Nearly 70 years ago the UK Government recognised the imbalance of power between commercial landlords and tenants and passed the Landlord and Tenant Act 1954 (the Act), giving most commercial tenants a right of security of tenure. What is security of tenure? The Act grants tenants of business premises (so this would include pharmacy tenants) the right when the fixed term of their lease has ended to remain in occupation of the premises and the right to apply for the grant of a new lease. The landlord can only object to the grant of the new lease of the premises to the tenant, and therefore regain possession of the property on certain grounds set out in the Act. The parties to a lease can contract outside the provisions of the Act and where this is the case, a tenant would not have security of tenure. Most landlords will insist on no security of tenure where a lease is granted for a short term. As pharmacy leases have tended to be granted for longer terms (usually between 10 and 15 years) pharmacy tenants often have security of tenure. The Act sets out strict procedures which need to be followed to both contract outside the provisions of security of tenure and also to exercise the security of tenure rights granted by the Act. Pharmacists should take legal advice before agreeing to a pharmacy lease being excluded from the Act, and also at the end of their lease term whether or not they have security of tenure. If the lease is contracted outside of the Act, advice should be sought on agreeing new lease terms, If the pharmacist wishes to remain, as there will be no right to do so beyond the end of the lease term. If the lease is protected by the security of tenure provisions of the Act, advice should still be sought, as the Act prescribes a formal notice procedure that both the landlord and tenant must adhere to, before a new lease can be granted.

The Pharmaceutical Services Negotiating Committee (PSNC) has been reminding contractors to complete the 2022/23 Community Pharmacy Assurance Framework (CPAF) screening questionnaire by midnight on Wednesday, 31 August 2022. As a result of NHS regulations introduced at the end of 2020, completion of CPAF is now a requirement of the Terms of Service. "Therefore, contractors must complete the screening questionnaire and, if required, the full CPAF questionnaire," said PSNC. It has also recommended that any contractor who has yet to do so takes immediate action. "It should only take approximately 10-20 minutes to complete." Information and instructions on how to complete the screening questionnaire has been shared either via an email from the NHS Business Services Authority (NHSBSA) or from their own Head Office. Contractors are advised to contact NHSBSA by emailing nhsbsa.cpaf@nhs.net if they have not received details of the questionnaire, or if they have any problems or queries completing the questionnaire.

A recent Pharmacists' Defence Association (PDA) survey revealed that 80 per cent of its member working in the NHS in England, Wales, and Northern Ireland rejected the NHS pay award. "For the first time in the history of our union, members have told us they are so angry that they would not rule out industrial action in conjunction with other NHS unions," said Paul Moloney, PDA Union national officer. "It is important that, whoever is to lead the government, they listen to this message and act now to ensure our members and others in the NHS do not face swinging cuts to their standard of living." PDA members were asked whether they would support industrial action if they had rejected the award and if other NHS unions would be taking industrial action. 58 per cent of those responding said they would support the PDA Union taking industrial action if members of other unions were also planning to take action on this issue. For now, however, the PDA Union will wait for other unions to publish the outcomes of their own consultations. As a union dedicated to representing the needs of only pharmacists, the PDA has been able to quickly survey members immediately after the pay award was announced.
