Pharmacist supervision has been the subject of debate for as long as I can remember. Strikingly, no one is sure what supervision requires. The Human Medicines Regulations 2012 say it is a criminal offence to sell or supply Pharmacy medicines or Prescription Only Medicines unless a pharmacist makes the sale or supply or, if the transaction is carried out by a non-pharmacist, that person acts under the supervision of a pharmacist. The wording of the Human Medicines Regulations is not identical to the wording of earlier legislation. In particular, on the only occasions when the courts have been called upon to interpret the requirement for supervision, the Pharmacy and Poisons Act 1933 was in force. In cases decided in 1943 and 1953, the courts decided that a pharmacist who was upstairs when a supply was made could not have been supervising; and that a sale was supervised by pharmacist standing at the cash desk because the pharmacist could intervene if a sale would not be appropriate.

The Health Select Committee Expert Panel has concluded in its report published on Tuesday (25 July) that the funding aspect in the community pharmacy sector 'requires improvement' based on the evidence received. The Expert Panel reviewed nine Government commitments, seven of which were from the Community Pharmacy Contractual Framework. It was found that available funding was not sufficient to keep pharmacies open, struggling financially with increased demand for dispensing, workforce pressures and rising costs due to inflation. One of the other commitments requiring improvement covered a scheme intended to protect access to local physical NHS pharmaceutical services in areas where there were fewer pharmacies. Professor Dame Jane Dacre, Chair of the Expert Panel, said: "Pharmacy plays a key role in the delivery of care so it's disappointing that progress overall to deliver on the Government's commitments was rated as 'requires improvement'.

To ease pressure on community pharmacies, the deadline to meet the requirements of the Pharmacy Quality Scheme will be extended, Pharmaceutical Services Negotiating Committee (PSNC) announced today (December 15). This follows an agreement reached between the negotiator and the NHS England and NHS Improvement (NHSE&I) and the Department of Health and Social Care (DHSC). Recognising the challenges faced by pharmacies and their contribution towards the Covid-19 vaccination programme, following additional changes have been agreed upon: Contractors will not be required to complete the Community Pharmacy Patient Questionnaire for 2021/2022; The requirement for pharmacy teams to complete a national audit (intended to be on valproate) in 2021/22 will be waived; and The requirement for pharmacy teams to complete a contractor-chosen clinical audit in 2021/22 will be waived.

Pharmacists with 'relevant experience in a pharmacy setting' can enroll for accredited independent prescribing course, as the General Pharmaceutical Council (GPhC) has decided to scrap the requirement of spending at least two years on the register and having previous experience in a specified clinical or therapeutic area before enrolling for the course. The GPhC Council meeting held on Thursday instead proposed that applicants must have "relevant experience in a pharmacy setting and be able to recognise, understand and articulate the skills and attributes required by a prescriber." This experience and awareness will act as the basis of their prescribing practice whilst training. The regulator noted that the majority of stakeholder organisations, including the Chief Pharmaceutical Officers, the Royal Pharmaceutical Society and the statutory education bodies, were in favour of removing the requirement in a consultation on the topic. They highlighted that a specific two-year period was not in itself a robust indication of whether an individual was ready to become a prescriber. They also highlighted that the rapidly developing roles in the profession meant more pharmacists were likely to gain the necessary experience more quickly than in the past. A smaller number of organisations and a larger minority of individuals were opposed, citing that a specific two-year period gave pharmacists the time they needed to develop experience and confidence before being ready to enrol on a course.

The Pharmaceutical Services Negotiating Committee (PSNC) has confirmed that the community pharmacy contractors are 'not required' to undertake a contractor-chosen or an NHS England determined clinical audit in 2023/24. "A clinical audit on anticoagulants is included in the Pharmacy Quality Scheme (PQS) 2023/24. If contractors choose to not participate in PQS, and therefore do not complete the anticoagulant clinical audit, there is still no requirement to complete two clinical audits in 2023/24," said PSNC. "The Department of Health and Social Care and NHS England have also committed to consider, during 2023/24, the removal of the requirement for a contractor-chosen clinical audit permanently."

The Pharmaceutical Services Negotiating Committee (PSNC) has called for improved workforce planning to be undertaken by the government and NHS. However, for this to happen, it added, "high quality workforce data for community pharmacy needs to be available." For this reason, the Department of Health and Social Care (DHSC), NHS England and PSNC have agreed that it will be a Terms of Service requirement for contractors to complete the annual Health Education England (HEE) community pharmacy workforce survey, which will then provide a full picture of the community pharmacy workforce, including identifying the number of vacancies and regions where these are particularly hard to fill. PSNC said: "It is acutely aware of the challenges that contractors and their teams are currently facing, so in recognition of the workload associated with completing the annual workforce survey, we have negotiated with DHSC and NHS England that the requirement to undertake an annual patient satisfaction survey will be removed from the Terms of Service from 1st October 2022." This means that contractual requirement will no longer apply to contractors in 2022/23 and going forward.

