The state's private-school voucher program in New Orleans -- the test case for Gov. Bobby Jindal's new statewide voucher push -- has yet to produce enough raw data to show whether it is really boosting student achievement. The governor's office is backing the voucher idea with figures that appear to show impressive test results for New Orleans students who get state aid to pay private school tuition. But in truth, limited test-score data and the lack of comparable public school numbers make the program's effectiveness almost impossible to judge, according to some of the country's leading number-crunchers in the education field. At best, state data offer only a snapshot of how those students are doing, and even then results are mixed.

Only a month before nearly 120 Louisiana schools are set to welcome their first voucher students, the state has finally released a slate of standards that approved schools must meet in order to receive both students and concurrent state dollars. And while the standards, created by Superintendent John White and approved by the state's Board of Elementary and Secondary Education (BESE) this week, are widely considered a step in the right direction, voucher opponents say the standards fall far short from the accountability they sought. Where every public school in Louisiana is subjected to a standardized slate of testing, the voucher students - who will bring an average of $8,000 in tuition from "failing" public schools to many that are affiliated with religious denominations - will only need to face testing if their new school has taken an average of 10 students per grade, or if the schools have accepted at least 40 voucher students into the grades testing.

Meet voucher supporters' new fellow strategists: students with disabilities. Creating private school vouchers for special education students-programs that are largely unchallenged in court, unlike other publicly financed tuition vouchers-can be the perfect way to clear a path for other students to get school options, according to school choice proponents.

On the discussion boards of UrbanBaby.com, worked-up moms from the Upper East Side argue over whether Riverdale sends enough seniors to Harvard, Yale and Princeton to be considered truly "TT" (top-tier, in UrbanBabyese), or whether it is more accurately labeled "2T" (second-tier), but it is, certainly, part of the city's private-school elite, a place members of the establishment send their kids to learn to be members of the establishment. Tuition starts at $38,500 a year, and that's for prekindergarten.

Seventeen-year-old Kevin Fish has won international mountain bike races, has ridden alongside Tour de France winner Lance Armstrong and hopes to become a professional cyclist when he turns 19. To do that, he trains 20 hours a week: four-hour bicycle rides, long runs and practice on a stationary bike. Spending seven hours a day in traditional private or public schools would leave Kevin riding in the evenings - or not at all, depending on homework. Then his family read about Star Charter School on the Web. The campus, which received the highest academic rating under the state accountability system, offers small classes and four-hour days. And as an open-enrollment charter school, it is public and tuition-free.

"State Education Secretary Ron Tomalis said Monday he is pushing to enact school tuition voucher legislation before state lawmakers breaks for their summer recess, joining the governor and special interest groups calling for immediate education reforms."

A public school offers a free education to every child in the community - that's what makes it public. A private school charges tuition and accepts students through a competitive selection process. Larchmont was bridging public and private by exploiting a loophole. Under federal guidelines, charter schools can give admissions priority to "founding parents." That's why these parents were being asked to "found" a school that had opened in 2004.

"Public schools achieve the same or better mathematics results as private schools with demographically similar students, concludes The Public School Advantage: Why Public Schools Outperform Private Schools, published in November by the University of Chicago Press. The authors are Christopher and Sarah Lubienski, a husband-and-wife team of education professors at the University of Illinois at Urbana-Champaign. Central to the controversy is their suggestion that vouchers, which provide public funding for private school tuition, are based on the premise that private schools do better-an assumption that is undercut by the book's overall findings."

"There has been a shift from the belief that we as a nation benefit from higher education, to a belief that it's the people receiving the education who primarily benefit and so they should foot the bill," concludes Ronald G. Ehrenberg, a trustee of the State University system of New York and director of the Cornell Higher Education Research Institute. A more accurate description, I think, is "Failure by Design," the title of a recent study by the Economic Policy Institute, which has long been a major source of reliable information and analysis on the state of the economy. The EPI study reviews the consequences of the transformation of the economy a generation ago from domestic production to financialization and offshoring. By design; there have always been alternatives.

The deliberate pepper-spraying by campus police of nonviolent protesters at UC Davis on Friday has provoked national outrage. But the horrific incident must not cloud the real question: What led comfortable, bright, middle-class students to join the Occupy protest movement against income inequality and big-money politics in the first place?
