05.10.09: EU leaders face 'difficult task' naming new Commission - 0 views

  • EU heads of state and government will have to make difficult choices when they meet in Brussels for a summit on 29-30 October, with uncertainty over when the Lisbon Treaty will come into force having huge consequences for the size of the next European Commission, analysts told EurActiv.
  • Background: According to pro-EU politicians, Europe is in a "completely new" situation after the resounding 'yes' vote in the second Irish Lisbon Treaty referendum, held last Friday (EurActiv 03/10/09).  At present, 25 out of 27 EU member states have ratified the Union's reform treaty, and the news from Poland is that its president, Lech Kaczyński, will soon sign the ratification by the country's parliament, completing the procedure in that country too.  All eyes are now turning to the Czech Republic, where a group of 17 Eurosceptic senators close to the country's president, Václav Klaus, filed a second complaint against the Lisbon Treaty with the constitutional court in Prague, putting its ratification on hold (EurActiv 30/09/09).  This strategy is seen as an attempt to delay final ratification of the Lisbon Treaty until a conservative government comes to power in Britain, where elections are due next year.  Tory leader David Cameron, who leads comfortably in opinion polls, said that in the event that the Lisbon Treaty is not fully ratified by then, he will call a referendum in the UK, despite the fact that the country has already ratified the treaty in parliament (EurActiv 24/09/09). 
  • On the one hand, EU leaders can assume that the Lisbon Treaty will soon be ratified and invite member states to submit candidacies for commissioners and other top jobs. Alternatively, they can choose to avoid taking any risks and launch a procedure for nominating a smaller-size Commission under the current Nice Treaty, analysts told EurActiv.

06.11.08: Western Balkans still way off EU entry criteria - 0 views

  • EU Enlargement Commissioner Olli Rehn made clear yesterday (5 November) that Serbia, Montenegro, Macedonia, Albania and Bosnia and Herzegovina, as well as Kosovo, are still a long way away from getting clear persprectives of EU accession.
  • In spite of the EU executive's insistence that its assessments are based on objective criteria, the countries in the region are increasingly aware that enlargement is no longer fashionable in the EU, especially in the context of the current financial crisis and uncertainty following the rejection of the Lisbon Treaty by Ireland.  European Parliament President Hans-Gert Poettering said on Tuesday that "perhaps with the exception of Croatia," no enlargement was possible without the Lisbon Treaty. This statement contradicts strong views, expressed repeatedly by French President Nicolas Sarkozy, that no enlargement whatsoever was possible before the Lisbon Treaty comes into force (EurActiv 20/06/08). In fact, the Nice Treaty provides institutional arrangements for only 27 member states, but some countries believe that it may be possible to find a compromise to accommodate Croatia.

03.11.10: EU leaders back 'limited' treaty change, budget cap - 0 views

  • Britain and other European Union countries put their weight behind Franco-German calls for tougher eurozone rules at a summit today (29 October), agreeing on "limited" changes to the EU's main treaty in return for a cap on the EU budget.
  • Officials struggled to deliver the message that legal tricks could accommodate both Germany's push for treaty change and conflicting calls from several other countries which had rejected the idea. Regarding treaty change, the key word is "simplified", officials explained. A simplified provision, enshrined in Article 48, Section 6 of the Lisbon Treaty, allows member countries to unanimously adopt a decision amending all or part of the main elements of the Treaty on the Functioning of the EU (TFEU), which governs how the Union carries out its work. Such a procedure would avoid the need to call a constitutional convention, experts explained. In addition, the European Parliament would only be "consulted" instead of enjoying full voting rights as part of the normal co-decision procedure. The changes to the treaty are to be settled by mid-2013, before the expiry of the present emergency fund agreed earlier this year to deal with crises such as the one that hit Greece. The objective is to replace that with a permanent mechanism. The simplified treaty change procedure will not enter into force until it is approved by member states in accordance with their constitutions. Most EU countries are expected to ratify the decision by a simplified procedure in their parliaments. As for Ireland, it remains unclear whether a change effected in this way would require another referendum.
  • UK Prime Minister David Cameron appears to have been instrumental in forging a deal, lending his backing to Franco-German calls for treaty change in return for keeping a lid on the EU's 2011 budget. 11 member states, including Britain, France and Germany, will send a letter to the European Commission and Parliament today saying that their plans to increase the EU budget by 5.9% in 2011 are "especially unacceptable at a time when we are having to take difficult decisions at national level to control public expenditure". The letter was signed by the leaders of the UK, Germany, France, the Netherlands, Sweden, the Czech Republic, Denmark, Austria, Finland, Slovenia and Estonia. The bloc's finance ministers had earlier voted for a limited increase in the EU budget of 2.9%. "We are clear that we cannot accept any more than the 2.9% increase proposed by the finance ministers," the leaders say in the letter. Cameron argued that a planned increase in the EU budget would cost his country's taxpayers the equivalent of one billion euros. The 2.9% rise would still cost them £435m (500m euros). Parliament to fight back By agreeing to cap the budget, EU leaders set themselves on a collision course with the European parliament, which has the power to approve or reject the proposed budget. Negotiations between the European Parliament and the Council, which represents the 27 member countries, over the EU's 2011 budget kicked off on 27 October (see 'Background'). "If Cameron is prepared to give up the British rebate [...] then we can for sure discuss a reduction of the budget," said Martin Schulz, leader of the Socialist & Democrats group in the European Parliament, speaking to EUX.TV, the European policy news channel powered by EurActiv. "The European budget is not to be compared with national budgets," said Schulz. "There are no own resources. We have no European taxes. We have no own money. It is money coming from the member states. We can make no debts. The British budget must be reduced because there is enormous debt. Europe has no debts," he said.

