28.10.10: EU leaders give green light to tweak treaty in order to allow for the creatio... - 0 views

  • European Union leaders have come to a consensus that the bloc's treaty must be changed, although only in a limited fashion, in order to allow for the creation of a permanent bail-out fund for member states. "Today we took important decisions to strengthen the euro," European Council President Herman Van Rompuy told reporters at a press conference in the early morning hours of Friday (29 October).
  • Initially horrified at the Franco-German demand for a wholesale re-writing of the EU rulebook only a year after the Lisbon Treaty had been approved, the other EU leaders are now warming to the idea of a "limited" tweaking of the treaty in a way that they hope will avoid major political fall-out. "Heads of state and government agree on the need for member states to establish a permanent crisis mechanism to safeguard the financial stability of the euro area as a whole and invite the president of the European Council to undertake consultations with the members of the European Council on a limited treaty change required to that effect," the draft conclusions of a two-day summit in Brussels read.
  • "No country is opposed in principle to a moderate treaty change but they want to know what the political and legal consequences of this would be," said one source close to the discussions. Two moves have been tentatively agreed. EU Council President Herman Van Rompuy is to be tasked with exploring whether such a limited change can be done via a simplified revision procedure, in which EU leaders can make the change without having to call a full Intergovernmental Conference (IGC) - involving negotiations between the governments, consultations with the European Parliament and the participation of the European Commission, which could open a Pandora's Box of other new proposals. Mr Van Rompuy would also explore whether legally this can be done without the tweak having to be presented to national parliaments for approval, which would almost certainly grind down the process, or even further, whether such a move would provoke referendums in some countries, notably Ireland, which maintains a constitutional requirement that any shift in powers from Dublin to Brussels be approved in a vote by the people. He would report back to the European Council in December.

17.12.10: European Parliament condems the outcome of the European Council - 0 views

  • The centre and left of the European Parliament have robustly condemned the outcome of the European Council, complaining that the interest of the bloc as a whole has been sidelined in favour of national interests. It is common for the groups in the parliament to criticise the results of European summits, but the missives issued the afternoon following the meeting were abnormally trenchant.
  • The Party of European Socialists "condemned" the result, attacking the "conservative leaders" who hold a majority in the Council. "The Conservative leaders are fundamentally mistaken. Yet again they have failed to take control of the crisis," said Poul Nyrup Rasmussen, the former Danish prime minister and leader of the PES. "The reaction of the Markets illustrates this clearly." Mr Rasmussen pointed to the overnight downgrading of Irish bonds by the Moody's credit agency as signifying that the investors were unconvinced by the council's plan. He warned that the EU Council had put itself in "direct conflict" with the parliament over its refusal to countenance any move towards debt issuance at the EU level. "The German, British, Swedish and Dutch Governments formed a roadblock to progress on the eurobonds issue. So blatantly putting national interest before European recovery is short-termist and lacking in leadership," he said.
  • The European Parliament must be consulted on the treaty change, but it has no co-decision power under the 'simplified revision procedure' - the new method the EU leaders are using to deliver the limited treaty change while avoiding any national referendums. But, depending on the fine print of how the permanent bail-out fund is constructed, it may have approval powers. The EU prime ministers and presidents at the summit did not take any decisions on the details of the fund. According to a parliamentary legal expert, if the European Council itself develops the mechanism on an 'intergovernmental' basis, and the fund is similar to the existing €440 billion rescue mechanism, which involves a series of loan guarantees by member states, then the chamber will only be consulted, as with the treaty change. But if the EU is asked to develop and present a proposal, or if it involves any direct EU funds as well as national loan guarantees, then "this is part of the community method, and the parliament has co-decision powers". The Greens also said that the permanent crisis mechanism "will not be enough to get Europe out of the crisis."

