The Department of Health and Social Care (DHSC) has introduced a new 'swap to stop' scheme to encourage one million smokers to swap cigarettes for vapes in England. As part of the world-first national scheme, almost 1 in 5 of all smokers in England will be provided with a vape starter kit alongside behavioural support to help them quit the habit as part of a series of new measures to help the government meet its ambition of being smokefree by 2030 - reducing smoking rates to 5% or less. Local authorities will also be invited to take part in the scheme later this year and each will design a scheme which suits its needs, including deciding which populations to prioritise. Health Minister Neil O'Brien announced on Tuesday (11 April) that pregnant women will be offered financial incentives to help them stop smoking. This will involve offering vouchers, alongside behavioural support, to all pregnant women who smoke by the end of next year. The government will also consult on introducing mandatory cigarette pack inserts with positive messages and information to help people to quit smoking. It has also announced a formation of new 'illicit vapes enforcement squad' to regulate and tackle the sales of illegal vapes to under 18s.

The Pharmacists' Defence Association (PDA) has welcomed the government's defeat in the House of Lords on the Strikes (Minimum Service Levels) Bill. It believes that the proposed Bill, if enacted, would allow the government to dictate minimum levels of service during times of industrial action, enabling employers to name specific employees that they require in work. Those employees could then face losing their jobs if they failed to turn up to work on that day. Trade unions could also be fined if they did not force those named individuals to go to work. PDA director, Paul Day said, "This Bill should be of real concern to pharmacists and other health professionals. The idea of their employer being able to effectively conscript them to work or face the sack does not feel like a positive employment relations environment." The House of Lords has voted for key amendments to the Bill to prevent unions from being required to force workers to comply. This also prevents workers from being forced to work or face the sack and allows for greater consultation and Parliamentary scrutiny on the proposals which the Westminster government is trying to implement. The House of Commons will now be required to vote on the amendments over the next few weeks. Whilst the House of Lords amendments are likely to be defeated, it shows the degree of opposition there is to this Bill.

Our Totton branch has an incredibly high volume of original pack dispensing, roughly 45,000 items. As we became busier and busier in the dispensary we were finding that our pharmacists, dispensers and other technicians simply didn't have capacity to deliver the services that we needed them to. The Pharmaceutical Services Negotiating Committee (PSNC) has urged community pharmacy to plan and ensure patients are able to access their prescription if they have to close in an emergency situation for a short period. It has prepared a guidance which can be undertaken by pharmacy in the event of a closure and the contractor's business can resume easily and effectively once the emergency has passed. In its guidance, PSNC has stated a few actions that can be taken by pharmacy in advance: Plan ahead - be ready before a closure is needed. Don't wait until your pharmacy needs to be closed before you consider how you will manage and what you can put in place to mitigate the impact. Make sure your business continuity plan is up to date and relevant to the current situation. For example, try not to rely on family and friends as part of your plan; if you're having to isolate because of infectious illness, your close contacts may need to do so as well. Ensure your SOPs are accurate, up to date and easy-to-find for someone completely unfamiliar with your pharmacy. Emergency numbers will be crucial. NHS England has urged the pharmacy owners to continue to voluntarily submit New Medicine Service (NMS) quarterly summary data to the NHS Business Services Authority (NHSBSA) for Quarter 4 (Q4) 2022/23 (January to March 2023). Community Pharmacy England have agreed with NHS England that the quarterly returns will continue to be on a voluntary basis, with Q4 (January to March 2023) as the second quarter to be reported. It has thanked all the members that submitted NMS quarterly summary data for Quarter 3. The mandatory requirement to submit this data has been suspended since 2020, due to the COVID-19 pandemic. "NHS England wants to continue collection of the quarterly returns to provide baseline data to support a long-term evaluation that will be conducted as part of ongoing work to expand the scope of NMS," said Community Pharmacy England. Voluntary submissions can be made via the NHSBSA website, where an updated reporting spreadsheet is also available for head offices to use who are able to submit data on behalf of multiple pharmacies.