13.12.08: EU Treaty's impact on defence policy remains unclear - 0 views

  • The Lisbon Treaty will strengthen the European Security and Defence Policy (ESDP) but the scope of the changes will very much depend on the composition of the new troika to be appointed in 2009, according to MEPs and experts participating in a European Parliament workshop.
  • Background: The Lisbon Treaty, which was signed by European heads of state and government in December 2007 and is expected to come into effect in 2009, brings with it several changes for the ESDP.  The most notable one is the upgrade of the position of the High Representative for Foreign Affairs and Security Policy (HR), a role currently held by Javier Solana. The HR, who will be supported by a European External Action Service (EEAS), will also serve as a Commission vice-president and will technically be the Union's foreign minister.  Moreover, the new treaty provides for an extension of the Petersberg Tasks on peacekeeping, disarmament and conflict prevention and resolution as well as 'permanent structured cooperation' of those member states "whose military capabilities fulfil higher criteria and which have made more binding commitments".  The text also includes first-ever mutual defence and solidarity  clause in an EU treaty.

19.06.08: What about the size of the eu-commission after the No vote in Ireland? - 0 views

  • The EU summit, which starts in Brussels today (19 June), was meant to give EU leaders the opportunity to discuss their first full-time president. But following the 'no' vote in Ireland, they now face the less pleasant prospect of having to reduce the size of the European Commission as currently required by the Nice Treaty.
  • Background: The Nice Treaty stipulates that when the number of EU member states reaches 27, the number of commissioners appointed in the subsequent EU executive would have to be less than this number, without giving a precise figure.  With the EU now having numbered 27 members since 1 January 2007, there is an understanding that the current number of commissioners exceeds the realistic number of portfolios.  As an example, to accommodate Bulgaria and Romania, Markos Kyprianou, the Cypriot health and consumer protection commissioner, had to abandon the second part of his portfolio in favour of his new Bulgarian colleague, Meglena Kuneva (EurActiv 26/10/06) Similarly, the multilingualism portfolio was taken from Ján Figel, the Slovak commissioner for education, training and culture, and handed to Leonard Orban, the Romanian commissioner (EurActiv 31/10/06).
  • But following the failed Irish referendum, heads of state and government will instead have to revert to the provisions of the Nice Treaty, which is designed for a Europe of 27 member states, diplomats said.  In short, this means having to consider reducing the number of commissioners to below 27, as foreseen under the current treaty agreed upon in Nice in 2001. In contrast, the Lisbon Treaty envisages reducing the number of commissioners to 15 by 2014.

The question of which country (or countries) should give up their commissioner will therefore now have to be open to negotiation between EU heads of state. 30.06.08: Czech Government: Lisbon-Treaty doesn't violate Czech Constitution - 0 views