08.10.09: Barroso fears powerful 'European president' - 0 views

  • European Commission President Jose Manuel Barroso has sided with smaller member states in trying to restrict the role of the proposed president of the European Council, a new post created by the Lisbon Treaty. Addressing the European Parliament on Wednesday (7 October), Mr Barroso chastised MEPs for referring to the post as "president of Europe."
  • "I am sorry, there will not be a president of Europe. There will be, if we have Lisbon, the president of the European Council. It is important to understand that point because sometimes I think there are some ideas about certain derives institutionelles [institutional drifts]," he said.
  • The commission president has no formal powers in appointing the European Council president but he warned: "The European Commission will not accept the idea that the president of European Council is the president of Europe." Mr Barroso's remarks came shortly after a leaked paper on the new Lisbon Treaty posts by Belgium, the Netherlands and Luxembourg underlined the importance of maintaining the "institutional balance" of the union. The paper has been interpreted in some quarters as an anti-Blair move. Poland has also prepared a document on the role of the president of the European Council. Earlier this week, Polish Europe minister Mikolaj Dowgielewicz indicated to EUobserver the limited role that Warsaw foresees for the new president.

17.06.08: EU ministers: Treaty 'not dead', 'emergency plan' needed - 0 views

  • The bloc's foreign ministers yesterday (16 June) discussed options to save the Lisbon Treaty despite its rejection in the Irish referendum last Friday, one being to offer Ireland certain assurances of its sovereignty and have it vote again next year.
  • Halting the ratification process must not be an option, foreign ministers vowed after the meeting, with the only borderline country being the Czech Republic, where the treaty is under review by the court (EurActiv 16/06/08)
  • "The worst would be for Brussels to impose something on Ireland," Italy's Foreign Minister Franco Frattini said after the meeting. According to him, there were three scenarios which should be categorically avoided: a long period of reflection such as the one following the failure of the constitution, a renegotiation of the Lisbon Treaty, and the suspension of the ratification process.

  • Slovenian Foreign Minister Dimitrij Rupel, whose country holds the EU Presidency until 30 June, insisted the EU was not in a crisis. He expressed his confidence that "sooner or later these reforms [envisaged by the Lisbon Treaty] will see the light of day". But, he added, it would be "risky to say that we are going to give life back to the treaty while faced with a deadlock".  Meanwhile, Enlargement Commissioner Olli Rehn further reassured EU candidate countries that enlargement is not threatened by the Irish 'no', said, dismissing calls such as that from European Parliament President Hans-Gert Pöttering, who said he saw Croatia as the last country to join for now as long as the new treaty is still not in place.

31.12.10. European Parliament urged to pass resolution condemning Hungary's new media law - 0 views

  • Despite unanimous opposition from leading media freedom organizations, the Hungarian parliament has adopted a controversial law overhauling the state-owned media and creating a Media Council with utterly disproportionate powers. The law was passed by an overwhelming majority of votes (256 to 87) on 21 December. Appointed directly by the government, the Media Council’s five members will not only have a right of oversight but also the authority to impose heavy fines (of up to 700,000 euros for a TV station and 89,000 euros for an online publication) for content that is “not politically balanced” or “violates human dignity.” The council can also punish offences against religion and the nation, while journalists can be forced to reveal their sources when national security is involved. Although the government intends to ensure “fair balance” in the media, it has not respected this principle in its choice of Media Council members, who all belong to the ruling Fidesz party. The council is supposed to enforce “balance” but it will have no opposition representatives. “Our organization, a 2005 Sakharov Prize laureate, urges the European Parliament’s president and bureau to make discussion of this law an emergency item on the next plenary session’s agenda,” Reporters Without Borders said.

