Ethics and Laws for Mental Health Professionals- 2 day In person Seminar - 0 views

  •
Overview: Mental health care practitioners work in today's diverse, fast-changing, multidisciplinary health care environment. Nowhere but in mental health is there such diversity of clinicians who provide the same or similar services of counseling and therapy. A potential client has a wide choice of mental health providers from whom to choose. Yet each individual mental health profession has a unique education, training, and experience requirement for practice. While similarities exist, requirements differ from state to state and even from profession to profession with a single state. What are these requirements and how do they apply? The state's authority and power over mental health practitioners often presents challenges to these mental health professionals that are not easy to navigate. Differing sources of legal and ethical authority govern each respective health care practitioner in ways that are similar but not the same. Ethics and law are similar, but not the same. All mental health practitioners must adhere to standards of state law which govern their professional practices, including the very core of the doctor-patient relationship. Codes of ethics and state law may both apply to govern the conduct of this clinician. Even some state laws are referred to as ethical codes. Complaints as to alleged misconduct or ethical failings are received and investigated by a state agency and leave the mental health practitioner with an uncertain process to handle and to defend the state action against them. With this background, this seminar empowers the full understanding and application of ethics and laws for mental health practitioners. Learn to identify and understand an ethical framework for a sound mental health practice. An ethical framework is essential to having the right perspective to examine mental health dilemmas. Compare and contrast regulatory laws and codes of ethics to understand their differing applicability. Know the difference between laws and ethics,

How to Ensure a Successful Health Care Systems Implementation - 0 views

  •
Overview: The presentation takes the participant through the steps needed to ensure a successful health care computer system implementation. Once presented the participant will see the logic of the tools and processes and be able to apply them to their system implementation. The tools and processes presented in this material have been developed by implementing health care systems for over 40 years and seeing what has worked and WHY it has worked. These tools and processes have been equally and successfully applied to the implementation of large, complex systems and smaller, simpler systems for large, multidepartment organizations and for small health care organizations. The process focuses on establishing the project's implementation expectations, identifying meaningful metrics for success, establishing project plans, assigning individual accountabilities and responsibilities, establishing and executing project tasks, monitoring project progress and validating project success. To establish viable project expectations, the presentation addresses the need for bringing all of the stakeholders (organization owners, providers and management, operations staff, IT staff and the vendor) into establishing common and realizable expectations. These are reviewed in context of the organization's current environment and its short and long term goals and are considered as a critical part of the implementation completion process. In the case of turning around an already troubled or failed system implementation, the process emphasizes the tasks of reassessing the project stakeholder expectations - why they decided the system would help the organization and what they expected to get from the system. Next the process shows the participant how to convert these expectations to realistic and measurable project success metrics. The process focuses on learning how to separate "so what" metrics from meaningful and measurable metrics. In addition, the process provides direction regardin

HIPAA 2016 -Texting and Emailing - 0 views

Overview: This lesson will be going into great detail regarding your practice or business information technology and how it relates to the HIPAA Security Rule, in particular portable devices. Areas covered will be texting, email, encryption, medical messaging, voice data and risk factors as they relate to IT. I will uncover myths versus reality as it relates to this very enigmatic law based on over 600 risk assessments performed as well as years of experience in dealing directly with the Office of Civil Rights HIPAA auditors. I will also speak to real life audits conducted by the Federal government (I've been on both sides of these audits) what your highest risks are for being fined (some of the risk factors may surprise you). In addition this course will cover the highest risk factors for being sued for wrongful disclosures of PHI and the manner in which patients are now using state laws to sue for wrongful disclosures. Don't always believe what you read online about HIPAA, especially as it relates to encryption and IT, there are a lot of groups selling more than is necessarily required. Why should you Attend: HIPAA NOW HAS TEETH! Be prepared for what's new in 2016! Protect your practice or business! What factors might spurn a HIPAA audit? …are you doing these things? Why are the Feds enforcing after all these years? It is important to understand the new changes going on at Health and Human Services as it relates to enforcement of HIPAA for both covered entities and business associates as it relates to portable devices, texting, and emailing of PHI. You need to know how to avoid being low hanging in terms of audit risk as well as being sued by individuals who have had their PHI wrongfully discloses due to bad IT practices. I have also been expert witness on multiple court cases where a business or medical practice is being sued for not doing their due diligence to minimize risk. Areas Covered in the Session: Updates for 2016 BYOD Portable devices B

