The laws of war are essential for citizens and legislators to master if humanity is to evolve beyond our violent history of war to enjoy civil communities. To bring these basic laws to life, we'll touch on war's history, explain the letter of US war laws, explain the philosophy/spirit of US war laws, and make the obvious conclusion once the laws are clearly understood that current US wars in Afghanistan and Iraq are unlawful orders that our military must refuse and stop as demanded in their oath to the protect and defend the US Constitution.

"AMY GOODMAN: Bill Hartung, before you go, I wanted to ask you about the largest weapons deal in history, and that was just worked out between the United States and Saudi Arabia. Explain the significance of this. WILLIAM HARTUNG: Well, first of all, at $60 billion, it's, you know, a huge gift to the weapons industry. They're going to sell, you know, over 70 Boeing F-15s. They're going to sell Apache helicopters. They're going to refurbish the Saudi air force. There's not a deal that's ever come close to this. Both Supreme Court justices Antonin Scalia and Clarence Thomas describe themselves as "originalists," meaning that they believe they possess the innate knowledge of exactly what the Founding Fathers intended when they penned the U.S. Constitution. Given such an almost reverent standard it is fair to ask a few questions regarding the Judiciary branch of government which, in my opinion, no longer represents the people of our country. It has become so deeply immersed in right-wing ideology that there is little resemblance to the this branch of government today and when the Founding Fathers established it. Did the Founding Fathers intend that Supreme Court judges sitting on the highest court of the land can decide who the president should be, especially if one of those judges was appointed by the father of one of the complainants? Surely, most of us would agree, that judge should be disqualified from involvement in such an extraordinary decision. Did the Founding Fathers intend that a judge sitting on the highest court of the land to be cozy with incendiary, hate-mongering partisan extremists who make seditious statements for the sole purpose of undermining and subverting democracy? Surely, you would ask, should a judge deciding cases on the Supreme court be colluding and conniving with a Screech Radio insurrectionist who spouts non-stop hatred and incites violence against our president and elected officials? Did the Founding Fathers also intend for the spouse of a sitting Supreme Court justice to be actively fomenting hatred, insurrection and subversion, the sole aim of which is to overthrow, even by armed insurrection, a democratically-elected president and political party? Surely, the Founding Fathers did not intend for that to be an admirable or patriotic role of the spouse of a Supreme Court justice? The solid phalanx of activist, partisan ideologues, Roberts,

Momentous Supreme Court cases tend to move quickly into the slipstream of the Court's history. In the first ten years after Brown v. Board of Education, the 1954 decision that ended the doctrine of separate but equal in public education, the Justices cited the case more than twenty-five times. In the ten years after Roe v. Wade, the abortion-rights decision of 1973, there were more than sixty-five references to that landmark. This month marks ten years since the Court, by a vote of five-to-four, terminated the election of 2000 and delivered the Presidency to George W. Bush. Over that decade, the Justices have provided a verdict of sorts on Bush v. Gore by the number of times they have cited it: zero.

After careful consideration, including a review of my recommendation, the President has concluded that given a number of factors, including a documented history of discrimination, classifications based on sexual orientation should be subject to a more heightened standard of scrutiny.   The President has also concluded that Section 3 of DOMA, as applied to legally married same-sex couples, fails to meet that standard and is therefore unconstitutional.   Given that conclusion, the President has instructed the Department not to defend the statute in such cases.

America is not broke. Contrary to what those in power would like you to believe so that you'll give up your pension, cut your wages, and settle for the life your great-grandparents had, America is not broke. Not by a long shot. The country is awash in wealth and cash. It's just that it's not in your hands. It has been transferred, in the greatest heist in history, from the workers and consumers to the banks and the portfolios of the uber-rich. Today just 400 Americans have more wealth than half of all Americans combined. Let me say that again. 400 obscenely rich people, most of whom benefited in some way from the multi-trillion dollar taxpayer "bailout" of 2008, now have more loot, stock and property than the assets of 155 million Americans combined. If you can't bring yourself to call that a financial coup d'état, then you are simply not being honest about what you know in your heart to be true.

The Big Money economy is booming. According to a new Commerce Department report, third-quarter profits of American businesses rose at an annual record-breaking $1.659 trillion - besting even the boom year of 2006 (in nominal dollars). Profits have soared for seven consecutive quarters now, matching or beating their fastest pace in history. Executive pay is linked to profits, so top pay is soaring as well. Higher profits are also translating into the nice gains in the stock market, which is a boon to everyone with lots of financial assets. And Wall Street is back. Bonuses on the Street are expected to rise about 5 percent this year, according to a survey by compensation consultants Johnson Associates Inc. But nothing is trickling down to the Average Worker economy. Job growth is still anemic. At October's rate of only 50,000 new private-sector jobs, unemployment won't get down to pre-recession levels for twenty years. And almost half of October's new jobs were in temporary help.

Several days ago I noted that Harry Reid and Mitch McConnell had agreed to a four-year extension of the most controversial provisions of the Patriot Act -- a bill Democrats everywhere once claimed to revile -- without a single reform (despite the long and documented history of its abuse and despite Obama's previously claimed desire to reform it).  Tonight, a cloture vote was taken in the Senate on the four-year extension and it passed by a vote of 74-8.  The law that was once the symbolic shorthand for evil Bush/Cheney post-9/11 radicalism just received a vote in favor of its four-year, reform-free extension by a vote of 74-8: only resolutions to support Israel command more lopsided majorities

The bet was audacious from the beginning, and given the miserable, low-down tenor of contemporary politics, not unfathomable: Could you divide the country between greedy geezers and everyone else as a way to radically alter the social contract? But in order for the Republican plan to turn Medicare, one of most popular government programs in history, into a much-diminished voucher system, the greed card had to work. The plan's architect, Representative Paul Ryan of Wisconsin, drew a line in the actuarial sand: Anyone born before 1957 would not be affected. They could enjoy the single-payer, socialized medical care program that has allowed millions of people to live extended lives of dignity and decent health care. And their kids and grandkids? Sorry, they would have to take their little voucher and pay some private insurer nearly twice as much as a senior pays for basic government coverage today. In essence, Republicans would break up the population between an I've Got Mine segment and The Left Behinds. Again, not a bad political calculation. Altruism is a squishy notion, hard to sustain in an election. Ryan himself has made a naked play for greed in defending the plan. "Seniors, as soon as they realize this doesn't affect them, they are not so opposed," he has said. Well, the early verdict is in, and it looks as though the better angels have prevailed: seniors are opposed. Republicans: Meet the Fockers. Already, there is considerable anxiety - and some guilt - among older folks about leaving their children worse off financially than they are. To burden them with a much costlier, privatized elderly health insurance program is a lead weight for the golden years.

We no longer have freedom; there is only the appearance of freedom. We are consumed by an endless and vague war on terror in which the perfidiousness of our enemy, whose number, location and nature are never clearly defined, justifies the shredding of constitutional rights, torture, kidnapping, detentions without charges or trials and an occult-like battle against an absolute evil. And if you think the state intends to limit itself to the persecution of Muslims, especially once there is an increase in domestic unrest and instability, you know little about human history.