06.07.10: Van Rompuy's Balkan visit focuses on Kosovo - 0 views

  • On his first tour of the Western Balkan, European Council President Herman Van Rompuy condemned the recent violence in Kosovo and called for restraint and dialogue. An extraordinary session of the UN Security Council will be held on the matter today (6 July).
  • Serbia unhappy with pace of EU integration Later in the day, Van Rompuy met with Serbian President Boris Tadić in Belgrade. According to an official communiqué, the two leaders discussed the situation in "Kosovo and Metohia," as Belgrade officially calls its former province. The press also reported that Tadić will attend an extraordinary session of the UN Security Council in New York today, called at the initiative of Serbia. According to the statement, Tadić voiced his dissatisfaction with the slowdown in the European integration process, and insisted that speeding up Serbia's EU accession was crucial for the future of the Western Balkans. Last month, Serbia took another step towards EU integration when EU foreign ministers agreed to start implementing an accord with Serbia known as the Stabilisation and Association Agreement (SAA). The agreement had been blocked for several years, mainly as a result of the Netherlands' insistence that Belgrade must cooperate fully with the UN war crimes tribunal for the former Yugoslavia. Later today, Van Rompuy will be in Pristina to meet the president of Kosovo, Fatmir Sejdiu. A visit to the headquarters of the EU's rule of law mission in Kosovo, EULEX, is also on the agenda.

Parliament warns EU summit against backroom deals - 0 views

  • Ahead of an EU summit opening today (28 October), Liberal group leader Guy Verhofstadt warned that the European Parliament was determined to use its new powers under the Lisbon Treaty and would not let economic governance plans be "diluted" by Germany and France.
  • But Verhofstadt, who leads the Parliament's Liberal group, warned that such backroom deals were now over. The European Parliament, he said, would have full co-decision powers on legislative proposals that will come out later in the year to flesh out the EU's new economic governance. His warnings were echoed by other political groups in Parliament, including the centre-right European People's Party (EPP), which commands the largest number of seats in the Strasbourg assembly. Iñigo Mendez De Vigo, a Spanish MEP in charge of institutional issues at the EPP, said he welcomed the Task Force's proposals. But he added that "they should take into account that the European Parliament is now co-legislator and will play its full part in defining the reforms to come".  "I regret that the French-German proposal does not even mention the European Commission, which also has a say on this issue," De Vigo said, adding the Parliament should also be more involved. The Greens, the fourth largest group in Parliament, also backed the Liberals and the EPP, in a move which could herald a long battle with member states over the economic reform plans. The Parliament "will be a co-legislator on four of the six legislative proposals" on economic governance, said Belgian MEP Philippe Lamberts, saying his group was "in favour of a more ambitious and broader economic framework than the Commission and Council". Verhofstadt said he hoped this new battle would not take nine months, referring to the time it took to pass a recent package of financial supervision laws through the assembly.
  • In a statement, Verhofstadt detailed the three key areas where the Task Force had diluted the Commission's initial proposal and on which he said Parliament was ready to pick a fight. First, the Commission had proposed to impose sanctions on member countries with excessive deficits or severe imbalances at an earlier stage, without delay. By contrast, the Task Force argues that a political decision should be taken on the proposed sanctions, meaning that they could be blocked by a country capable of putting together a blocking minority. The result is that there will be no preventive procedure and therefore no sanctions, the liberal group leader warned. Second, the Task Force foresees a "double filter" for decision-making, involving a political recommendation by the Council before the Commission can take action. In practice, this means the Commission will be allowed to take sanctions only after a certain period, Verhofstadt said. Finally, while the EU executive had proposed that corrective action or sanctions be initiated directly by its own services, the Task Force called instead for a recommendation that would need subsequent backing by the bloc's 27 finance ministers. "It's easy to change a recommendation, and far more difficult to change a proposal by the Commission, because in that case you need unanimity," Verhofstadt explained.