Healthcare fraud and abuse: Healthcare fraud and abuse are different but related kinds of malpractice. They affect everyone concerned: the patient, the healthcare unit, the healthcare sector, and eventually, the economy. Healthcare fraud and abuse are serious malpractices that can have very grave consequences for the patient, the hospital and the healthcare sector. They can also cost taxpayers heavy amounts of money. Healthcare fraud: There is some distinction between healthcare fraud and healthcare abuse. Healthcare fraud is said to happen, according to medicare.gov, when Medicare gets billed for a service or supply the end user never gets. These fraudulent claims result in loss of billions of dollars of revenue to Medicare each year. Healthcare fraud could be said to happen when: False statements are submitted knowingly or facts are misrepresented with the purpose of obtaining a federal health care payment for claims for which the person is not entitled A person knowingly solicits, pays, or/and accepts a payment with the intention of inducing or rewarding referrals for services or items that any of the federal healthcare programs reimburse Eligibility is falsified Prohibited referrals are made for select, designated health services Healthcare abuse: Although related, healthcare fraud and abuse are not totally similar to each other in spirit. A healthcare abuse can be when physicians do not comply with or bypass established good medical practices or administer treatments that are not necessary. This is less serious than fraud in terms of intent, but carries the same consequences: loss of billions of dollars to the exchequer and potential damage the patient's health and the physician's and/or healthcare provider's reputation. Some examples of healthcare abuse These are some of the examples of healthcare abuse: When services that are not medically warranted are performed and charged for When services and/or supplies are charged in excess of their actual value

HIPAA Survival Guide - 0 views

HIPAA Survival Guide: The HIPAA Survival Guide is a set of practical help guides that seek to make compliance with HIPAA and HITECH easy for providers. This kit is some kind of checklist on what to keep in mind and implement to survive a HIPAA audit. The HIPAA Survival Guide was created as a need to comply with the HIPAA audit requirements. It evolved as a response to simplifying the HIPAA Privacy Rule and HIPAA Security Rule without its legal complexity. In other words, the framers of this Guide have developed this concept strictly as a guide, rather than as a legally enforceable set of rules. "Forest from the trees" approach: The HIPAA Survival Guide came into being in order to help users understand HIPAA and HITECH better. The approach the developers of this Guide adapted was what was called the "forest from the trees" way, because the aim was to help users navigate and wade through the complex text. It was aimed at helping them chaff and finesse the parts that required their compliance into simple terms. HIPAA Survival Guide is thus not a strict, legislative Act that lays down rules for conformity. No wonder, it was developed by the joint efforts of a Registered Nurse and an Attorney, who wanted to facilitate a greater understanding of the legislation's audit requirements. The basis on which this Guide came into existence was the HIPAA and HITECH background. It concerns itself with only the part of HIPAA and HITECH relating to a part of Covered Entities, namely providers. This is deliberate, since the aim of this Guide is to help small providers with guidelines aimed at simplifying their task. Important steps for HIPAA survival: The fundamental goal of the HIPAA Survival Guide is to equip providers with the knowledge of what needs to be kept in order and fine-tuned if they have to meet regulatory requirements. These are the thumb rules for the HIPAA Survival Guide: Documenting the provider's privacy, security and breach policies and revie

Key Factors to Write an Effective Standard Operating Procedure (SOP) and Work I... - 0 views

Course "Key Factors to Write an Effective Standard Operating Procedure (SOP) and Work Instructions (WIs)" has been pre-approved by RAPS as eligible for up to 12 credits towards a participant's RAC recertification upon full completion. Overview: Writing SOPs or procedural documents can be challenging at times. However, writing SOPs is overall a straightforward process. However, enforcing what you already created and implemented in the pipeline is another story. The term SOP is very obvious. We have seen "clearly written description of how specific tasks are to be done." Another satisfactory definition would be "detailed written instructions that achieve the uniformity of the performance of a specific function." Is the firm doing what the regulations specify? Is the firm doing what their procedures specify? If you are medical device or a pharmaceutical manufacturer, these definitions come as no surprise because when it comes to FDA regulations and guidance documents "establish" means to define, to document (in writing or electronically) and to implement. The goal and emphasis with FDA is simple. Proof of "Establish" is the foundation. Is the firm doing what the regulations specify? Is the firm doing what their procedures specify? Are the procedures being followed and enforced by company personnel? SOPs are needed in regulated industries to give step-by-step instructions for performing a particular job or task. This session will provide a step-by-step overview and a snapshot of the procedure description, the process and format. The subject matter of a SOP may range from how to operate a piece of machinery to how to log into a particular software program. SOPs ensure consistency and reliability because they require training of all affected parties. This session will address recent enforcement actions for SOP related violations but no surprise. Most of our enforcement actions are documentation related, i.e., SOP or other procedural documents. We will review examples from