  • The Czech government has advised the country's Constitutional Court that the EU's Lisbon treaty does not violate the Czech Republic's own constitution, improving the climate for ratification in the most problematic EU state after the Irish No vote.
  • Analysts expect the EU treaty to get through the 200-seat lower house. But the eurosceptic ODS party, many of whose members say Lisbon is dead after the Irish referendum, holds a 41-strong majority in the 81-seat upper house. The Czech president, Vaclav Klaus - an outspoken enemy of Lisbon - must also sign the text to make it law. The largely honorary office of the Czech president would find it hard to block a parliamentary decision in practice, however.
  • Ratification map France, Germany and the European Commission have called for ratification to continue despite the Irish No, pointing to a scenario in which Ireland stands isolated against 26 EU states and faces pressure for a re-vote, as occured with the 2001 Nice treaty referendum. Sixteen EU states have so far definitively ratified Lisbon. The Finnish, Polish and German parliaments have approved the text, but are awaiting their presidents' signatures. The Swedish, Dutch, Belgian, Italian, Spanish, and Cypriot legislatures will finish voting between July and the autumn. The Czech Republic is not the only problem country left, with the Polish president's office questioning whether the treaty still legally exists and the German constitutional court considering a legal challenge. Austrian leader Alfred Gusenbauer last week said he would also call a referendum if Lisbon is tweaked for a second Irish vote.

14.06.08: Brussels calls vor Lisbon treaty ratification to continue - 0 views

  • The European Commission has called for ratification of the Lisbon treaty to continue, despite the No result in Ireland's referendum. "This vote should not be seen as a vote against the EU… [It] has not solved the problems which the Lisbon Treaty is designed to solve," commission president Jose Manuel Barroso said in Brussels on Friday (13 June).
  • "The ratification process is made up of 27 national processes, 18 Member States have already approved the Treaty, and the European Commission believes that the remaining ratifications should continue to take their course," he added.
  • In a joint statement later on, France and Germany also called for the ratification of the Lisbon treaty to continue. "The ratification procedure has already been achieved in 18 countries. Therefore we hope that the other member states will continue the process," the Franco-German declaration reads. Britain has already said it would press ahead with the ratification, according to the BBC.

17.06.08: EU mulls Lisbon Treaty sweeteners for Ireland - 0 views

  • As EU foreign ministers try to breathe life back into the Lisbon Treaty, the charter of institutional reforms rejected by Irish voters last week, Dublin is likely to be offered stronger guarantees in the sensitive areas of taxation, defence and family policies. According to the Financial Times, "explanatory protocols" should explicitly state that the document does not affect Ireland's ability to set its own tax rates, the country's neutrality status or its abortion policy.
  • Another solution being floated involves a legal assurance that Ireland will never lose its seat at the European Commission table, the Irish Times reports. The Lisbon Treaty enables EU leaders to put the reduction of the size of the commission on ice. Either scenario is expected to be agreed at the first top-level meeting of EU leaders under the French EU presidency in October.
  • Irish No will not put brakes on EU enlargement Aside from the size of the next European Commission - now capped by the current EU rules - a question mark hangs over the 27-nation bloc's capacity to absorb new members. The Nice Treaty is tailored to no more than 27 member states. When asked about the prospects of EU hopefuls' accession to the EU, Mr Rupel excluded any changes to the process. "The outcome of the Irish referendum in no way changes enlargement policy...The EU unanimously decided to invited the countries of the Western Balkans to take membership so there is no doubt about that," the minister said, but added: "How we will carry that out that is another question."

13.05.08: EP report on European External Action Service (EEAS) - 0 views

  • The European Parliament is trying to influence the ongoing preparations for the establishment of a 'European External Action Service' (EEAS), to be set up jointly between the EU Council of Ministers and the Commission after the entry into force of the Lisbon Treaty. But critics say this major novelty in the EU architecture is about to be introduced in almost complete secrecy.
  • On 6 May, the European Parliament Foreign Affairs Committee put forward a draft report on the Common Foreign and Security Policy, which is intended to constitute MEPs' wish-list vis-à-vis the Council and the Commission on establishing EEAS.  The report points out that the future office of High Representative/Vice-President of the Commission will derive its legitimacy directly from the European Parliament. It also stresses the need for "transparency and democratic input" into the process of setting up the planned European External Action Service, and calls for a mechanism to be set up to provide confidential information to select Foreign Affairs Committee Members. 
  • "The key expectation of the Parliament is that it has more to say on that and Parliament can add additional democratic legitimacy from taking positions. And we expect to be involved in shaping these decisions ex ante, and not only post factum," Saryusz-Wolsky said.

