Following concerns raised by the competition watchdog, UK PCR testing provider Randox has improved its terms on cancellations, refunds and liability. The development is part of the Competition and Markets Authority's (CMA) ongoing engagement in the PCR tests sector. The CMA has also sent letters to 25 PCR providers, warning them to review their terms and conditions or risk facing enforcement action. It currently has formal investigations open into two PCR providers, Expert Medicals and Dante Labs. The General Pharmaceutical Council (GPhC) today decided to convene a new group, involving all the key stakeholders, focused on assurance of practice post-registration. The decision in today's (9 December) council meeting follows the recommendation of a working group chaired by council member and pharmacist Aamer Safdar on the role of the regulator in post-registration education and training. The new group will be tasked with articulating a set of guiding principles where patient safety is the overarching priority, after carrying out a horizon scanning exercise to pull together an understanding of the system wide approach currently in place. The working group noted that the wider approach, in relation to regulation of post-registration practice and not simply education and training, may require the GPhC reviewing and developing its own control measures, and involving patients and the public in the next stages of work. Reviewing the work on online pharmacy services, the council meeting supported the regulator's plans to continue to require pharmacy websites to be arranged so that a person cannot choose a prescription only medicine and its quantity before there has been an appropriate consultation with a prescriber.

The High Court has dismissed the British Generic Manufacturers Association (BGMA)'s claim on being excluded from ongoing negotiations between the government and industry to agree a new Voluntary Scheme for medicine pricing and access (VPAS). The association had sought a judicial review of the Department of Health and Social Care's (DHSC) decision to negotiate a new Voluntary Scheme for branded medicines with the Association of the British Pharmaceutical Industry (ABPI) in April. Commenting on the result of the case, Richard Torbett, Chief Executive of the ABPI said: "For over 60 years the ABPI has acted as the representative industry body for negotiations on the Voluntary Scheme for branded medicines - a responsibility we take extremely seriously - and one which has been reaffirmed by today's judgment. "While we were disappointed that the BGMA decided to take this action - we recognise their decision was driven by the extreme challenge placed on all parts of the industry from the surge in the branded medicine payment rates. "The solution to these problems must be a completely new and sustainable approach to medicines provision in the UK which rapidly brings industry revenue payments in line with comparator countries to unlock investment and growth."

The British Generic Manufacturers Association (BGMA) has sought a judicial review of the Department of Health and Social Care's (DHSC) decision to negotiate a new Voluntary Scheme for branded medicines with the Association of the British Pharmaceutical Industry (ABPI). Mark Samuels, Chief Executive of BGMA said: "The Government has decided not to involve the trade body representing these medicine suppliers in its negotiations on the voluntary scheme for branded medicine pricing (VPAS). "We are deeply concerned by this decision. It has left us no choice but to take legal action." "While not all generic drugs fall within VPAS, four out of ten products in the current scheme are branded generics or biosimilars. As the representative trade body for both generic and biosimilar UK manufacturers, we must play a full part in the VPAS negotiations for the next period of the scheme from 2024 to 2028." "The VPAS tax has risen five-fold in under two years, an unprecedented tax increase. Yet our sector currently has no input into the negotiations on future schemes or rates; this is untenable as any decisions made on VPAS could significantly define the future of our sector in the UK and its ability to supply the NHS. The association had raised its full participation in the negotiations with the Government last November.

The Association of Independent Multiple Pharmacies (AIMp) and senior official of NHS Property Services (NHSPS) had a meeting on August 18 to review the rent policy for health centre pharmacies. Health authorities in India have launched an inquiry into an allegation that a local pharmaceutical regulator, in return for a bribe, helped switch samples of cough syrups that the World Health Organization (WHO) had linked to the deaths of children in Gambia before the samples were tested at an Indian laboratory, according to two government officials and documents reviewed by the Reuters news agency. In an April 29 letter to the Anti-Corruption Bureau (ACB) in Haryana state reviewed by the news agency, a lawyer named Yashpal accused the state's drug controller, Manmohan Taneja, of taking a bribe of 50 million rupees (£481,600 approx.) from local manufacturer Maiden Pharmaceuticals to help it switch the samples before an Indian government laboratory tested them. Maiden's factory is based in Haryana state. Reuters points out that it was unable to independently establish that any bribes were paid. Taneja did not respond to phone calls, messages or emails seeking comment. Maiden did not respond to requests for comment. The WHO said it had no knowledge of the allegation. Yashpal - who like some Indians uses only one name - did not say in the letter where he got the information, or provide evidence for his claim about the syrups made by Maiden. Reuters was unable to independently establish that any bribes were paid.