Medical Informatics is a story of phenomenal growth: Medical informatics is an area that is growing at a fervid pace. Its growth is not likely to get hindered or slow down in the near future, due to the surge in its use in the healthcare and IT industries. Medical Informatics is a relatively recent development in the field of healthcare. It is interwoven into the development and application of IT-based innovations in the healthcare industry. Medical informatics is often synonymously and loosely used with other related words such as clinical informatics, nursing informatics, healthcare informatics and so on. Its associations with related or similar disciplines notwithstanding, one can draw a fairly clear idea of medical informatics. It can be described as the application, adoption, design and development of IT into activities relating to the healthcare industry. What is the objective of medical informatics? Medical informatics seeks to enhance knowledge and innovate in the healthcare field by using IT and its applications. Towards this end, it uses and merges the principles, knowledge, data, application, and the tools needed for applying these in the process of decision-making. Who are involved in the use of medical informatics? Medical informatics is used by almost everyone in the healthcare industry. These include physicians, nurses, billers, coders, many others who provide healthcare, and medical librarians. In addition, there are specialists who are tasked purely with working with medical informatics, such as Data analysts Hospital record managers, and Programmers and analysts in the industry. The rise and rise of medical informatics The birth and growth of medical informatics has been tied to those of the IT industry, the Internet in particular. In a sense, they are twins, having started and grown in almost a conjoined fashion. Its early development started in the 1960s, very nearly contemporaneous with that of the Net. Pediatric Wheelchair - 0 views

A Pediatric Wheelchair is a very important piece of mobility equipment for any patient. There are many instances where a patient would find himself in need of one, no just in cases of long-term disability. Upon admittance and discharge from the hospital, a patient is wheeled around. Those with temporary hurts to their lower extremities will also need a Pediatric Wheelchair for a short time. No matter the reasons for needing a Pediatric Wheelchair, many will find themselves looking for the right one for themselves, their patients, or for their medical care facility. For a pediatrician seeking to prescribe a Pediatric Wheelchair, must be sure that the patient has the proper upper body strength to use one. If the patient is too weak for self movement, the practitioner would be better to consider a powered wheelchair for mobility. While Pediatric Wheelchairs are smaller and can be just as manuverable as scooters, that depends upon the patient's own abilities in steering the chair. These are factors that the doctor must think about before recommending what type of wheelchair a patient should get. Electric wheelchair is a chair fitted with wheels. The device comes in variations allowing either manual propulsion by the seated occupant turning the rear wheels by hand, or electric propulsion by motors. There are often handles behind the seat to allow for different individuals to push. Electric Wheelchairs are used by people for whom walking is difficult or impossible due to illness, injury, or disability. Disabled People who have difficulty sitting and walking often make use of a wheelbench. A basic manual wheelchair incorporates a seat, foot rests and four wheels: two, caster wheels at the front and two large wheels at the back. The two larger wheels in the back usually have handrims; two metal or plastic circles. Electric wheelchairs are propelled by a motor and battery. They are very sophisticated. They are operated with a joy stick or push buttons. Some electric wheelchairs use advanced technology and can climb up stairs, move across gravel and even raise up to give access to high shelves. Electric wheelchairs need strong frames to support the motor and battery so they are very heavy and also quite expensive. People with spinal cord injuries face similar decisions. Often a person with a spinal cord injury will use a motorized wheelchair, even though they are physically capable of using a manual chair. They don't do this because they are lazy. They do this to be more efficient with their energy reserves. People with spinal cord injuries often choose motorized wheelchairs to preserve their physical energy, so that they can complete the work. Sometimes need to save on physical energy so that have some allowance left over for intellectual or emotional pursuits. Clinical informatics throws up opportunities and challenges alike - 0 views

Clinical information: Clinical informatics is the new exciting kid on the block. With the right mix of aptitude and attitude, professionals can look forward to many opportunities and challenges in the field. An understanding of the coining of the term "clinical informatics" gives an idea of what it is. Clinical informatics is a combination of two words, "clinical" and "informatics". Together, these relate to the knowledge of how information technology works in the healthcare sector. It is very important for clinicians to understand the functioning of IT into its domain, because with the advent of IT; there has been a major need to integrate clinical practices with it. A clinician who understands the way IT impacts the workings on in her industry is a better equipped professional when it comes to handling IT-related issues in the clinical setting. A clinical informatics professional should have a clear idea of the following approaches to IT: Analysis Design Implementation Assessment of information and communication that enhance the quality of clinical informatics Single approach to multiple health areas: One important element that needs to be understood about clinical informatics is that given the scope and breadth of the area of clinical informatics; professionals from any discipline of health -be it pathology, pharmacy, dentistry, radiology, dermatology, etc. -apply the same principles of clinical informatics to optimize the use of IT in healthcare. This requires constant coordination and cooperation with professionals and practitioners of all these areas. Clinical informatics is thus an area which is interspersed with all these other specializations and can be used and applied in any of these areas. What should a clinical informatics professional ensure? The aim of clinical informatics is to use this discipline to coordinate with nearly all the areas of medicine to provide optimal outcomes in patient care that delivers and ens
