Premises Injury Case: What Evidence Is Needed? - 0 views

  •
If you have been injured on someone else's property, you may be wondering what evidence is needed to win your case. Property owners are responsible for ensuring that their premises are safe for visitors, and if they fail to do so, they can be held liable for any injuries that occur. In this blog post, we will discuss the types of evidence that may be necessary to prove your case and win financial compensation for your injuries. 1) DUTY OF CARE The first piece of evidence that you will need to prove your case is that the property owner owed you a duty of care. This means that they were required to take reasonable steps to keep you safe from harm while you were on their property. If the property owner did not live up to this duty, and you were injured as a result, they can be held liable according to Carpenter & Zuckerman lawyers. To prove that the property owner owed you a duty of care, you will need to show that you were an invitee or licensee on the property. Invitees are people who are invited onto the property for business purposes, such as customers or delivery people. Licensees are people who are allowed onto the property for non-business reasons, such as social guests. If you were not an invitee or licensee, the property owner may not be held liable for your injuries.

NPA denounces 'unaffordable' health centre pharmacy rent - 0 views

  •
The National Pharmacy Association (NPA) has raised its concerns over rising cost of rent for its members. The association highlighted that pharmacy spending is shrinking, and therefore, the NHS Property Services must ensure viability of health centre pharmacies. In May, the NPA wrote to NHS Property Services to voice its concerns over the rising cost of rent after some of its members reported demands for a three-fold increase in rent. Many pharmacies operate in premises of which NHS Property Services is the landlord. In a letter last month to chief executive Martin Steele, NPA said: "The past years have seen far fewer patients in health centres and therefore using the on-site pharmacy - whilst the situation will change somewhat as we move out of the pandemic we expect a permanent impact on workload as practices handle more of their interactions virtually. "The NPA encourages NHS Property Services to review lease agreements involving community pharmacies and consider favourable changes to terms that are in line with current financial realities affecting the sector. This could avoid the loss of a pharmacy service to communities and the resulting loss of rental income to NHS Property Services."

Pharmacy and Intellectual Property Right: Things to Know - 0 views

  •
In many cases, a pharmacy's most valuable asset is its NHS contract. This is what buyers are paying for - the right to provide pharmaceutical services commissioned by the NHS and be reimbursed for the medicines dispensed. However, a pharmacy consists of more than just an NHS contract and when buyers look for a pharmacy to buy, they will also examine these other areas - the pharmacy's customer base, its staff, the property it operates from - to name a few - because these are all also crucial to a successful pharmacy. In this day and age, another important consideration is the pharmacy's intellectual property (IP) i.e. the pharmacy's rights to certain types of information, ideas, and forms of expression. At the most basic level, this includes the trade mark in the name of the pharmacy, because all pharmacies will have a name by which they distinguish themselves from other pharmacies. The more well-known the name, the more valuable this form of IP is - mention 'Boots', for example, and most will have an instant association with the largest pharmaceutical retailer in the UK.

Premises Injury Cases:4 Legal Facts Businesses Should Know - 0 views

  •
Businesses have a responsibility for the safety of their employees, as well as visitors that are on their premises. If an injury occurs on their property, a company can be held responsible. There are various issues and rules that may apply, so it is important to know the facts regarding such situations. Here are 4 impacts legalities to consider for your business when dealing with such incidents. STATUS OF ENVIRONMENT AND RESPONSIBILITY OF PREMISES When you are looking into injury cases that occur and involve the premises or property of a business, one of the most important aspects to consider is the status of the property itself. All property that has access to the public owned by an individual or business must be maintained in a manner that is safe for people to reasonably move around. This is often associated with sidewalks and pathways, as well as corridors, hallways, and various rooms in businesses. You must ensure that areas where people may be around are safe such as ensuring no water or substance is present on floors that would cause falls or slips, and otherwise having the signage to indicate the need for caution. This is not limited to people, but can also apply to vehicles and equipment, ensuring oil stains and spills do not endanger the operators and employees in the area. Businesses should recognize any risks that are present and also be mindful to address environmental concerns in the immediate area as they are made aware of them. If a business fails to address such potential dangers, they are indeed potentially liable for any injuries and health concerns that come as a result of willful ignorance of the situation.

Base rent for health centre pharmacies needs revision - 0 views

  •
The Association of Independent Multiple Pharmacies (AIMp) and senior official of NHS Property Services (NHSPS) had a meeting on August 18 to review the rent policy for health centre pharmacies. Earlier, the association had sent a letter to NHSPS that was signed by pharmacies from across the sector, including single independents, pharmacy groups and members of the Company Chemists' Association. The letter outlined concerns about rent reviews and the impact of it on the co-located health centre pharmacies. Dr Leyla Hannbeck, CEO of AIMp, said: "We outlined that whilst in the past, the norm established by the industry, was to base rents for co-located pharmacies primarily based on patient list size, (and taking account of a few other factors), the industry now needs to revise the basis on which rents are determined for co-located pharmacies." The association, on behalf of the pharmacy sector, met the CEO of NHSPS and two of their senior directors (director or property management and their finance director).

Pharma group seeks fairer future access for covid patents - 0 views

  •
An alliance of companies has pledged to ensure equitable access to vaccines and treatments for pandemics, as the friction around intellectual property rights for Covid-19 interventions between the pharmaceutical industry and developing nations endures. At the heart of the plan is a commitment to set aside part of the production of vaccines and treatments upfront for vulnerable populations in low-income countries when the next pandemic arises, given how fragmented access to Covid tools has left many populations unprotected. In order to do better next time - and without knowing which companies will develop the first drugs and vaccines for the next pandemic - having the industry collectively make this commitment is potentially transformative, said Thomas Cueni, head of the International Federation of Pharmaceutical Manufacturers & Associations (IFPMA). The pledge, called the Berlin Declaration, was made on July 19 by members of the global pharmaceutical industry group that include many of the companies involved in developing Covid interventions, such as AstraZeneca, GSK, Moderna, Pfizer and Merck. The declaration is not legally binding. However, if a company that signed on reneges on its vow, it would face grave consequences in the court of public opinion, said Cueni.