17.11.10: 'Wrong answers' on Kosovo could block Serbia's EU candidacy - 0 views

  • When EU enlargement commissioner Stefan Fule hands his 'questionnaire' over to the Serbian authorities during his visit to Belgrade next week, the recipients may wish to take a step back and reflect carefully before they sit down to formulate their responses. Serbia's replies to the list of questions will largely determine the European Commission's assessment of the country's readiness to become an EU candidate, and a few 'wrong' answers on Kosovo could easily compromise the process.
  • Either the European Commission or the Council of Ministers could advise against granting Belgrade candidate status or the decision could be put on hold until Belgrade has clarified contested positions, according to EU officials dealing with Serbia. The questionnaire itself is 'status neutral' regarding Kosovo, and takes into account UN Resolution 1244, which set up an international military presence in Kosovo in 1999. "Serbian answers should be status neutral and respect UN Resolution 1244 as well," an EU member state diplomat told WAZ.EUobserver. "That means Serbia will not be forced to recognise Kosovo's independence in the questionnaire but Belgrade should accept in the answers the reality that Kosovo is not under Serbian sovereignty or control."
  • "Some important EU countries have already signalled they will veto Serbia's candidate status if Belgrade tries to use the questionnaire to affirm sovereignty and territorial integrity in Kosovo," an EU diplomat warned. A positive opinion by the commission is usually essential for an aspiring country to become an official candidate. The only exception so far has been Greece, which became a candidate in spite of a negative assessment by the Brussels-based executive.

  • "It is imaginable that the commission gives a positive opinion on Serbia without Ratko Mladic being arrested," said a source in the EU Council of Ministers. "But it is unimaginable, after the council conclusion last month in Luxembourg, that the EU [member states] will find the unanimity required to grant candidate status to Serbia without Ratko Mladic being arrested and transferred to the Hague tribunal prison in Scheveningen."

12.12.08: EU summit gives in to Irish demands on Lisbon Treaty - 0 views

  • On the first day of the European Council (11 December), EU leaders agreed on a package of Irish demands which pave the way for a second referendum on the Lisbon Treaty in Ireland, which will most probably be held in October 2009.
  • Under the compromise text, seen by EurActiv, all EU countries are expected to keep their commissioner. Ireland will receive legal guarantees on taxation policy, social and ethical issues and the Common Security and Defence Policy (CFSP), with regard to Ireland's traditional policy of neutrality among other provisions. 
  • Transitional accommodations  Therefore, transitional measures have been adopted with respect to the Presidency of the European Council, as well as of the European Parliament. The member state holding the EU presidency when the Lisbon Treaty enters into force (Sweden holds the presidency until the end of 2009) will continue to chair all meetings in the same manner as today's presidencies.  But the next EU presidency holder (Spain from January 2010) will make changes in conformity with the Lisbon Treaty, making room for a permanent President of the European Council and a High Representative for foreign affairs and security policy.  Also, European Parliament will be enlarged from 736 to 754 members in the course of 2010, if indeed the Irish say 'yes' to the reform treaty. The elections will take place under the Treaty of Nice, but soon the Parliament is expected to accommodate the provisions of Lisbon.  Answering questions from the press, Poettering acknowledged that the situation was not ideal, and the legitimacy of MEPs falling between the Nice and Lisbon Treaties should be preserved, as their status should not be different. He admitted that legal experts would struggle with the issue.

29.05.08: EU, UN in talks to share leadership of Kosovo mission - 0 views

  • The legal problems encountered by EU-Lex, the EU mission in Kosovo, could soon be solved, with diplomats currently in talks over plans to share the leadership with UNMIK, the United Nations peace-keeping mission.
  • Background: The EU decided in February 2008 to deploy a 2,200 strong 'Rule of Law' mission to Kosovo under the name 'EU-Lex Kosovo'. Its deployment has already started, after having been delayed for both technical and political reasons.  The initial objective was for EU-Lex to take over from UNMIK, the civilian mission established in the Serbian province following the adoption of UN Security Council Resolution 1244 in June 1999. But Serbia and Russia strongly protest against EU-Lex, because this mission has not been endorsed by the UN Security Council (EurActiv 16/04/08). The objective of setting up an EU mission in Kosovo is highly political. The EU has ambitions to take over the post-crisis management of a territory on European soil. It previously failed to do so in 1999 when it had to resort to NATO to stop the ethnic cleansing and acts of extreme violence perpetrated by the regime of Slobodan Milosevic. 
  • Under plans originally foreseen by the EU, the 2,200 strong EU-Lex mission would eventually replace UNMIK as the leading rule-of-law mission in the new-born state of Kosovo.  But faced with rejection from Serbia and Russia, which have both challenged the mission's legal legitimacy, diplomats are now drawing up plans for the two missions to co-exist under joint command.  The solution would provide the EU with a face-saving trick, according to diplomats who were speaking to EurActiv on condition of anonymity. This is because UNMIK has already been accepted by Serbia and Russia, which has a permanent seat at the UN Security Council.