Dividends The annual tax-free dividend allowance for 2022/2023 is £2,000. The Department of Health and Social Care (DHSC) has issued Serious Shortage Protocols (SSPs) on three HRT medicines to limit dispensing supply to three months. To ensure women across the UK will be able to more reliably access HRT products SSPs has been issued on the supply of Oestrogel, Ovestin cream and Premique Low Dose. DHSC stated, "Women who have a prescription for more than three months but are only able to access three months' supply will not have to pay an additional prescription charge." "This means women will not incur any additional costs. Imposing a three month limit will mean more women are able to access the medication they want. Any woman who is worried about access to HRT or is unable to access HRT should speak to her GP." The Royal Pharmaceutical Society (RPS) has urged the government to amend medicines legislation to allow pharmacists to make minor amendments to a prescription without any protocol being needed. RPS wants to see a change in the law that makes the whole process of supply of medicines easier and quicker, enabling pharmacists to use their knowledge and expertise in medicines to better support patients. "At present a prescription can only be changed by a prescriber, which causes unnecessary workload for GPs and delays for patients," said RPS. RPS President Professor Claire Anderson said: "We want to see all pharmacists across the UK able to supply a different quantity, strength or formulation of a medicine (for example changing capsules to tablets) when required, to avoid unnecessary bureaucracy and the need for an SSP to be developed, signed and authorised by a Minister. In effect it would mean that pharmacists can help patients straight away - it would future proof the problem to some degree.

Nearly 70 years ago the UK Government recognised the imbalance of power between commercial landlords and tenants and passed the Landlord and Tenant Act 1954 (the Act), giving most commercial tenants a right of security of tenure. What is security of tenure? The Act grants tenants of business premises (so this would include pharmacy tenants) the right when the fixed term of their lease has ended to remain in occupation of the premises and the right to apply for the grant of a new lease. The landlord can only object to the grant of the new lease of the premises to the tenant, and therefore regain possession of the property on certain grounds set out in the Act. The parties to a lease can contract outside the provisions of the Act and where this is the case, a tenant would not have security of tenure. Most landlords will insist on no security of tenure where a lease is granted for a short term. As pharmacy leases have tended to be granted for longer terms (usually between 10 and 15 years) pharmacy tenants often have security of tenure. The Act sets out strict procedures which need to be followed to both contract outside the provisions of security of tenure and also to exercise the security of tenure rights granted by the Act. Pharmacists should take legal advice before agreeing to a pharmacy lease being excluded from the Act, and also at the end of their lease term whether or not they have security of tenure. If the lease is contracted outside of the Act, advice should be sought on agreeing new lease terms, if the pharmacist wishes to remain, as there will be no right to do so beyond the end of the lease term. If the lease is protected by the security of tenure provisions of the Act, advice should still be sought, as the Act prescribes a formal notice procedure that both the landlord and tenant must adhere to, before a new lease can be granted.

David Webb, the Chief Pharmaceutical Officer for England, acknowledged that the "pressure in the system is high", but urged everyone to "keep our eye on the design" of the NHS plan, adding that the "the objective is to bring the different parts of primary care together" in the patient interest. Speaking during the opening keynote session at the the National Pharmacy Association (NPA) conference held on Thursday (13 October), he added that the NHS plan intends to bring different parts of primary care together to help patients. He said the new integrated care boards (ICBs) are a key strategic framework as they provide the "potential to form partnerships to deliver integrated services across larger populations". "ICBs will want to work with Local Pharmaceutical Committees to plan for the local population and the new community pharmacy clinical leads in ICBs, who have been funded by NHS England, are there to advise." He explained that once an ICB takes over the commissioning of pharmaceutical services (which they are all due to do by April 2023), it could use its funds to commission a local enhanced service as an add on to an advanced service. For instance, a CVD risk assessment could be added to the blood pressure check service.
