Leaving aside the reasons for steep price rises, I have been asked on social media and elsewhere whether pharmacy owners can refuse to supply prescribed medicines if they would make a significant financial loss. Legal obligation The first thing to point out is that the National Health Service Act 2006 imposes a legal duty on the Secretary of State and NHS England to make arrangements for people to receive sufficient prescribed drugs. These arrangements involve the publication of the Drug Tariff. The Drug Tariff includes reimbursement prices or a method for determining prices. Various factors can be taken into account in determining reimbursement prices. The Drug Tariff does not provide a pound for pound reimbursement for medicines that pharmacies supply on NHS prescriptions.

The General Pharmaceutical Council (GPhC) has produced a new resource to support pharmacists and pharmacy technicians who are providing pharmacy services to children and young people with gender incongruence or dysphoria. It emphasises that pharmacy teams providing such services need to adhere to the standard process of clinical assessment and care provision they have been trained to take as healthcare professionals. The starting point is that pharmacy professionals must provide compassionate, inclusive and person-centred care, within the current relevant legal and regulatory context. "It's essential that all patients have access to appropriate, high-quality and respectful healthcare, free from discrimination or bias," the GPhC noted

The Department of Health and Social Care (DHSC) has finally published its response to the 2022 consultation on hub and spoke dispensing. Considering the consultation evidence and further discussions, the government has expressed its intention to progress the proposals for enabling hub and spoke models across different legal entities as soon as possible. This will be achieved by using the enabling powers outlined in Part 2 of the Medicines and Medical Devices Act 2021 (MMDA) to amend the Medicines Act 1968 and the HMRs. Furthermore, the DHSC has decided to proceed with the implementation of the two models of hub and spoke dispensing that it consulted on. The government response to the consultation reads: "Having considered the responses, the government intend to proceed to implement the necessary changes to medicines legislation to remove the current restrictions that prevent the hub and spoke dispensing models from operating across different legal entities found in section 10 of the Medicines Act 1968.

The Pharmacists' Defence Association (PDA) is probing major concerns arising from Boots' communications to pharmacists regarding the company's recently announced pension arrangements. In November, Walgreens Boots Alliance (WBA), the parent company of Boots, transferred the Boots employees' pension scheme to the financial service provider Legal and General (L&G) in a £4.8 billion deal. Boots notified staff that terms allowing an unreduced pension from age 60 have ceased immediately, following its agreement with L&G. The PDA highlighted member concerns regarding Boots management's announcement that an unreduced pension from the age of 60 is a discretionary benefit and not guaranteed under the Boots Pension Scheme (BPS), contrary to some members' assumptions.

The Pharmacists' Defence Association (PDA) is playing a vital role in helping pharmacists who are dealing with stress at the workplace. It launched its new awareness factsheet 'It's Time to Address Stress' last week. The factsheet looks at the causes and symptoms of stress in the workplace and provides advice on ways pharmacists can access support and improve working conditions. The association said that it recognises the well-being services offered by employers and specialist charities such as the PDA's charity partner Pharmacist Support play an important part in helping pharmacists who may be experiencing stress. However, the PDA is also committed to working with members to challenge employers to provide well workplaces and to help them to make real impact changes. This can be done by addressing the causes of stress and fulfilling their responsibilities to their employees. It added: "Under the management of Health and Safety at Work Regulations 1999, employers are required by law to protect employees from harm. Their legal obligations include identifying hazards and risks and implementing ways to reduce or eliminate them. The PDA's new factsheet highlights the importance of employers recognising the hazards causing stress as the health and safety issues they are."

In a significant move to enhance the working conditions of over 50,000 postgraduate doctors in the National Health Service, NHS England has unveiled a series of measures aimed at providing greater choice and opportunities to the new entrants in the medical profession. With flexible rotas, reducing payroll errors, and easing the financial burden of course fees, the NHS has taken steps to address the issues faced by junior doctors in order to support their well-being. In recent announcement, 83 per cent of senior doctors and dentists accepted the government's pay offer. Alongside the junior doctors who still fighting for fair pay and recognition, the senior medical professionals demanded that the authorities help them tackle issues pertaining underfunding and overworking in the NHS. Junior doctors in training also often face challenges with frequent moves between trusts, leading to short notice changes in work schedules and duplicated inductions when transitioning to new hospitals. As a measure taken by the health serivces, the committee aims to review the minimum legal requirements for statutory and mandatory training, potentially halving the time burden for such training and allowing doctors to spend more time caring for patients as part of the long-term workforce plan.

New amendments to the Human Medicines Regulations will soon allow registered pharmacy technicians to supply and administer medicines under Patient Group Directions (PGDs). Laid before Parliament at the end of May, the legislative changes will come into effect from June 26, 2024, the Community Pharmacy England (CPE) announced today. The introduction of this new legislation follows an announcement made by the Department of Health and Social Care (DHSC) earlier this year. The regulatory adjustments provide the legal framework for pharmacy technicians to engage in the supply and administration of medicines under PGDs in the course of their professional practice. The Society has urged its members to fill out the survey before May 20. RPS president Claire Anderson said: "It is vital that RPS members have their say on issue that impact you in your roles. Currently only single legal entities can make use of this model of dispensing. "Our survey, which opened today, seeks your views and comments and will help to inform the RPS submission to this consultation." The consultation on the proposals to enable all community pharmacies to access hub and spoke dispensing published by the Department of Health and Social Care (DHSC) will run for three months and will close on June 8, 2022.

The Pharmacists' Defence Association (PDA) has begun conciliation with 86 pharmacy companies to safeguard the interests of former LloydsPharmacy pharmacists. The Advisory, Conciliation and Arbitration Service (Acas), a government agency, serves as a mediator between companies and employees to resolve disputes. If the ongoing mediation prove unsuccessful, individual employees retain the option to file claims in the employment tribunal, the PDA has said. The ongoing dispute centres around employers potentially failing to conduct the required consultation under the Transfer of Undertakings (Protection of Employment) regulations (TUPE) with employees and their representatives during employee transfers, the PDA said. The TUPE legislation, known for its complexity and technical nature, applies when a section of the company, like a pharmacy sold as an asset using standard disposal, undergoes a transfer. According to NHS England's recent pharmaceutical list, LloydsPharmacy has either sold or shuttered 461 branches since September 2022. According to NHSE data, as of June 30, the pharmacy chain operates approximately 512 pharmacies in England. This positions it as the third-largest chain after Boots UK and Well Pharmacy.