Department of Health and Social Care (DHSC) has implemented a process to roll over certain concessionary prices to the following month. From May 2023, the roll over process will apply to any products where agreement is reached on the final prices granted by DHSC for any price concession requests submitted late in the month (on or after the 23rd of the month) by Community Pharmacy England. Community Pharmacy England said: "As part of the Year 4 & 5 funding settlement for community pharmacy, it was agreed that an urgent review of the price concession setting system would take place." It has been working with DHSC to determine improvements to the price concession system. Community Pharmacy England said: "Pharmacy owners (members) will be able to see the lines that have rolled over on our price concessions page here. Please note any rolled over prices can be adjusted upwards if we receive reports from our members to indicate suppliers' selling prices have increased. The review can be requested at any point during the month."

Community pharmacy should be involved in key decisions in neighbourhoods and systems to help reduce workload and increase patient access, a roundtable organised by the National Pharmacy Association to discuss a recent review on primary care integration has concluded. The NPA said it would be sending the recently published report on the roundtable to local pharmaceutical committees (LPCs) and other local pharmacy leaders as a tool to help them engage with Integrated Care Systems (ICSs) which will become statutory bodies from July 1. The 'Fuller Stocktake: Community Pharmacy Roundtable' report, published on June 13 by the NPA, is based on a meeting hosted by the association on behalf of the NHS team running a key review of primary care integration, the so-called 'Fuller Stocktake'. NPA integration lead, Michael Lennox, said: "The NPA recognises the critical importance of our LPC network colleagues being there for contractors at the 42 local systems level and influencing to fulfil the laudable ambitions of the Fuller Report. "We ensured that community pharmacy voices were heard in the stocktake process and now that conversation needs to be amplified locally."

The voter turnout in England for the Royal Pharmaceutical Society's English Pharmacy Board election dropped to 7.9 per cent this year. Out of a total of 19,512 eligible individuals, only 1,534 decided to vote. The RPS English Board received ten nominations for five vacancies this year; therefore an election was conducted. One nomination was received for the three vacancies on the Welsh Pharmacy Board. Three nominations were received for the three vacancies on the Scottish Pharmacy Board. Therefore, no election was conducted in pharmacy boards in Wales or Scotland. RPS president Claire Anderson said: "It's disappointing that the voter turnout in England has dropped to 7.9 from 11.8 per cent in 2021. We have now appointed an independent review of how RPS members, elected members and stakeholders can feel more engaged and empowered to influence RPS decisions, and eagerly await its recommendations." The Society appointed communications agency Luther Pendragon to lead a review into how it can develop and strengthen member participation.

The National Pharmacy Association (NPA) is asking independents to vote 'yes' to reform of pharmacy representation in England as a three-week voting period opens on Friday, May 27. The NPA is also calling on PSNC to complete unfinished business and present 'the compelling case for change' that the Review Steering Group was unable to deliver. The Associations says it is "on balance" and with some degree of reluctance supporting an affirmative vote, because the benefits marginally outweigh the several valid arguments for a "no" vote. NPA chief executive, Mark Lyonette, said on Thursday (May 19): "After much deliberation and engagement with members, we are recommending our members vote yes, because the alternatives are either the flawed status quo or a further period of uncertainty for the sector, with months or even years of introspection to come. There is no guarantee that going back to the drawing board, particularly with the same actors, would bring about a better outcome.

The Medicines and Healthcare products Regulatory Agency (MHRA) has advised 'no one should stop taking valproate without advice from their healthcare professional.' The latest data on the use of valproate in England revealed that in the last 6 months the number of pregnant women prescribed valproate in a 6-month period has fallen from 68 women in April to September 2018, to 17 women in October 2021 to March 2022. In light of concerns that the current regulatory requirements for safe use are not being consistently followed, the MHRA conducted a review of the available data and asked for advice from the independent Commission on Human Medicines (CHM). "The CHM has advised that no one under the age of 55 should be initiated on valproate unless two specialists independently consider and document that there is no other effective or tolerated treatment," said MHRA. "Where possible, existing patients should be switched to another treatment unless two specialists independently consider and document that there is no other effective or tolerated treatment or the risks do not apply."
