The previous spring, both had tested below grade level in math.   • Media literacy education distinctively features the analytical attitude that teachers and learners, working together, adopt toward the media objects they study. The foundation of effective media analysis is the recognition that: All media messages are constructed.Each medium has different characteristics and strengths and a unique language of construction.Media messages are produced for particular purposes.All media messages contain embedded values and points of view.People use their individual skills, beliefs and experiences to construct their own meanings from media messages.Media and media messages can influence beliefs, attitudes, values, behaviors, and the democratic process.   • Law provides copyright protection to creative works in order to foster the creation of culture. Its best known feature is protection of owners’ rights. But copying, quoting, and generally re-using existing cultural material can be, under some circumstances, a critically important part of generating new culture.
  • In reviewing the history of fair use litigation, we find that judges return again and again to two key questions: Did the unlicensed use "transform" the material taken from the copyrighted work by using it for a different purpose than that of the original, or did it just repeat the work for the same intent and value as the original? Was the material taken appropriate in kind and amount, considering the nature of the copyrighted work and of the use? If the answers to these two questions are "yes," a court is likely to find a use fair. Because that is true, such a use is unlikely to be challenged in the first place.
  • Both key questions touch on, among other things, the question of whether the use will cause excessive economic harm to the copyright owner. Courts have told us that copyright owners aren’t entitled to an absolute monopoly over transformative uses of their works.
  • Another consideration underlies and influences the way in which these questions are analyzed: whether the user acted reasonably and in good faith, in light of general practice in his or her particular field.

For example, students may use copyrightedmusic for a variety of purposes, but cannot rely on fair use when their goal is simplyto establish a mood or convey an emotional tone, or when they employ popular songssimply to exploit their appeal and popularity.
  • FIVE:  Developing Audiences for Student Work
  • If student work that incorporates, modifies, and re-presents existingmedia content meets the transformativeness standard, it can be distributed to wideaudiences under the doctrine of fair use.

  • MYTH:  Fair Use Is Just for Critiques, Commentaries, or Parodies. Truth:  Transformativeness, a key value in fair use law, can involve modifying material or putting material in a new context, or both. Fair use applies to a wide variety of purposes, not just critical ones. Using an appropriate excerpt from copyrighted material to illustrate a key idea in the course of teaching is likely to be a fair use, for example. Indeed, the Copyright Act itself makes it clear that educational uses will often be considered fair because they add important pedagogical value to referenced media objects.
  • So if work is going to be shared widely, it is good to be able to rely on transformativeness. As the cases show, a transformative new work can be highly commercial in intent and effect and qualify under the fair use doctrine.

    Students across the country have already started working on their IWitness Challenge project sponsored by the USC Shoah Foundation - The Institute for Visual History and Education, but there's still time for youngsters in your community to enter this free online program geared to all secondary-school students. The deadline to enter the Challenge is Dec. 2, 2013. The winning student, along with their teacher and a family member will be brought to Los Angeles to showcase their work as part of the 20th anniversary activities for the Shoah Foundation, which was founded by director Steven Spielberg in 1994 after making "Schindler's List." Tthe IWitness Challenge (iwitness.usc.edu) connects students with the past in a very personal way that spurs them to take action to improve the future. With access to many of the Shoah Foundation's 52,000 testimonies of survivors, liberators and rescuers, students experience history in a way that hits home. Instead of reading facts from textbooks, students feel the emotions and build relationships with those who lived through seemingly impossible situations. But students do more than watch the testimony. The IWitness Challenge compels them to think, to make smart choices and to create their own project and video from what they've learned. By encouraging teachers and students to create their own lesson plans, IWitness allows them to expand on practically any subject they wish to pursue. From civics, government and history to poetry, art and ethics, educators can tailor lessons appropriate for their classrooms. And by using the embedded editor, participants not only learn valuable searching and editing skills, but also how to make ethical editing decisions that ensure their finished assignments are a fair and accurate reflection of what they've seen.     Civil War Augmented Reality project -- just in my inbox. You civil war buffs and history teachers may really get a "kick" out of this. Speaking of "kick" they are trying to get a grant that requires people to vote for them. Take a look: "This message is from a group of educators in Pennsylvania who have developed a Social Studies project that is in the process of raising a modest amount of money to build prototypes for gathering additional partners. Our project, the Civil War Augmented Reality Project, is intended to enhance the experiences of students visiting Civil War sites. It is also intended to increase attendance and revenue for historic sites by offering both "high" and "low" tech experiences to best reach the majority of the population. We feel that our project is fulfilling a need that educators, park workers, technology enthusiasts, and Civil War enthusiasts have discussed in the past: How can historic sites both raise educational value and public interest in their institutions though technology, while not alienating the non-technical history fans? We have worked hard on the answer, and are interested in promoting our creative solutions. We would like to make clear that the project is not intended solely for Pennsylvania.     I agree with Audrey Watters -- we need a way to QUESTION TED talks. Good ideas worth spreading are worth interrogating and discussing. There is NO platform for that and a growing issue, I think that TED MUST address if it is going to live long and prosper. Good educators, good leaders always question and are curious. We try things out and we wonder. We want solutions but solutions packaged in a cute 15 minute presentation aren't ever really as simple as they seem. There is a different between a sound byte and a bit of something I can REALLY use.  I agree with Audrey - READ her post. My worry is that we're spreading ideas that haven't, perhaps, been tested and gone through full examination. IF we didn't learn anything from the Mortensen "3 cups of tea" fiasco then education deserves to be mislead again. We should examine and have transparency with the speeches and be able to continue the conversation. "But I have questions. I have questions about this history of schooling as Mitra (and others) tell it, about colonialism and neo-colonialism. I have questions about the funding of the initial "Hole in the Wall" project (it came from NIIT, an India-based "enterprise learning solution" company that offers 2- and 4-year IT diplomas). I have questions about these commercial interests in "child-driven education" (As Ellen Seitler asks, "can the customer base be expanded to reach people without a computer, without literacy, and without any formal teaching whatsoever?"). I have questions about the research from the "Hole in the Wall" project - the research, not the 15 minute TED spiel about it. I have questions about girls' lack of participation in the kiosks. I have questions about project's usage of retired British schoolteachers - "grannies" - to interact with Indian children via Skype. I have questions about community support. Part of the problem may be that while universities are spectacularly good at producing new forms of understanding, they are not always very good at explaining what they are doing when they do this.

  • I studied at a U.K. university for 4 years and much later taught at one for 12 years. My last role was as head of the R&D group of a large company in India. My corporate role confirmed for me the belief that it is quite wrong for companies to expect universities to train the graduates they will hire. Universities are for educating minds (usually young and impressionable, but not necessarily) in ways that companies are totally incapable of. On the other hand, companies are or should be excellent at training people for the specific skills that they require: if they are not, there are plenty of other agencies that will provide such training. I remember many inclusive discussions with some of my university colleagues when they insisted we should provide the kind of targeted education that companies expected, which did not include anything fundamental or theoretical. In contrast, the companies I know of are looking for educated minds capable of adapting to the present and the relatively uncertain future business environment. They have much more to gain from a person whose education includes basic subjects that may not be of practical use today, than in someone trained in, say, word and spreadsheet processing who is unable to work effectively when the nature of business changes. The ideal employee would be one best equipped to participate in making those changes, not one who needs to be trained again in new skills.