14.10.10: EU states and MEPs clash over international talks - 0 views

  • Member states are considering taking the EU Parliament to court if it does not back down on demands for new powers on EU foreign policy and international agreements, EUobserver has learnt. Ambassadors representing member states at a meeting in Brussels on Wednesday (13 October) signaled their discontent over an inter-institutional agreement between the European Commission and the EU legislature which may give fresh powers to euro-deputies, especially when it comes to international negotiations on behalf of the EU.
  • The draft report, according to an analysis by the council of ministers' legal services, could lead to a stand-off between EU institutions if adopted as such next week in Strasbourg. "The court option is not off the table," one EU source said. Ambassadors will come back to the matter in their meeting next Wednesday, following the MEP's vote in the plenary. The crux of the matter is to what extent MEPs can be part of EU delegations to multilateral and bilateral meetings and negotiations with other countries. According to the draft, the Parliament wants to have its representatives guaranteed participation in all multilateral, but also bilateral agreements "of particular political importance" - for instance on trade or fisheries.

  • The incoming Hungarian presidency of the European Union is bracing itself for an unexpectedly difficult six months (Jan-June 2011) at the helm, likely to test the diplomatic skills of the presidency first-timers to the full. The ongoing fight to shore up eurozone stability, together with calls for EU treaty change and acrimonious EU budget talks are among the prickly issues on the packed agenda, with Turkish accession talks and the Roma ethnic question also potential flashpoints.
  • Some EU and member state officials have been alarmed at what they perceive as a concentration of power under Herman Van Rompuy, the bloc's first president of the European Council, the body representing EU leaders. "Mr Van Rompuy has taken on a number of issues that should instead be run by the rotating presidency, helped by the current political limbo surrounding the Belgian government," one Polish official said earlier this month.

  • European Commission President Jose Manuel Barroso was cheered in the European Parliament on Tuesday (23 November) when he outlined plans to publish an official proposal on EU self-funding before the end of June 2011. A fresh draft of next year's budget is also expected before 1 December.
  • Parliament has said debate on the controversial 'own resources' issue is a key demand in the ongoing battle over next year's annual EU budget, but France, Germany and European Council President Herman Van Rompuy have all indicated they oppose the idea of an EU tax. "We will use our right of initiative to put forward formal proposals as to own resources before the end of next June," Mr Barroso told MEPs in the Strasbourg plenary chamber. "The proposals ... will make large endeavours to achieving a consensus in the future. We're open to any ideas," he added.
  • "I am against the introduction of an EU tax," German Chancellor Angela Merkel said earlier this month. "I do not think that redesigning the way the EU get its revenue is a top priority," Mr Van Rompuy said a week later. Reacting to Mr Barroso's announcement, non-attached UK MEP Diane Dodds called on British Prime Minister David Cameron to clearly state that proposals for an EU tax would trigger a referendum in the country.