The Pharmacists' Defence Association (PDA) has welcomed the government's defeat in the House of Lords on the Strikes (Minimum Service Levels) Bill. It believes that the proposed Bill, if enacted, would allow the government to dictate minimum levels of service during times of industrial action, enabling employers to name specific employees that they require in work. Those employees could then face losing their jobs if they failed to turn up to work on that day. Trade unions could also be fined if they did not force those named individuals to go to work. PDA director, Paul Day said, "This Bill should be of real concern to pharmacists and other health professionals. The idea of their employer being able to effectively conscript them to work or face the sack does not feel like a positive employment relations environment." The House of Lords has voted for key amendments to the Bill to prevent unions from being required to force workers to comply. This also prevents workers from being forced to work or face the sack and allows for greater consultation and Parliamentary scrutiny on the proposals which the Westminster government is trying to implement. The House of Commons will now be required to vote on the amendments over the next few weeks. Whilst the House of Lords amendments are likely to be defeated, it shows the degree of opposition there is to this Bill.

Dr Jim Livingstone, president of the PSNI, said: "The Department of Health has set a clear direction which will see pharmacist independent prescribers becoming increasingly important in the delivery of pharmacy services in Northern Ireland. Our role is to protect the public, but we are clear that our regulatory objective should not be an unnecessary barrier to the development of the profession and enhanced services being provided to the public."

The regulators have reduced the notice periods for change to supplementary opening hours for community pharmacy contractors from 1 October 2022. "If a contractor wants to increase supplementary opening hours at the pharmacy, this can be done with no notice - but notification of the change must still be given to NHS England," said PSNC. "To decrease supplementary opening hours at the pharmacy, at least five weeks' notice must be given to NHS England prior to implementing the change."

The General Pharmaceutical Council (GPhC) today decided to convene a new group, involving all the key stakeholders, focused on assurance of practice post-registration. The decision in today's (9 December) council meeting follows the recommendation of a working group chaired by council member and pharmacist Aamer Safdar on the role of the regulator in post-registration education and training. The new group will be tasked with articulating a set of guiding principles where patient safety is the overarching priority, after carrying out a horizon scanning exercise to pull together an understanding of the system wide approach currently in place. The working group noted that the wider approach, in relation to regulation of post-registration practice and not simply education and training, may require the GPhC reviewing and developing its own control measures, and involving patients and the public in the next stages of work. Reviewing the work on online pharmacy services, the council meeting supported the regulator's plans to continue to require pharmacy websites to be arranged so that a person cannot choose a prescription only medicine and its quantity before there has been an appropriate consultation with a prescriber.

When endorsing using EPS, contractors are reminded to select the SSP endorsement and input the correct three-digit reference number leaving a space in between 'SSP' and the three-digit reference number for example, SSP 019. Remember to insert the leading zero in the three digit reference number. Each of the affected HRT medicines has its own SSP reference number. Check that the correct SSP number is endorsed for e.g. for Oestrogel® Pump-Pack 0.06% gel the SSP endorsement should be 'SSP 019'. Please note the 'NCSO' endorsement is no longer accepted for SSPs. Endorse the SSP product dispensed including the quantity. Ensure your endorsements are accurate and clear - NHSBSA processing staff must be able to determine what has been supplied. Contractors should note that SSP claims submitted using EPS tokens are no longer permitted.

NHS England has mandated a business continuity plan for pharmacies dealing with temporary closures from the end of this month. Community Pharmacy England (CPE) has put together a briefing and a template plan to help guide pharmacy owners through the process. It explains what is required in the plan, describes how and when to implement it, and outlines some additional considerations. "This could be added as an annex to your pharmacy's existing business continuity plan. A checklist has also been added, which may be used in the event of a temporary suspension," said CPE. "NHS England will be publishing the approved particulars shortly. NHS England is also still to publish guidance on the amendments to the Pharmaceutical Regulations that came into force on 25th May, which will include guidance on these requirements.

The Pharmaceutical Services Negotiating Committee (PSNC) has reminded community pharmacies (its members) to update their NHS Profile Manager information. Ahead of the NHS contract quarter deadline- 30th June 2023, the committee has urged its members to ensure that their pharmacy's NHS website and Directory of Services (DoS) profile information is kept up-to-date. The Pharmacy Terms of Service requires pharmacy owners to verify profile information at least once per quarter, however the new NHS Profile Manager has been introduced to make the process as quick as possible and it can be done on either a smartphone or computer. PSNC said: "We continue to work with NHS England and the NHS Profile Manager team to make the process as easy as possible and to improve the management tool. Our feedback has led NHS England to automatically set pharmacy opening hours to 'closed' for many bank holidays (however these can be reset to 'open' if required)."

The survey closes on Wednesday (November 30). The completion requirements are mandatory and particularly pertinent at a time when workforce challenges have become a major issue within the sector. The Pharmaceutical Services Negotiating Committee (PSNC) has been reminding contractors to complete the 2022/23 Community Pharmacy Assurance Framework (CPAF) screening questionnaire by midnight on Wednesday, 31 August 2022. As a result of NHS regulations introduced at the end of 2020, completion of CPAF is now a requirement of the Terms of Service. "Therefore, contractors must complete the screening questionnaire and, if required, the full CPAF questionnaire," said PSNC. It has also recommended that any contractor who has yet to do so takes immediate action. "It should only take approximately 10-20 minutes to complete." Information and instructions on how to complete the screening questionnaire has been shared either via an email from the NHS Business Services Authority (NHSBSA) or from their own Head Office. Contractors are advised to contact NHSBSA by emailing nhsbsa.cpaf@nhs.net if they have not received details of the questionnaire, or if they have any problems or queries completing the questionnaire.
