By Justin Miller On August 25, 2008, two little boys walked into public elementary schools in Southeast Washington, D.C. Both boys were African American fifth-graders. The previous spring, both had tested below grade level in math. One walked into Kimball Elementary School and climbed the stairs to Mr. William Taylor's math classroom, a tidy, powder-blue space in which neither the clocks nor most of the electrical outlets worked. The other walked into a very similar classroom a mile away at Plummer Elementary School. In both schools, more than 80 percent of the children received free or reduced-price lunches. At night, all the children went home to the same urban ecosystem, a zip code in which almost a quarter of the families lived below the poverty line and a police district in which somebody was murdered every week or so.   • Media literacy education distinctively features the analytical attitude that teachers and learners, working together, adopt toward the media objects they study. The foundation of effective media analysis is the recognition that: All media messages are constructed.Each medium has different characteristics and strengths and a unique language of construction.Media messages are produced for particular purposes.All media messages contain embedded values and points of view.People use their individual skills, beliefs and experiences to construct their own meanings from media messages.Media and media messages can influence beliefs, attitudes, values, behaviors, and the democratic process.   • Lack of clarity reduces learning and limits the ability to use digital tools. Some educators close their classroom doors and hide what they fear is infringement; others hyper-comply with imagined rules that are far stricter than the law requires, limiting the effectiveness of their teaching and their students’ learning.

  • Law provides copyright protection to creative works in order to foster the creation of culture. Its best known feature is protection of owners’ rights. But copying, quoting, and generally re-using existing cultural material can be, under some circumstances, a critically important part of generating new culture.
  • In reviewing the history of fair use litigation, we find that judges return again and again to two key questions: Did the unlicensed use "transform" the material taken from the copyrighted work by using it for a different purpose than that of the original, or did it just repeat the work for the same intent and value as the original? Was the material taken appropriate in kind and amount, considering the nature of the copyrighted work and of the use? If the answers to these two questions are "yes," a court is likely to find a use fair. Because that is true, such a use is unlikely to be challenged in the first place.
  • Both key questions touch on, among other things, the question of whether the use will cause excessive economic harm to the copyright owner. Courts have told us that copyright owners aren’t entitled to an absolute monopoly over transformative uses of their works.
  • Another consideration underlies and influences the way in which these questions are analyzed: whether the user acted reasonably and in good faith, in light of general practice in his or her particular field.

  • Students should be able to understand and demonstrate, in a mannerappropriate to their developmental level, how their use of a copyrighted workrepurposes or transforms the original. For example, students may use copyrightedmusic for a variety of purposes, but cannot rely on fair use when their goal is simplyto establish a mood or convey an emotional tone, or when they employ popular songssimply to exploit their appeal and popularity.
  • FIVE:  Developing Audiences for Student Work
  • If student work that incorporates, modifies, and re-presents existingmedia content meets the transformativeness standard, it can be distributed to wideaudiences under the doctrine of fair use.

When sharing is confined to a delimited network, such uses are more likely to receive special consideration under the fair use doctrine.

  • MYTH:  Fair Use Is Just for Critiques, Commentaries, or Parodies. Truth:  Transformativeness, a key value in fair use law, can involve modifying material or putting material in a new context, or both. Fair use applies to a wide variety of purposes, not just critical ones. Using an appropriate excerpt from copyrighted material to illustrate a key idea in the course of teaching is likely to be a fair use, for example. Indeed, the Copyright Act itself makes it clear that educational uses will often be considered fair because they add important pedagogical value to referenced media objects.
  • So if work is going to be shared widely, it is good to be able to rely on transformativeness. As the cases show, a transformative new work can be highly commercial in intent and effect and qualify under the fair use doctrine.

Education Department Wants Tweets from Teachers and Students - High School Notes (usEducation.com) - 11 views

    Great article on US news about initiatives in the US that have started but of special interest is the request that students and educators tweet. The biggest issues I've had with the town hall meetings is that most of them are in the middle of the day when everyone is teaching. On Thursday at 3 pm there is a chat about rural news. It is nice that they're having these meetings but if they REALLY want teachers to participate it will be when teachers are able to focus on the conversation. You can't have teachers teaching and Tweeting. It doesn't work. If you see me tweet during the day, most of the tweets are scheduled or I'm on break or lunch break. "February has been a busy month for K-12 news. On February 1, U.S. Secretary of news Arne Duncan kicked it off by announcing that all U.S. schools should transition to digital textbooks within the next five years. On the 9th, President Obama waived 10 states from No Child Left Behind. And last week, the president proposed a 2013 budget that includes a $1.7 funding increase for news." Although these federal policy decisions may not seem directly connected to day-to-day classroom activities, the Department of news is using Twitter to encourage teachers, administrators, parents, and students to play a more active role.

