diplomatic” efforts the US is making in Syria, they are also considering conducting “military or other options.” The US demonstrably is not conducting diplomatic efforts in Syria anymore, despite Toner’s claims to the contrary, as the US made a very public show of withdrawing from the diplomatic track yesterday, and condemning Russia on the way out. Adding to the uncomfortable talk about military possibilities, Toner also declared the US to “always consider unilateral options when looking at a situation like Syria,” and while he insisted the US prefers to work with its coalition, it’s unlikely much of the coalition will eagerly follow them into a war with Russia.
  • Earlier today, Russia announced they are deploying S-300 anti-aircraft missiles to their naval base at Tartus, to defend naval personnel against any potential attacks. With the US-led campaign materially the only air operations in Syria not directly aligned with Russia, the underlying message is that they’re preparing for a unilateral US attack. That US officials reacted negatively to the deployment of purely defensive missiles only adds to this.

  • A recent public opinion poll asked Americans which of two options they would favour if a two-state solution to the Israel-Palestine conflict was no longer on the table. (It is in the rhetoric of leaders and diplomats but not in reality.) The two options were: The continuation of Israel’s Jewish majority [presumably this assumes permanent Israeli occupation of the West Bank and continuing ethnic cleansing of it by stealth] even if it means that Palestinians will not have citizenship and full rights. One democratic state for all in which Jews and Arabs would be equal.   Only 24 per cent supported the continuation of things as they are.
  •  According to the poll,  65 per cent of those asked for their opinion preferred the one-state option. What explains this? Is it that an apparent majority of Americans are at last understanding and supporting the need and rights of the Palestinians for justice, or is it something else – an indication that while they are not much concerned about the rights of the Palestinians, an apparent majority of Americans are fed up with an Israel they rightly perceive to be the obstacle to peace?

Akiva Eldar’s interpretation of Obama’s message to Netanyahu via Goldberg was that he, the president, “is sick and tired of fighting on Netanyahu’s behalf vis-a-vis the Europeans and automatically vetoing (in the UN Security Council) their proposals condemning the settlements”.

  • A new poll shows strong opposition to sending any troops into Iraq.The survey released Tuesday by the left-leaning Public Policy Polling found 74 percent of the public is opposed to sending combat troops back into Iraq, with only 16 percent supporting that option. ADVERTISEMENTMajorities of Republicans, Democrats and independents all said they are strongly opposed to sending in combat troops. Just over a quarter of Republicans support deploying them. More than half of those surveyed said they agreed with President Obama that U.S. troops shouldn’t return to Iraq. Just over a quarter, by contrast, agreed with Sen. John McCain (R-Ariz.) that troops should have remained in Iraq past 2011.

They've blamed the current violence in Iraq on that failure to reach an agreement. However, the poll found that more than two-thirds say the renewed violence in Iraq is a result of a centuries-old conflict that was worsened by the 2003 invasion launched by President George W. Bush. On Monday, Obama announced that he is sending 275 U.S. troops to Baghdad to protect the U.S. Embassy and personnel there. The poll surveyed 790 registered voters on June 14 and 15, and has a 3.5 percentage point margin of error.

Obama has scheduled a telephone conference with key members of Congress to encourage them not to interfere, but reportedly the phone conference will use non-secure connections so classified information will not be discussed.  Personally, I want the raw intelligence data on the alleged use of sarin by the Syrian government to be publicly released, including audio recordings, so that it can be subjected to debate by the public. Based on my monitoring of news on the Syrian conflict for more than a year, it seems clear that the Syrian foreign "rebels" have the ability to manufacture Sarin and have used it repeatedly in Syria. And the Syrian government has very strong incentives not to use Sarin, particularly at the moment the gas attack occurred. A UN team had just arrived, at Syria invitation, to investigate prior incidents involving alleged gas attacks in which both sides blamed the other. Not a good time for the Syrian government to launch such an attack but a great time for the rebels to stage a false flag attack, blaming the Syrian government.  So I want to see the evidence Obama claims to be relying upon. Supposedly, it is an intercept of a panicked conversation between a Syrian commander and a lower officer in the field. But that too could have been staged. Unfortunately, the main obstacle is a lack of natural gas fuel infrastructure in our country. Currently in the United States, there are only 449 CNG fueling stations accessible to the public, which is dwarfed by the more than 157,000 gasoline stations. There are a number of proposals to spur natural gas infrastructure development in Washington. Not surprisingly, when it comes to Congress, the most talked about option involves subsidies for both natural gas vehicles and for the actual CNG fuel itself. While we should be using all of our available natural resources to aid in lowering the costs of transportation, the reality is that our country has neither the money to subsidize development nor the expertise to pick winners and losers in the energy and transportation sectors. Half of Federal Agencies Still Use Outdated Freedom of Information Regulations - 0 views

