[Barring unforeseen events, I'm going to leave this post at the top of the page for today and tomorrow, as I think the events it examines, rather in detail and at length, are vitally important and merit much more attention than they've received] The Obama DOJ's effort to force New York Times investigative journalist Jim Risen to testify in a whistleblower prosecution and reveal his source is really remarkable and revealing in several ways; it should be receiving much more attention than it is.  On its own, the whistleblower prosecution and accompanying targeting of Risen are pernicious, but more importantly, it underscores the menacing attempt by the Obama administration -- as Risen yesterday pointed out -- to threaten and intimidate whistleblowers, journalists and activists who meaningfully challenge what the government does in secret. The subpoena to Risen was originally issued but then abandoned by the Bush administration, and then revitalized by Obama lawyers.  It is part of the prosecution of Jeffrey Sterling, a former CIA agent whom the DOJ accuses of leaking to Risen the story of a severely botched agency plot -- from 11 years ago -- to infiltrate Iran's nuclear program, a story Risen wrote about six years after the fact in his 2006 best-selling book, State of War.  The DOJ wants to force Risen to testify under oath about whether Sterling was his source.

Obama's policies cannot be more antithetical to our constitution and values. Obama's administration has even arrogated the power to assassinate American citizens without oversight let alone due process. If Obama does not lose your support for this, what would it take?

Consider Paul Allen, 55, a former mortgage CEO who defrauded lenders of over $3 billion. This week, prosecutors celebrated the fact they got him a 40-month prison sentence. Consider Roy Brown, 54, a hungry homeless man who robbed a Louisiana bank of $100 - the teller gave him more but he handed the rest back. He felt bad the next day and surrendered to police. He got 15 years. Justice in America has a ways to go.

Obama hasn't closed Guantanamo and people are still being tortured at Bagram[2], the U.S. is bombing at least six Muslim countries that we know of (Iraq, Afghanistan, Libya, Somalia, Yemen, Pakistan)[3], and the healthcare bill fiasco in which he had secretly traded away the public option from the beginning[4] very clearly show that he definitely hasn't changed the way Washington works. If anything he's made every conceivable pernicious undemocratic influence stronger.

It's in the works. A massive Occupy Wall Street gathering with delegates from all over the country. And if these plans are carried out, Occupy Wall Street will be a major force to be reckoned with on Election Day 2012.

Assuming philosophy should be relevant to the way we choose to live our lives, three questions guide this paper. What are some moral foundations for revolution? Do you realize what is happening? Are you willing to do anything about it?

If, as Lessig conclusively demonstrates, Congress is indifferent to the will of the people and to democratic debate - because it has been captured by monied interests to whose interests it exclusively attends - then the people lose the ability to affect what government does in any realm. It doesn't make much difference which problem you believe is most pressing: this is the dynamic that lies at the heart of it. Inaction on climate issues is due to the power of polluters and energy companies; the power of the private health insurance industry blocks fundamental health-care reform; endless war and civil liberties abuses are sustained by the power of the surveillance and National Security State industries; and a failure to achieve real Wall Street reform is due to the fact that, as Sen. Dick Durbin amazingly acknowledged about the institution in which he serves, "the banks frankly own the place." Without finding an effective way to address that overarching problem, the only recourse for citizens becomes either passive acceptance of their powerlessness (i.e., apathy and withdrawal) or disruption and unrest fomented outside of the electoral system (the driving ethos of OccupyWallStreet).

WAYS TO PARTICIPATE ON NOVEMBER 2 GENERAL STRIKE & DAY OF ACTION called for by Occupy Oakland Occupy Oakland is calling for no work and no school on November 2 as part of the general strike. We are asking that all workers go on strike, call in sick, take a vacation day or simply walk off the job with their co-workers. We are also asking that all students walk out of school and join workers and community members in downtown Oakland. All banks and large corporations must close down for the day or demonstrators will march on them. The Occupy Oakland Strike Assembly has vowed to picket and or occupy any business or school which disciplines employees or students in any way for participating in the Nov 2 General Strike. Occupy Oakland recognizes that not all workers, students and community members will feel able to strike all day long on November 2, and we welcome any form of participation which they feel is appropriate. I'm genuinely excited today to announce the release of my new book, With Liberty and Justice for Some: How the Law is Used to Destroy Equality and Protect the Powerful. The book focuses on what I began realizing several years ago is the crucial theme tying together most of the topics I write about: America's two-tiered justice system - specifically, the way political and financial elites are now vested with virtually absolute immunity from the rule of law even when they are caught committing egregious crimes, while ordinary Americans are subjected to the world's largest and one of its harshest and most merciless penal states even for trivial offenses. As a result, law has been completely perverted from what it was intended to be - the guarantor of an equal playing field which would legitimize outcome inequalities - into its precise antithesis: a weapon used by the most powerful to protect their ill-gotten gains, strengthen their unearned prerogatives, and ensure ever-expanding opportunity inequality. Jack Heyman, a recently retired business agent for the International Longshore and Warehouse Union local 10, drove through the Port of Oakland and called in the following statement to Truthout at 9:25 AM Pacific time:"The port of Oakland is effectively shut down. None of the ships are being worked. There is limited trucking activity by non-union workers but the port is effectively shut down. Trucks waiting to pick up containers are backed up over a mile," Heyman said. The truck backup was confirmed by the Oakland Tribune.According to Heyman, this partial shutdown was initiated by the rank-and-file workers at the port, in solidarity with the call for a general strike by the Occupy Oakland protesters. The union's official position on the strike call was to work in the morning and then join the demonstrations in the evening, but according to Heyman, the rank and file decided to vote with their feet and not fill key jobs at the port this morning.