12.12.08: Ireland has a diplomatic victory but the real winner is Europe - 0 views

  • But the deal struck, which allows the ratification process to resume in Ireland, with a view to ratification by the end of 2009, maintains the package of institutional reforms that will allow the EU to be better able to deal with these long-term political problems. So, what was agreed and what does it all mean?
  • All governments had agreed that the size of the European Commission should be cut down, as successive enlargements of the European Union turned the Commission from a compact executive into a miniature assembly, and several governments were reported as being reluctant to give up on this reform. This is a major coup for the Irish.
  • In return, the Irish government has committed itself to ratifying the treaty by the end of the term of the current Commission, paving the way for a second referendum on the treaty by October 2009. As far as the composition of the Parliament is concerned, next year's European elections will (if the treaty has not been ratified) elect 736 members. Following ratification, the twelve EU countries due to gain extra seats in the Parliament will obtain them at that point, while Germany will temporarily keep the three extra seats that it would have lost in the event of Lisbon being ratified before the elections. In the absence of a ratified treaty, the six month rotating presidency of the European Council will continue. The Czech presidency will take place, while the following presidency in the second half of 2009 will be responsible for making the arrangements of the new permanent presidency and the proposed External Action Service and Foreign Affairs Council.

10.12.08: EU-Macedonia Stabilisation and Association Council hold 5th meeting - 0 views

  • Macedonia has made good progress in meeting the criteria for visa liberalisation but it is too early to say when it will happen. The EU mission will soon arrive to Skopje to assess what was done after which EC will recommend on removing the Schengen visa barrier.
  • The EC set eight benchmarks in March and from their fulfilment it will depend whether accession negotiations will be opened, however the EU Council will pass the final decision on this, Rehn said. He reiterated at the press conference that Macedonia has made progress in several areas - judiciary, police, consolidation of multi-ethnic democracy, Ohrid Agreement implementation and Stabilisation and Association Agreement, and key test will be forthcoming municipal and presidential elections.

  • PODGORICA -- Montenegro's application for EU candidate status has been blocked in the EU Council of Ministers, Podgorica-based daily Vijesti reports on Thursday. This took place before the European Commission even presented its opinion on the country's readiness to gain candidate status. Referring to information published by the EU press agency, Agence Europe, the daily says that several member states within the Enlargement Working Group, above all Holland, Spain, France and Belgium, object to the issue being shifted to the Committee of Permanent Representatives (COREPER), and then to the Council of Ministers.

13.05.08: EP report on European External Action Service (EEAS) - 0 views

  • The European Parliament is trying to influence the ongoing preparations for the establishment of a 'European External Action Service' (EEAS), to be set up jointly between the EU Council of Ministers and the Commission after the entry into force of the Lisbon Treaty. But critics say this major novelty in the EU architecture is about to be introduced in almost complete secrecy.
  • On 6 May, the European Parliament Foreign Affairs Committee put forward a draft report on the Common Foreign and Security Policy, which is intended to constitute MEPs' wish-list vis-à-vis the Council and the Commission on establishing EEAS.  The report points out that the future office of High Representative/Vice-President of the Commission will derive its legitimacy directly from the European Parliament. It also stresses the need for "transparency and democratic input" into the process of setting up the planned European External Action Service, and calls for a mechanism to be set up to provide confidential information to select Foreign Affairs Committee Members. 
  • "The key expectation of the Parliament is that it has more to say on that and Parliament can add additional democratic legitimacy from taking positions. And we expect to be involved in shaping these decisions ex ante, and not only post factum," Saryusz-Wolsky said.

11.03.08: EU Urges More Progress In Bosnia - 0 views

  • 11 March 2008 Brussels _ The European Union has urged Bosnian authorities to "make further efforts" if the country is to sign a key agreement with Brussels next month. A meeting of EU Foreign Ministers urged that, "important underlying problems remain and called upon all parties in Bosnia to work together in order to overcome them as soon as possible.”
  • “I trust the country will be able to settle the remaining problems so it can achieve the signing of the Stabilisation and Association Agreement, SAA, in April,” he added. The EU's Council of Ministers, too, concluded that Bosnia has made progress with regards to the SAA, and reiterated its full support to Sarajevo's European perspective.
  • “The Council welcomed the PIC Steering Board's unanimous decision that the Office of the High Representative (OHR) will remain in place and continue to carry out its mandate under the Dayton Peace Agreement until necessary objectives and conditions as set out in the PIC Steering Board Declaration are met,” it was concluded.