07.10.09: Brussels in limbo over Klaus treaty delay - 0 views

  • The heads of the EU's three main institutions on Wednesday (7 September) came together to point out to Czech President Vaclav Klaus the "costs" to Europe if he continues to delay ratification of the Lisbon Treaty, the union's new rulebook. European Commission chief Jose Manuel Barroso, European Parliament President Jerzy Buzek and Fredrik Reinfeldt, the Swedish Prime Minister and the current chair of the EU, said several pending decisions are awaiting clarification from Prague.
  • The uncertainty stems from the fact that the Czech constitutional court is examining a legal challenge to the Lisbon Treaty, lodged by senators close to Mr Klaus. It is unclear how quickly the court will make its decision and, if the decision is positive, how much later Mr Klaus would then sign the treaty, completing ratification. Time is pressing because the current commission's mandate expires at the end of October, as does the post of the current high representative for foreign affairs, held by Javier Solana. The Swedish presidency is nervous about entering uncharted legal territory. It can either keep the commission as a caretaker, but ineffectual, executive, or try to set up a new commission under the Lisbon Treaty rules. Another option would be to negotiate a new commission with the current rules, but that would mean unwanted negotiations on reducing its size.

13.12.10: Treaty change to provide for a permanent European Stability Mechanism from mi... - 0 views

  • A two-sentence paragraph to be inserted into the Lisbon Treaty will prepare the legal groundwork for a permanent European Stability Mechanism (ESM) from mid-2013 onwards, under which the costs of future eurozone bail-outs may also be shared by sector private sector participants.

    "The member states whose currency is the euro may establish a stability mechanism to safeguard the stability of the euro area as a whole. The granting of financial assistance under the mechanism will be made subject to strict conditionality," reads the paragraph, contained in draft EU summit conclusions seen by this website on Monday (13 December).

  • German Chancellor Angela Merkel has pressed EU leaders to accept the treaty change as she fears Germany's powerful constitutional court may raise objections to the €440 billion temporary European Financial Stability Facility (EFSF), agreed in May and set to provide aid to Ireland. While EU policymakers insist the temporary facility and earlier aid to Greece do not contravene the EU treaty's 'no bail-out clause', Berlin is keen to remove any legal uncertainty, with a number of legal challenges currently under examination by the German court.
  • The treaty change is to take place under a new procedure introduced under the Lisbon Treaty - the simplified revision procedure - allowing for limited treaty changes without the setting up of a convention, on condition that new powers are not transferred from the national to EU level. In the draft conclusions, EU leaders also call on euro area finance ministers and the commission to finalise work on setting up the permanent aid mechanism, including features that could force sovereign bond holders to accept diminished returns on their investments, should a eurozone government be forced to call for aid under the ESM from 2013 onwards. The move stands in marked contrast to aid terms recently agreed for Ireland, under which holders of Irish sovereign debt and senior debt in Irish banks were not forced to accept a 'haircut.' Instead, Irish taxpayers will indirectly pay back the €85 billion borrowed from the EU-IMF for many years to come. Analysts say this move was partially designed to prevent further instability in the European banking sector, with many firms considerably exposed to the Irish market.

  • The treaty, which aims to make decision-making smoother, creates a long-term president and enhances the powers of the EU foreign policy chief, is intended to give the 27-country bloc more political clout to match its economic weight.
  • The Lisbon Treaty changes the rules on how decisions are reached by the EU because decision-making has become unwieldy since the accession of 10 countries, mostly from eastern and central Europe, in 2004 and two more in 2007. It hands more power to the European Parliament, which shares some legislative responsibilities with the European Commission - the EU executive and a powerful regulatory body. Member states' leaders retain a lot of power.

  • In a resounding defeat for the treaty, only ten out of 43 Irish constituencies voted in favour of the Lisbon Treaty. A majority of Irish people - 53.4 percent - voted against the EU's Lisbon treaty in Thursday's referendum, while 46.6 percent voted in favour, according to final results released Friday (13 June). Participation was at 53.13 percent.
  • Labour: 'Lisbon is dead' His Yes coalition ally, Labour leader Eamon Gilmore, however disagreed with Mr Cowen that it should be "full-steam ahead". "The Lisbon Treaty is dead," he said in a separate RTE interview. "Ireland cannot ratify it – therefore Lisbon falls." 25.03.09: Czech government defeat raises major Lisbon concerns - 0 views

  • The presidents of both the European Commission and the European Parliament on Wednesday (25 March) urged the Czech Republic to proceed with the ratification of the EU's Lisbon Treaty despite the fall of the Czech government the day before, while Czech deputy premier Alexandr Vondra admitted the ratification would now become "more difficult."
  • "I would like to urge all political leaders not to use this political crisis in a way to make the Lisbon Treaty hostage to domestic problems. That would not be fair to the other countries of Europe," Mr Barroso said at a press conference in Strasbourg.
  • The Czech Republic, Ireland, Germany and Poland comprise the four countries that have yet to complete the ratification of the Lisbon Treaty.