  • Nearly half (50 out of 101) of all federal agencies have still not updated their Freedom of Information Act regulations to comply with Congress's 2007 FOIA amendments, and even more agencies (55 of 101) have FOIA regulations that predate and ignore President Obama's and Attorney General Holder's 2009 guidance for a "presumption of disclosure," according to the new National Security Archive FOIA Audit released today to mark Sunshine Week. Congress amended the Freedom of Information Act in 2007 to prohibit agencies from charging processing fees if they missed their response deadlines, to include new online journalists in the fee waiver category for the media, to order agencies to cooperate with the new FOIA ombudsman (the Office of Government Information Services, OGIS), and to require reports of specific data on their FOIA output, among other provisions co-authored by Senators Patrick Leahy (D-VT) and John Cornyn (R-TX). But half the government has yet to incorporate these changes in their regulations, according to the latest National Security Archive FOIA Audit. After President Obama's "Day One" commitments to open government, Attorney General Eric Holder issued new FOIA guidance on March 19, 2009, declaring that agencies should adopt a "presumption of disclosure," encourage discretionary releases if there was no foreseeable harm (even if technically covered by an exemption), proactively post the records of greatest public interest online, and remove "unnecessary bureaucratic hurdles" from the FOIA process. But five years later, the Archive found a majority of agencies have old regulations that simply ignore this guidance.
  • The Archive's FOIA Audit also highlights some good news this Sunshine Week: New plans from both the House of Representatives and White House have the potential to compel delinquent agencies to update their regulations. This year, Pustay testified that the Department of Justice has indeed resubmitted its FOIA regulations for OMB approval; their content is unknown to the public.

  • The House of Representatives recently unanimously passed the bipartisan Freedom of Information Act Implementation Act (H.R. 1211), which includes a provision compelling agencies to update their FOIA regulations. The House bill — which now awaits Senate approval — would require each agency to update its FOIA regulations "not later than 180 days after the enactment of this Act." The White House is also addressing the problem of outdated FOIA regulations, albeit in a different manner. In its latest Open Government Partnership National Action Plan, the White House has committed (on paper, at least) to creating one "core FOIA regulation and common set of practices [that] would make it easier for requesters to understand and navigate the FOIA process and easier for the Government to keep regulations up to date." Transparency watchdogs went on alert this week after the Department of Justice's Director of Information Policy Melanie Pustay announced during her Senate testimony on March 11, 2014 that, "My office is leading that project" to create the White House-backed common regulation which, she estimated will be, "a one or two year project." Despite Pustay's pledge that she would accept input from OGIS and the requester community, her Department's history of crafting FOIA regulations has been anything but stellar.
  • As the Department of Justice and other agencies have demonstrated, new regulations do not necessarily make good regulations. As such, the National Security Archive has recommended that any updated FOIA regulations must: mandate that FOIA officers embrace direct communications with requesters; require agencies to receive requests by e-mail and post all responses and documents online; direct agencies to update their FOIA processing software so documents can be posted to any online repository, including the government-sponsored FOIAonline; encourage agencies to join FOIAonline to make their FOIA processing more cost-effective and efficient; stream-line inter and intra-agency "referral" black holes — and keep requesters abreast of where their requests are if the agency does have to refer them; include language encouraging use of the OGIS, which can help requesters and agencies mediate disputes to avoid animosity and costly litigation; end the practice of using fees to discourage FOIA requesters. The Office of Government Information Services — which reviews and comments on agency regulations as they are proposed — has also compiled a list of best practices for agencies to consider while crafting regulations. These include: "let the Freedom of Information Act itself" — and its presumption for disclosure — "be your guide;" bring attorneys, FOIA processors, records managers and IT pros to the table; include your plan for records management and preservation; and alert requesters of their option to contact OGIS for mediation and dispute resolution services.

"As the staffer who waded through every single federal agencies' FOIA website and CFR chapter to locate their — sometimes hidden — regulations, I learned FOIA officials often say they view their FOIA requesters as customers," said Archive researcher Lauren Harper, "I think easy to find, updated model FOIA regulations are the best way for agencies to demonstrate they truly value their customer service, and the spirit of the FOIA."

What does it tell you when there are 24 different explanations for a thing? It tells you that someone just dropped a cognitive dissonance cluster bomb on the public. Heads exploded. Cognitive dissonance set in. Weird theories came out. This is the cleanest and clearest example of cognitive dissonance you will ever see. Remember it. This phenomenon is why a year ago I told you I was putting so much emphasis on PREDICTING the outcome of the election using the Master Persuader Filter. I told you it would be easy to fit any theory to the facts AFTER the result. And sure enough, we can fit lots of theories to the facts. At least 24 of them by CNN's count. Generally speaking, the greater the persuasion, the more cognitive dissonance you get. Trump is - in my opinion - the greatest persuader of my lifetime. I expected this level of cognitive dissonance. Next time you see a persuader of this magnitude, you can expect the outcome to be cognitive dissonance in that case too. This brings me to the anti-Trump protests. The protesters look as though they are protesting Trump, but they are not. They are locked in an imaginary world and battling their own hallucinations of the future. Here's the setup that triggered them. 1. They believe they are smart and well-informed. 2. Their good judgement told them Trump is OBVIOUSLY the next Hitler, or something similarly bad. 3. Half of the voters of the United States - including a lot of smart people - voted Trump into office anyway. Those "facts" can't be reconciled in the minds of the anti-Trumpers.
