Companies Act, 2017. New Depreciation Amendments! - 0 views

  •
The Companies Amendment Act, 2017 ("Amendment Act") was executed with the sole determination to resolve the challenges arising upon the implementation of the Companies Act 2013.. The primary basis for the Amendment Act 2013, is the report of the Company Law Committee(CLC). The Ministry of Corporate Affairs ("MCA") had established the Company Law Committee with the approval to: (a) Pass instructions on the challenges arising from the enactment of the Companies Act 2013. (b) Review the approvals received from the Bankruptcy Law Reforms Committee, the Law Commission of India, and other agencies, the High-Level Committee on Corporate Social Responsibility. In the beginning, The Ministry of Corporate Affairs (MCA) had disclosed 43 sections of the Amendment Act compatible to its notification dated 9 February, 2018. It also briefed 28 additional sections on 7 May, 2018. As a practice, the modifications released (dated 7 May, 2018) have provided improved transparency on the clarification of the various provisions of the Companies Act. Additionally, the MCA insists to ease the procedural requirements under the Companies Act, including the fines imposed in the event of failure to comply. Additional provisions notified. Modifications to the following main provisions were announced on the 7 May 2018:

Pambazuka - Globalising economic apartheid - 1 views

  • the presence of tax havens, whether specialising in corporate or maritime services, consistently undermines national and international rule-of-law. This was the case with the capitalist apartheid regime in South Africa, who circumvented oil sanctions through the 'socialist' government of Seychelles. The Iranian revolution evidenced the fall of the US-backed Shah, depriving the apartheid regime of secure oil supplies.
  • By pyramiding holding companies in jurisdictions characterised by secrecy, the corporate beneficiaries of the apartheid regime were able to access resources and labour on the cheap, while easily navigating global sanctions.
  • Not much has changed when it comes to the use of secrecy jurisdictions as a means of looting African minerals. Until recently, Sierra Leone’s diamond industry was dominated by two firms: SLDC and Koidu Holdings. The latter was wholly owned by two entities based in tax havens, both of which are directly connected to the UK: Guernsey and the British Virgin Islands (BVI) through BSG Resources, recently implicated as a potential funder for Zimbabwe's Marange fields (via Canadile).

  • As Fidelity Corporate Services stated, bearer shares ‘represent the ultimate way of ensuring the anonymity of offshore company owners’. To better state the obvious, Fidelity articulated why corporations should maintain entities in tax havens: ‘Tax avoidance generally means creating and organising such business structure which would pay minimum possible amount of taxes without breaking the law. All international offshore financial services industry which is functioning on a legal basis is about tax avoidance and not about tax evasion.’

Distributing the Corporate Clout : The Influence of the World's Largest 100 Economic En... - 0 views

  •
Of all of the world's 100 largest economic entities in 2010, 42 (42%) are corporations. The largest, as in 2009 was Wal-Mart, whose 2010 revenues exceeded the GDPs of 171 countries making it the 25th largest economic entity in the world. The next group in terms of size is energy majors with the combined revenues of the five largest players (Royal Dutch Shell, ExxonMobil, BP, Sinopec and China National Petroleum) equivalent to 2.5% of global GDP in 2010. A key trend is the movement from West to East as global challengers from rapidly developing economies (RDEs) continue to grow their economic power - along with their countries. Among the Top 100 economic entities there are now 6 RDE companies versus just 1 in 2000, and looking at the Top 150 the number of RDE companies tripled between 2000 and 2010 to 15.