17.06.08: Ireland's commisioner under fire for poor EU treaty campaign - 0 views

  • The leader of the Socialists in the European Parliament, Martin Schultz, has accused Irish EU commissioner Charlie McCreevy of "arrogance" for his public revelations that he had not read the Lisbon Treaty and for a visit to the US just ahead of the referendum in Ireland.
  • We have to ask Mr Barroso what kind of people he has in his commission, particularly if you have someone acting as the deregulation Pope in Europe who then goes home and says he hasn't read the treaty and doesn't understand it," Mr Schultz told reporters on Tuesday (17 June). He was reacting to several statements of Mr McCreevy, who is in charge of internal market in the 27-member-strong European Commission, ahead of the only popular vote on the new EU reform treaty in Ireland held last week, in which the Irish rejected the document. The commissioner admitted a lack of knowledge of details of the treaty in an interview with the EUobserver, saying he had only read most of a summary of the document.

11.08.10: EU's first post-Lisbon Treaty ambassador to US assumes post - 0 views

  • The European Union's new ambassador to the United States has presented his credentials to President Barack Obama in Washington, formally assuming his position in the process.  Joao Vale de Almeida formally became the new European Union ambassador to the United States on Tuesday after handing over his credentials to President Barack Obama in Washington. Vale de Almeida is the first EU ambassador to the US since the reforming Lisbon Treaty came into force on December 1, 2009. The Lisbon Treaty aims to enhance the EU's capacity to operate more effectively and act more cohesively in matters of foreign affairs and security. Prior to the Lisbon Treaty, the position of ambassador to the US was held by the rotating EU presidency, which changed hands every six months. Vale de Almeida's duties will include representing the European Commission President Jose Manuel Barroso and President of the European Council Herman van Rompuy. "I'm the first new type of ambassador for the European Union anywhere in the world," Vale de Almeida told news agency Agence France-Presse after the credentials ceremony at the White House. "I'm supposed to have a wider mandate than my predecessors," he said. "Our delegations now cover a wide spectrum of issues well beyond the economic dimension, trade dimension and regulatory dimension, to cover all policies in the union, including foreign policy and security policy."

  • The Czech EU presidency is preparing a contingency plan for one of the most sensitive areas in the EU institutional set-up in case Ireland rejects Europe's new treaty for a second time later this year. According to the Irish Times newspaper, Prague is working on a plan for how to reduce the size of the European Commission should Irish voters once again vote No in autumn.
  • "On the composition of the commission we have to be ready for both possible scenarios: One scenario is that the Lisbon Treaty enters force at the end this year or we have to act and co-operate in the EU under Nice," deputy prime minister Alexander Vondra told the newspaper. The rules of the Nice Treaty state that if the number of EU member states reaches 27, the number of commissioners would then be reduced. The EU's pending set of new rules, known as the Lisbon Treaty, however allows the continuation of one commissioner per member state if all EU governments unanimously agree to it.

09.05.08: National parliaments prepare for bigger role in the EU - 0 views

  • Members of parliament from across the EU, meeting in Brdo (Slovenia) on 7-8 May, have begun developing an embryonic strategy to deal with new provisions contained in the EU's Lisbon Treaty that would significantly increase their powers within the EU. 
  • Indeed, the Lisbon Treaty, due to enter into force in 2009 once it has been ratified by all member states, would give national MPs a stronger voice in the EU policymaking process by granting them the right to raise objections against European Commission legislative proposals - the so-called "yellow and orange card" procedure.
  • In this new legislative context, cooperation among national parliaments will be essential. Indeed, a reasoned opinion will have to gather support from at least a third of all EU national parliaments (18 out of the total of 54 chambers in the EU) in order for a proposal to be sent back for review by the Commission (the so-called "yellow card"). To actually strike down a Commission proposal ("orange card"), a simple majority of national parliaments will be required.

05.11.09: EU military chiefs nervous about Lisbon Treaty implications - 0 views

  • EU military chiefs are nervous that their advice will not carry the same weight once the new Lisbon Treaty is in place and that the planned diplomatic service will not contain enough experienced military personnel.
  • Once in force on 1 December, the Lisbon Treaty will merge the current military planning unit with a civilian one and fold all operational and planning divisions into the diplomatic service, due to be fully up and running by 2012. The military chiefs will no longer report to the rotating EU presidency, but directly to the new EU foreign minister, who will also be a vice-president of the European Commission.
