    This study found that schools fail to make AYP most often because of the students with disabilities subgroup. The failure of the special education subgroup to make AYP occurs mainly because the students with disabilities subgroup is expected to maintain the exact same proficiency levels as their general education peers-a standard that has proved to be problematic because special education students often start out with lower average test scores than general education students. In addition, the students with disabilities subgroup is the only subgroup in which actual limitations on ability to learn might come into play. The existence of these limitations calls into question the wisdom of trying to close the general education-special education "achievement gap" at the same pace as the race- or class-based achievement gaps. In addition to quantitative methods, this study also used legal research techniques to examine the legal impact that the two laws are having on students with disabilities.

Similar to previous economic downturns, schools are being targeted to be transformed from financial liabilities to laboratories of excellence representing the hope for our nation's economic future. Of course, educational reformers who are looking for structural changes during a cyclical downturn argue that schools are not adequately preparing the nation's future workforce. In an effort to develop a highly skilled workforce for the future, educational reformers claim that the push to eliminate tenure, evaluate teachers based on standardized test scores and favor charter schools over traditional pubic schools will in the end produce better students. However, educational reformers have made a significant mistake in targeting public school resources and teachers' incentives and punishments over teaching and learning processes. As a result, these efforts have failed to take into account the political economy of public schools.

    A few weeks ago, I wrote about how I did my own analysis of the 1997 study which is always quoted by Rhee about how 3 effective teachers in a row vs. 3 ineffective teachers in a row is life changing.  Now, as someone who considers himself an effective teacher, and someone who has been taught by effective teachers and also by ineffective teachers, I'm very aware that there is a difference.  The question is whether or not this difference really shows up in standardized test scores accurately enough so that districts can use them reliably as part of evaluations which can lead to teachers getting fired over them.