    Education is an issue around the world as demonstrated in this video from New South Wales Premier Barry O'Farrell. They have problems with "reneged deals with Federal and State governments." Education is in flux the world over, lest any one group of educators feel they are being singled out. This is largely caused by the information age. While the industrial age changed how people worked, the information age is fundamentally changing how people learn and those organizations that can adapt and progress will remain. Some towns suffered the loss of factories but kept their schools. What happens when the schools close?     Joy Resmovits Aug. 5, 2011 ""We have become increasingly concerned with the proposed contract," Michael Mulgrew and Richard Iannuzzi, who respectively head New York City's and the state's teachers' unions, wrote in the note. The letter is addressed to New York State Board of Regents Chancellor Merryl Tisch, state Commissioner of Education John King, Jr., and copied to State Comptroller Tom DiNapoli. "It is especially troubling that Wireless Generation will be tasked with creating a centralized student database for personal information even as its parent company, Education Corporation, stands accused of engaging in illegal Education gathering tactics, including the hacking of private voicemail accounts," the letter reads. Murdoch acquired 90 percent of Wireless Generation for about $360 million last November. At the time of the acquisition, Murdoch said he saw K-12 Education as a "$500 billion sector." Murdoch's first general move in the Education sector had come just a few weeks earlier, when he tapped Joel Klein, then the chancellor of New York City's schools, to lead his Education ventures. The Wireless Generation contracts were approved while Klein still ran the district, leading to speculation about the chancellor's intentions."

    Pakistan is pushing to educate more of its children, amidst financial woes and a struggle for more funding. Their goal: 100% enrollment. Of course, there is a great effort also to build a firewall in Pakistan much like the "great firewall of China." That said, there are many lovely educators from Pakistan who contribute and connect increasingly online and I wish this country well as well as the many countries working to increase enrollment. "As schools returned to session in Pakistan's northwestern Khyber Pakhtunkhwa (KP) province this fall, the newly elected provincial government - with the help of the non-profit campaign Alif Ailaan - launched an enrollment drive. In its first month, the drive managed to enroll nearly 245,000 out of school children - about 65% male and 35% female - across 25 districts of the province, according to figures provided by Alif Ailaan. But considering Pakistan's education woes, where more than 25 million children between the ages of 5-16 remain out of school, it is a small step. "In order to provide schooling to all the kids, we need about Rs. 138 billion (roughly $1.2 billion) just in KP - for school infrastructure, classrooms, teachers so on and so forth," Joudat Ayaz, the province's education secretary, told me over dinner. Ayaz estimates the number of out of school children in KP between 2 to 3 million, about 20% to 30% of the school-age children in the province. "You can't do this [reaching 100% enrollment] in one go - you have to do it progressively, over six or seven years.""

    I agree with Audrey Watters -- we need a way to QUESTION TED talks. Good ideas worth spreading are worth interrogating and discussing. There is NO platform for that and a growing issue, I think that TED MUST address if it is going to live long and prosper. Good educators, good leaders always question and are curious. We try things out and we wonder. We want solutions but solutions packaged in a cute 15 minute presentation aren't ever really as simple as they seem. There is a different between a sound byte and a bit of something I can REALLY use.  I agree with Audrey - READ her post. My worry is that we're spreading ideas that haven't, perhaps, been tested and gone through full examination. IF we didn't learn anything from the Mortensen "3 cups of tea" fiasco then education deserves to be mislead again. We should examine and have transparency with the speeches and be able to continue the conversation. "But I have questions. I have questions about this history of schooling as Mitra (and others) tell it, about colonialism and neo-colonialism. I have questions about the funding of the initial "Hole in the Wall" project (it came from NIIT, an India-based "enterprise learning solution" company that offers 2- and 4-year IT diplomas). I have questions about these commercial interests in "child-driven education" (As Ellen Seitler asks, "can the customer base be expanded to reach people without a computer, without literacy, and without any formal teaching whatsoever?"). I have questions about the research from the "Hole in the Wall" project - the research, not the 15 minute TED spiel about it. I have questions about girls' lack of participation in the kiosks. I have questions about project's usage of retired British schoolteachers - "grannies" - to interact with Indian children via Skype. I have questions about community support.     Great reflection of a student on education!

    This student has done a marvelous speech on Education and giving choices to student. My favorite quote from Andrew ( a student from New Zealand) -- "A closed book test is simply not a realistic situation in the modern world." I'm not putting this on my blog as an embedded video because I would love for you to respond on NetGen where all educators are welcome to join in with students to discuss how Education should evolve. This is an excellent video, and as you can see with my comments, there are a few points I take up with Andrew -- it is one of those -- you've gotta listen to this student kinda videos. He makes some great points speaking out for his generation. He says that when he asks his parents to help him and they say "I don't know how to do this" it tells him that it is not something that will be used and thus is unimportant! Hmmm.
